Minutes of the 74th meeting of the Committee Constituted for Deciding the Consent under Orange Category, held on 28.08.2008 in the Conference Room of Chairman, DPCC.

The following persons attended the meeting:

Following decisions were taken in the said meeting:-

Mc-Donold Restaurant, West Punjabi Bagh

The unit came for personal hearing today. It seeks one month time to do certain experiments for installation of ETP. The record of the unit shows that it has given contradictory data w.r.t. waste water discharge in the affidavit and the application for Consent to Establish. The unit is directed to comply with all previous directions issued by DPCC within 07 days i.e. by 03.09.2008. Call on 03.09.2008.

Tirupati Infra projects Private Limited, “Indus Hotel & Spa", Plot No. - D, Paschim Vihar Dist Centre, New Delhi

The unit came for personal hearing today. It sought lenient view for payment for damages and Bank Guarantee on the lines of some similar cases decided by this Committee where only excavation work had been completed. It also highlighted that the High Level Committee of the Government had enabled the hotel site owners to start the excavation work and seek the required clearances urgently. The Committee deliberated on the issue for about an hour and gave several options to the project proponent. Finally the Committee decided that 10 % of ½ % of the project cost of Rs. 475 crores i.e. Rs. 24 Lakhs may be taken as damages and equivalent amount as Bank Guarantee valid for three years. The unit has to file these two by 10.09.2008. As soon as the damages and Bank Guarantee are paid, Consent to Establish should be issued at the same time. Call on 10.09.2008. The unit came for personal hearing today. It sought lenient view in the payment for damages and Bank Guarantee on the lines of some similar cases decided by this Committee where only excavation work had been completed. It also highlighted that the High Level Committee of the Government had enabled the hotel site owners to start the excavation work and seek the required clearances urgently.

The Committee deliberated on the issue for about an hour and gave several options to the project proponent. Finally the Committee decided that 10 % of ½ % of the project cost of Rs. 160 crores i.e. Rs. 8 Lakhs may be taken as damages and equivalent amount as Bank Guarantee valid for three years. The unit has to file these two by 17.09.2008. As soon as the damages and Bank Guarantee are paid, Consent to Establish should be issued at the same time. Call on 17.09.2008.

Construction of Indus Hotel & Spa at Plot No. 4, Sector-13, Dwarka, New Delhi by M/s Divine Infracon Pvt. Ltd.

The unit came for personal hearing today. It sought lenient view in the payment for damages and Bank Guarantee on the lines of some similar cases decided by this Committee where only excavation work had been completed. It also highlighted that the High Level Committee of the Government had enabled the hotel site owners to start the excavation work and seek the required clearances urgently.

The Committee deliberated on the issue for about an hour and gave several options to the project proponent. Finally the Committee decided that 10 % of ½ % of the project cost of Rs. 457.20 crores i.e. Rs. 23 Lakhs may be taken as damages and equivalent amount as Bank Guarantee valid for three years. The unit has to file these two by 17.09.2008. As soon as the damages and Bank Guarantee are paid, Consent to Establish should be issued at the same time. Call on 17.09.2008.

Construction of Indus Hotel & Spa at Plot No. 3, Sector-10, Dwarka, New Delhi by M/s Tirupati Buildings and Offices Pvt. Ltd.

The unit came for personal hearing today. It sought lenient view in the payment for damages and Bank Guarantee on the lines of some similar cases decided by this Committee where only excavation work had been completed. It also highlighted that the High Level Committee of the Government had enabled the hotel site owners to start the excavation work and seek the required clearances urgently.

The Committee deliberated on the issue for about an hour and gave several options to the project proponent. Finally the Committee decided that 10 % of ½ % of the project cost of Rs. 407.88 crores i.e. Rs. 20 Lakhs may be taken as damages and equivalent amount as Bank Guarantee valid for three years. The unit has to file these two by 17.09.2008. As soon as the damages and Bank Guarantee are paid, Consent to Establish should be issued at the same time. Call on 17.09.2008.

Aditya Infracon (P) Ltd , at Plot no 8 Jasola District New Delhi

The unit came for personal hearing today. The total project cost is Rs. 77.90 crores and the total effluent discharge is 80 KLD. STP / ETP is yet to be installed and the SIT report has found certain other deficiencies which have been communicated to the unit. Unit is operating without Consent to Establish and Consent to Operate since January, 2008.

