LYON COUNTY FISCAL COURT REGULAR MEETING JANUARY 8, 2015

The Lyon County Fiscal Court met in regular session on Thursday January 8, 2015 with the following members present: Judge Wade White, Magistrates Bobby Cummins, Danny Walker, and Steve Cruce and County Attorney Lee Wilson.

The invocation was given by Sheriff Kent Murphy and the court led the pledge to the flag.

On motion made by Mag. Cruce and seconded by Judge White the court approved the minutes from the December 11, 2014 meeting. The vote was unanimous.

On motion made by Mag. Walker and seconded by Judge White the court approved the minutes from the January 5, 2015 special called meeting. The vote was unanimous.

Denise Sutton was sworn in as Lyon County Treasurer with her term being 7-1-2015 to 6-30-2019.

On motion made by Judge White and seconded by Mag. Walker the court approved the Agreement between Lyon County Sheriff’s Office and the City of Kuttawa. The agreement provides for law enforcement services within the city limits of Kuttawa. The vote was unanimous.

HOLIDAY SCHEDULE Motion made by Mag. Cruce to amend the holiday schedule as presented and remove President’s Day from the schedule. The motion failed for a lack of a second.

On motion made by Judge White and seconded by Mag. Walker the court approved the Holiday Schedule for 2015 as presented. The vote was Judge White and Magistrates Walker and Cummins voting yes and Mag. Cruce voting no. Lyon County Fiscal Court Regular meeting January 8, 2015

On motion made by Judge White and seconded by Mag. Walker the court approved the salary for Patricia Peek at $300.00 per week as part-time custodian. The position will be advertised and a custodian will be named at a later date. The vote was unanimous.

Tommy Melton, Lyon County Road Foreman, discussed the need for a one (1) ton 4x4 truck (replacing 99 1 ton) and a ¾ ton truck (replacing Jason’s) for the road department. He gave an extensive report regarding the truck inventory at the road department. He recommended to salvage the 1999 Ford one (1) ton truck, keeping the 2004 one (1) ton 4x4 and the 2007 truck (Jason’s truck).

Magistrate Cruce requested of Tommy Melton to list a complete inventory at the road department of all trucks and tractors, whether operational or not and include the year, make and model of each.

On motion made by Mag. Walker and seconded by Judge White the court will compose a bid package for advertising and will open bids at the next meeting. The vote was unanimous. Bid package to include one (1) ton 4x4 And a ¾ ton 4x4 extended cab long wheelbase

On motion made by Mag. Cruce and seconded by Mag. Cummins the court places for salvage the 1999 Ford 1 ton truck. The vote was unanimous.

On motion made by Mag. Cummins and seconded by Mag. Walker the court approved the Sheriff’s Fee Budget for 2015. The vote was unanimous.

On motion made by Judge White and seconded by Mag. Cummins the court approved the Clerk’s Fee Budget for 2015. The vote was unanimous. Lyon County Fiscal Court Regular meeting January 8, 2015

On motion made by Mag. Cruce and seconded by Mag. Walker the court approved the inter fund transfers. The vote was unanimous.

On motion made by Judge White and seconded by Mag. Cummins the court approved the transfers. The vote was unanimous.

On motion made by Mag. Walker and seconded by Mag. Cruce the court approved the Finance Officers report. The vote was unanimous.

On motion made by Mag. Cummins and seconded by Judge White the court approved the Treasurer’s report. The vote was unanimous.

On motion made by Mag. Walker and seconded by Judge White the court approved the claims. The vote was unanimous.

On motion made by Mag. Cruce and seconded by Mag. Walker the court approved the Clerk’s report, subject to audit. The vote was unanimous.

On motion made by Mag. Cruce and seconded by Mag. Cummins the court approved the Sheriff’s report, subject to audit. The vote was unanimous.

EXECUTIVE SESSION

The court convened into executive session per 68.810(c) to discuss pending litigation. Case 13-CI-00088 Lyon County vs. Freedom Waste

On motion made by Judge White and seconded by Mag. Cruce the court convened in executive session. The vote was unanimous.

There was no action taken after the closed session.

On motion made by Mag. Cruce and seconded by Mag. Walker the meeting was adjourned. The vote was unanimous.
