First Meeting of State Level Environment Impact Assessment Authority, Chhattisgarh s2

SUMMARY RECORD OF THE 30 TH MEETING OF STATE LEVEL EXPERT APPRAISAL COMMITTEE, CHHATTISGARH

The 30th meeting of State Level Expert Appraisal Committee, Chhattisgarh was held on 08/05/2009 at Conference Hall, SEAC, Secretariat, 1-Tilak Nagar, Shiv Mandir Chowk, Main Road, Avanti Vihar, Raipur at 12:00 Noon. Dr. Harendra Kumar, Chairman, SEAC, Chhattisgarh chaired the meeting. The following members of SEAC were present in the meeting: - 1. Shri Ashok Masih Member, SEAC 2. Shri V.N. Singh, Member, SEAC 3. At the outset, the Technical Officer, SEAC, Chhattisgarh welcomed the Chairman and Members of State Level Expert Appraisal Committee, Chhattisgarh. Agenda wise discussions were carried out as follows: -

Agenda Item No. 1 - Confirmation of minutes of the 29th meeting of SEAC, Chhattisgarh.

Minutes of the 29th meeting of SEAC, Chhattisgarh held on 28/04/09 was presented before the committee. The Committee approved minutes of the meeting.

Agenda Item No. 2 - Discussion on the proposals submitted for reconsideration.

(1) M/s Maruti Clean Coal & Power Limited, Village – Bandhakhar, Tehsil – Pali, District – Korba (C.G.) M/s Maruti Clean Coal & Power Limited has proposed to set up a Thermal Power Plant project of 2 x 135 = 270 MW capacity. Project proponent has applied for Environmental Clearance to Ministry of Environment and Forests, Government of India, New Delhi vide letter dated 25/12/2007. The proposal was considered by State Expert Appraisal Committee (Thermal & Coal Mining Projects) in 16th meeting on 11- 13/02/08. TOR was issued to project proponent on 18/03/08. Public Hearing was held on 06/08/2008 at Tehsil Office Parisar, Katghora, District-Korba (C.G.). Public Hearing proceedings were received by Ministry of Environment and Forests, Government of India from CECB Raipur vide letter dated 21/08/08. Ministry of Environment and Forests, Government of India New Delhi transferred the original file of M/s Maruti Clean Coal & Power Limited vide their letter no. J-13011/MISC/2008-IA.II(T) dated 26/08/2008. Project proponent has applied to SEIAA Chhattisgarh on 05/11/08 for the grant of Environmental Clearance as per schedule five of EIA Notification 2006. The application submitted was considered in 20th meeting of SEAC, Chhattisgarh held on 27/12/2008. Committee then decided to ask the project proponent to submit the additional information/documents. Project proponent submitted the desired information on 06/02/2009. The proposal was reconsidered in 23rd meeting on 07/02/2009 of SEAC, Chhattisgarh. As per decision, project proponent made presentation in the 27th meeting of SEAC, Chhattisgarh on 28/03/2009.

D:\Docs\2018-04-12\0fc0c6bc1a8a226edaaa64ac0a98b5b8.doc 1 The brief of the project is as follows: - Name of the Project M/s Maruti Clean Coal & Power Limited, Proposed Site Village – Bandhakhar, Tehsil – Pali, District – Korba (C.G.) Production Coal Based Thermal Power Plant of 2x135 = 270 MW Capacity Fuel Coal rejects will be used as primary fuel. The fuel shall be mixture of ROM coal (40%) and washery rejects (60%) and shall be consumed at the rate of 1.05 kgs per KWH, totaling to 6800 TPD (2720 TPD ROM coal and 4080 TPD washery rejects). The washery reject shall be available from the washery of M/s Maruti Clean Coal and Power Ltd. located at a distance of about 6 km. The washery reject shall be transported to the proposed power plant through pipe conveyor. Raw coal transport shall be through road. Cooling System The steam turbine will be of 3000 rpm, tandem compound single re-heat condensing type, air cooling, condensing machine with extraction for regenerative feed water heating. Area of the Project 174.50 Ha

Based on the consideration of the documents submitted, the presentation made by the project proponent and discussion held, the Committee then decided that project proponent should be asked to submit the clarification regarding points raised during the presentation. Project proponent then assured the committee to submit the desired information at the earliest. Committee then decided that after receipt of the requisite information, the information/documents should be placed before the committee for consideration of Environmental Clearance as per Environment Impact Assessment Notification, 2006. Accordingly, project proponent submitted the desired information on 13/04/09. The submitted information/documents were considered by SEAC, Chhattisgarh in 30th meeting on 08/05/2009.

Project proponent informed that:-  Local species Mahua, karanj, Neem, Jamun, Aam, Arjun etc. will be given preference for green belt. Selection of broad leaf local plant species for the development of green belt will be ensured.  Copy of Preliminary Feasibility Report for availability of water in Lilagarh River submitted to Water Resources Department, Government of Chhattisgarh is submitted along with the agenda note of WRD, Korba, WRD Bilaspur vide letter dated 13/04/09. As per the agenda note, the water requirement of 3.09 MCM can be created by Lilagarh River in spite of previous allocations of 7.5 MCM as the annual yield of the river is 52.65 MCM which conclusively establishes the availability of water from Lilagarh River for the project.  Transportation route map (from SECL Dipka mines to the project site via Tivarta, Kekranar, rainpur & Bhandhakhar) for the transportation of fuel and ash is submitted. The total distance is 12.8 kms. The route from SECL Dipka mines to Bhandhakhar is maintained by SECL. Project proponent will construct the approach road from the plant site to SECL maintained Dipka – Pali road (0.7 kms.) Project proponent will be responsible for its regular maintenance and upkeep.  Undertaking for financial provision of Rs. 100.00 lacs or 5% of net profit (whichever will be higher) per annum for various CSR activities is submitted.  Possibility of railway siding : Chief Engineer (PRG -I) CSEB has entrusted M/s Wardha Paower Company Private Limited to coordinate amongst all the investors who are interested for supply of coal to their respective project site D:\Docs\2018-04-12\0fc0c6bc1a8a226edaaa64ac0a98b5b8.doc 2 through the common railway corridor developed for the Hasdeo Arand coal belt. They have already done the pre-feasibility study through RITES and started communication with various proponents in this regard. Their letter to the sister concern M/s Godawari Power & Ispat Limited (previously Ispat Godawari Limited) seeking our participation is submitted and the commitment of MCCPL to be a party to this common railway corridor project is also submitted. As evident from their letter that the corridor will be operational from 2013-14. Since the excepted COD of MCCPL is July, 2011. Project proponent intend to transport coal from the mines by road transport till then.  Commitment for providing financial support for establishment of ITI : Project proponent has adopted women ITI Korba. A Institute Management Committee has been from and registered by the registrar of societies Bilaspur (Chhattisgarh). Copy of memorandum of association of the Institute Management Committee of women ITI Korba is also submitted.  Justification for not selecting the monitoring station beyond 5 km : The position of all the air sampling stations were kept within the periphery of 6 kms with the farthest at 5 kms southwards from the core zone because the ground level concentrations (GLC) of all the air pollutants were found to be maximum at a distance of 3.3.5km to get the best representation and in consistent with the spread excepted from a 220 meter high chimney. However as required by SEAC Chhattisgarh project proponent has submitted GLC values study for 7 days (from 31/03/09 to 06/04/09) at 6 locations mainly at a distance of 9-10 kms in all directions (along with the map showing the locations of sampling stations). The values of GLC of new stations are lower then the values of initial stations with RPM reducing from 59.0 to 53.83 µg/m3, SPM from 146.5 to 133.0 µg/m3, Sox from 8.48 to 6.55 µg/m3 and Nox from 12.23 to 9.41 µg/m3.  Copy of Coal linkage recommendation letter issued by under secretary, the Govt. of India, Ministry of Power is submitted.  Action plan for utilization of fly ash as per Ministry of Environment & Forest, Government of India, New Delhi Notification : MCCPL has submitted the undertaking that they will use the fly ash generated from combustion of the coal in the plant for brick making, fly ash aggregate making supply to nearby cement industries and coal mine filling if permitted in future. No fly ash will be used for land and road filling.  Authentic information regarding no historical importance monument within 10 km radius : MCCPL has submitted the undertaking that there are no monuments, temples and structures of historical importance within 10 km radius of the proposed site. Toposheet map is also enclosed indicating that Mahadev Temple Pali (ASI monument) is beyond 10 km radius.

The proposed project does not fulfill the criteria as mentioned in general condition of Schedule of EIA Notification, 2006, hence falls under Category ‘B’. Based on the consideration of the documents submitted, the presentation made by the project proponent, discussion held, the Committee recommended for grant of Prior Environmental Clearance for the proposed 270 MW (2x135 MW) Washery Rejects / Coal Based Thermal Power Plant subject to fulfillment of terms and conditions as per Annexure-I. SEIAA may be informed accordingly.

(2) M/s Vandana Energy & Steels Private Limited, Vandana House, Ramkund, G.E. Road, Raipur (C.G.). M/s Vandana Energy & Steels Private Limited has proposed to set up a 2 x 35 MW Coal/Washery Reject/ Dolochar Based Power Plant. Project proponent has applied for Environmental Clearance to Ministry of Environment and Forests, Government of India, New Delhi on 09/08/2007 and 22/12/2007. The proposal was considered by Expert Appraisal Committee (Thermal & Coal Mining Projects) on 11- D:\Docs\2018-04-12\0fc0c6bc1a8a226edaaa64ac0a98b5b8.doc 3 13/02/08. TOR was issued to Project proponent on 12/03/07. Public Hearing was held on 04/10/2008 at Tehsil Office Parisar, Katghora, District-Korba (C.G.). Public Hearing proceedings were received by SEIAA Chhattisgarh on 27/10/08 from CECB, Raipur. Ministry of Environment and Forests, Government of India, New Delhi transferred the original file of M/s Vandana Energy & Steels Private Limited vide their letter no. J- 13012/207/2007-IA(T) dated 07/10/2008. Project proponent has applied to SEIAA Chhattisgarh on 30/10/2008 for the grant of Environmental Clearance. The application submitted was considered in 20th meeting of SEAC, Chhattisgarh held on 27/12/2008. Committee then decided to ask the project proponent to submit the additional information/documents. Project proponent submitted the desired information on 04/02/2009. The proposal was reconsidered in 23rd meeting on 07/02/2009 of SEAC, Chhattisgarh. As per decision, project proponent made presentation in the 27th meeting of SEAC, Chhattisgarh on 28/03/2009. The brief of the project is as follows:- Proposed Site Village – Dhanras, Tehsil- Katghora, District – Korba Capacity Coal/Washery Reject/ Dolochar Based Power Plant of 2 x 35 MW Fuel Washery Rejects = 1604 TPD Dolochar = 295 TPD Coal = 290 TPD Water Source River Hasdeo Area of the Project Land requirement has been optimized and reduced to 29.54 ha from 33.0 ha. Description Area (ha) Power Plant and 05.0 Ancillaries Coal Storage Yard 01.54

Based on the consideration of the documents submitted, the presentation made by the project proponent and discussion held, the Committee then decided that project proponent should be asked to submit the clarification regarding points raised during the presentation. Project proponent then assured the committee to submit the desired information at the earliest. Committee then decided that after receipt of the requisite information, the information/documents should be placed before the committee for consideration of Environmental Clearance as per Environment Impact Assessment Notification, 2006. Accordingly, project proponent submitted the desired information on 31/03/09. The submitted information/documents were considered by SEAC, Chhattisgarh in 30th meeting on 08/05/2009.

Project proponent informed that:-

 Ash dyke area will be optimized to 10 ha instead of 11 ha. Balance 1 ha land will be utilized for the green belt development. The green belt area will be 11 ha instead of 10 ha.

D:\Docs\2018-04-12\0fc0c6bc1a8a226edaaa64ac0a98b5b8.doc 4  Analysis of washery reject and dolochar to be used as fuel is submitted.  Greenbelt plantation : Plantation will be done by the trees which are very useful for environment protection the name of some trees are as Nim, Jam, Aam, Arjun, Karangi, Nilgiri etc. with consultation of forest department.  Colling tower COC will be maintained 5 (Five).  Water allocation letter no. 1788 dated 31/03/08 from Water Resources Department, Govt. of Chhattisgarh Raipur is submitted.  Details of emission calculation and GLC for SPM are submitted with verification.  Financial provision for CSR activities under capital investment will be increased to Rs. 25 Lacs (Rs. Twenty Five Lacs) from Rs. 12 lacs and under recurring annual provision will be increased to Rs. 2 lacs from Rs. 1.5 lacs.  Approach road of approx. 2 km from main road to the plant site shall be constructed.  Transportation route map for the transportation of coal and washery reject is submitted.  Possibility of railway siding: The proposed site is just 22 km from SECL coal mines, hence road transport is economical and convenient. Further there is no Railway siding in between plant site and coal mine. The coal requirement for the project is also very less i.e. 290 TPD hence road transport has been considered however, possibilities for development of common Railway corridor will be explored along with other coal block alottees.  Feasibility for air condenser in place of water condenser: Water has been allocated for this 70 MW project from Hasdeo River by WRD of C.G. Govt. hence project proponent has opted for water cooled condenser.  Stack height calculation has been submitted. 110 m stack will be provided as against the calculated height (93.85m) on the basis of SO2 emission.  The ambient air quality monitoring locations were selected as per the guidelines of CPCB /MoEF (Method of Monitoring & analysis). In the upwind direction, three locations at chhurikhurd, Salera & Katghora were selected considering the wind rose diagram.  High concentration slurry disposal system shall also be adopted.

The proposed project does not fulfill the criteria as mentioned in general condition of Schedule of EIA Notification, 2006, hence falls under Category ‘B’. Based on the consideration of the documents submitted, the presentation made by the project proponent, discussion held, the Committee recommended for grant of Prior Environmental Clearance for the proposed 70 MW (2x35 MW) Washery Rejects / Coal Based Thermal Power Plant subject to fulfillment of terms and conditions as per Annexure-II. SEIAA may be informed accordingly.

