B. SCOPE/BACKGROUND

The County is seeking proposals from qualified vendors who can provide global positioning satellite (GPS), radio frequency (RF), Transdermal Alcohol Detector (TAD) Continuous Alcohol Monitoring (CAM) and other probationer tracking equipment and services in the following areas: active, passive, and hybrid (active and/or passive) monitoring, application support, orientation and training, documentation of confidential information, data entry and storage, types of network, server, and equipment, with the option to add additional services. The purpose of the equipment is to ensure the probationer’s accountability through the use of electronic monitoring technology. Utilizing this technology will assist the Alameda County’s Probation Department in monitoring the probationer’s compliance with legal mandates, court orders, and treatment plans that are designed to facilitate positive behavioral change and reduce the risk of recidivism. The County currently uses G4S Omnilink GPS equipment and services for approximately two hundred (200) probationers daily.

e. RF tracking equipment must:

(1) Have internal batteries that are either rechargeable or replaceable; (a) be capable of running on internal batteries for at least 48 hours without having to be recharged while in passive monitoring mode;

(b) have a transmitter capable of sending a low battery indicator signal on the RF unit and;

(c) low battery indicator on the RF unit will emit sounds at ten (10) minute intervals to remind user that unit is low on battery.

(d) internal battery must last a minimum of two (2) years before requiring replacement

f. Transdermal Alcohol Detector (TAD) Continuous Alcohol Monitoring (CAM) units must differentiate between ingested alcohol and environmental contamination.

in near real time (within 10 seconds of status update request) and then analyzed to determine consumption vs. contamination prior to alerting agency staff.

(2) The TAD function must be incorporated into the GPS tracking unit or vice versa. Please describe (on Exhibit B-3 CAM Unit) if the continuous alcohol monitoring system operates in conjunction with any location monitoring systems such as RF or GPS.

g. Spare parts for the tracking equipment and TAD CAM will be provided to the Department, as needed, at no charge.

RESPONSES TO SUBMITTED QUESTIONS:

Q1) Page 5 of 28 Section C, (VENDOR QUALIFICATIONS), Item 1.a states: 1. Minimum Qualifications a. Vendor must be regularly and continuously engaged in the business of providing GPS and RF tracking devices and monitoring services, requiring strict confidentiality, for law- enforcement or similar agencies of similar size to Alameda County, for at least three (3) years. Can the County make the vendor qualification for a TAD CAM device a three- year minimum as it is for GPS and RF? A) No. That technology is too new.

Q2) Should bidders include a line by line response to Items D, E, F, and G in Exhibit M? A) Yes.

Q3) Should bidders include a response to the vendor minimum qualifications as stated on pages 5 – 6 of the RFP, Section C (VENDOR QUALIFICATIONS)? A) Yes. A simple statement will suffice and should be submitted as part of the “Bidder’s Qualifications and Experience” response portion.

Q4) Page 6 of 28, Section D, (SPECIFIC REQUIREMENTS) Item 1.b states: 1. Monitoring and Support Requirements a. Internet access and application support, via Internet Service Provider (ISP) that allows Probation Department personnel access to data from the Monitoring Center. Does the County intend to specify the vendor must utilize a third party ISP or only that the Probation Department should have Internet access to the system’s monitoring data? A) The Probation Department requires internet access to the system’s monitoring data.

Does the County expect the winning bidder to supply laptops and/or computers at no extra charge? A) No, unless the laptop or computer is required for the maintenance or programming of the monitoring units.

1. Monitoring and Support Requirements g. Contractor must have a written quality control plan for equipment to ensure that all requirements are met. The plan and any future amendments to the plan are subject to County review and approval and shall include, but not be limited to the following: (1) A method for ensuring uninterrupted service to Probation in the event of a strike of Contractor’s employees. Would the County please clarify “in the event of a strike”? It is unclear whose employees the County is concerned about striking because few vendors have a unionized staff? A) This requirement relates to vendor’s employees.

