Following are the minutes of the said meeting: -

Agenda Item No 1: Cases of Consent to Establish w.e.f. 21.06.2007.

Decisions taken with respect to this agenda are tabulated and annexed as Annexure – 1.

Agenda Item No 2: Cases of Consent to Operate w.e.f. 28.01.2005.

Decisions taken with respect to this agenda are tabulated and annexed as Annexure – 2.

Chairman asked about the points raised by Dr. Chandra Prakash, SEE for the last meeting, it was informed that following three points have been mentioned:-

(i) Action Taken Report (ATR) of the meeting. (ii) Surprise inspection of some cases. (iii) Recommendation by the CMC officials.

It was found that ATR has been submitted by the Cells in the form of confirmation on a note sheet rather than status of individual cases and note sheet also does not mention about the status of inspections carried out as per the recommendations of the Committee. The total number of consent pending with the Green Committee is about 550 besides cases of redevelopment areas. Normally, ATR is prepared on the individual case basis but due to heavy work load and availability of status of individual case on the website, the CMC officials insisted the submission of the ATRs in the present form. The purpose of ATR is basically to monitor the compliance of decisions taken and the pendancy etc. Since, it is going to be available on web, the monitoring remains to be done is for the cases where inspection has been decided. Hence, from the next meting onwards, in all cases where inspection has been decided, the ATRs should be clearly placed before the Committee. As far as ATR given on note sheet in the form of confirmation about the consent / SCNs issued, they are liable for action if found contrary. However, Dr. Chandra Prakash, SEE, DPCC was of the view that ATR of all the individual cases in which decision has been taken in the last meeting, should be placed before the CMC(Green) but the same was not agreed in view of above.

Idea of surprise inspection was basically to check the border line cases w.r.t. categorization. CMCs informed that inspection is built in for the grant of consent hence there is no need of surprise inspection. In the borderline cases, consent can be granted only after the inspection. However, it was decided that team will be authorized by MS to carry out such surprise inspection in such borderline cases where consent is being grant based on declaration / affidavit. As far as recommendation by the officials of CMCs is concerned, this point has already been discussed in earlier CMC meetings and it was agreed upon that recommendations at the level of individual CMC is not possible without inspection, hence, this point was not agreed.