(3) M/s Chhattisgarh Mineral Development Corporation Limited Village- Kudarwahi, Tehsil – Keshkal, Dist.- Bastar (C.G.) (Area – 20ha.) The Project proponent submitted application (Form-I, and Pre-Feasibility Report) for Environment Clearance on 14/11/08 for Bauxite mining of 10,000 TPA capacity in 20.00 ha area. The proposal was discussed in 20th meeting on 27/12/08 of SEAC, Chhattisgarh. Committee then decided to ask the project proponent to present the case. Project proponent made presentation in the 25th meeting of SEAC, Chhattisgarh on 16/02/2009. The brief of the project is as follows: Proposed Site Village- Kudarwahi, Tehsil – Keshkal, District- Bastar (C.G.) Capacity Bauxite Mine – 10000 Tonnes/Annum

Based on the consideration of the documents submitted, the presentation made by the project proponent and discussion held, the Committee then decided that project proponent should be asked to submit the clarification regarding points raised during the presentation. Project proponent then assured the committee to submit the desired information at the earliest. Committee then decided that after receipt of the requisite information, the information/documents should be placed before the committee for consideration of Environmental Clearance as per Environment Impact Assessment Notification, 2006. Accordingly, project proponent submitted the desired information on 27/04/09. The submitted information/documents were considered by SEAC, Chhattisgarh in 30th meeting on 08/05/2009.

Project proponent informed that:-  Copy of approved mining plan, approved vide letter BST/BX/BPLN903/NGP dt. 31/10/05 and copy of progressive mine closure plan along-with financial assurance is submitted.  Area map of 10 km radius in the form of toposheet no. 64H/8 is submitted. The lease area is Govt. revenue land (Pahad-Chattan).  There is no (i) Protected Areas notified under the Wild Life (Protection) Act, 1972, (ii) Critically Polluted areas identified by the Central Pollution Control and (iii) inter-State boundary. Urvstikur reserved forest, Dev dongri RF, Pat dongri protected forest and Kotor PF are situated at 6 km, 6 km, 9.5 km and 7.0 km from the site respectively.  The adjoining land to the proposed site is government revenue land (Khasra noiyat : “Pahad–Chattan” in North, South & East direction and “Chote Bade Jhad ka Jangal”) in southern direction and no other activity in this area.  The proposed mining 7.28 ha (10000 Tonnes/Annum) of M/s Chhattisgarh Mineral Development Corporation Limited Village- Kudarwahi is located at 1 km. away from this site.  Only small machinery like Hydraulic excavator wheel loader to be used for mining. Trucks/Tipper would be used for transportation.  Mining depth is restricted to 3.3m. from surface level without deep hole blasting.  It is a semi mechanized mining of very small capacity without any stone crusher etc.

The Committee was unanimously of the opinion that the study area should cover an area of 10 km radius around the proposed site and surface water, ground water, soil, noise and ambient air quality should be monitored at-least at eight locations around the proposed site.

Based on the consideration of the documents submitted, the presentation made by the project proponent and discussion held, the Committee decided that the proposed project should be considered as ‘B1’ category and prescribed the Terms of Reference (TOR) for preparing draft EIA report for the above-mentioned project. The prescribed Terms of Reference (TOR) for preparing draft EIA report is enclosed as Annexure-III.

Project proponent should be informed accordingly.

(4) M/s Chhattisgarh Mineral Development Corporation Limited, Village- Kudarwahi, Tehsil – Keshkal, Dist.- Bastar (C.G.) (Area – 7.28 ha.)

The Project proponent submitted application (Form-I, and Pre-Feasibility Report) for Environment Clearance on 14/11/08 for Bauxite mining of 10,000 TPA capacity in 7.28 ha area. The proposal was discussed in 20 th meeting on 27/12/08 of SEAC, Chhattisgarh. Committee then decided to ask the project proponent to present the case. Project proponent made presentation in the 25th meeting of SEAC, Chhattisgarh on 16/02/2009. The proposal was reconsidered in 30 th meeting on 08/05/2009 of SEAC, Chhattisgarh. The brief of the project is as follows: -

Proposed Site Village- Kudarwahi, Tehsil – Keshkal, District- Bastar (C.G.) Capacity Bauxite Mine – 10000 Tonnes/Annum Proposed Cost Rs. 25.00 Lacs Lease Area 7.28 Ha Government revenue land. Mining Plan Approval Mining plan has been approved by Ministry of Mines, Indian Bureau of Mines, Nagpur Regional Office, Govt. of India vide letter no. BST/BX/MPLN- 904/NGP dated 31/10/2005. Mining Lease Area Approval Lease deed agreement 17/11/2006 Recoverable Reserves 0.119 Million Tones Waste Generation 22,013m³ (during plan period) Life of Mine 12 years Water Requirement 3.5m³/day Source of Water Ground water Ground Water table 10 to 12 m from the surface level

Based on the consideration of the documents submitted, the presentation made by the project proponent and discussion held, the Committee then decided that project proponent should be asked to submit the clarification regarding points raised during the presentation. Project proponent then assured the committee to submit the desired information at the earliest. Committee then decided that after receipt of the requisite information, the information/documents should be placed before the committee for consideration of Environmental Clearance as per Environment Impact Assessment Notification, 2006. Accordingly, project proponent submitted the desired information on 27/04/09. The submitted information/documents were considered by SEAC, Chhattisgarh in 30th meeting on 08/05/2009.

Trucks/Tipper would be used for transportation.  Mining depth is restricted to 3.3m. from surface level without deep hole blasting.  It is a semi mechanized mining of very small capacity without any stone crusher etc.  It is a very small, open cast mine of only 10,000 TPA production capacity. Draft Guidelines of B category projects for considering as B1 or B2 was discussed in the 12th meeting. As per para 7 (i) I of Environment Impact Assessment, Notification, 2006, Ministry of Environment & Forests, Government of India, New Delhi has to issue guidelines for categorization of projects into B1 or B2. The guidelines to be issued by Ministry of Environment & Forests, Government of India, shall be final and binding to SEIAA/SEAC Chhattisgarh. After deliberation committee then decided that finalization of guidelines by SEAC for categorization of B1 & B2 projects is not necessary. The projects/proposals being put up for scrutinizing / scoping/appraisal shall be considered as B1 & B2 category depending up on the nature and location specificity of the project/ proposal case to case basis. Accordingly the proposed activity was considered by committee. No significant impact on the surrounding environment due to mining activity proposed by project proponent. No National Park/ Wildlife Sanctuary are located within 10 km radius of site. Based on the consideration of the documents submitted and discussion held in 30th meeting on 08/05/09 of SEAC, Chhattisgarh, the Committee decided that the proposed project should be considered as ‘B2’ category and recommended for grant of Environmental Clearance. SEIAA, Chhattisgarh should be informed accordingly.

(5) M/s Inspire Industries Private Limited, Village – Belmundi, Sakarra, Tehsil – Takhatpur, District – Bilaspur (C.G.) The project proponent submitted application (Form-I and Pre-feasibility Report) for prescribing Terms of Reference (TOR) for preparation of draft EIA report for obtaining Environment Clearance on 13/01/2009. The Project Proponent has proposed Coal Washery of capacity 0.95 million tonnes per annum. The brief of the project is as follows:- Proposed Site Village – Belmundi, Sakarra, Tehsil – Takhatpur, District – Bilaspur (C.G.) Production Capacity Coal Washery - 0.95 Million Tonnes Per Annum. Proposed Cost Rs. 11.5730 Crores Land Area 19.82 acres (8.02 Ha)

Green Belt development Area 6.54 acres (2.65 ha)

After deliberation, the Committee then decided to ask the project proponent to submit the additional information/documents and present the case. Project proponent made presentation along with the desired information in the 26th meeting of SEAC, Chhattisgarh on 13/03/2009. Based on the consideration of the documents submitted, the presentation made by the project proponent and discussion held, the Committee then decided that project proponent should be asked to submit the clarification regarding points raised during the presentation. Project proponent then assured the committee to submit the desired information at the earliest. Committee then decided that after receipt of the requisite information, the information/documents should be placed before the committee for consideration of Environmental Clearance as per Environment Impact Assessment Notification, 2006. Accordingly, project proponent submitted the desired information on 24/04/09. The submitted information/documents were considered by SEAC, Chhattisgarh in 30th meeting on 08/05/2009. After deliberation committee decided that project proponent should be asked to submit the following additional information/documents:-  The land documents submitted along with the letter are on the name of “Singhai Lakshmi Chand Memorial Trust”. The documents should be on the name of the industry.  The land diversion documents submitted along with the letter, reflects that the land is diverted for educational purposes. The land should be diverted for industrial purposes. Committee decided that project proponent should be asked to submit the above information/documents. After receipt of the information/documents, Committee would consider the application for further necessary action as per provisions of E.I.A. Notification, 2006. Project proponent should be intimated accordingly. (6) M/s Medesara Limestone Deposit, Khasra no. 1200,1203,1204,1212,1214, Village – Medesara, Tehsil – Dhamdha, District – Durg (C.G.) (O.P. Singhania). The Project proponent submitted application (Form-I and Mining Closure Plan) for Environment clearance on 16/01/09 for mining of Lime Stone of capacity 1,20,000 Tonnes per year at Khasra No. 1200 part,1203,1204,1212,1214, at Village – Medesara, Tehsil – Dhamdha, District – Durg (C.G.) Lease Area is 17.90 ha. The brief of the project is as follows:- Proposed Site Khasra no. 1200 part,1203,1204,1212,1214, Village – Medesara, Tehsil – Dhamdha, District – Durg (C.G.) Production Capacity Lime Stone – 120,000 TPA Lease Area Lease Area – 17.90 hactare. Cost of the Project 40.00 Lacs Mining Plan Approval Mining scheme has been approved by IBM, Nagpur vide letter no. DRG/LST/MPLN-751/NGP dated 23/10/2007. Activity falls under the Schedule of 1(a) EIA Notification, 2006

As per decision, project proponent made presentation in the 27 th meeting of SEAC, Chhattisgarh on 28/03/2009. Based on the consideration of the documents submitted, the presentation made by the project proponent and discussion held, the Committee then decided that project proponent should be asked to submit the clarification regarding points raised during the presentation. Project proponent then assured the committee to submit the desired information at the earliest. Committee then decided that after receipt of the requisite information, the information/documents should be placed before the committee for consideration of Environmental Clearance as per Environment Impact Assessment Notification, 2006. Accordingly, project proponent submitted the desired information on 28/03/09. The submitted information/documents were considered by SEAC, Chhattisgarh in 30th meeting on 08/05/2009. The committee noted the followings:

 Layout plan and area map submitted along with the letter is adequate.  In the original mining plan approved vide letter DRG/LST/MPLN-751/NGP dated 14/05/2001, mentioned mining capacity was 2700 TPA.  In the modified mining plan approved vide letter DRG/LST/MPLN-751/NGP dated 30/03/2005, mentioned mining capacity was 70,000 TPA.  In the mining scheme approved vide letter DRG/LST/MPLN-751/NGP dated 23/10/2007, mentioned mining capacity was 88,000 TPA.  In the application form –I submitted for the grant of environmental clearance, mentioned mining capacity was 1,20,000 TPA. After deliberation committee decided that project proponent should be asked to submit the following information/documents:-  Layout plan and area map submitted along with the letter is adequate. Hence detailed layout plan and area map of 10 km radius showing major topographical features such as land use, drainage, location of habitats, major construction including railways, highways, pipelines, major industries / mines, stone crushers and other polluting sources etc. All above major topographical features should be clearly marked on the map and distance from mine site should be given.  Clarification regarding the production capacity. Project proponent has applied for lime stone mining 1,20,000 tonnes per annum; where as the mining plan/scheme has not been approved for this capacity. Project proponent should revise the application as per the capacity mentioned in mining plan/scheme (lime stone mining ROM 88,000 tonnes per annum).  Detailed de-watering scheme of mine pit water. Committee decided that project proponent should be asked to submit the above information/documents. After receipt of the information/documents, Committee would consider the application for further necessary action as per provisions of E.I.A. Notification, 2006. Project proponent should be intimated accordingly.

(7) M/s Sarda Energy & Minerals Limited, Works:- Karwahi & Khamria, Raigarh (Coal Washery – 0.96 MTPA) The project proponent submitted application (Form-I and Pre Feasibility Project Report) for prescribing Terms of Reference (TOR) for preparing draft EIA report for Environment Clearance on 28/05/2008. The application submitted was considered in 8th meeting of SEAC, Chhattisgarh held on 30/06/2008. As per decision, Sub Committee comprising of three members visited the site on 22/07/2008. Project proponent submitted required information vide letter no. 541, dated 25/07/2008.

SEAC, Chhattisgarh then decided that project proponent should be asked to present the case before SEAC, Chhattisgarh. Accordingly project proponent along with their consultants made the presentation before SEAC, Chhattisgarh in 11th meeting on 05/09/2008. Based on the consideration of the documents submitted, the presentation made by the project proponent and discussion held, the Committee decided that the proposed project should be considered as ‘B1’ category and prescribed the Terms of Reference (TOR) for preparing draft EIA report for the above-mentioned project. TOR were issued to Project proponent on 07/11/08. Project proponent submitted a letter SEML/ENVR/97 dated 24th April, 2009 requesting that : There is minor change in location of proposed 0.96 MTPA coal washery project from village - Karwahi & Khamria to village – Bajarmura –Dholnara, Tehsil – Gharghora, (Now Tamnar) District – Raigarh which is about 600 meters away from the previous location in west direction due to shortage of area for O.B. dump. The location of the proposed 0.96 MTPA coal washery will remain in the same allotted coal block area to the project proponent. The proposal was considered by SEAC, Chhattisgarh in 30th meeting on 08/05/2009. After deliberation, the committee accepted the request of Project proponent for minor change in location of proposed 0.96 MTPA coal washery project from village - Karwahi & Khamria to village – Bajarmura –Dholnara, Tehsil – Gharghora, (Now Tamnar) District – Raigarh which is about 600 meters away from the previous location in west direction. TOR issued vide letter dated 07/11/08 will remain same for this newly located site. Project proponent should be intimated accordingly. (8) M/s Matiya Limestone Mine, Works: Khasra No. 404, 405/1, Village – Matiya, Tehsil- R1aipur (C.G.) The Project proponent submitted application (Form-I and approved Mining Plan) for prescribing Terms of Reference (TOR) for preparation of draft EIA report for obtaining Environment Clearance on 26/12/08 for mining of Lime Stone of capacity 22,501 tonnes per year at Khasra No. 404, 405/1 at Village-Matia, Tehsil & District- Raipur (C.G.). Lease Area is 12.137 ha. The case was discussed in the 22nd meeting of SEAC, Chhattisgarh held on 31/01/2009. As per decision, project proponent made presentation in the 26th meeting of SEAC, Chhattisgarh on 13/03/2009. The brief of the project is as follows:- Proposed Site Khasra No. 404, 405/1, Village-Matiya, Tehsil- Raipur (C.G.) Production Capacity Lime Stone - 22,501 Tonnes Per Year (maximum) open cast mining. Lease Area Lease Area – 12.137 ha. Non forest government revenue land. Cost of the Project Rs. 10.00 Lakhs

Based on the consideration of the documents submitted, the presentation made by the project proponent and discussion held, the Committee then decided that project proponent should be asked to submit the clarification regarding points raised during the presentation. Project proponent then assured the committee to submit the desired information at the earliest. Committee then decided that after receipt of the requisite information, the information/documents should be placed before the committee for consideration of Environmental Clearance as per Environment Impact Assessment Notification, 2006. Accordingly, project proponent submitted the desired information on 04/05/09. The submitted information/documents were considered by SEAC, Chhattisgarh in 30th meeting on 08/05/2009.