Central monitoring computer must be backed up in real-time to local redundant servers and to redundant servers located at least 500 miles away. If bidders can describe their central monitoring computer’s secured data redundancy protocols, both the local and secondary off site will the County waive the “500 mile away” requirement? A) Vendor can take exception to this requirement on Exhibit I and describe their comparable solution. The County is under no obligation to accept any exceptions.

Q8) Page 7 of 28, Section D, (SPECIFIC REQUIREMENTS), Item 1.q states, 1. Monitoring and Support Requirements q. System shall allow the County to establish GPS, RF, TAD CAM and other monitoring at one (1) or more locations. Can the County please explain what the above item means? A) There are multiple locations where monitoring takes place. The County wants to make sure that monitoring of clients can be performed at all locations in all formats.

Q9) Page 7 of 28, Section D, (SPECIFIC REQUIREMENTS), Item 1.t states: 1. Monitoring and Support Requirements t. Central monitoring computer must be set to perform an automatic monitoring check-in with field monitoring device at a minimum of every 30 minutes, or as determined by the County. direct communication with the Point of Contact for the Agency must be made. i. Can the County please describe what direct communication means? ii. Is the County referring to GPS or RF monitoring devices? A) i. The County is currently using emails and texts for direct communication. However the County is open to other solutions that can provide information reliably and verifiably. ii. The County requires that the vendor report the maximum frequency with which a GPS or RF device can technically report.

Q10) Page 8 of 28 Section D, (SPECIFIC REQUIREMENTS), Item 2.a states: 2. Training Requirements a. Vendor shall include four (4) all day on-site trainings per year at no additional cost. Can the County amend the above section to read, Vendor shall include two (2) all day on-site trainings per year at no additional cost. Additionally, ongoing and interim training must be delivered via live webinar and computer-based training as requested by the Department at no additional charge? A) Two (2) days of all day on-site training is sufficient. Please see the revised specification on page 2 of this Addendum.

Q11) Page 8 of 28 Section D, (SPECIFIC REQUIREMENTS), Item 3.c.4 states: 3. Transmitting Equipment Requirements: c. All tracking units must meet the following specifications: (4) The units must track probationers at a minimum of every 30 minutes, or as determined by the County. i. Does this requirement apply to GPS or an RF unit? ii. Will the County please clarify which tracking parameter it stipulates at every 30 minutes? A) i. The County requires that both the GPS and RF units track probationers at a minimum of every 30 minutes. ii. The County requires a rate plan that can be set to send information regarding the clients’ physical location at different times as set by Probation.

(1) Hybrid Monitoring - The device can provide both active and passive monitoring as requested on call. It is sometimes called On Demand or Pert. (2) Active Monitoring - The device can be monitored in real time providing instant information about a subject’s whereabouts or condition. (3) Passive Monitoring - The device “reports in” past- tense information for examination on either a pre-set schedule or “on-demand” basis? i. Can the County please describe in detail the definition of Hybrid Monitoring? ii. Does the County require the monitoring unit to transmit information instantly or for information to be transmitted at each check in call? iii. Can the County please describe in detail the definition of Active Monitoring? iv. Can the County amend this section to read, Active Monitoring - The device can be monitored in near real time, providing instant information about a subject’s whereabouts or condition? v. Can the County please describe in detail the definition of Passive Monitoring? A) i. Hybrid monitoring allows the units to be set to be passive or active. Active monitoring is near real time(within 10 seconds of status update request) and can track defendants actively while they are on the move or at their residence or job. Passive monitoring can be set to send messages at a later time or day. ii. The County requires that the device report in on demand or at a near real time (within 10 seconds of status update request) frequency for short durations. iii. Active monitoring allows the department to track the movements of clients in near real time (within 10 seconds of status update request.) The person monitoring should be able to see movements on the screen, speed, time, accuracy. iv. Please see the revised specification on page 2 of this Addendum. v. Passive monitoring allows the unit to send movements of clients after the fact. The information could be transmitted on the same evening as well as the following day.

