Prior to the start of the meeting, Senator Bob Mensch of the 24th District arrived to meet the Board of Commissioners and staff. The Commissioners discussed Township concerns with the Senator. Senator Mensch was forthcoming with his understanding of the concerns. He informed the Commissioners of work being done on other state issues. The Senator encouraged the Commissioners to contact him at his office any time.

COLEBROOKDALE TOWNSHIP BOARD OF COMMISSIONERS MEETING MINUTES OF JANUARY 20, 2014

The regular meeting of the Board of Commissioners of Colebrookdale Township was held on the above date at the Township Building. President Todd Gamler called the meeting to order at 7:30 PM with all present joining in the Pledge of Allegiance to the Flag.

The following Commissioners were present: Todd Gamler (President), William Spade (Vice President), Daniel Ritter and Linwood Bartman. Also present were Township Manager Cindy Conrad, CEO/Zoning Officer Allen Stauffer, Tax Collector/Treasurer Joan Herb, Solicitor Jeffrey Karver, Engineer John Sartor and Police Chief David Viola. Commissioner Baus was absent.

PUBLIC PARTICIPATION Curtis Rader addressed the Board of Commissioners and insisted that the Township force Martins Stone Quarry to reimburse him for damages to his home resulting from the quarry business activity. The Commissioners explained his house is located in Washington Township and Colebrookdale Township has no responsibility. Solicitor Karver told Mr. Rader this issue was dismissed by the courts and he cannot come back to the Commissioners asking for relief.

MINUTES The January 6, 2014 Board of Commissioners Meeting minutes were presented to the Board for their review and approval. On a motion by Commissioner Spade, seconded by Commissioner Ritter, the January 6, 2014 Board of Commissioners meeting minutes were approved. Motion carried.

FINANCIAL REPORTS Joan Herb submitted the Treasurer’s Report for December 2013 and the Certification of Uncollected Real Estate Taxes. There were no questions from the Board.

President Gamler acknowledged submission of the Customer Balance Summary and Deposit Detail Report then read a list of the payment of bills from the following Township funds for approval: General Fund Expense 1/6/14 - 1/20/14 $ 58,888.03 Payroll Fund Expense 1/17/14 $ 41,785.62 Health Reimbursement Account 1/20/14 $ 371.24 (Highmark Blue Shield Payments) ($ 1,205.54) Recycling Fund Expenses 1/20/14 $ 1,000.00

President Gamler noted the submission of the Profit & Loss Budget vs. Actual General Fund statement. The statement was available to the public for review. POLICE REPORT Chief Viola informed the Commissioners that all officers were scheduled for mandatory training in the next week. He also reported that the new radios were installed today in all the vehicles.

ROAD MASTER REPORT President Gamler said he read a newspaper report that municipalities who purchased road salt from Cargill had problems with the product not working. The salt was powdery and trash was in the salt loads. A representative from the company addressed the issue and will use a different location to get the salt where it is processed better. Manager Conrad said there are meetings being held to address reimbursement for the inferior salt.

CODE ENFORCEMENT OFFICER’S REPORT CEO Stauffer reported he sent letters to four residents concerning the overgrowth of bamboo along property lines. There was no response from the residents so the road crew cut back the over-extending growth in the right-of-way.

SEO REPORT The Manager told the Commissioners there is a meeting tomorrow with Matt Hostrander, the new SEO, to coordinate the program with the Township.

PLUMBING INSPECTOR’S REPORT Nothing submitted at this time.

SOLICITOR’S REPORT Solicitor Karver informed the Commissioners the executed Quit-Claim Deed was sent to Mr. & Mrs. Bergan with a request for directions as to how they want the Deed recorded. The owners stated they will talk with the neighbors about sharing the costs of maintenance.

ENGINEER’S REPORT Engineer Sartor submitted their Concept Plan Zoning Review, first review for Sunoco, Inc., 722 Rt. 100 North. Manager Conrad informed the Board that a $1,000.00 escrow was posted to cover the costs for Engineer Sartor to attend meetings with PennDOT. There was no discussion on the review letter.