Radius is submitted.  Copy of original approved mining plan vide letter no RAP/LST/MPLN-598/NGP dated 14th October 1997 is submitted.  Commitment regarding expenditure of 5% of royalty of Rs. 1 lakh/annum (which is higher) for eco development and community welfare purpose is submitted.  Commitment regarding no crusher shall be installed in the mining lease area is submitted.  The scheme of mining approved for the period of 2008-09 to 2012-13 during this period the top level of working pit will be at 281 and the bottom level of working pit will be touch the 278 meter MSL level. The level of pit bottom is higher to the surrounding old workings. So water will not accumulate in this pit even at rainy reason. Therefore no proposals of water sump and dewatering of working pit given in plan. Hence no dewatering scheme will be required at this stage.  Mr. Gangaram Sharma is the mine owner. Manjeet Singh Khanuja is having power of attorney and control over the mine premises on behalf of Gangaram Sharma. Copy of power of attorney is submitted. The Committee was unanimously of the opinion that the study area should cover an area of 10 km radius around the proposed site and surface water, ground water, soil, noise and ambient air quality should be monitored at-least at eight locations around the proposed site. The proposed project fulfills the criteria as mentioned in the Schedule of EIA Notification, 2006, hence falls under Category ‘B’. Based on the consideration of the documents submitted, the presentation made by the project proponent and discussion held, the Committee decided that the proposed project should be considered as ‘B1’ category and prescribed the Terms of Reference (TOR) for preparing draft EIA report for the above-mentioned project. The prescribed Terms of Reference (TOR) for preparing draft EIA report is enclosed as Annexure-IV. Project proponent should be informed accordingly.

Agenda Item No. 2 - Remaining issues of 29th meeting for discussion on the proposals submitted for reconsideration.

(1) M/s Surya Cement, Post-Nevra, Tehsil-Tilda, Raipur Works:- Village- Khoka, Tehsil-Tilda, Raipur (C.G.) The Project proponent submitted application (Form-I and Project Report) for prescribing Terms of Reference (TOR) for preparing draft EIA report to Ministry of Environment & Forests, Government of India, New Delhi. The project proponent has proposed to establish cement-manufacturing plant by vertical shaft kiln technology of capacity 12000 metric tonnes per annum at Village-Khoka, Tehsil-Tilda, Raipur (C.G.). The Ministry of Environment & Forests, Government of India, New Delhi has forwarded the case to SEIAA/SEAC, Chhattisgarh vide letter no. J-11011/1271/2007- IA II(I) dated 25/04/2008. Project proponent submitted the additional sets of Form-I and documents to SEIAA on 16/06/2008. The application submitted was considered in 8th meeting of SEAC, Chhattisgarh held on 30th June 2008. As decided, the project proponent was informed to submit requisite information/documents vide letter no. 132/SEAC -CG/ EC/Cement/31/08 Raipur dated 18/07/08. Project proponent submitted the information

Based on the consideration of the documents submitted and discussion held, the Committee then decided to ask the project proponent to submit the remaining requisite information/documents and present the case before SEAC, Chhattisgarh. Project proponent made presentation in the 17 th meeting of SEAC, Chhattisgarh on 29/11/2008. The brief of the project is as follows: Proposed Site Village–Kohka,Tehsil-Tilda, District: Raipur. Production Capacity Cement – 12000 Metric Tonnes Per Annum Area of the Project 11750 sqm (2.90 acres) Proposed Cost Rs. 58 Lakhs Water Requirement 4 KLD for Clinker making + 2KLD for Domestic+ 8 KLD for Dust Suppression & Plantation. 1.2 KLD Domestic Waste Water will be treated in sock pit & Septic Tank. No industrial effluent will be generated. Activity falls under the Schedule 3(b) of EIA Notification, 2006

Based on the consideration of the documents submitted, the presentation made by the project proponent and discussion held, the Committee then decided that project proponent should be asked to submit the clarification regarding points raised during the presentation. Project proponent then assured the committee to submit the desired information at the earliest. Committee then decided that after receipt of the requisite information, the information/documents should be placed before the committee for consideration of Environmental Clearance as per Environment Impact Assessment Notification, 2006. Accordingly, project proponent submitted the desired information on 08/04/09. The submitted information/documents were considered by SEAC, Chhattisgarh in 30th meeting on 08/05/2009. Project proponent submitted the documents of additional 4.00 acres. Now total available land is 4.66 + 4.0 =8.66 acres. After deliberation committee decided that project proponent should be asked to submit the following additional information/documents:-  Total land available is only 8.66 acres. To develop the adequate width of green belt, project proponent advised to acquire additional land, so that total area should not be less than 4 ha (10.0 acres).  Accordingly, revise layout plan showing at-least 10 meters wide green belt all along the periphery and maximum width of green belt towards Kohka Village. Committee decided that a Sub Committee comprising of three members of SEAC, Chhattisgarh should visit the site and submit the report accordingly. Committee decided that after receipt of the above mentioned information / documents and report from Sub Committee, proposal should be considered. Project proponent should be intimated accordingly. (2) AIIMS, Apex Health Care Institute Raipur (now “SARDAR VALLABH BHAI PATEL INSTITUTE OF MEDICAL SCIENCES, RAIPUR”) Site: Bhilai Road, Tantibandh, Raipur The Project proponent submitted application (Form-I, Form IA and Concept Report) for Environment Clearance to Ministry of Environment & Forest, Government of India on 13/05/2008. The Ministry of Environment & Forest, Government of India has forwarded the case to SEIAA/SEAC, Chhattisgarh vide letter no. 21-271/2008-IA- III dated 3rd June 2008. The application submitted was considered in 8th meeting of

The brief of the project is as follows: Name of the Project AIIMS, Apex Health Care Institute Raipur now “SARDAR VALLABH BHAI PATEL INSTITUTE OF MEDICAL SCIENCES, RAIPUR” Proposed Site Site: Tantibandh, Bhilai Road, Raipur Capacity 960 Bed Hospital Including 50 Critical Care Beds, Medical College And Hostels. Area of the Project About 100 acres land (63.85 acres for Hospital and 36.00 acres for Housing) Site (Land) Area – 2,58,406 sq. m. (63,85 acres) Hard Paved Area – 56,758 sq. m. Soft Paved Area (Lawn etc.) – 1,08,608 sq. m. Total Ground Coverage Area – 41,707 sq. m. Total Constructed Area – 1,71,358 sq. m. Ground Coverage Permissible – 30% Ground Coverage Achieved – 16.14 % F.A.R. Permissible – 150 F.A.R. Achieved – 66.31 Proposed Cost Rs. 275 crores Activity falls under 8(b) the Schedule of EIA Notification, 2006

Based on the consideration of the documents submitted, the presentation made by the project proponent and discussion held, the Committee then decided that project proponent should be asked to submit the clarification regarding points raised during the presentation. Project proponent then assured the committee to submit the desired information at the earliest. Committee then decided that after receipt of the requisite information, the information/documents should be placed before the committee for consideration of Environmental Clearance as per Environment Impact Assessment Notification, 2006. Accordingly, project proponent submitted the desired information on 15/04/09. The submitted information/documents were considered by SEAC, Chhattisgarh in 30th meeting on 08/05/2009.

Project proponent informed that:-  Application for the change of name to “SARDAR VALLABH BHAI PATEL INSTITUTE OF MEDICAL SCIENCES, RAIPUR” is submitted.  Corrected water balance chart is submitted. Total fresh water requirement shall be 1210 KLD (total water requirement – 1500 KLD, out of which 290 KLD shall be recycle after treatment for horticulture & AC makeup) for all utilities. 1200m3/day capacity Sewage Treatment Plant shall be installed for treatment of domestic waste water from various units of the Hospital.  Plasma Technology (in place of proposed Incineration Technology) for the treatment of Bio Medical Wastes has been recommended. Details of plasma gasification processing system are submitted.  A plasma gasification processing system has been recommended in which particulate matter emission shall always be less than 50 mg/Nm3.  Application has been submitted to Nagar-Nigam Raipur and Town & Country Planning Department Raipur for the approval of building plan. It shall be submitted soon after receiving the approval.

The site is situated at Khsra no. 391/1, 392, 393/2, 394/3, 394/4, 394/5, 394/7, 419/4, 422/2, 423, 425, 427, 433/1, 434/2, 435, 436/2, 442/2, 442/4, Tantibandh, Bhilai Road, Raipur. Total land area is 100 acres land (63.85 acres for Hospital and 36.00 acres for Housing). Proposed cost of the project is Rs. 275.00 Crores. Project proponent informed that Building plan drawings have been submitted for approval to the competent authority. Total fresh water requirement shall be 1210 KLD (total water requirement – 1500 KLD, out of which 290 KLD shall be recycle after treatment for horticulture & AC makeup) for all utilities. Water will be supplied from Municipal Water Supply of Raipur. 1200m3/day capacity Sewage Treatment Plant shall be installed for treatment of domestic waste water from various units of the Hospital. About 290m3/day of treated wastewater will be received from the STP which will be utilized within the project premises. The remaining treated wastewater will be utilized for flushing purpose and thus, no wastewater will be discharged outside the hospital premises. The Infectious Waste (excluding plastic waste), Infectious Plastic Waste, Non- Infectious Waste (biomedical wastes) and Sharp waste will be 360.66 kg/day, 115.7 kg/day, 1184.8 kg/day and 1.88 kg/day respectively. Biomedical waste will be collected, treated and disposed as per the Bio-Medical Wastes (Management and Handling) Rules, 1998. Plasma gasification processing system of adequate capacity and specification as mentioned in the Bio-Medical Wastes (Management and Handling) Rules, 1998 will be provided for treatment of bio-medical wastes. About 10 MVA of power will be required for proposed medical facility which will be sourced from the Chhattisgarh State Electricity Board. It is proposed to install DG sets for standby power supply for essential locations. Committee noted that building plan is yet to be approved by competent authority. Committee, after considering the proposals regarding management of land degradation, waste management, bio-medical waste management water pollution, air pollution, noise pollution, plantation, rainwater harvesting, storm water management, power requirement, energy conservation, environmental impact mitigation measures, safety measures, socio-economic aspects, employment etc. recommended for issue of provisional Environmental Clearance (Conditions to be complied with for according Environment Clearance) As per Ministry of Environment and Forests, Government of India circular No.23/3/2007-IA.III, dated - 05/02/2008. The conditions to be complied with for according Environment Clearance are enclosed as Annexure-V. SEIAA may be informed accordingly.

(3) M/s. SKS Ispat & Power Limited, Works: Siltara Industrial Growth Center, Siltara, Raipur (C.G.) The project proponent submitted application (Form-I and Project Report) for prescribing Terms of Reference (TOR) for preparing draft EIA report for Environment Clearance on 23/08/08. The project proponent has proposed 0.96 MTPA Coal Washery at Village-Siltara, Block- Dharsiwa, District – Raipur (C.G.). The application submitted was considered in 12th meeting of SEAC, Chhattisgarh held on 12/09/2008. Based on the consideration of the documents submitted and discussion held, the Committee then decided to ask the project proponent to submit the requisite information/documents and present the case before SEAC, Chhattisgarh. Project proponent made presentation in the 17th meeting of SEAC, Chhattisgarh on 29/11/2008. The brief of the project is as follows:- Proposed Site Village- Siltara, Block- Dharsiwa, District – Raipur (C.G.) Production Capacity Coal Washery of capacity 0.96 Million Tonnes Per Annum (Raw Coal Input) Area of the Project About 2.60 Ha. (6.5 acres) Proposed Cost Rs. 14.34 Crores

Project proponent submitted the information on 10/12/2008. The information submitted was reconsidered in 19th meeting on 26/12/08 of SEAC Chhattisgarh. Based on the consideration of the documents submitted, presentation made and discussion held, the Committee decided that a sub Committee should visit the site. After visit of Sub Committee, it should be placed before the Committee for further consideration. Sub Committee visited the site on 24/01/2009. The Sub-Committee also visited the surrounding areas for the study of environmental susceptibilities. Accordingly the following recommendation/observations are made:-  Coal washery has already been installed. During visit large quantity of coal fines were deposited in the slime ponds. It reveals that coal washery has already commissioned.  Coal washery units includes (a) Primary Sizer 200 TPH (b) Primary Screen 200 TPH (c) Secondary Screen 150 TPH (d) Secondary Crusher 200 TPH (e) Jig 200 TPH (f) Centrifuge 150 TPH (g) D.D. Screen 200 TPH (h) S.D. Screen 150 TPH (i) Slime Pond 30X15X2.5 meter.  As per the capacity of coal washery units, the capacity of coal washery seems to be more than one million tonnes per annum. Hence the project appears to fall under ‘A category’ project. Clarification regarding capacity of coal washery should be sought from the project proponent.  Ministry of Environment & Forest, Government of India, New Delhi had issued TOR for expansion of steel plant near Siltara Industrial Growth Centre, Phase – II, Siltara Raipur Chhattisgarh by M/s SKS Ispat and Power Limited, vide there letter no. J-11011/43/2008-IA II (I) dated 6th June 2008. Project proponent had applied to Ministry of Environment & Forest, Government of India, New Delhi for above expansion on 18/12/2007. The coal washery activity had not been incorporated in that application. Clarification regarding this should be sought from the project proponent.  Internal roads are not tarred and the house keeping of the industry is not satisfactory. Heavy fugitive dust emission found due to vehicle movement.  Heavy particulate matter emission found from power plant. Opacity meter was not in operation.  Green belt coverage is less than the stipulated norms and consent conditions. The information submitted and the inspection report of the Sub-Committee was discussed in 23rd meeting of SEAC Chhattisgarh on 07/02/09. The Committee then decided to ask the project proponent to submit the additional information. Project proponent submitted the information on 13/04/2009. The information/documents submitted were reconsidered in 30th meeting on 08/05/09. As per the capacity of coal washery units, the capacity of coal washery seems to be more than one million tonnes per annum. Hence the project appears to fall under ‘A category’ project. Based on the consideration of the documents submitted, presentation made, visit of the sub-committee and discussion held, the Committee decided to recommend the SEIAA for rejection and de-listing of the proposal. The SEIAA and project proponent should be intimated accordingly.