Q13) Will the County consider cellular capability for RF, GPS, and TAD CAM monitoring units? A) Yes. County of Alameda, General Services Agency – Purchasing RFP No. 900945, Addendum No. 4 Page 8 of 18 June 28, 2012

Q14) Will the County consider using a unit that is RF with the TAD CAM function if the unit meets the standards for admissibility in court? A) Only if it has been utilized in court and accepted previously.

Q15) Page 9 of 28, Section D, (SPECIFIC REQUIREMENTS), Item 3.e.(1) states: 3. Transmitting Equipment Requirements: e. RF tracking equipment must: (1) Have internal batteries that are rechargeable; Can the Addendum read that the batteries must be long lasting with a notification method of low battery if they are not rechargeable? A) See revised specification on page 2 of this Addendum. The County prefers rechargeable batteries, but will consider all technologies. Battery details for each type of unit can be listed on Exhibit B-1, B-2, and B-3.

Q16) Page 9 of 28, Section D, (SPECIFIC REQUIREMENTS), Item 3.e.(1)(a) states: 3. Transmitting Equipment Requirements: e. RF tracking equipment must: (1) Have internal batteries that are rechargeable; (a) be capable of running on internal batteries for at least 48 hours without having to be recharged; i. Will a vendor be disqualified if they cannot provide an RF unit that doesn’t hold a charge for 48 hours? ii. Does this requirement apply to tracking devices operating in active mode? A) i. Yes. See revised specification on page 3 of this Addendum. ii. No. See revised specification on page 3 of this Addendum.

Q17) Page 9 of 28, Section D, (SPECIFIC REQUIREMENTS), Item, 3.e.(1)(c) states: 3. Transmitting Equipment Requirements: e. RF tracking equipment must: (1) Have internal batteries that are rechargeable;

(c) low battery indicator on the RF unit will emit sounds at ten (10) minute intervals to remind user that unit is low on battery. Is this a GPS or RF feature? A) This is an RF feature, but the County prefers a ‘Low Battery Notice’ on all equipment, if available. Q19) Page 9 of 28, Section D, (SPECIFIC REQUIREMENTS), Item 3.e.(2) states: 3. Transmitting Equipment Requirements: e. RF tracking equipment must: (2) Unit must be capable of storing data for a minimum of 72 hours in the event that communication with the contractor’s central computer is disrupted and be immediately transmitted when communication is restored. Does this requirement apply to RF or GPS units? A) The requirement stated above applies to both RF and GPS units.

Q20) Will the County require a single device that has active, hybrid, and passive monitoring capabilities? A) Yes.

Q21) Page 9 of 28 Section D, SPECIFIC REQUIREMENTS item 3.f. states: 3. Transmitting Equipment Requirements: f. Transdermal Alcohol Detector (TAD) Continuous Alcohol Monitoring (CAM) units must differentiate between ingested alcohol and environmental contamination. i. Some transdermal equipment requires a urinalysis test to confirm the difference between environment and ingested alcohol for court admissibility. Is this acceptable or must the bracelet be able to differentiate itself? ii. What does the County expect the monitoring system to do in order to differentiate between ingested alcohol and environmental contamination? iii. Does the County expect the results to be admissible in court? iv. Can the County amend the above section to read, any and all types of alcohol detection must be time-stamped in real time and then analyzed to determine consumption vs. contamination prior to alerting agency staff? The alcohol detection equipment must be able to differentiate between environment and ingested alcohol without a urine screening. ii. The County expects the system to factor possible environmental contamination into results. The County expects the system to either differentiate between consumption and contamination or to provide sufficient data that a defensible finding on the subject can be made with certainty. The County prefers the former condition. iii. Yes. iv. Yes. See revised specification on page 3 of this Addendum.

