NOTICE OF VACANCY

MUNICIPAL LAW ENFORCEMENT OFFICER I (Part-time) Non-Union Building and By-law Services Department

The successful applicant will:

1. In order to undertake responsibilities set out in this position description, including response to complaints and inquiries, inspections and investigations, initiation of legal action, etc. the incumbent must be knowledgeable and proficient in the interpretation and application of various statutes and by-laws, including but not limited to:

a. Provincial Offences Act l. Livestock, Poultry and Honeybees Act b. Municipal Act m. Various by-laws including but not limited to c. Dog Owner’s Liability Act the Municipal Code By-law (i.e. animal control, parks, d. Highway Traffic Act discharge of firearms, operation of motorized vehicles, sale and display of fireworks, etc.); sign by-law; e. Line Fences Act business licensing by-law; adult entertainment by-law; f. Off-Road Vehicles Act nuisance by-law; lawn watering by-law, etc. g. Motorized Snow Vehicles Act n. Applicable case law as may be established h. Criminal Code of Canada by various levels of court including the Supreme Court i. Canadian Constitution of Canada, to assist in and guide the interpretation and application of legislation, enforcement and legal j. Ontario Evidence Act activities. k. Freedom of Information and Right to Privacy Act

2. Carries out inspections and investigations with respect to municipal by-laws and provincial statutes enforced by the City Clerk’s Office including:

a) Dog Owners Liability Act Vehicles, Lawn Watering.Adult Entertainment b) Business Licensing By-law Licensing By-law Tree Cutting c) Nuisance By-law, including: retail sales on municipal e) property; fouling of municipal property (e.g. urinating, f) Street Numbering By-law defecating, spitting, debris, etc.); vehicles (motorized g) Open Fire Burning and non-motorized) on sidewalks; busking; impeding h) Noise (administration, education) or interfering with pedestrian traffic (loitering). i) On-street Parking Municipal Code By-law consisting of Animal Control, d) j) Fire Routes Firearms, Fireworks, Livestock and Poultry Protection, Parks, Lottery Licensing, Signs, Smoking, Snow k) Handicapped Parking (Public & Private Property) l) Other by-laws and provincial statutes enforced by the City Clerk’s Office from time to time 3. Receives and responds to complaints. Carries out inspections of property, premises, vehicles, etc. Conducts interviews with members of the public, experts and other individuals in relation to potential violations of municipal by-laws, provincial or federal laws for which officers are responsible.

4. When assigned to animal control activities:

a. Carries out enforcement of municipal by-laws, including the rescue, capture, trapping, destruction, impound of domestic pets, urban and other wildlife, etc. b. Ensures prompt response to reported animal bites and suspected rabies or other potentially diseased or injured animals. Ensures property security, quarantine or destruction of animal as may be appropriate and required. c. Enforces provisions of Dog Owner’s Liability Act including breed identification, execution of search warrant for purpose of seizing prohibited or dangerous dog, public seizure (without warrant) of prohibited or dangerous dog, initiates appropriate legal action and ensures carrying out court orders. d. Retrieves carcasses from public and private property, as may be appropriate; disposes of carcasses. e. Reviews and Investigates livestock claims. Consults livestock valuers; recommends appropriate action to Senior MLEO including reimbursement to livestock owner. f. Ensures licensing of dogs or other animals as may be required. g. Ensures annual renewal of all dog or other animal licenses and compliance with requirement for rabies inoculations. h. Identifies need for and co-ordinates joint investigations as may be required to facilitate capture, control, protection or destruction of animals and protection of the public.

5. When assigned to sign by-law activities;

a. Reviews applications, architectural drawings, site plans, surveys, building permit applications, and other documents to determine compliance to sign by-law. b. Assists in negotiations for relocation of signs as a result of municipal road widening c. Negotiates with developers and ensures appropriate location, design and style of new signage. d. Negotiates and facilitates placement of Tourism Orientated Signage including Trailblazing and Wayfinding Signs. e. Issues permits or approvals as may be applicable. f. Makes decisions regarding denial, suspension or revocation of permits for non-compliance g. Reviews proposed site plans for commercial developments and provides comments to Building Services regarding the anticipated impact in community, concerns and ability of sign to comply with by-law provisions. Provides recommendations to the City Clerk for exemptions if necessary. h. Conducts site inspections. Monitors placement of signs to ensure compliance (eg. setbacks, visual hazards, etc.) i. Negotiates relocation of signs placed in violation of by-laws to achieve compliance. Remove signs from private and public property where compliance not achieved. j. Maintains sign database, statistical and other reports. k. Co-ordinates joint investigations/site visits with building inspectors, sign installers, architects, engineers, etc. to facilitate and ensure proper location of signs.