(4) M/s Pharhada Lime Stone Mine, Works: Village-Pharhada, Tehsil-Simga, Dist.- Raipur (C.G.) The Project proponent submitted application (Form-I, Feasibility Report and approved Mining Plan) for prescribing Terms of Reference (TOR) for preparing draft EIA report on 26/08/08 and 12/09/08 for mining of Lime Stone of capacity 60000 Tonnes per year at Khasra No. 1732/1, 1727/1 (Govt. revenue land) at Village- Pharhada, Tehsil-Simga, District- Raipur (C.G.). The case was considered in the 16th D:\Docs\2018-04-12\0fc0c6bc1a8a226edaaa64ac0a98b5b8.doc 16 meeting of SEAC, Chhattisgarh held on 23/10/2008. Committee then asked to submit the desired information/documents. Project proponent submitted the information on 17/12/2008. The information submitted was reconsidered in 19th meeting on 26/12/08 of SEAC Chhattisgarh. As per decision, project proponent made presentation in the 24th meeting of SEAC, Chhattisgarh on 13/02/2009. The brief of the project is as follows:- Proposed Site Khasra No. 1732/1, 1727/1 Govt. revenue land. Village-Pharhada, Tehsil-Simga, District- Raipur (C.G.) Production Capacity Mining of Lime Stone 60000 TPA Lease Area Lease Area – 21.373 ha Lime Stone Mines in 21.373 ha Mining lease was granted from 23/12/1995 to 22/12/2015 for a period of 20 years. Minable Reserve Proved 11,04,500 Tonnes ( 4-6 m) Probable 23,10,000 Tonnes ( 6-10 m) Mining Plan Mine plan has been approved by IBM vide letter no. Approval RAP/LST/MPLN-450/NGP dated. 29/06/1995. Progressive Mine Closure Plan has been approved by IBM vide letter no. RAP/LST/MPLN-450/NGP dated 08/01/2008. Mining Scheme is under approval for period of 2009- 10 to 2013-14. Working permission has been issued on 06.03.2003. Mining started from 20/10/2004.

Based on the consideration of the documents submitted, the presentation made by the project proponent and discussion held, the Committee then decided that project proponent should be asked to submit the clarification regarding points raised during the presentation. Project proponent then assured the committee to submit the desired information at the earliest. Committee then decided that after receipt of the requisite information, the information/documents should be placed before the committee for consideration of Environmental Clearance as per Environment Impact Assessment Notification, 2006. Accordingly, project proponent submitted the desired information on 16/03/09. The submitted information/documents were considered by SEAC, Chhattisgarh in 30th meeting on 08/05/2009.

Project proponent informed that:-  Approved Mining Scheme for period of 2009-10 to 2013-14.  5% of royalty or Rs. 1.00 lac/annum (whichever is higher) will be spent on eco development and community welfare purposes.  The production capacity of lime stone from the mine will be kept as 60000 TPA (the production capacity, as per the approved mining plan).  Khasra no. /land records has been submitted. The land is Govt revenue grass land.  Crusher shall not be installed in the mining lease area.  De-watering scheme of mine pit water is submitted. The Committee was unanimously of the opinion that the study area should cover an area of 10 km radius around the proposed site and surface water, ground water, soil, noise and ambient air quality should be monitored at-least at eight locations around the proposed site. The proposed project fulfills the criteria as mentioned in the Schedule of EIA Notification, 2006, hence falls under Category ‘B’. Based on the consideration of the documents submitted, the presentation made by the project proponent and discussion held, the Committee decided that the proposed project should be considered as ‘B1’

(5) M/s Charbhuja Gold Cement, Village – Gondpendri, Dist. – Durg (C.G.) The Project proponent submitted application (Form-I and Project Report) for Environment Clearance on 16/09/08. It is an existing Cement Clinker Grinding Unit of 100 TPD capacity. The Project Proponent has proposed to expand the unit by adding 350 TPD capacity. The brief of the project is as follows:- Proposed Site Village – Gondpendri, District – Durg (C.G.) Capacity Existing - Clinker Grinding 100TPD Expansion- Clinker Grinding 350 TPD Total After Expansion– Clinker Grinding 450 TPD Proposed Cost Rs. 4.8843 Crores Area 12.12 acres. SEAC, Chhattisgarh considered the application in 16th meeting held on 23/10/2008. Based on the consideration of the documents submitted and discussion held, the Committee then decided to ask the project proponent to submit additional information/documents. Committee also decided that a Sub Committee of SEAC Chhattisgarh would visit the site also. Sub committee visited the site on 07/12/2008. The information submitted and the inspection report of the sub-committee was discussed in 19th meeting on 26/12/08 of SEAC, Chhattisgarh. After detailed deliberation, the Committee decided to ask the project proponent to present the case in 24th meeting of SEAC, Chhattisgarh on 13/02/2009. Project proponent made presentation in the 24th meeting of SEAC, Chhattisgarh on 13/02/2009. The Committee then decided that project proponent should be asked to submit the clarification regarding points raised during the presentation. Project proponent submitted the desired information on 26/02/09. The information submitted was reconsidered in 30th meeting on 08/05/2009 of SEAC Chhattisgarh.

Project proponent informed that:-  5% of net profit or Rs. 8.00 lac/annum (whichever is higher) will be spent on eco development and community welfare purposes.  To reduce noise level near ball mill : Adequate packing will be provided in between mill shell and liners and the job will be completed within one and half months.  Technical details of proposed air pollution control equipments are submitted : 1. Existing mill – reverse pulse jet bag filter (with 35 bags) 2. Proposed mill – reverse pulse jet bag filter (with 80 bags) 3. Cement silo – reverse pulse jet bag filter (with 30 bags) Draft Guidelines of B category projects for considering as B1 or B2 was discussed in the 12th meeting. As per para 7 (i) I of Environment Impact Assessment, Notification, 2006, Ministry of Environment & Forests, Government of India, New Delhi has to issue guidelines for categorization of projects into B1 or B2. The guidelines to be issued by Ministry of Environment & Forests, Government of India, shall be final and binding to SEIAA/SEAC Chhattisgarh. After deliberation committee then decided that finalization of guidelines by SEAC for categorization of B1 & B2 projects is not necessary. Based on the consideration of the documents submitted and discussion held in 30th meeting on 08/05/09 of SEAC, Chhattisgarh, the Committee decided that the proposed project should be considered as ‘B2’ category and recommended for grant of Environmental Clearance. SEIAA, Chhattisgarh should be informed accordingly.

(6) M/s Agrawal Minerals, Kharkena Dolomite Mines, Village -Kharkena, Distt. – Bilaspur (C.G.) The Project proponent submitted application (Form-I, Feasibility Report and approved Mining Plan) for prescribing Terms of Reference (TOR) for preparing draft EIA report. The Project Proponent has applied for the mining of 60361 MTPA Dolomite. The total mine lease area is 5.708 ha. This mine was open in January 1997 (Lease period 29/11/1996 to 28/11/2016). The Proposal was discussed in 20th meeting on 27/12/08. After detailed deliberation, the Committee decided to ask the project proponent to present the case in 24th meeting of SEAC, Chhattisgarh on 13/02/2009. The brief of the project is as follows:

Project proponent then assured the committee to submit the desired information at the earliest. Committee then decided that after receipt of the requisite information, the information/documents should be placed before the committee for consideration of Environmental Clearance as per Environment Impact Assessment Notification, 2006. Accordingly, project proponent submitted the desired information on 02/03/09. The submitted information/documents were considered by SEAC, Chhattisgarh in 30th meeting on 08/05/2009. Project proponent informed that:-  Crusher shall not be installed in the mining lease area.  De-watering scheme of mine pit water is submitted.

(7) M/s Jhuradabri Quartize & Silica Sand Mine, Village – Jhuradabri, Tehsil & District -Rjnandgaon (C.G.) The Project proponent submitted application (Form-I, Approved Mining Plan and Project Report) for the Environment Clearance on 24/09/2008 for Quartzite and Silica sand mining of maximum 12000 TPA capacity in 9.71 ha area at Khasra No. 19, Village – Jhuradabri, Tehsil & District- Rajnandgaon (C.G.). Project proponent has informed that mining lease was granted vide letter no. 3-261/86/12/06 dated 15/01/87 by then Madhya Pradesh Government for a period of 20 years, for which environment clearance was given by Environment Planning and Co-ordination Organisation (EPCO), Bhopal. As the mining lease had expired on 14/01/2007, therefore for renewal of the mining lease, environmental clearance is required. Accordingly project proponent has applied for grant of environmental clearance. Project proponent has requested for categorization the proposal as B -2 category. The brief of the project is as follows:- Proposed Site Khasra No. 19, P.H. no. 13 Village – Jhuradabri, Tehsil & District- Rajnandgaon (C.G.) None Forrest Government revenue land. Nearest village is Jhuradabri which is 1.5 km away. Production Capacity Quartzite and Silica Sand Mining - 12,000 Tonnes/Annum. It is a manual and open cast mine. Lease Area Lease Area – 9.71 Ha. The lease area is Govt. non forest revenue land. The Mining lease was granted vide letter No. 3- 261/86/12/6 dated 15th January 1987 by Madhya Pradesh Government for period of 20 years, for which environment clearance was given by Environmental Planning and Co-ordination D:\Docs\2018-04-12\0fc0c6bc1a8a226edaaa64ac0a98b5b8.doc 20 Organization (EPCO) Bhopal. Project proponent has applied for the renewal of mining lease. Working permission granted on 05/02/1987 vide letter no. 234 by collector office (Mining section) Rajnandgaon. Mine able Reserve 9,00,000 MT Mining Plan Approval Mine plan and Progressive Mine Closure has been approved by IBM vide letter no. RNG/873/MPLN-924/NGP dated. 04/05/2006.

The case was considered in the 16th meeting of SEAC, Chhattisgarh held on 23/10/2008. Project proponent submitted the information on 23/12/2008. The information submitted was reconsidered in 19th meeting on 26/12/08 of SEAC Chhattisgarh. Committee then decided to ask the project proponent to submit the additional information/documents. Project proponent submitted the desired information on 30/01/2009. Project proponent made presentation in the 24th meeting of SEAC, Chhattisgarh on 13/02/2009. Based on the consideration of the documents submitted, the presentation made by the project proponent and discussion held, the Committee then decided that project proponent should be asked to submit the clarification regarding points raised during the presentation. Project proponent then assured the committee to submit the desired information at the earliest. Committee then decided that after receipt of the requisite information, the information/documents should be placed before the committee for consideration of Environmental Clearance as per Environment Impact Assessment Notification, 2006. Accordingly, project proponent submitted the desired information on 14/04/09. The submitted information/documents were considered by SEAC, Chhattisgarh in 30th meeting on 08/05/2009.

Project proponent informed that:-  5% of royalty or Rs. 1.00 lac/annum (whichever is higher) will be spent on eco development and community welfare purposes.  Crusher shall not be installed in the mining lease area.  De-watering scheme of mine pit water is submitted.  The production capacity of the mine mentioned in approved mining closure plan is up to 6000 TPA (It is also mentioned in the approved mining plan that mine has capacity of producing more than 10,000 TPA, if there is any such requirement).  Commitment regarding, not exceeding the production capacity, given in the mining plan, in any case – Submitted, Draft Guidelines of B category projects for considering as B1 or B2 was discussed in the 12th meeting. SEIAA, Chhattisgarh should be informed accordingly.

(8) M/s Kasturi Cement Private Limited, Village – Patharakundi, Tehsil – Tilda, District – Raipur (C.G.) The project proponent submitted application (Form-I and Project Report) for prescribing Terms of Reference (TOR) for preparing draft EIA report for Environment Clearance on 10/12/2008 for proposed 2x0.49 Million Tonne per Annum Cement Plant based on rotary kiln technology and Coal Based Captive Thermal Power Plant of 2x20 MW. The brief of the project is as follows: - Proposed Site Village – Patharakundi Tehsil – Tilda, District – Raipur (C.G.) Capacity Cement (based on rotary kiln technology) - 2x0.49 Million Tonne per Annum = 0.98 Million Tonne per Annum Coal Based Captive Thermal Power Plant 2x20MW= 40 MW Proposed Cost Rs. 468.22 Crores Area 264.889 acres. Activity falls under 3 (b) & 1 (d) the Schedule of EIA Notification, 2006 The proposal was discussed in 20th meeting on 27/12/08 of SEAC Chhattisgarh. Committee then decided to ask the project proponent to submit the additional information/documents. Project proponent submitted the desired information on 23/03/09 and 04/05/2009. The information submitted was reconsidered in 30th meeting on 08/05/2009 of SEAC Chhattisgarh. Project proponent has change the capacity of proposed power plant from 40 MW to 50 MW and submitted the revised application form and project report accordingly. After detailed deliberation, the Committee decided to ask the project proponent to present the case with following details: -  Project proponent should be asked to submit the layout plan and area map of 10 km radius showing major topographical features such as land use, drainage, location of habitats, major construction including railways, highways, pipelines, major industries, mines, stone crushers and other polluting sources etc.  Whether the project site located in whole or in part within 10 km from the boundary of: (i) Protected Areas notified under the Wild Life (Protection) Act, 1972, (ii) Critically Polluted areas as identified by the Central Pollution Control Board from time to time, (iii) Notified Eco-sensitive areas (including national park/ wild life sanctuary), (iv) inter-State boundaries, (v) Reserved Forest/protected forest)? Please provide details.  Feasibility of air-cooled condenser in the power generation should be explored. Action plan should be submitted accordingly.  Feasibility of transportation of raw coal through rail should be explored and action plan should be submitted accordingly.  Water allocation letter for proposed expansion activity from competent authority.

The Committee decided to ask the project proponent to present the case along- with above information and issues like site details: existing condition, land document, land area statement, permission from concerned authority, power supply, water supply, materials balance, manufacturing process / flow sheet, water source, consumption with water balance and effluent generation, treatment and reuse, fuel consumption, type of fuel, emission sources and emission control system, solid waste / hazardous waste management, DG Set and noise pollution control, greenbelt, fugitive emission, storage yards, monitoring stations details along-with justification for selection, proposed EMP along-with community welfare/eco development works to be carried out and other relevant issues/TOR. Project proponent should be intimated accordingly.