Q22) Page 9 of 28, Section D, (SPECIFIC REQUIREMENTS), Item 3.f.(2) states: 3. Transmitting Equipment Requirements: f. Transdermal Alcohol Detector (TAD) Continuous Alcohol Monitoring (CAM) units must differentiate between ingested alcohol and environmental contamination. (2) The TAD CAM function must be incorporated into the GPS tracking unit or vice versa. i. Will the County accept RF units with the TAD CAM function incorporated into them? ii. Can the County specify the parameters of hybrid monitoring that it is seeking? iii. Does the County require the GPS tracking device and the TAD CAM function to be a one (1) piece unit? iv. Can the County amend the above section to read, please describe if the transdermal alcohol detection Continuous Alcohol Monitoring system operates in conjunction with any location monitoring systems such as RF or GPS? A) i. Please see revised specification on page 1 of this Addendum. Yes. ii. System should be able to provide information on demand and be able to function as a passive system, if needed. iii. Q23) What type of monitor device does the County prefer? A) GPS.

Q24) Page 12 of 28, Section G, (DELIVERABLES/REPORTS), Item 1.o states: 1. System will provide: o. Mapping Playback Report: Moving dots to show where a client was during a specific period of time. The client’s County of Alameda, General Services Agency – Purchasing RFP No. 900945, Addendum No. 4 Page 11 of 18 June 28, 2012

direction, speed, and equipment status displayed at each point. This report is also interactive and allows users to customize the playback. Does the Mapping playback report refer to a static hard/soft copy or an interactive report on screen? A) The mapping playback report is interactive and on screen.

Q25) On page 13 of 28, Section I, (CALENDAR OF EVENTS), the Evaluation Period is tentatively scheduled for May 22 – July 16, 2012. Will the County be testing proposed equipment during the evaluation period? A) The County may ask to field test the equipment for up to 10 days with a single machine and with support from the vendor for installation and monitoring.

Q26) Page 17 of 28, Section M, (EVALUATION CRITERIA/SELECTION COMMITTEE), the third paragraph states: Each of the following Evaluation Criteria below will be used in ranking and determining the quality of bidders’ proposals. Proposals will be evaluated according to each Evaluation Criteria, and scored on a five- point scale. The scores for all the Evaluation Criteria will then be added according to their assigned weight (below) to arrive at a weighted score for each proposal. A proposal with a high weighted total will be deemed of higher quality than a proposal with a lesser-weighted total. The final maximum score for any project is five hundred twenty five (525) points including local preference points. The points on the evaluation chart on page 18 through 20 only add up to 100. How does the County calculate a total possible score of 525? A) The total amount of points awarded per scoring criteria weight (100) will be multiplied by a scoring range of zero to five points, resulting in a possible score of 500 points. The extra 25 points (5%) are awarded for the 5% local preference. This results in a maximum possible score of 525 points.

Q27) Where should bidders include the delivery plan in their proposal? A) Please see revised specification on page 3 of this Addendum. The Delivery Plan criterion has been removed from the RFP.

Q28) Page 28 of 28, Section Y, (GENERAL REQUIREMENTS), Item 1 states: Contractor shall provide a dedicated competent account manager who shall be responsible for the County account/contract. The account manager shall receive all orders from the County and shall be the primary contact for all issues regarding Bidder’s response to this RFP and any contract which may arise pursuant to this RFP. i. Can the County please describe what dedicated competent account manager means? ii. What services are provided to the County by the current vendor and what support services the Contractor is expected to provide going forward: what tasks, during what hours, and at what locations? A) i. The winning bidder must provide the County with one (1) point of contact, an Account Manager, who is familiar with the County contract and equipment and can provide prompt service and problem resolution. ii. The current vendor provides 24 hour support service, overnight shipment of equipment when needed, and training, in person, on site, and by computer network. The County requires 24 hour tech support and a live person to provide service at all times.

