This fact sheet lists the documents that should accompany an application for approval under the family assistance law for different child care service legal entity types. 1 Does the operator/provider have a trading name (business name) different to their legal name?
If the Certificate of Business Name does not contain the applicant’s name, also attach the Business Name Extract. Certificate of business name registration attached; and/or Business name extract attached 2 What type of entity is the operator/provider?

Applicants seeking approval of a Family Day Care service may be asked to provide the following additional documents to assist with the assessment of the application. A copy of Provider Approval (if required and issued under the Education and Care Services National Law, as supplied by the appropriate State or Territory Regulatory Authority) A Criminal History Check issued not more than 6 months before the date of the application (unqualified, i.e. not just child care specific) for key personnel an Australian Securities and Investments Commission (ASIC) Current and Historical extract of the entity (not older than 3 months) an Australian Securities and Investments Commission (ASIC) Current and Historical extract of the person (not older than 3 months). Extract from the National Personal Insolvency Index Bankruptcy search for the applicant and each of the key personnel, including a Nil Result, dated no more than 6 months before the application is made A copy of the working with children card or working with children check (if required to hold one) for key personnel listed on the application 100 Point proof of Identification for all Key and Authorised Personnel listed on the application A selection of policies and procedures that the applicant is required to have in place under the National Law. The documents are: o governance and management of the service, including confidentiality of records o payment of fees and provision of a statement of fees charged by the education and care service o assessment and approval and reassessment of approved family day care venues and family day care residences, including matters to meet the requirements of regulation 116 of the National Law o engagement or registration of family day care educators o keeping of a register of family day care educators under regulation 153 of the National Law o note that this would include a copy of the register at 154 of the National Law o assessment of family day care educators, family day care educator assistants and persons residing at family day care residences, including the matters required under regulation 163 of the National Law o this includes the service’s policy and procedures on the ‘fit and proper person’ (e.g. considering criminal history checks).