(i) The acquisition of land for the 2 x 135 = 270 megawatt washery rejects/coal based thermal power plant shall be restricted to maximum 174.50 Ha (431.0 acres) with the following break-up: - Description Area (acres) Land for Power Plant 213.0 (including 141 acres for landscaping and green belt) Ash Disposal Area 91.0 Colony/Township 24.0 HT line & Road clearance 103.0 Total 431.0 (ii) The confirmed coal linkage to meet the requirement for requisite quantity of coal (2720 TPD) for the ultimate capacity shall be obtained before commissioning the project. Copy of the coal linkage shall be submitted to the SEIAA, CG and Regional Office, Ministry of Environment & Forests, Government of India, Bhopal. The consumption of coal washery reject shall be 4080 TPD. (iii) Project proponent shall provide adequate facility for proper treatment of industrial and domestic effluent. Project proponent shall provide effluent treatment plant before commissioning of the plant. All the effluent treatment system shall be kept in good running condition all the time and failure (if any), shall be immediately rectified without delay otherwise same alternate arrangement shall be made. Project proponent shall ensure the treated effluent quality within standard prescribed by Ministry of Environment & Forests, Government of India. (iv) Any liquid effluent what so ever generated from industrial activities including ash dyke (if any) shall not be discharged into the river or any surface water bodies under any circumstances, and it shall be reused wholly in the process/plantation. All the industrial effluent including ash dyke effluent (if any) generated shall be re-circulated/reused after proper treatment. Project proponent shall provide sewage treatment plant of adequate capacity for treatment of domestic effluent generated from township. The un- treated/treated domestic effluent shall not be discharge into the river or any surface water bodies. The treated domestic effluent shall be used for plantation purpose after proper disinfections. Industry shall make proper arrangements of suitable drains/pipe networks to ensure adequate flow for utilization of treated effluent inside the premises. The concept of zero discharge shall be maintained all the time except during monsoon. Arrangements shall be made that effluents and storm water do not get mixed. (v) Project proponent shall provide adequate measuring arrangements for the measurement of water utilized in different categories and effluent generated before commissioning of the plant.

(vii) Project proponent shall provide adequate air pollution control arrangements at all point and non point sources. Electro Static Precipitator(s) having efficiency of not less than 99.9% (with maximum designed emission of particulate matter less than 50 mg/Nm3 in one field out condition) in all the boilers, suitable & effective air pollution control equipments ( adequate dust extraction system such as cyclones/ bag filters) for the control of emission from processes/ operations and for the control of emission during the handling & transportation of raw materials/coal, fly ash/bottom ash etc. shall be installed before commissioning of the plant. Project proponent shall install suitable & effective air pollution control equipments at all transfer points, junction points etc., also. All the conveying system, transfer point, junction point etc. shall be covered. Close conveying system with dust suppression mechanism shall be used for transport of coal washery reject from the coal washery and for carrying the ash to the disposal areas. Adequate provision shall be made for sprinkling of water at strategic locations for ensuring fly ash does not get air borne. For controlling fugitive dust, regular sprinkling of water in coal handling and other vulnerable areas of the plant shall be ensured. The emission of pollutants from any point source shall not exceed the following limit: -

3 Particulate Matter 50 mg/Nm (Fifty Milligram per Normal Cubic Meter)

Project proponent shall provide proper space provision for further retrofitting of air pollution control systems in case of further stringent of particulate matter emission limit. (viii) As per the proposal submitted, the project proponent should examine the feasibility of laying a railway siding for the transport of raw coal. Hence, rail transport should be attempted as per priority. Road transport should be carried out only if the rail transport is totally unavoidable. In case of road transport, transportation should be in covered trucks. (ix) All air pollution control systems shall be kept in good running conditions all the time and failure (if any), shall be immediately rectified without delay otherwise same alternate arrangement shall be made. In the event of any failure of any pollution control system adopted by the industry, the respective production unit shall not be restarted until the control measures are rectified to achieve the desired efficiency. (x) Regular monitoring of ground level concentration of SO2, NOx, SPM and RSPM shall be carried out in the impact Zone and records maintained. If at any stage these levels are found to exceed the prescribed limits, necessary control measures shall be provided immediately. The location of the monitoring stations and frequency of monitoring shall be decided in consultation with CECB Raipur. Periodic reports shall be submitted to SEIAA Chhattisgarh and the Regional Office Bhopal, of Ministry of Environment & Forests, Government of India. (xi) Project proponent shall provide a bi-flue stack of 220 meters height with top internal diameter of 3.86 meter of each flue for adequate dispersal of gaseous pollutants emitted from boilers with continuous online monitoring instrument for Sox, NOx, and Particulate Matter. Exit velocity of flue gases shall not be less than 22m/sec for adequate dispersal of gaseous pollutants. Continuous record of exit velocity shall also be maintained and submitted to the SEIAA, CG and Regional Office, Ministry of Environment & Forests, D:\Docs\2018-04-12\0fc0c6bc1a8a226edaaa64ac0a98b5b8.doc 25 Government of India, Bhopal on a yearly basis. The height of other stack(s) shall not be less than 30 meters. (xii) Sulphur and ash contents in the coal to be used in the project shall not exceed 0.36% and 36.4% respectively at any given time. Similarly Sulphur and ash contents in the coal washery reject to be used in the project shall not exceed 0.6% and 62.9% respectively at any given time. (xiii) Adequate number of permanent ambient air quality monitoring stations (not less than four) in the core zone as well as buffer zone for SPM, RPM, CO, NOx and SO2 shall be set-up in the down wind direction as well as where maximum ground level concentrations are anticipated in consultation with the Chhattisgarh Environment Conservation Board. Monitoring net-work shall be designed taking into account the environmentally and ecologically sensitive targets, land use pattern, location of the stacks, meteorological conditions and topographic features including existing ambient air quality data. The data so collected shall be properly analyzed and submitted to the SEIAA, CG and Regional Office, Ministry of Environment & Forests, Government of India, Bhopal in every six months. (xiv) Space provision for installation of flue gas de- sulphurization plant (FGD) shall be made so that the same could be installed, if required from environmental angle. Due to commissioning of the power generation units, if 98 percentile values for SO2 (based on actual monitored field data) in the ambient air of nearby areas exceed the prescribed permissible limit for respective sensitive areas, rural, residential and other areas; project proponent shall install flue gas de-sulphurization units immediately without any delay. (xv) Project proponent shall install separate electric metering arrangements with time totalizer for the running of pollution control devices. These arrangements shall be made in such a fashion that any non-functioning of pollution control device/devices shall immediately stop the electric supply to the fuel supply system and shall remain tripped till the pollution control device/devices are made functional again/rectified to achieve the desired efficiency. (xvi) Project proponent shall incorporate total ash utilization as integral part of the project. Project proponent shall install dry fly ash extraction system so that ash generated during the power generation, collected in dry form and it shall be utilized 100% for other beneficial uses such as brick/block/products making, road construction, cement making, abandoned mines filling and low lying area filling, ash dyke height raising etc. as per guidelines/notification of Ministry of Environment and Forests, Government of India/Central Government/Central Pollution Control Board. Project proponent shall provided silos of adequate capacity with pneumatic/automatic arrangement of dry fly ash withdrawal to avoid dust emissions for dry collection and withdrawal of fly ash generated to facilitate the use of fly ash for different beneficial purposes such as brick/block/products making, road construction, cement making, etc. Project proponent shall also use fly ash/bottom ash/pond ash based products for the construction activities. Project proponent shall adopt dry ash disposal system or high ash concentration slurry disposal system for disposal of unutilized fly ash and bottom ash in conventional slurry mode in ash pond. (xvii) Project proponent shall install fly ash brick/block/products-manufacturing machine of adequate capacity before start of construction activities of super structure of 2 x 135 megawatt units. Project proponent shall utilize the fly ash bricks/blocks etc. manufactured by own fly ash brick/block manufacturing machine in its construction activities. Project proponent shall

Project proponent shall install additional fly ash brick/block/products-manufacturing machine of adequate capacity before commissioning of the power plant. (xviii) Project proponent shall follow the guidelines, notification etc. for utilization of fly ash/bottom ash/pond ash issued by Ministry of Environment and Forests, Government of India/Central Government/Central Pollution Control Board from time to time. 100% fly ash utilization shall be achieved within 9 years in accordance with the notification on fly ash utilization SO 763 (E) dated 14/09/1999 and the amendments made therein from time to time. Industry shall abide by the decisions taken by Ministry of Environment and Forests, Government of India/Central Government/ Central Pollution Control Board from time to time regarding use of fly ash/bottom ash/pond ash. (xix) Ash pond area shall be provided with impervious lining with suitable leachate collection systems to avoid any leaching of contaminants into underground water table/surface water. Project proponent shall provide suitable drainage systems around the fuel stockyard. Water sprinklers shall also be provided to control the ash emission from dyke area. Adequate safety measures shall also be adopted for the ash dyke to prevent any breaching. (xx) Project proponent shall take effective steps for safe disposal of solid wastes and sludge. Project proponent shall obtain authorization from Board for management and handling of hazardous wastes as per Hazardous Wastes (Management and Handling) Rules, 1989 (as amended). (xxi) All the internal roads shall be made pucca before commissioning of the power plant. Good house keeping practices shall be adopted by the project proponent. (xxii) Project proponent shall take proper action to control the noise pollution. Project proponent shall install appropriate noise barriers /control measures including acoustic hoods, silencers, enclosures etc. on all sources of noise generation to control the noise. Earplugs/ear muffs etc. shall be provided to the employee working in the area of generator halls and other high noise areas. Leq of /noise levels emanating from turbines shall be limited to 75 dBA. The noise level shall not exceed the limits 75 dB (A) during the daytime and 70 dB (A) during the nighttime within the factory premises. Project proponent shall take adequate measures for control of noise level below 85 dB (A) in the work environment. Workers engaged in noisy areas such as turbine area, air compressors etc shall be periodically examined to maintain audiometric record and for treatment for any hearing loss including shifting to non noisy/ less noisy areas. (xxiii) Project proponent shall provide appropriate arrangements to avoid air pollution, water pollution, noise pollution etc. during construction phase and during transportation of plants/machineries/equipments/ construction materials etc. to the site for 2 x 135 megawatt units. For controlling fugitive dust during transportation and construction works, regular sprinkling of water in village roads and other vulnerable areas of the plant shall also be ensured. The emission from vehicles engaged for transportation of plants/machineries/ equipments/construction materials etc. to the site shall be ensured within prescribed vehicle emission norms. First aid and sanitation arrangements shall be made for the drivers and other contract workers during construction phase.

The progress of the activities related to the project shall be submitted periodically to SEIAA, CG and Regional Office, Ministry of Environment & Forests, Government of India, Bhopal. (xxv) Project proponent shall provide adequate number of influent and effluent quality monitoring stations/points in consultation with Chhattisgarh Environment Conservation Board. Regular monitoring shall be carried out for relevant parameters. Regular monitoring of surface and ground water quality including heavy metals shall be undertaken around ash dyke and the project area to ascertain the change in the water quality, if any, due to leaching of contaminants from disposal area/project area. Result and data collected shall be analyzed to ascertain the status of water quality and findings shall be submitted. Continuous monitoring of ground water level and quality shall be carried out by establishing a network of existing wells and constructing new piezometers at suitable locations at the proponent's cost in and around project area including ash dyke area in consultation with Regional Director, CGWB, Central Region, Bhopal. Project proponent shall install at least four observation wells around the fly ash disposal area. (xxvi) Adequate safety measures shall be provided in the plant area to check/minimize spontaneous fires in fuel yard, especially during summer season. Copy of the these measures with full details along with location plant layout shall be submitted to SEIAA, CG and Regional Office, Ministry of Environment & Forests, Government of India, Bhopal. (xxvii) Storage facilities for auxiliary liquid fuel such as LDO and/ HFO/LSHS shall be made in the plant area where risk is minimum to the storage facilities. Disaster Management plan shall be prepared to meet any eventuality in case of an accident taking place. Mock drills shall be conducted regularly and based on the same, modifications required, if any shall be incorporated in the DMP. Sulphur content in the liquid fuel will not exceed 0.5%. (xxviii) At-least 50 meter wide green belt shall be developed all along the boundary of the plant premises. Adequate wide green belt shall be developed all along the boundary of the ash pond area. As far as possible maximum area of open spaces shall be utilized for plantation purposes. Project proponent shall abide by the decisions taken by Ministry of Environment and Forests, Government of India/Central Government/ Central Pollution Control Board from time to time in this regard. Tree density of 1500–2000 trees per hectare with local broad leaf species should be maintained. At least 141 acres (about one third of the total plant area) shall be used for green belt development. (xxix) Project proponent shall provide garland drains with appropriate check dams all along the fuel, dust / ash storage areas etc. to avoid any possibility of erosion (wearing away) during rain. Garland drain (size, gradient & length) and sump capacity shall be designed keeping 50% safety margin over and above the peak sudden rainfall and maximum discharge in the area adjoining the project site. Sump capacity shall also provide adequate retention period to allow proper settling of silt material. Sedimentation pits shall be constructed at the corners of the garland drains. Project proponent shall provide adequate collection and treatment arrangement for proper management of storm water. The surface run-off shall be de-silted through a series of check dams and drains. (xxx) Project proponent shall adopt rainwater-harvesting technique in the project area and residential area for recharge of ground water. The rainwater-

Project proponent shall develop rainwater-harvesting structures to harvest the rainwater for utilization in the lean season as well as to recharge the ground water table. A detailed scheme for rainwater harvesting to recharge the ground water aquifer shall be prepared in consultation with Central Ground Water Authority/State Ground Water Board. A copy of the same shall be submitted within three months to the SEIAA, CG and Regional Office, Ministry of Environment & Forests, Government of India, Bhopal. No ground water shall be used for any purpose. (xxxi) Project proponent shall establish an environmental management cell to carryout function relating to environmental management under the supervision of senior executive who will directly report to the head of organization. A full-fledged laboratory with qualified technical/scientific staffs to monitor the influent, effluent, ground water, surface water, soil, stack emission and ambient air quality etc. shall be provided. (xxxii) Adequate funds shall be allocated for undertaking CSR activities (community welfare, environmental development activities apart from committed plantation) and in any case it shall not be less than 5% of the net profit. Details of activities shall also be submitted to SEIAA Chhattisgarh and Regional Office, Ministry of Environment & Forests, Government of India, Bhopal. The funds earmarked for the environment protection measures shall not be diverted for other purpose and year-wise expenditure should be reported to the SEIAA Chhattisgarh and Regional Office, Ministry of Environment & Forests, Government of India, Bhopal. (xxxiii) Project proponent shall also ensure the availability of adequate pastureland for cattle feed after acquisition of land for power plant. Project proponent shall also facilitate the respective Gram Panchayats for development of alternative posture land for cattle feed in the villages as per demand of concerning Gram Panchayat. (xxxiv)The issuance of this environmental clearance does not convey any property rights in either real or personal property, or any exclusive privileges, nor does not authorize any injury to private property or any invasion of personal rights, nor any infringement of Central, State or Local laws or regulations. (xxxv) The PAP shall be rehabilitated/compensation in accordance with the norms of the State Government. Details of R&R plan with compensation package shall be submitted to SEIAA, Chhattisgarh and Regional Office, Ministry of Environment & Forests, Government of India, Bhopal. (xxxvi)SEIAA, Chhattisgarh reserves the right to amend/cancel any of the conditions and add new conditions and further stringent the emission/effluent limit as and when deemed necessary in the interest of environmental protection, change in the project profile or non-satisfactory implementation of the stipulated conditions etc.