Q29) Will the County send an electronic copy of the Exhibits to the vendors? A) No. Bidders can download electronic copies from the County website at http://www.acgov.org/gsa_app/gsa/purchasing/bid_content/contractopport unities.jsp

Q30) Are bidders required to submit their response to Exhibit B on the bid forms provided? A) Yes. Any change to the Bid Form will result in disqualification per page 1 of Exhibit B: Cost shall be submitted on Exhibit B as is. No alterations or changes of any kind are permitted. Bid responses that do not comply will be subject to rejection in total.

Q31) What is the meaning of “Extended Year” on Exhibit B (Bid Form)? A) Extended Year refers to the total cost for the indicated year and is calculated by multiplying the ‘daily cost for unit’ times ‘estimated usage per day’ times 365 as shown on the Bid Form.

Q32) Can the County include two (2) line items on Exhibit B, one for RF landline and another for RF cellular? A) Yes. Please see REVISED Exhibit B (Bid Form) attached to this Addendum.

Q33) Will the County change page two (2) of Exhibit B to be included in the evaluation of cost? A) See REVISED Exhibit B (Bid Form). County of Alameda, General Services Agency – Purchasing RFP No. 900945, Addendum No. 4 Page 13 of 18 June 28, 2012

Q34) Can the County amend page 2 of Exhibit B to allow for a quantity discount for transdermal alcohol detectors Continuous Alcohol Monitoring units? A) Yes, please see revised Exhibit B (Bid Form).

Q35) Exhibit B page 1 asks for pricing on TAD CAM and monitoring. Does the County want pricing for TAD CAM with RF monitoring or TAD CAM with GPS? A) The Department is open to either option; details, including types of monitoring, should be included on the REVISED EXHIBIT B-3 TAD CAM Unit page.

Q36) Is the quantity discount cumulative or specific to the unit ranges given on Exhibit B? A) Please see revised Exhibit B, Bid Form. The quantity discount is specific to the ranges on Exhibit B.

Q37) Can vendors propose a price for an item not on the bid form? A) Vendor can propose other equipment and services on page two (2) of the bid form.

Q38) Is the quantity discount based on the number of units that are online and in use? A) Yes.

Q39) Is the Standard Service Agreement Template link on Exhibit J inserted in the RFP as a reference for potential vendors? A) Yes.

Q40) Exhibit M, Item H (Description of the Proposed Equipment/System), states: Bid response shall include a description of the proposed equipment/system, as it will be finally configured during the term of the contract. The description shall specify how the proposed equipment/system will meet or exceed the requirements of the County and shall explain any advantages that this proposed equipment/system would have over other possible equipment/systems. The description shall include any disadvantages or limitations that the County should be aware of in evaluating the PROPOSAL. Q42) Please describe the County’s expectation regarding the overall proposal and delivery plan? The ‘Delivery Plan’ criterion has been removed from the RFP.

Q43) If bidders are required to respond specification by specification, do bidders have to respond to all requirements A to Z? A) Bidders should provide a reference to explain how their product meets each specification in their proposal.

Q44) If the County requires a spec-by-spec response, should vendors include this response within Item H (Description of Proposed Equipment/System) or Item I (Description of the Proposed Services) as listed in Exhibit M? Q45) Will the County accept biographical and professional information in place of physical résumés? A) The County requires standard resume information as described in Exhibit M, Item G (Key Personnel) for each staff member who will service the County account.

Q51) Is there any possibility that the vendor interviews will be held before July 10, 2012? A) The dates on the Calendar of events are tentative.

Q52) Will the winning bidder be responsible for the installation and maintenance of the monitoring equipment? A) The Alameda County Probation Department will install the monitoring units; however, the winning bidder will be responsible for maintaining the units.

Q53) Is there any future use beyond the five (5) units estimated on Exhibit B for TAD CAM devices? A) Yes. Please see revised Exhibit B, Bid Form for updated usage.

