On motion of Mr. Johnston, seconded by Mr. , the following ordinance was offered: SUMMARY NO. 23524 ORDINANCE NO. An ordinance approving the Preliminary and Final Plat of resubdivision of Lots H-2, Sq. D, Highland Acres Subdivision and 7, River Bend Park Subdivision, Jefferson Parish, Louisiana, into Lot H-2-A, Sq. D, Highland Acres Subdivision and Lot 7-A, River Bend Park Subdivision, in accordance with plan by Dading, Marques & Associates, INC., L.S., dated January 6, 2012, which lots are owned by Catherine S. Banister, Peggy Banister Rubio and Henry Rubio and approving and accepting the Final Plat of said subdivision. (Council District 2) WHEREAS, Catherine S. Banister is the owner of Lot H-2, Sq. D, Highland Acres Subdivision which she acquired by Act before Susan Hicks, Notary Public, dated December 19, 1974 registered in COB 839, Folio 944 and Catherine S. Banister, Peggy Banister Rubio and Henry Rubio are the owners of Lot 7, River Bend Park Subdivision, Jefferson Parish, Louisiana, which they acquired by Act first before Paul M. Lapeyre, Notary Public, dated August 30, 1985 registered in COB 1321, Folio 58 and secondly before Kevin Rung, Notary Public, dated November 29, 1993 registered in COB 2884, Folio 785, Parish of Jefferson; and WHEREAS, said owners desire to resubdivide said Lots into Lots to be designated as Lots H-2-A, Square D, Highland Acres and Lot 7-A, River Bend Park Subdivision; and WHEREAS, the owners and/or applicants have a pending sale predicated on subdivision plat approval, upon which the act of sale is to be completed and recorded in the Office of the Jefferson Parish Clerk of Court; and WHEREAS, the Planning Director of this Parish has caused to be duly advertised as prescribed by law, a public hearing in connection with the resubdivision of said lots; and WHEREAS, a public hearing was held by the Planning Advisory Board, in accordance with the law: NOW THEREFORE, THE JEFFERSON PARISH COUNCIL HEREBY ORDAINS: SECTION I. That the Preliminary Plat of Dading, Marques & Associates , L.S., dated January 6, 2012 showing the resubdivision of Lot H-2, Square D, Highland Acres and Lot 7, River Bend Park Subdivision, Jefferson Parish, Louisiana into Lots H-2-A, Square D, Highland Acres and 7-A River Bend Park Subdivision, Jefferson Parish, Louisiana, in accordance with said plan, is hereby approved. SECTION II. That the Final Plat of Dading, Marques & Associates, L.S., dated January 6, 2012 showing the resubdivision of Lot H-2, Square D, Highland Acres and Lot 7, River Bend Park Subdivision, Jefferson Parish, Louisiana, into Lots H-2-A, Square D, Highland Acres and 7-A River Bend Park Subdivision, Jefferson Parish, Louisiana, in accordance with said plan, is hereby approved and accepted. SECTION III. That within sixty (60) days of the effective date of this ordinance, the applicant shall submit to the Planning Director a copy of the recorded act of sale; without which, the Planning Director shall submit an ordinance to the Parish Council to rescind the ordinance that approved said subdivision plat in accordance with Sec. 33- 2.26(f)(2). SECTION IV. That in accordance with Section 33-2.31 of the Unified Development Code (UDC), Subdivision Waivers, the insufficient lot area of 15,100.73 square feet for Lot H-2-A, Square D, Highland Acres, instead of the required 20,000 square feet in Rural Residential District, R-1D, is hereby waived, accepted and approved. SECTION V. That the Parish of Jefferson has not examined or reviewed the title of any portion of land shown, or any restrictive covenants or restrictions placed on said property, and that the action of the Parish in this matter does not imply (1) that the applicant’s or owner’s title or ownership is valid, (2) that there are or are not any restrictive covenants or other restrictions on said property, or (3) that any restrictive covenants or restrictions that may be on said property are enforceable or are not enforceable. SECTION VI. That the Chairman of the Parish Council of Jefferson Parish, or in his absence the Vice Chairman, is hereby authorized, empowered, and directed to sign all documents and acts necessary and proper in the premises to give full force and effect to this ordinance. This ordinance having been submitted to a vote, the vote thereon was as follows: YEAS: NAYS: ABSENT: This ordinance was declared to be adopted on the 13th day of June, 2012, and shall become effective as follows, if signed forthwith by the Parish President, ten (10) days after adoption; thereafter, upon the signature by the Parish President, or, if not signed by the Parish President, upon expiration of the time for ordinances to be considered finally adopted without the signature of the Parish President, as provided in Section 2.07 of the Charter. If vetoed by the Parish President and subsequently approved by the Council, this ordinance shall become effective on the day of such approval.