(i) The acquisition of land for the 2 x 35 = 70 megawatt washery reject/coal based thermal power plant shall be restricted to maximum 29.54 ha. with the following break-up: - Description Area (ha) Power Plant & Ancillaries 5.00 Coal Storage yard 1.54 Raw Water Reservoir 1.00 Greenbelt / Green Cover 11.00 Ash Disposal Area 10.00 Road , Drainage, 1.00 Open Areas, Rationalization Areas etc. Total 29.54 (ii) The confirmed coal linkage to meet the requirement for requisite quantity of coal (290 TPD) for the ultimate capacity shall be obtained before commissioning the project. Copy of the coal linkage shall be submitted to the SEIAA, CG and Regional Office, Ministry of Environment & Forests, Government of India, Bhopal. The consumption of coal washery reject and Dolochar shall be 1604 TPD and 295 TPD respectively.

(iii) Project proponent shall provide adequate facility for proper treatment of industrial and domestic effluent. Project proponent shall provide effluent treatment plant before commissioning of the plant. All the effluent treatment system shall be kept in good running condition all the time and failure (if any), shall be immediately rectified without delay otherwise same alternate arrangement shall be made. Project proponent shall ensure the treated effluent quality within standard prescribed by Ministry of Environment & Forests, Government of India. (iv) Any liquid effluent what so ever generated from industrial activities including ash dyke (if any) shall not be discharged into the river or any surface water bodies under any circumstances, and it shall be reused wholly in the process/plantation. All the industrial effluent including ash dyke effluent (if any) generated shall be re-circulated/reused after proper treatment. Project proponent shall provide sewage treatment plant of adequate capacity for treatment of domestic effluent generated from township. The un-treated/treated domestic effluent shall not be discharge into the river or any surface water bodies. The treated domestic effluent shall be used for plantation purpose after proper disinfections. Industry shall make proper arrangements of suitable drains/pipe networks to ensure adequate flow for utilization of treated effluent inside the premises. The concept of zero discharge shall be maintained all the time except during monsoon. Arrangements shall be made that effluents and storm water do not get mixed. (v) Project proponent shall provide adequate measuring arrangements for the measurement of water utilized in different categories and effluent generated before commissioning of the plant.

COC of at least 5 shall be adopted and the effluents shall be treated as per the prescribed norms. Minimum water drawl for makeup purposes shall be ensured. (vii) Project proponent shall provide adequate air pollution control arrangements at all point and non point sources. Electro Static Precipitator(s) having efficiency of not less than 99.9% (with maximum designed emission of particulate matter less than 50 mg/Nm3 in one field out condition) in all the boilers, suitable & effective air pollution control equipments ( adequate dust extraction system such as cyclones/ bag filters) for the control of emission from processes/ operations and for the control of emission during the handling & transportation of raw materials/coal, fly ash/bottom ash etc. shall be installed before commissioning of the plant. Project proponent shall install suitable & effective air pollution control equipments at all transfer points, junction points etc., also. All the conveying system, transfer point, junction point etc. shall be covered. Close conveying system with dust suppression mechanism shall be used for transport of coal washery reject from the coal washery and for carrying the ash to the disposal areas. Adequate provision shall be made for sprinkling of water at strategic locations for ensuring fly ash does not get air borne. For controlling fugitive dust, regular sprinkling of water in coal handling and other vulnerable areas of the plant shall be ensured. The emission of pollutants from any point source shall not exceed the following limit: -

3 Particulate Matter 50 mg/Nm (Fifty Milligram per Normal Cubic Meter)

Project proponent shall provide proper space provision for further retrofitting of air pollution control systems in case of further stringent of particulate matter emission limit. (viii) As per the proposal submitted, the project proponent should examine the feasibility of laying a railway siding for the transport of raw coal. Hence, rail transport should be attempted as per priority. Road transport should be carried out only if the rail transport is totally unavoidable. In case of road transport, transportation should be in covered trucks. (ix) All air pollution control systems shall be kept in good running conditions all the time and failure (if any), shall be immediately rectified without delay otherwise same alternate arrangement shall be made. In the event of any failure of any pollution control system adopted by the industry, the respective production unit shall not be restarted until the control measures are rectified to achieve the desired efficiency. (x) Regular monitoring of ground level concentration of SO2, NOx, SPM and RSPM shall be carried out in the impact Zone and records maintained. If at any stage these levels are found to exceed the prescribed limits, necessary control measures shall be provided immediately. The location of the monitoring stations and frequency of monitoring shall be decided in consultation with CECB Raipur. Periodic reports shall be submitted to SEIAA Chhattisgarh and the Regional Office Bhopal, of Ministry of Environment & Forests, Government of India. (xi) Project proponent shall provide a bi-flue stack of 110 meters height with top internal diameter of 4 meter of each flue for adequate dispersal of gaseous pollutants emitted from boilers with continuous online monitoring instrument for Sox, NOx, and Particulate Matter. Exit velocity of flue gases shall not be less than 23m/sec for adequate dispersal of gaseous pollutants. Continuous record of exit velocity shall also be maintained and submitted to the SEIAA, CG and Regional Office, Ministry of Environment & Forests, Government of India,

Sulphur and ash contents in the coal washery reject to be used in the project shall not exceed 0.1% and 64.0% respectively at any given time. Similarly Sulphur and ash contents in the dolochar to be used in the project shall not exceed 1.05% and 74.19% respectively at any given time. (xiii) Adequate number of permanent ambient air quality monitoring stations (not less than four) in the core zone as well as buffer zone for SPM, RPM, CO, NOx and SO2 shall be set-up in the down wind direction as well as where maximum ground level concentrations are anticipated in consultation with the Chhattisgarh Environment Conservation Board. Monitoring net-work shall be designed taking into account the environmentally and ecologically sensitive targets, land use pattern, location of the stacks, meteorological conditions and topographic features including existing ambient air quality data. The data so collected shall be properly analyzed and submitted to the SEIAA, CG and Regional Office, Ministry of Environment & Forests, Government of India, Bhopal in every six months. Sump capacity shall also provide adequate retention period to allow proper settling of silt material. Sedimentation pits shall be constructed at the corners of the garland drains. Project proponent shall provide adequate collection and treatment arrangement for proper management of storm water. The surface run-off shall be de-silted through a series of check dams and drains. (xxx) Project proponent shall adopt rainwater-harvesting technique in the project area and residential area for recharge of ground water. The rainwater- harvesting technique shall be incorporated right from the design stage of all structures. Project proponent shall develop rainwater-harvesting structures to harvest the rainwater for utilization in the lean season as well as to recharge the ground water table. A detailed scheme for rainwater harvesting to recharge the ground water aquifer shall be prepared in consultation with Central Ground Water Authority/State Ground Water Board. A copy of the same shall be submitted within three months to the SEIAA, CG and Regional Office, Ministry

(xxxi) Project proponent shall establish an environmental management cell to carryout function relating to environmental management under the supervision of senior executive who will directly report to the head of organization. A full- fledged laboratory with qualified technical/scientific staffs to monitor the influent, effluent, ground water, surface water, soil, stack emission and ambient air quality etc. shall be provided. (xxxii) Adequate funds shall be allocated for undertaking CSR activities (community welfare, environmental development activities apart from committed plantation) and in any case it shall not be less than 5% of the net profit. Details of activities shall also be submitted to SEIAA Chhattisgarh and Regional Office, Ministry of Environment & Forests, Government of India, Bhopal. The funds earmarked for the environment protection measures shall not be diverted for other purpose and year-wise expenditure should be reported to the SEIAA Chhattisgarh and Regional Office, Ministry of Environment & Forests, Government of India, Bhopal. (xxxiii) Project proponent shall also ensure the availability of adequate pastureland for cattle feed after acquisition of land for power plant. Project proponent shall also facilitate the respective Gram Panchayats for development of alternative posture land for cattle feed in the villages as per demand of concerning Gram Panchayat. (xxxiv)The issuance of this environmental clearance does not convey any property rights in either real or personal property, or any exclusive privileges, nor does not authorize any injury to private property or any invasion of personal rights, nor any infringement of Central, State or Local laws or regulations. (xxxv) The PAP shall be rehabilitated/compensation in accordance with the norms of the State Government. Details of R&R plan with compensation package shall be submitted to SEIAA, Chhattisgarh and Regional Office, Ministry of Environment & Forests, Government of India, Bhopal. Environmental Impacts:  Impacts of project, if any, in the land use, in particular agricultural land, forest land, grazing land, water bodies, existing users of water bodies, drainage of the area and the surroundings;

Examine whether existing roads are adequate to take care of additional load of mined out materials and solid wastes transportation. Whether any additional infrastructure would need to be constructed and the agency responsible for the same with time frame?  Prediction of impact of project on different environmental components inter-alia (1) air including noise, (2) water (surface and groundwater regime), (3) soil, (4) flora and fauna and (5) socio-economic. Also take into account the emission from the vehicles and loading & unloading activities;  The details of input data, emission factor and model used for air quality modeling. The air quality contours may be plotted on location map showing the location of project site, habitation nearby, sensitive receptors, if any. The wind roses should be shown on this map;  Examine the number and efficiency of mobile/static water sprinkling system along the main haul roads, approach roads and also the frequency of their use in impacting the air quality; 4. Additional Study:  Public Hearing details covering the notices issued in the newspaper, proceedings/minutes of public hearing, the points raised by the general public and commitments made, in a tabular form. CONDITIONS TO BE COMPLIED WITH FOR ACCORDING ENVIRONMENTAL CLEARANCE FOR AIIMS, “SARDAR VALLABH BHAI PATEL INSTITUTE OF MEDICAL SCIENCES, RAIPUR” SITE: BHILAI ROAD, TANTIBANDH, RAIPUR (C.G.)

As per Ministry of Environment and Forests, Government of India circular No.23/3/2007-IA.III, dated - 05/02/2008, the State Level Expert Appraisal Committee, Chhattisgarh hereby recommends provisional Environmental Clearance (Conditions to be complied with for according Environment Clearance) as per the provision of Environmental Impact Assessment Notification, 2006 and the subsequent amendments, subject to strict compliance of the terms and conditions mentioned below:

PART A – SPECIFIC CONDITIONS I. Construction Phase Facility of Labourers during Construction: - (i) Construction camp and temporary labour sheds shall be located away from the construction site. Construction camps shall be provided for construction personnel to avoid indiscriminate settlement of construction workers and labourers. (ii) Provision of drinking water, wastewater disposal, solid wastes management and primary health facilities shall be ensured for labour camps. Proper sanitation facilities shall be provided at the construction site to prevent health related problem. Domestic as well as sanitary wastes from construction camps shall be cleared regularly. Provision shall be made for mobile toilets. The safe disposal of wastewater and solid wastes generated during construction phase shall be ensured. (iii) Water usage during construction shall be optimized to avoid any wastage. (iv) Adequate safely measures shall be adopted to the construction workers. (v) All the labourers to be engaged for construction works shall be screened for health and adequately treated before issue of work permits. The contractor shall ensure periodic health check-up of construction workers. A first Aid room shall be provided in the project both during construction and operation of the project. (vi) Provision shall be made for the supply of kerosene or cooking gas /pressure cooker to the labourers during construction phase.

Environmental Management during Construction: - i) As far as practicable, re-use of debris of demolished existing buildings/houses/structures at existing site is recommended with a special care for handling and disposal of asbestos waste, if any. Rest of waste is to be disposed at the sanitary landfill disposal site. ii) The asbestos waste, from demolition debris, if any, shall separated and shall be disposed at Common Hazardous Wastes, Treatment and Disposal Facility. iii) Appropriate measure like adequate drainage, embankment consolidation and slope stabilization shall be taken along the roads to avoid soil erosion. Top soils (20 cm) of the borrow pit sites shall be conserved and restored after completion of excavation. All the topsoil excavated during construction activities shall be stored for use in horticulture/landscape development within the project site. Proper erosion control and sediment control measures shall be adopted.

