4 ORDINANCE 2017-39-E 5 AN ORDINANCE REZONING APPROXIMATELY 44.0 ACRES 6 LOCATED IN COUNCIL DISTRICT 12 ON 0 OLD 7 MIDDLEBURG ROAD SOUTH BETWEEN SANDLER ROAD AND 8 MARLEE ROAD (R.E NO(S) 015590-0000; 015589- 9 0100; 015588-9520; AND 015588-9510), AS 10 DESCRIBED HEREIN OWNED BY AUDREY ANN CAMPBELL 11 AND BRENDA CLOWER LIFE ESTATE, FROM 12 RESIDENTIAL RURAL-ACRE (RR-ACRE) DISTRICT TO 13 PLANNED UNIT DEVELOPMENT (PUD) DISTRICT, AS 14 DEFINED AND CLASSIFIED UNDER THE ZONING CODE, 15 TO PERMIT SINGLE FAMILY RESIDENTIAL AS 16 DESCRIBED IN THE APPROVED WRITTEN DESCRIPTION 17 AND SITE PLAN FOR THE SANDLER OAKS PUD; PUD 18 REZONING SUBJECT TO CONDITION(S); 19 CERTIFICATION REQUIRED FOR SATISFACTION OF 20 CONDITION(S); PROVIDING A DISCLAIMER THAT THE 21 REZONING GRANTED HEREIN SHALL NOT BE CONSTRUED 22 AS AN EXEMPTION FROM ANY OTHER APPLICABLE 23 LAWS; PROVIDING AN EFFECTIVE DATE. 24

25 WHEREAS, Aundrey Ann Campbell and Brenda Clower Life Estate, 26the owner(s) of approximately 44.0 acres located in Council 27District 12 on 0 Old Middleburg Road South between Sandler Road and 28Marlee Road (R.E. No(s) 015590-0000; 015589-0100; 015588-9520; and 29015588-9510), as more particularly described in Exhibit 1, attached 30hereto and dated November 15, 2016 and generally depicted in

1Exhibit 2, both of which are attached hereto and incorporated 2herein by this reference (Subject Property), have applied for a 3rezoning and reclassification of that property from Residential 4Rural-Acre (RR-Acre) District to Planned Unit Development (PUD) 5District, as described in Section 1 below; and 6 WHEREAS, the Planning Commission has considered the 7application and has rendered an advisory opinion; and 8 WHEREAS, the Land Use and Zoning Committee, after due notice 9and public hearing, has made its recommendation to the Council; and 10 WHEREAS, the Council finds that such rezoning is: (1) 11consistent with the 2030 Comprehensive Plan; (2) furthers the 12goals, objectives and policies of the 2030 Comprehensive Plan; and 13(3) is not in conflict with any portion of the City’s land use 14regulations; and 15 WHEREAS, the Council finds the proposed rezoning does not 16adversely affect the orderly development of the City as embodied in 17the Zoning Code; will not adversely affect the health and safety of 18residents in the area; will not be detrimental to the natural 19environment or to the use or development of the adjacent properties 20in the general neighborhood; and will accomplish the objectives and 21meet the standards of Section 656.340 (Planned Unit Development) of 22the Zoning Code; now therefore 23 BE IT ORDAINED by the Council of the City of Jacksonville: 24 Section 1. Property Rezoned. The Subject Property is 25hereby rezoned and reclassified from Residential Rural-Acre (RR- 26Acre) District to Planned Unit Development (PUD) District. This 27new PUD district shall generally permit single family residential, 28and is described, shown and subject to the following attached 29documents: 30Exhibit 1 – Legal Description dated November 15, 2016.

1Exhibit 2 – Subject Property per P&D D. 22nd Revised Exhibit 3 – 2nd Revised Written Description dated March 331, 2017. 4Revised Exhibit 4 – Revised Site Plan dated March 17, 2017. 5 Section 2. Owner and Description. The Subject Property 6is owned by Aundrey Ann Campbell and Brenda Clower Life Estate, and 7is legally described in Exhibit 1. The agent is Gred Atwill, 8Atwill, LLC, 9001 Forest Acres Lane, Jacksonville, Florida 32234; 9(904) 610-8975. 10 Section 3. Rezoning Approved Subject to Condition(s). 11This rezoning is approved subject to the following condition(s). 12Such conditions control over the written description and may only 13be amended through a rezoning. 14 (a) The minimum lot size shall be 60 feet in width and 6,000 15square feet in area. 16 (b) The owner/developer shall provide a traffic study to 17include a right and left turn warrant and signal warrant at the 18intersection of Old Middleburg Road and Sandler Road. Any proposed 19traffic control and proposed intersection at the access point at 20Sandler Road and the access drive T-intersection with the internal 21roadway must be included in the traffic study. 22 (c) The developer shall provide $7,300 to the City of 23Jacksonville Department of Public Works “Neighborhood Speed Limit 24Reduction Trust Fund” for the neighborhood’s cost portion of the 25estimated total cost of $14,400 for the installation of six (6) 26speed humps with pavement markings, and twelve (12) fabricated and 27installed warning signs on Marlee Road. Marlee Road is located 28approximately 625 feet south of the Subject Property and will be 29impacted by the increased traffic generated by its development.

1The speed humps shall be installed by the City as designed by the 2City Traffic Engineer. 3 Section 4. Disclaimer. The rezoning granted herein 4shall not be construed as an exemption from any other applicable 5local, state, or federal laws, regulations, requirements, permits 6or approvals. All other applicable local, state or federal permits 7or approvals shall be obtained before commencement of the 8development or use and issuance of this rezoning is based upon 9acknowledgement, representation and confirmation made by the 10applicant(s), owner(s), developer(s) and/or any authorized agent(s) 11or designee(s) that the subject business, development and/or use 12will be operated in strict compliance with all laws. Issuance of 13this rezoning does not approve, promote or condone any practice or 14act that is prohibited or restricted by any federal, state or local 15laws. 16 Section 5. Effective Date. The adoption of this 17ordinance shall be deemed to constitute a quasi-judicial action of 18the City Council and shall become effective upon signature by the 19Council President and the Council Secretary. 20
