Sub : APSWREIS – Communication of tentative seniority of Principals, Grade-I – Objections received – Certain objections of principals to protect seniority – Proposed seniority to [3] principals – Objections if any – Called for – Reg.

Ref : 1. Tentative seniority list of Principals, Grade-I Communicated vide this Office Memo.Rc.No.G1/30799/2001, dt.21.01.2011. 2. Objections received from Smt.CVB Lakshmi, Smt.Ch.E. Madhulatha & Smt.M.Geetha Lakshmi, Principals, Grade-I. * * * The Principals, Grade-II working in APSWR Institutions were promoted as Principal, Grade-I from July 2009 onwards. The Principals promoted as Grade-I were fixed at appropriate roster points as per Rule of Reservation in promotions. Basing on this, tentative seniority list of Principals, Grade-I was prepared and was communicated vide reference 1st cited and objections were called for on the tentative seniority list.

The Principals against whom no disciplinary cases were pending and were not under the period of punishment were only promoted as Principal, Grade-I, since, Principal, Grade-I is a promotion post. The Principals against whom disciplinary cases were pending and were under the period of punishment were not promoted as Principal Grade-I, even though, they were seniors. Subsequently, certain principals were promoted as Principal, Grade-I after disposal of disciplinary case or after completion of period of punishment or after waiving of the punishment issued earlier. The following are the Principals, who were promoted as Principal, Grade-I after waiving of the punishment issued earlier and no disciplinary action was taken against them. 1. Smt.Ch.E.Madhulatha 2. Smt.M.Geetha Lakshmi 3.Smt.CVB Lakshmi

The above Principals have requested to protect the seniority since their punishments were waived / they were not facing disciplinary case as on the date of promotion of other principals. The details of their objections and detailed remarks on each objection are as follows :

1. Smt. C.V.B.Lakshmi, Principal, Grade-I Objection raised by Smt.CVB Lakshmi She stated that, she was eligible for promotion to Principal, Grade-I as on 25.07.2009. However promotion orders were issued as Principal, Grade-I on 13.07.2010 after a lapse of nearly 1 year. She has requested to consider her promotion from 25.07.2009.

Remarks on the objection raised by Smt.CVB Lakshmi. While affecting promotion as Principal Grade-I during July, 2009, there was an allegation against her. The Enquiry Officer was appointed to conduct enquiry into the allegations. Due to this, she was not considered promotion as Principal Grade-I at that time.

The content of GO Ms No.424, dt.25.5.1976 is that in cases where the Officer’s promotion is deferred in terms of GO Ms No.424 Gen. Admn (Ser.C) Department, dated 25.5.1976 and the proceedings have not been disposed of, such cases should be reviewed by the Departmental Promotion Committee in its next meeting to ascertain the progress made in the Disciplinary proceedings / Criminal Prosecution and further measures taken to expedite their completion.

Her request is to consider her promotion w.e.f., 25.07.2009 along with 1st batch of Principals on whom there were no cases / punishment pending against them at that time. While affecting the above promotion there was only allegation against Smt. C.V.B.Lakshmi, and no charges were framed. It was an anonymous petition. Subsequently, the Chairman APSWREIS /Hon’ble Minister (SW), considered her promotion as Principal grade-I on 13.07.2010.

As per G.O.Ms.No.66, (Ser-C) Department Dt.30.01.1991, the promotion / appointment to a higher post in respect of Officers who are facing disciplinary proceedings for a Criminal Case or whose conduct is under investigation, shall be differed only when charges of misconduct are framed by the competent authority and served on the concerned delinquent officer.

In this case, no articles of charges were issued and no punishment was awarded. No enquiry was conducted against Smt.CVB Lakshmi, and it was an anonymous petition.

2. Smt. M.Geetha Lakshmi, Principal, Grade-I Objection raised by Smt.M.Geetha Lakshmi

She stated that, she was awarded a punishment of stoppage increments for non-achieving 100% results in 10th class during the academic year 2007-08. However, after achieving 93% & 95% in SSC during the past consequent years, the management revoked her punishment by releasing the stopped increments and promoted as Principal, Grade-I vide procdgs. Dt:07.02.2011. She requested to consider her promotion as Principal, Grade-I w.e.f, 25.07.2009.

Remarks on the objections raised by Smt.M.Geetha Lakshmi. She was awarded punishment of stoppage of 2 Annual Grade Increments without cumulative effect vide proceedings Dt: 15.05.2009. The punishment period was upto 14.05.2011. Mean while, the above punishment was waived for securing good results in the (2) consecutive academic years vide proceedings Dt:28.06.2010. After waiving the punishment, she was promoted as Principal Grade-I vide proceedings dt:07.02.2011.

Smt.M.Geetha Lakshmi, Principal was awarded a punishment of stoppage of two annual grade increment without cumulative effect under Rule-28 for poor performance for the academic year 2007-2008 vide proceedings dt.15.5.2009 and the said punishment was waived vide proceedings dt.28.06.2010 as she secured good results in the next two academic years.

3. Smt. Ch.Esther, Madhulatha, Principal, Grade-I Objection raised by Smt.Ch.E. Madhulatha She stated that, most of the Juniors and some of them are not even declared their probation as Principal are appearing as seniors to her in the seniority list. She has stated that, her name ought to have been considered on the top of the seniority list basing on her the 27 years service particulars mainly experience and other criteria.

Remarks on the objections raised by Smt.Ch.E.Madhulatha While issuing promotions as Principal Grade-I to the Principals, Smt.Ch.E.Madhulatha was under period of punishment of Censure for poor performance in public examinations. The punishment period was completed by 16.06.2009. As per the orders of the Chairman, dt:13.10.2009, the punishment of Censure was waived. Subsequently, she was promoted as Principal. Grade-I vide proceedings dt.11.01.2010.

During the year 2009, Principal, Grade-I, promotions were issued to [75] Principals in the 1st spell, at that time Smt.Ch.E.Madulatha was not considered for promotion as Principal, Grade-I as she was under the period of punishment. At that time, her seniors along with her juniors were promoted as Principal, Grade-I. Later, consequent on waiving of the punishment awarded to her, she was promoted as Principal, Grade-I vide proceedings dt.11.01.2010.

In this regard, it is to inform that as per the provisions contained in Rule 24 (c) of AP State and Subordinate Service Rules, 1996, if it is proposed to undertake revision of Panel or list of eligible candidates for appointment by promotion or by transfer, notices have to be issued to the persons likely to be affected by such proposed revision before any order of revision is passed. After examining the objections, if any received and disposing the same, proposals have to be submitted to the Government for relaxation of Rule 33 (a) of AP State and Subordinate Service Rules. On considering notional promotion to the [3] principals, the seniority list will be revised as per ANNEXURE-I. In the revised seniority list, the 3 Principals occupies the following places.

1. Smt.CVB Lakshmi stands at S.No.6 2. Smt.Ch.E.Madhulatha stands at S.No.10 3. Smt.M.Geetha Lakshmi stands at S.No.24

On considering notional promotion as above i.e., from the date of considering promotions to the 1st batch of Principals, the names of principals have to be fixed at appropriate place in the seniority list and thus their junior principals [Grade-II] as given in ANNEXURE-II will be affected.

In view of the above, the principals, Grade-I concerned as per ANNEXURE-I are hereby informed to submit objections if any on the above proposed revision of date of promotion as principal, Grade-I notionally for the [3] principals, within [15] days from the date of receipt of this notice. If no objections are received by the stipulated date, it will be construed that they have no objection on the above proposed revision of seniority and action will be taken accordingly in publishing the final seniority list.