D:\Docs\2018-04-12\0fc0c6bc1a8a226edaaa64ac0a98b5b8.doc 46 iv) Earth material generated from excavation shall be reuse to the maximum possible extent as filling material during site development. The construction debris and surplus excavated material shall be disposed off by mechanical transport in suitable pre-identified dumping areas to avoid land degradation and water logging due to indiscriminate dumping. Dumping areas shall be biologically reclaimed through topsoil cover and plantation. v) A soil erosion and sedimentation control plan shall be prepared prior to construction. The soil erosion, sediment control and storm water practices shall be incorporated depending upon the site characteristics to control soil erosion and loss of topsoil during construction. vi) Disposal of muck including excavated material during construction phase shall not create any adverse effects on the neighboring communities and disposed off taking the necessary precautions for general safety and health aspects. vii) Low sulphur diesel type diesel generator sets shall be used during construction phase. Diesel generator sets during construction phase shall have acoustic enclosures and shall conform to Environment (Protection) Rules, 1986 prescribed for air and noise emission standards. viii) All Vehicles/equipments deployed during construction phase shall be ensure in good working condition and shall conform to applicable air and noise emission standards. These shall be operated only during non-peaking hours. ix) Ambient noise levels shall conform to residential standards both during day and night. Incremental pollution loads on the ambient air and noise quality shall be closely monitored during construction phase. Equivalent noise levels shall be ensured during construction phase and closely monitored during construction phase. Adequate measures shall be provided to maintain ambient air quality and noise levels during construction phase, so as to conform to the stipulated standards by CPCB/CECB. Fortnightly monitoring of ambient air quality (RPM, SPM, SO2 and NOx) shall be done. x) The protective equipments such as earplugs etc. shall be provided to construction personnel exposed to high noise levels. Stationary construction equipments generating noise shall be placed away from inhabited areas and silence zones. Construction activities carried out near residential area shall be scheduled to daytime only. Only limited necessary construction shall be done during nighttime. No unloading of construction materials shall be done at night. Vehicular noise and use of horns shall be controlled through enforcement of laws and public awareness. Use of pressure horns shall be strictly prohibited. To reduce noise level, the roads shall be designed to have more rows of plantation. xi) Construction spoils, including bituminous material and other hazardous materials including oil from construction equipments must not be allowed to contaminate watercourses and the dumpsites for such material must be secured so that they shall not leach into the ground water. If necessary, oil trap shall be installed where heavy machineries are deployed. xii) Proper and prior planning, sequencing and scheduling of all major construction activities shall be done. Construction material shall be stored in covered godowns / sheds. Truck carrying soil, sand and other construction materials shall be duly covered to prevent spillage and dust emission. Adequate dust suppression measures shall be undertaken to control fugitive dust emission. Regular water sprinkling for dust suppression shall be ensured. xiii) Use of Ready-Mix concrete is recommended for this project. Water demand during construction shall be reduced by use of pre-mix concrete, curing agents and other best practices. xiv) Accumulation/stagnation of water shall avoid ensuring vector control. xv) Regular supervision of the above and other measures shall be in place all through the construction phase so as to avoid disturbance to the surroundings.

D:\Docs\2018-04-12\0fc0c6bc1a8a226edaaa64ac0a98b5b8.doc 47 Selection of Materials for Better Energy Efficiency: - i) Use of fly ash based bricks/blocks/tiles/products shall be ensured. Blended cement with fly ash shall be used (not less than 17%). The provisions of Ministry of Environment and Forests, Government of India Notification No. 763(E) dated 14/09/1999 [amended notification no. SO 979 (E) dated 27/08/2003] regarding use of Fly ash must be complied with. Appropriate usage of other industrial wastes shall also be ensured. Soil borrow area shall be filled up with ash with proper compaction and covered with topsoil kept separately. Fly ash/pond ash shall be used for low- lying areas filling. In embankments / road construction etc. ash shall be utilized as per guidelines of Ministry of Environment and Forests, Government of India/ Central Pollution Control Board/ Indian Road Congress etc. concerning authorities. The use of perforated brick / hollow blocks / fly ash based lightweight aerated concrete etc. shall also be ensured so as to reduce load on natural resources. ii) Construction shall conform to the requirements of local seismic regulations. The project proponent shall obtain permission for the plans and designs including structural design, standard, safety, adequacy of firefighting equipments, protection measures for lightning and specifications of all construction works from concerned authority. iii) Reduce the use of glazed surface as per National Building Code 2005. Use of glass in various buildings may be reduced up to 40% to reduce the electricity consumption and load on air-conditioning. If necessary, use of high quality double glass with special reflective coating in windows. Roof of the various buildings shall meet prescriptive requirement as per Energy Conservation Building Code by using appropriate thermal insulation material to fulfill requirement. Opaque wall shall meet prescriptive requirement as per Energy Conservation Building Code which is proposed to be mandatory for all air conditioned spaces while it is inspirational for non-air-conditioned spaces by use of appropriate thermal insulation material to fulfill requirement. iv) Use of energy efficient construction materials to achieve the desired thermal comfort shall be incorporated. The desired level of roof assembling ‘U’ factor and insulation ‘R’ value must be achieved. Roof assembling ‘U’ factor for the top roof shall not exceed 0.4 Watt/sq.m/degree centigrade with appropriate modifications of specifications and building technologies. The provisions of National Building Code 2005 shall be strictly followed. v) Modern electrical power transmission & distribution system shall be installed. vi) Street lighting shall be energy efficient. The High Pressure Sodium Vapour (HPSV) Lamps & Compact Fluorescent Lamps (CFL) along the building network system shall be provided. High intensity, high mast lights to be installed at intersections, parking areas, vehicles stops and major pedestrian movement areas as per the specifications and guidelines prescribed by the Bureau of Indian Standards. Solar energy may be used for outdoor lighting. vii) Extensive network of cellular phones and landlines shall be provided. The telephone and electric cables shall be laid in the same corridor. Adequate vertical and horizontal separation between telephone and electric cable shall be maintained. viii) Reduce hard paving-onsite (open area surrounding building premises) and/or provide shade on hard paved surfaces to minimize heat island effect and imperviousness of the site. ix) All proposed air-conditioned buildings shall follow the norms proposed in the ECBC regulations framed by the Bureau of Energy Efficiency. Use of chillers shall be CFC & HCFC free.

Water Body Conservation: - i) No untreated/treated wastewater shall be discharge in the any water bodies under any circumstances. D:\Docs\2018-04-12\0fc0c6bc1a8a226edaaa64ac0a98b5b8.doc 48 ii) All the construction and preparatory activities shall be carried out during dry seasons only.

Water Supply: - i) Total fresh water requirement shall be 1210 KLD (total water requirement – 1500 KLD, out of which 290 KLD shall be recycle after treatment for horticulture & AC makeup) for all utilities. Water shall be supplied from Municipal Water Supply of Raipur. ii) The water treatment plant shall be provided for treatment of water. Appropriate arrangement shall be made for treatment and reuse of backwash water of filtration plant. iii) Project proponent shall provide adequate measuring arrangement at the inlet point of water uptake and at the discharge point for the measurement of water utilized in different categories to monitor the daily water consumption. Measuring arrangement for effluent generated shall also be provided. iv) Water saving practices such as usage of water saving devices / fixtures, low flow flushing systems, sensor based fixtures, auto control walls, pressure reducing devices etc. shall be adopted.

Greening Programme: - i) Lay out of proposed buildings and roads etc. shall be made in such a way that it shall cause minimum disturbance to existing flora and fauna. Appropriate green belt shall be developed to compensate the habitat loss of trees for site clearing. The project proponent must obtain permission for tree cutting from competent authority as per prevailing Act/Rules. Plantation along the side of the roads and in the open spaces shall be developed to act as sinks of air pollutants. Adequate plantation programme along the roads and open spaces shall be planned. The plantation of trees shall be completed in the construction stage. The plantation programme shall be drawn to confirm the natural climate conditions. The plantations shall consist of mixture of available indigenous, fast growing and sturdy species of trees, shrubs and herbs. Preferential plantation of flowering trees with less timber and fruit value shall be carried out. Greenbelt shall be developed in an area of 33 acres covering at-least 33% of the total project area.

Sewage Management: - i) The infectious liquid wastes and other non- infectious liquid wastes shall be collected and treated separately. The biomedical liquid effluent generated from hospital shall be treated in effluent treatment plant comprising of (1) Screen (2) Oil & Grease trap (3) Equalization tank (4) Neutralization Tank (5) Settling tank (6) Activated carbon filter (7) UV disinfection (8) Treated effluent water tank. The treated liquid effluent from the effluent treatment plant shall be discharged in to sewage treatment plant. All the night soil and waste pipelines from the toilets, kitchen, pantries, and internal toilets shall be connected to the Sewage Treatment Plant. The Sewage Treatment Plant (STP) shall comprise of primary, secondary and tertiary treatment facility. As per the proposal submitted, 1200m3/day capacity Sewage Treatment Plant shall be installed for treatment of domestic waste water from various units of the Hospital. About 290m3/day of treated wastewater from the STP will be utilized within the project premises. The remaining 910m3/day treated wastewater will be utilized for flushing purpose and thus, no wastewater shall be discharged outside the hospital premises under any circumstances. Sewage collection system of adequate capacity to convey the sewage during peak hours shall be laid to collect and convey the sewage from various buildings. The augmentation of Sewage Collection System, Sewage- Pumping Station (if any) and Sewage Treatment Plant shall be ensured before the completion of the buildings.

D:\Docs\2018-04-12\0fc0c6bc1a8a226edaaa64ac0a98b5b8.doc 49 ii) Delay tanks, which shall store the faecal matter generated from the isolation ward, where patients are exposed to radioactive therapy, shall be provided within hospital complex as per the standard prescribed by Atomic Energy Regulatory Board (AERB). The tanks shall be provided with non-corrosive double lining to protect against any damage. The time for each tank shall not be less than 48 hours. The outlet of delay tank shall be located higher than the main sewer line. After this retention time the soil shall be transferred to the STP for further biological treatment. Delay tank facility shall be fenced from all sides with lock and key, in order to restrict any entry of general public in that area.

Rain Water Harvesting Scheme: - i) Rainwater from open spaces shall be collected and reuse for landscaping and other purposes. Rooftop rainwater harvesting shall be adopted for the buildings. Every building shall have rainwater-harvesting facilities. The storm water flowing in roadside drains shall also be recycled and reused to maintain the vegetation and discharged into natural water bodies. Before recharging the surface runoff, pre treatment must be done to remove suspended matter and oil & grease. ii) Net imperviousness of the site shall not exceed the imperviousness factor as prescribed by the National Building Code of India, Bureau of Indian Standards, 2005.

Transport Management: - i) Dedicated pedestrian paths shall be provided along the roads. Appropriate access shall be provided for patients/physically challenged people in the pedestrian paths. ii) Traffic congestion near the entry and exit points from the roads adjoining the project site must be avoided. The design of service roads and the entry and exit from the hospital building shall conform to the norms & standards prescribed by the National Highways Authority of India / State Public Works Department. iii) Permeable (porous) paving in the parking areas, and walkways & patio areas shall be used to control surface water runoff by allowing storm water to infiltrate the soil and return to ground water. iv) All utility lines (electricity, telephone, cable, water supply, sewage, drainage, etc.) shall be laid below ground level. Ducts shall be provided along and across the roads to lay the utility lines. Major trunk (water/sewerage) lines are to be laid along the utility corridor. v) The road drainage shall be designed to enable quick runoff of surface water and prevent water logging. The road level shall be kept at least 0.5 to 1.0 meter above the observed high flood level. The guidelines on Urban Drainage, IRC: SP-50 shall be followed. On the both sides of all roads, well –lit and smooth surfaced footpaths shall be provided. The hoardings shall be strictly prohibited along the roads. vi) Parking shall be provided for at least 805 vehicles (595 cars, 8 HMV, 10 Ambulances and 192 two-wheelers). Adequate provision shall be made to cater the parking needs. Parking shall be fully internalized and no public space shall be utilized. Parking spaces standards as given in ‘Manual on Norms and Standards for Environmental Clearance of Large Construction Projects’ issued by Ministry of Environment & Forests, Government of India shall be adapted. Others: - i) All mandatory approvals and permissions as required shall be obtained. ii) Unskilled construction labourers shall be recruited from the local areas. Construction materials shall be procured locally as far as possible. iii) Provisions shall be made for the integration of solar water heating system. D:\Docs\2018-04-12\0fc0c6bc1a8a226edaaa64ac0a98b5b8.doc 50 iv) Provision of 51vermin-composting for the biodegradable solid wastes generated from the Complex as well as the large amount of biomass that shall be available from the tree plantation shall be made. v) The ground water shall not be abstracted without prior permission from the competent authority in the project area. vi) Adequate roadside drains shall be provided along the road to facilitate its better maintenance and increase in the life of the carriageway, which shall avoid soil erosion and land degradation due to water stagnation. The roadside drains shall be provided on both sides of the road. Longitudinal and cross drainage system shall be regularly maintained. Adequate new drainage works and cross drainage structures shall be provided for smooth passage of runoff. Filling of existing natural drainage courses shall be strictly avoided. Suitable drainage at construction site and camp shall be provided to eliminate the formation of stagnant water pools. vii) Regular supervision of the above and other measures for monitoring shall be in place all through the construction phase, so as to avoid disturbance to the surroundings. viii) Under the provisions of Environment (Protection) Act, 1986, legal action shall be initiated, if the construction of the project has been started without obtaining Environmental clearance. I. Operation Phase Sewage Treatment Plant: - i) An independent expert shall certify the installation of the Sewage Treatment Plant (STP-comprising of (1) Screen (2) Oil & Grease trap (3) Grift Chamber (4) Equalization tank (5) Aeration tank (5) Secondary Clarifier (6) UV disinfection (7) Sludge Holding tank (8) Pressure sand filter (9) Activated Carbon Filter (9) Treated effluent water tank.) and report in this regard shall be submitted to SEIAA, Chhattisgarh before the project is commissioned. The treated liquid effluent from the effluent treatment plant shall be discharged in to sewage treatment plant. After treatment the effluent will be used for horticulture and other such uses. Project proponent shall operate and maintain the sewage collection / conveyance system, sewage pumping system and sewage treatment system regularly to ensure the treated effluent quality within the standards prescribed in Bio-Medical Wastes (Management and Handling) Rules, 1998 published by Ministry of Environment and Forests, Government of India or prescribed by Chhattisgarh Environment Conservation Board (which ever stringent). All the effluent treatment system shall be kept in good running conditions all the time and failure (if any), shall be immediately rectified without delay, otherwise, same alternate arrangement shall be made for storage of untreated sewage until the control measures are rectified to achieve the desired efficiency. Project proponent shall install separate electric metering arrangement with time totalizer for the running of pollution control systems. The record (logbook) of power & chemical consumption for running the pollution control systems shall be maintained. ii) Properly treated and disinfected sewage shall be utilized in flushing the toilets, gardening purpose, make up water in air conditioning systems etc. No treated/untreated effluent shall be discharged out side the hospital premises under any circumstances. Zero discharge condition shall be maintained all the time. Necessary measures shall be made to mitigate the odour problems from Sewage Treatment Plant (STP). Emission of Diesel Generator Set: - i) Noise barriers shall be provided at appropriate locations so as to ensure that the noise levels do not exceed the prescribed standards. DG sets shall be

Ensure Energy Efficiency: - i) Power requirement shall be 10 MVA through CSEB and power back up shall be through eco-friendly DG Sets of adequate capacity. The project proponent shall resort to solar energy at least for water heating for buildings. Use of solar panels may be done to the extent possible. ii) The different hospital buildings shall have adequate distance among them to allow movement of fresh air and passage of natural light, air and ventilation. iii) During maintenance, energy efficient electric light fittings & lamps – low power ballasts, low consumption high power luminaries, lux level limiters & timers for street lighting shall be provided. Used CFLs and TFLs shall be properly collected and disposed off/sent for recycling as per the prevailing guidelines/rules of the regulatory authority to avoid mercury contamination. A report on the energy conservation measures confirming to energy conservation norms finalized by Bureau of Energy Efficiency shall be prepared incorporating details about building materials & technology, ‘R’ value & ‘U’ factors etc.