The unit was informed that in similar cases, for violation of the provisions of Air and Water Acts, the Committee has levied the damages of 1 % of the project cost which comes out to Rs. 78 Lakhs and 2 % of the project cost i.e. Rs. 1.56 crores as the Bank Guarantee valid for three years. The unit seeks time for few days. Call for personal hearing on 03.09.2008 at 5.15 PM. Since the IIT Survey indicates the built up area of more than 20,000 sqm, unit must apply for EC before the SEIAA which is being set up early next month.

ABW Infrastructure Ltd 208-210, Rectangle -I , D-4, Saket Dist Centre, New Delhi

The unit came for personal hearing today. The total project cost is Rs. 78.35 crores and the total effluent discharge is 69.6 KLD. STP / ETP is yet to be installed and the SIT report has found certain other deficiencies which have been communicated to the unit. Unit is operating without Consent to Establish and Consent to Operate since August, 2007. Trade effluent is being discharged without treatment into the sewer.

The unit was informed that in similar cases, for violation of the provisions of Air and Water Acts, the Committee has levied the damages of 1 % of the project cost which comes out to Rs. 78 Lakhs and 2 % of the project cost i.e. Rs. 1.56 crores as the Bank Guarantee valid for three years. The unit seeks time for few days. Call for personal hearing on 03.09.2008, at 5.45 PM. Since the IIT Survey indicates the built up area of more than 20,000 sqm, unit must apply for EC before the SEIAA which is being set up early next month.

All cases of hotel sites where notices have been issued afresh based on the data from DDA may be called on 10.09.2008 for response to the show cause notice.

Agenda Item No.5- Cases of Wazirpur Industrial Area

Decisions taken with respect to this agenda are tabulated and annexed as Annexure – 4. Committee has decided to take up the remaining cases of this agenda in the next CMC meeting to be held on 03.09.2008. Committee has also decided that all the cases of WIA will be merged into a single list for consideration of the CMC in future.

Agenda Item No.6- Cases of Friends Colony Industrial Area

This agenda could not be taken up due to paucity of time and it was decided by the Committee to take up the same along with cases of Okhla Industrial Area, cases of Naraina Industrial Area, Phase-I and cases of CBI reference in the CMC meeting to be held on 19.092008.

Agenda Item No.7- Action plan for new industries on the vacant plot after the closure of the industries placed in the negative list of MPD-2021.

Under the provision of Master Plan of Delhi-2021 units falling under the negative list have to close down their operations within three years by or before 06.02.2010. Once this exercise is completed the plots will fall vacant and new industries may come up for operation. The owner of the vacant plot shall submit the action plan for such new industries and take necessary permission for new activities. Such industrial units falling under negative list at present will submit an action plan for the new activity proposed on or after 06.02.2010.

The unit moved the Delhi High Court on 27.08.2008 and the Hon’ble High Court directed that affidavit is to be filed by the unit within 03 days stating therein that he shall not undertake any activity without the permission of DPCC. The unit has already filed an affidavit in this regard therefore the electricity and water connection must be restored if not already disconnected. W.r.t. the other units i.e. M/s Satish Gupta, notice for closure must be issued stating the deficiencies listed in the inspection report dated 26.08.2008.

The unit moved the Delhi High Court on 27.08.2008 and the Hon’ble High Court directed that the electricity and water connection is to be restored immediately as it stood already disconnected on 24.08.2008. His application for Consent to Establish under Green category may be disposed off by CMC(Green). W.r.t. the other units located in the same premises namely (i) M/s Somdutt, the unit has already applied under the Green category and the same may be disposed off in the CMC (Green) meeting (ii) M/s Suresh Kumar located at ground floor has already applied for CTE under Orange category, the same may be taken up in next CMC(Orange) of WIA on 03.09.2008 (iii) M/s Sushil Goel has applied under the Green category and his application may be considered by the CMC(Green). (iv) M/s A.K. Metal has not applied for Consent to Establish, he may be asked by way of notice to apply for Consent to Establish. (v) M/s J.P. Steel, the unit has already applied for Consent to Establish under Green category and the same may be disposed off in the CMC(Green) meeting.