Manager Conrad also informed the Commissioners she and CEO Stauffer met with PennDOT representatives at Boyertown High School. They looked at and discussed the proposed road opening to Montgomery Avenue and details at other intersections involved in the planning.

COMMISSIONERS’ REPORT President Gamler explained that he met with Fred Beans Ford service advisor and discussed having the police vehicles serviced at their shop. The advisor offered a proposal for oil changes, tire rotation, engine work with discounts on parts and labor and pick-up and delivery of the vehicles at the convenience of the Township. Chief Viola discussed the proposal with the Commissioners. He will take the vehicles in for service rather than having them picked up. The Commissioners concurred to use Fred Beans Ford of Boyertown on a trial basis for all service of Township owned vehicles. Board of Commissioners January 20, 2014 Meeting Minutes 3

MANAGER’S REPORT Manager Conrad submitted a revised proposal from Matt Hess for the Township building remodeling project. The proposal was revised to meet the new design specifications requested by the Commissioners. The Commissioners asked that the other contractors be given a chance to rebid the new design specs. Manager Conrad will contact the bidders. Commissioner Bartman asked that Mr. Hess’ proposal state that he will ‘furnish’ all material. Commissioner Spade noted the need to get a price to move the air conditioning units.

Manager Conrad reported that she and Commissioner Ritter attended the BAFAR Company meeting. Fire Chief Chuck Neubauer resigned and Dave Shainline was appointed as Fire Chief. The Directors wanted to know if the Commissioners still want to see run cards. President Gamler said they should see them now that they will be one fire company. The Board discussed the contributions by each municipality to support the new fire company. The Commissioners concurred they do want to see all run cards from the new fire company.

COMMITTEE REPORT President Gamler acknowledged the submission of the Recycling reports (Dec.2013 and Total Year) from Allied Waste Services.

OLD BUSINESS Hunter’s Ridge Subdivision January 13, 2014 received a certified letter from Longview Management requesting the Township sign a letter for a five-year extension for the Land Development Plan. Solicitor Karver said the Township already has an agreement with Longview and the letter should not be signed. He will send a letter explaining the Township’s position.

SUBDIVISIONS Nothing submitted at this time.

NEW BUSINESS Almost Home Children’s Center – Final Land Development Plan December 17, 2013 the Township received a final LDP for 611 Montgomery Avenue. This will be a replacement of a fire damaged and demolished accessory structure with a larger accessory structure. It was accepted by the PC for review December 19, 2013. - January 13, 2014 received first review letter from G & A. - January 17 Planning Commission submitted a letter recommending a conditional waiver of LDP review.

Manager Conrad explained the Planning Commission reviewed and discussed the daycare plan and based on the Engineer’s review letter and the Solicitor’s opinion, it is not a land development. However, they still must comply with the stormwater management ordinance and post an escrow.

There was a motion by Commissioner Ritter, seconded by Commissioner Bartman to waive LDP review contingent on posting a $1,000.00 escrow for stormwater inspections, an engineer review of the plan to ensure compliance with the stormwater management ordinance and the execution of a stormwater agreement. It was brought to the attention of the Board of Commissioners, there is an issue concerning payment to companies who are called to a fire for assistance with a burning structure. Bartman Plumbing Heating & AC was called out to Almost Home Children’s Center to pull down the burning structure which resulted in the need for this current building plan. Bartman has not yet been paid for their services. The Bartman Company was also called to a Hill Crest Drive fire and assisted with a burning structure for ~six hours and was not compensated. The Commissioners agreed the Township needs to address this issue.

COMMUNICATIONS All communication received since January 6, 2014 is submitted to the Board of Commissioners. All correspondence was available for review by the public.

PUBLIC PARTICIPATION (NOT SIGNED IN) There was no public comment at this time.

ADJOURNMENT There being no other business to come before the Board, Commissioner Spade made a motion and it was seconded by Commissioner Bartman to adjourn this meeting at 8:50 pm. Motion carried.