Bio-Medical and Municipal Solid Waste/ Other Wastes: - i) The Infectious Waste (excluding plastic waste), Infectious Plastic Waste, Non- Infectious Waste (biomedical wastes) and Sharp waste shall not exceed 360.66 kg/day, 115.7 kg/day, 1184.8 kg/day and 1.88 kg/day respectively. Biomedical waste shall be collected, handled, treated and disposed off strictly as per the Bio-Medical Wastes (Management and Handling) Rules, 1998. Bio-medical liquid waste from laboratory, washing, cleaning, housekeeping and disinfecting activity shall be properly disinfected by chemical treatment and sent to sewage treatment plant. Plasma gasification processing system of adequate capacity and specification as mentioned in the Bio-Medical Wastes (Management and Handling) Rules, 1998 shall be provided for treatment of bio-medical wastes. Two-chambered container (one for recyclable wastes and other for all organic and compostable wastes) shall be placed at appropriate distance/places on the roadside and inside the hospital building. Covered dustbins / garbage collector in convenient places to collect the municipal solid wastes shall be provided. Modern trucks capable of using hydraulic lifting as well as safe covered garbage containers shall be provided for transportation. ii) The proponent must develop the Solid Wastes Segregation, Collection, Handling, Transportation and Disposal Scheme ensuring safe and scientific segregation, collection, handling, transportation and disposal of organic and inorganic portion. The organic wastes are to be composted / 52vermi composted at the compost plant. The sludge generated from Sewage Treatment Plant (after drying) shall be used as manure for gardening purpose. Wet garbage of kitchens and food outlets collected from various outlets shall be kept in refrigerated cold rooms. All municipal solid wastes shall be segregated, collected, transported, treated and disposed as per provisions of the Municipal Solid Wastes (Management and Handling) Rules, 2000 (As amended). iii) Public awareness programmes of benefit of living a clean and healthy life by proper management of solid wastes shall be organized regularly. iv) All hazardous wastes shall be segregated, collected, transported, treated and disposed as per provisions of the Hazardous Materials (Management Handling and Tran boundary Movement) Rules, 2008. v) The use of hand gloves, shoes and safety dress for all waste collectors and sorters shall be enforced. vi) Recycling of all recyclable wastes such as newspaper, aluminium cans, glass bottles, iron scrap and plastics etc. shall be encouraged.

Others: - I) Noise shall be controlled to ensure that it does not exceed the prescribed standards. During nighttime the noise level measured at the boundary of the building shall be restricted to the permissible levels to comply with the prevalent regulations. II) Weep holes in the compound walls shall be provided to ensure natural drainage of rainwater in the catchments area during the monsoon period. III) The ground water level and its quality shall be monitored regularly in consultation with Central Ground Water Authority.

PART B – GENERAL CONDITIONS i) After approval of the competent authority appropriate fire fighting system shall be adapted. ii) The environmental safeguards and mitigation measures contained in the application shall be implemented in letter and spirit. iii) All the conditions, liabilities and legal provisions contained in the Environmental Clearance shall be equally applicable to the successor management of the project in the event of the project proponent transferring the ownership, maintenance of management of the project to any other entity. iv) The project proponent shall make financial provision in the total budget of the project for implementation of the above-mentioned conditions and for suggested environmental safeguard measures. The funds earmarked for the environmental protection measures shall not be diverted for other purposes. v) Six monthly monitoring reports shall be submitted to the SEIAA, Chhattisgarh; Regional Office, Ministry of Environment and Forests, Government of India, Bhopal and Chhattisgarh Environment Conservation Board, Raipur, who shall be monitoring the implementation of environmental safeguards shall be given full cooperation, facilities and documents / data by the project proponents during their inspection. A complete set of all the documents shall submit to State Level Environmental Impact Assessment Authority, Chhattisgarh. vi) The responsibility of implementation of environmental safeguards rests fully on the project proponent. Project proponent shall establish an environmental management cell to carryout functions relating to environmental management under the supervision of senior executive, directly reporting to the head of organization. vii) In the case of any change(s) in the scope of the project, the project shall require a fresh appraisal by the SEIAA. viii) The issuance of this letter does not convey any property rights in either real or personal property, or any exclusive privileges, nor does it authorize any injury to private property or any invasion of personal rights, nor any infringement of Central, State or Local laws or regulations. ix) All other statutory clearances from Chief Controller of Explosives, Fire Department, Civil Aviation Department, Forest Conservation Act, 1980 and Wildlife (Protection) Act, 1972 etc. shall be obtained, as applicable by project proponent. Project proponent shall obtain statutory clearances / licenses/ permissions from concerned Central Government/State Government Departments, Boards, Bodies and Corporations etc. Project proponent shall follow direction issued by Central Government/ State Government, Central Pollution Control Board/Chhattisgarh Environment Conservation Board from

D:\Docs\2018-04-12\0fc0c6bc1a8a226edaaa64ac0a98b5b8.doc 53 time to time regarding control of water & air pollution and for environmental conservation. x) The State Level Environmental Impact Assessment Authority, Chhattisgarh reserves the right to amend the above conditions and add additional safeguard measures subsequently, if found necessary, and to take action including revoking of the environment clearance under the provisions of the Environmental (Protection) Act. 1986, to ensure effective implementation of the suggested safeguard measures in a time-bound and satisfactory manner. xi) After submission of sanctioned building plan of hospital by competent authority and consideration and recommendation of it by State Level Expert Appraisal Committee, the final Environmental Clearance shall be accorded by State Level Environmental Impact Assessment Authority, Chhattisgarh.

Description of the Environment:  Study area should cover an area of 10 km radius around the proposed site;  A study area map of the core zone and 10 km area of the buffer showing major topographical features such as land use, drainage, location of habitats, major construction including railways, highways, pipelines, major industries / mines and other polluting sources, which shall also indicate the migratory corridors of fauna, if any, and the areas where endangered fauna and plants of medicinal and economic importance found in the area;  Contour map along with the site plan of the mine and mine lease land use area statement including land for various mining operations, such as quarry area, overburden dumps, material handling plant, safety zone, building infrastructure, effluent treatment plants, stock yard, labour quarter/colony (within/adjacent to the mine lease area), greenbelt, undisturbed area, natural topographical features (such as existing roads, drains/natural water bodies if any) to be left undisturbed, natural drainage adjoining the lease area and modification thereof in terms of construction of embankments/bunds, proposed diversion / re-channeling of natural drainage or water courses, if any;  Stage of acquisition of mine lease area; Revenue records/letter from District Revenue Office in regard to land records/usage;  One complete season site specific meteorological data;  Information regarding surface hydrology, water regime, hydrogeology and ground water regime;  Information regarding drainage pattern of the study area;

D:\Docs\2018-04-12\0fc0c6bc1a8a226edaaa64ac0a98b5b8.doc 55  Location of any National Park, Wildlife Sanctuary, Reserve Forest, Protected Forest and Eco-sensitive zones, elephant/tiger reserve (existing as well as proposed), migratory routes, if any, within 10 km of the mine site be specified and marked on the map duly authenticated by concerned Government department;  Map showing the core zone delineating the agricultural land (irrigated and un-irrigated), uncultivable land (as defined in revenue records), forest areas (as per records), grazing land and waste land;  Land use statement of the study area well as mine area;  Collection of one complete season (non-monsoon) primary base line data (along-with dates of monitoring) on environmental quality such as air (RPM, SPM, SOx & NOx), noise, water (surface and ground water), soil;  The monitoring be conducted as per Central Pollution Control Board’s guidelines and parameters for water testing for both ground water as per ISI and surface water as per Central Pollution Control Board guidelines;  Surface water, ground water, soil, noise and ambient air quality be monitored at-least at eight stations / locations around the proposed site. At-least one monitoring station in the upwind direction/downstream/non- impact non-polluting area as a control station;  Wind roses to determine air pollutant dispersion;  The location of the air monitoring stations decided after taking into consideration the predominant wind direction, population zone and sensitive receptors including Reserve Forests;  Details of various facilities to be provided for the personnel involved in mined out materials and all solid wastes production, transportation & handling in terms of parking, rest areas, canteen, sanitation, and effluents / pollution load from these activities;  Details of infrastructure facilities such as sanitation, fuel, restroom, canteen etc. to be provided to the labour force including casual workers during construction as well as during operation phase. Effluents / pollution load from these activities be included;  Details of workshop, if any, and treatment of workshop effluents;  Occupational health issues, baseline data on the health of the population;  Study on the existing flora and fauna in the study area carried out by an institution of relevant discipline and the list of flora and fauna duly authenticated separately for core and buffer zone, names of the species along with the classification under the Wild Life Protection Act and a statement clearly specifying whether the study area forms a part of the migratory corridor of any endangered fauna;  Details of mineral reserves, geological status of the study area and the seams to be worked, ultimate working depth and stage wise working plan/scheme until end of mine life on the basis of approved rated capacity and calendar plans of production from the approved Mining Plan/scheme; Include Geological maps also; 3. Environmental Impacts:  Impacts of project, if any, in the land use, in particular agricultural land, forest land, grazing land, water bodies, existing users of water bodies, drainage of the area and the surroundings;  Impact of choice of the selected mining technology and impact on air quality and waste generation (emission and effluents); Impact of choice

D:\Docs\2018-04-12\0fc0c6bc1a8a226edaaa64ac0a98b5b8.doc 56 of selected use of HEMM machinery; impact of blasting, noise and vibrations;  Impacts of mined out materials and all solid wastes transportation covering the entire sequence of production, transportation, handling, transfer and storage on air quality showing in a flow chart with the specific points of fugitive emissions generation;  Impact of the project on local infrastructure of the area, such as rood network. Examine whether existing roads are adequate to take care of additional load of mined out materials and solid wastes transportation. Whether any additional infrastructure would need to be constructed and the agency responsible for the same with time frame?  Prediction of impact of project on different environmental components inter-alia (1) air including noise, (2) water (surface and groundwater regime), (3) soil, (4) flora and fauna and (5) socio-economic. Also take into account the emission from the vehicles and loading & unloading activities;  The details of input data, emission factor and model used for air quality modeling. The air quality contours may be plotted on location map showing the location of project site, habitation nearby, sensitive receptors, if any. The wind roses should be shown on this map;  Examine the number and efficiency of mobile/static water sprinkling system along the main haul roads, approach roads and also the frequency of their use in impacting the air quality; 4. Mitigation Measures:  Details of pollution control measures with respect to effluent treatment, air pollutants emission control, noise control, vibration control and scientific & safe disposal of all solid wastes etc.;  Specific pollution control and mitigative measures for the entire mining operations, Specific pollution control / mitigative measures proposed to be put in place at every air pollutants emission points, transfer and handling points;  All solid wastes temporary storage yard/ overburden dumps be provided with wind shields / wind breaking walls;  Measures for occupational health and safety of the personnel and manpower for the project;  Compliance to the standards (effluent discharge standards, noise level standards particulate matter emission standards) prescribed by Ministry of Environment and Forests, Government of India / Central Pollution Control Board / Chhattisgarh Environment Conservation Board (which ever stringent);  Scheme for rainwater harvesting and ground water recharging with mined out water, if any;  Details of Progressive mine Closure Plan and Details along-with action plan for development of greenbelt with not less than 1500 trees per ha giving details of species, planting schedule etc; details of waste generation such as topsoil and overburden as per approved calendar programme in the approved Mining Plan/Scheme for the rated capacity and their management shown in maps as well as in explanatory chapter with tables giving progressive mine development and mine closure plan, greenbelt development, backfilling programme and conceptual post mining land use; overburden dumps heights and terracing based on slope stability studies with a maximum of 280 angle as the ultimate slope;

D:\Docs\2018-04-12\0fc0c6bc1a8a226edaaa64ac0a98b5b8.doc 57 show the sections of the dumps (ultimate) (both longitudinal and cross section) with relation to the adjacent area;  Topsoil management when new land is broken;  Impacts of change in land use of agricultural land for mining operations and whether the land can be restored for agricultural use post mining; also examine if, at the end of mine life, the depth of void left as water reservoir can be gently sloped to reduce risk to end users; 5. Environmental Management Plan:  The EIA-EMP report covering the impacts and management plan of 60000 tonnes/annum rated capacity for the project specific activities on the environment of the region, and the environmental quality – air, water, noise, land, biotic community through collection of data and information, generation of data on impacts for a rated capacity;  Detailed EMP to mitigate the adverse impacts due to project along-with item-wise cost of its implementation (capital and recurring) until the end of mine life;  Integrating in the EMP, measures for minimizing use of natural resources such as water, land energy, raw materials/mineral etc.;  Disaster Management Plan and mitigative measures for disaster prevention and control;  Risk assessment to be undertaken, based on the same, propose safeguard measures;  Conceptual mine closure plan along with the fund requirement for the detailed activities proposed there under;  Details along-with action plan and year wise funds to be allocated for eco-development/community welfare works including maintenance of roads in nearby villages/areas; 6. Additional Study:  Public Hearing details covering the notices issued in the newspaper, proceedings/minutes of public hearing, the points raised by the general public and commitments made, in a tabular form. If the Public Hearing is in the regional language, provide an authenticated English translation of the same;  Status of litigations/court cases filed/ pending against the project (all cased including environment) and / or any direction / order passed by any hon’ble court of law against the project, if so, details thereof; The following general points should be noted:  All documents should be properly indexed, page numbered.  Period/date of data collection should be clearly indicated.  Authenticated English translation of all material provided in regional languages.  After the preparation of the Draft EIA Report for 60000 tonnes/annum rated capacity (as per the generic structure prescribed in Appendix –III of the EIA Notification, 2006) covering the above mentioned TOR issues, the project proponent shall get the Public Hearing conducted and take further necessary action for obtaining environmental clearance in accordance with the procedure prescribed under the EIA Notification, 2006.  The copy of the letter received from SEAC, Chhattisgarh on the TOR prescribed for the project should be attached as an annexure to the final

The compliance statement of TOR prescribed should also be incorporated.  The final EIA-EMP report submitted to SEIAA, Chhattisgarh must incorporate the issues in TOR and that raised in Public Hearing. The index of the final EIA-EMP report must indicate the specific chapter and page no. of the EIA-EMP report where the specific TOR prescribed by SEAC, Chhattisgarh and the issue raised in the Public Hearing have been incorporated.