Q54) In addition to transdermal alcohol devices Continuous Alcohol Monitoring devices, is Alameda County interested in receiving other proposals for breath alcohol systems, which are often less expensive? A) Yes. This can be provided under “Other Equipment/Services” on page 2 of 2 on the REVISED Exhibit B (Bid Form).

Q56) How many officers does the Probation Department currently have supervising offenders? A) Probation: Approximately 200 supervision officers. Juvenile Justice Center: There are 11 staff members assigned to the GPS unit.

Q57) Is the risk assessment used for both adult and juvenile offenders? A) Yes. The juvenile assessment is in use; the adult assessment is in development.

Q58) What risk assessment does the County use? A) The County’s risk assessment was designed by the National Council on Crime and Delinquency specifically for its use.

Q59) Does the County conduct a risk assessment to determine what type of monitoring device to use for certain offenders? A) Yes, the County utilizes risk assessments for both juvenile and adult offenders.

Q60) Can the County please describe the current adult monitoring program? A) The adult program is currently running with a number of under 10. It is Probation understands that the adult program may be waiting for release from confinement of new clients to increase their numbers.

Q61) Can the County please describe the current juvenile monitoring program? A) The current juvenile monitoring program places minors on the program as ordered by the Court. The nature of the offense is not the determining factor, the court orders minors on and off the program. Probation is monitoring 225+ individuals on a daily basis.

Q62) Who is the current vendor for the Alameda County Probation Department for each technology, and how many units does the agency currently utilize for each technology at what current price? A) G4S is the vendor. As of May 14, 2012, the County is utilizing 230 units (this includes the Adult side).

Q63) Can the County please provide the average monthly volume for the current equipment and services? A) The current average is 228 units per month.

RFP No. 900945, Addendum No. 4 The County of Alameda is soliciting bids from qualified vendors to furnish its requirements per the specifications, terms and conditions contained in the above referenced RFP number. This Bid Acknowledgement must be completed, signed by a responsible officer or employee, dated and submitted with the bid response. Obligations assumed by such signature must be fulfilled. 1. Preparation of bids: (a) All prices and notations must be printed in ink or typewritten. No erasures permitted. Rights and remedies of County for default: (a) In the event any item furnished by vendor in the performance of the contract or purchase order should fail to conform to the specifications therefore or to the sample submitted by vendor with its bid, the County may reject the same, and it shall thereupon become the duty of vendor to reclaim and remove the same forthwith, without expense to the County, and immediately to replace all such rejected items with others conforming to such specifications or samples; provided that should vendor fail, neglect or refuse so to do the County shall thereupon have the right purchase in the open market, in lieu thereof, a corresponding quantity of any such items and to deduct from any moneys due or that may there after come due to vendor the difference between the prices named in the contract or purchase order and the actual cost thereof to the County. In the event that vendor fails to make prompt delivery as specified for any item, the same conditions as to the rights of the County to purchase in the open market and to reimbursement set forth above shall apply, except when delivery is delayed by fire, strike, freight embargo, or Act of God or the government. (b)Cost of inspection or deliveries or offers for delivery, which do not meet specifications, will be borne by the vendor. (c) The rights and remedies of the County provided above shall not be exclusive and are in addition to any other rights and remedies provided by law or under the contract. 8. Discounts: (a) Terms of less than ten (10) days for cash discount will considered as net. (b) In connection with any discount offered, time will be computed from date of complete, satisfactory delivery of the supplies, equipment or services specified in the RFP, or from date correct invoices are received by the County at the billing address specified, if the latter date is later than the date of delivery. California Government Code Section 4552: In submitting a bid to a public purchasing body, the bidder offers and agrees that if the bid is accepted, it will assign to the purchasing body all rights, title, and interest in and to all causes of action it may have under Section 4 of the Clayton Act (15 U.S.C.