6. When assigned to lottery licensing activities:

a. Reviews eligibility documentation including budgets, financial statements, by-laws and constitutions, charitable or non-profit registrations, etc. to determine eligibility of organization in compliance with the Criminal Code of Canada and the Alcohol & Gaming Commission of Ontario (AGCO). . b. Reviews applications for lottery licenses, including bingos, break-opens, raffles, etc. Issues licenses. c. Reviews applications for e-bingo permits. Issues permits as authorized by Ontario Lottery Gaming Commission (OLGC). d. Makes decisions regarding denial, suspensions or revocation of licenses. e. Conducts site inspections to determine compliance with gaming laws including those established under the Criminal Code of Canada, and by the AGCO and the OLGC. f. Provides information and guidance to licensees/operators, etc. to achieve compliance. g. Identifies need for and co-ordinates joint inspections particularly with respect to potential violations of the Criminal Code and Terms and Conditions established by the AGCO and the permit requirements established by the OLGC. h. Consults with and carries out investigations as may be appropriate, including joint investigations and enforcement with Barrie Police Service, Ontario Provincial Police, the Alcohol & Gaming Commission of Ontario and the Ontario Lottery Gaming Commission. i. Co-ordinates and prepares crown briefs to facilitate charges under the Criminal Code of Canada.

7. When assigned to business licensing activities:

a. Conducts physical inspections of property, buildings, premises, and vehicles required to be licensed; b. Conducts in-vehicle driving tests for taxicab drivers. c. Reviews business licence applications and other relevant documentation including criminal code checks, liability insurance, driver’s licence, vehicles safety inspection certificates, TSSA certificates, trade credentials, etc. to determine eligibility for a licence and compliance with by-laws. d. Consults with other city departments and outside enforcement agencies to co-ordinate inspections, receive information and determine their approval of application. e. Recommends issuance/denial/suspension/revocation of business licence. f. Conducts inspection of business premises, vehicles, individuals and equipment, from time to time, to determine compliance with by-laws and other related statutes and regulations.

8. With respect to enforcement of the Line Fences Act, carries out site inspections. Assesses costs against property owners. Participate in appeals as may be required.

9. Negotiates and mediates resolution/gains compliance. Serves Notices and Orders as may be appropriate. Obtains and executes search warrants as may be necessary and appropriate to facilitate investigation, collection of evidence, etc.

10. Collects evidence, including physical, photographic, written (witness statements), etc. Prepares charges (Part I, Part II, and Part III), under authority of Provincial Offences Act as may be appropriate. Swears documentation before Justice of the Peace, serves Certificate of Offences, Summons, etc. Ensures proof of service before Justice of the Peace. Ensures legal rights of members of the public are communicated and protected.

11. Prepares full Crown Brief for review by Senior MLEO, Supervisor and Prosecutor. Works co-operatively with prosecutor to facilitate successful prosecution.

12. Attends court and gives evidence (i.e. examination-in-chief; cross-examination; redirect; voir dires, etc.)

13. Identifies areas of concern when other authorities/departments have jurisdiction (e.g. Barrie Police Services, Ontario Provincial Police, Alcohol and Gaming Commission of Ontario, OLGC, Simcoe Muskoka District Health Unit, Barrie Hydro, Building Services, Barrie Fire and Emergency Services, Planning Services, Finance, etc.). Ensure appropriate referrals and/or communications. Works in conjunction with such authorities/departments to achieve compliance and/or support appropriate legal action.

14. Makes recommendations to Senior MLEO for issuance/denial/suspension/revocation of licenses, permits, etc. as a result of enforcement and related activities.

15. Maintains accurate records, prepares reports, compiles statistical information, issues correspondence, conducts research and provides administrative assistance for the Municipal Law Enforcement operations.

16. Maintains effective, co-operative and professional liaison with other city staff, municipalities, enforcement agencies and other external organizations.

17. Keeps informed on relevant matters including new and amended by-laws, provincial legislation, related case law, regulations, practices and procedures.

18. Attends courses, seminars, workshops and conferences, relating to changes in regulations, procedures etc.

19. Assists the Senior MLEO by providing occasional guidance to new full, part time, temporary and contract staff, co-op and summer students, etc. through job shadowing, demonstrating use of technical equipment (including animal control instruments, hand-held ticket writers, etc.) and use of various databases, showing preparation of crown briefs, etc.

20. Performs such other related duties as may be assigned, such as assisting in all phases of municipal elections. Applicants must have: 1. Must have a two year Community College diploma in Law Enforcement. 2. Must have a Part I Foundations Certificate from the Municipal Law Enforcement Officers’ Association. 3. Must have MLEO Certification which accreditation is legislated under Bill Pr83 and requires meeting minimum education/experience criteria as well as ongoing membership with the Municipal Law Enforcement Officers’ Association. 4. At least two years of closely related experience performing the above functions. 5. Possession and Acquisition License (PAL) re. firearms and related firearms training. 6. Successful completion of the four courses of the Municipal Administration Program. 7. Computer literacy utilizing Microsoft Office Suite (Word, Excel, Outlook, PowerPoint). 8. A vehicle for City use, a valid Class “G” driver’s licence and a good driving record. 9. Valid First Aid and CPR certificates.

This is a part-time position involving no more than 24 hours per week on average. The successful applicant will be required to respond to call-outs during off-hours including nights and weekends.

The 2014 starting wage rate is $23.24 per hour, eventually progressing to a job rate of $32.09 per hour.
