City of Gary, South Dakota Regular Council Meeting – Tuesday, December 29, 2015 at 7:00 p.m. at Gary City Hall

The Gary City Council met in a regular session on Tuesday, December 29, 2015, at 7:00 p.m. in the City Hall. Aldermen Albert Bekaert, John Jenson, Clark Dessler, and Darwyn Engesser were present. Mary Peterson and Cory Borg were absent. Mayor Jeff Engesser presided. Present also were Mike Nosbush and Shirley Pederson. Motion by Bekaert, second by Jenson to approve the agenda with one addition: Bigger battery back-up for security system. All members voted aye, motion carried. Motion by Darwyn Engesser, second by Dessler to approve the minutes of the December 7, 2015 regular meeting. All members voted aye, motion carried. Motion by Darwyn Engesser, second by Bekaert to approve the verified claims and issue warrants in payment thereof. All members voted aye, motion carried. Comments were heard by Mike Nosbush. Finance Officer reminded council members whose terms are expiring in 2016 and that petitions can be circulated starting January 29, 2016. Committee and Ward reports were also heard. Further discussion was held on the City purchasing Cardtrol pumps and placing them at C & A Auto Repair. Mayor will get a new quote on the cost of the pumps. Finance Officer will contact city attorney regarding drawing up an agreement with the property owner and also drawing up a lease agreement with the current operators. The cost of liability insurance on the pumps will be researched as well. This item will again be on the February 1st agenda. Motion by Darwyn Engesser, second by Bekaert that a homeowner will be responsible for the full amount of his water bill that was considerably high due to a hot water heater bursting. All members voted aye, motion carried. Motion by Jenson, second by Dessler to declare DNB National Bank of Gary and Clear Lake as the 2016 bank depository and to declare the Clear Lake Courier as the legal newspaper for the City of Gary for 2016. All members voted aye, motion carried. Motion by Bekaert, second by Dessler to pass and adopt the following Resolution #2015-03, 2015 Contingency Transfer: CITY OF GARY RESOLUTION 2015-03 2015 CONTINGENCY TRANSFER TRANSFER OF CONTINGENCY FUNDS TO GENERAL FUND DEPARTMENTS

WHEREAS, the following departments within the General Fund could be over expended for the year 2015; NOW THEREFORE, BE IT RESOLVED that the City Council of Gary, South Dakota transfers the remaining $40,000.00 available in contingency funds in the following manner:

General Fund – 101

412.1 - Mayor/Council - $5,000.00 419.2 - General GovBldgs - $5,000.00 431 - Hwys/Streets/Alleys - $30,000.00

Total: $40,000.00

Motion by Darwyn Engesser, second by Jenson to transfer 2015 ending balance in the Video Lottery Fund and the Liquor Fund to the 2016 General Fund. Exact dollars will be determined and published at next regular council meeting. All members voted aye, motion carried. Motion by Dessler, second by Jenson to write-off two bad checks issued to the Gary Liquor Store in 2014 on closed accounts after other methods of collection had failed. One check was from Christopher Maeyaert for $300.00 and the other one from Eric Windingstad for $14.25. All members voted aye, motion carried. Motion by Bekaert, second by Darwyn Engesser to pass and adopt the following Resolution #2016- 01, Wages & Salaries. RESOLUTION 2016-01

BE IT RESOLVED BY The City Council of the City of Gary, South Dakota: Whereas, The City Council must establish and publish salaries of all officers and employees in the minutes of the first meeting of the beginning of the fiscal year under section of (SDCL 6-1-10). Michael Nosbush - Street & Water Supt. - $3,728.33 per month and attend meetings. Shirley Pederson - $20.21 per hour. Jeff Engesser-Mayor - $100 per month/regular meeting. Aldermen: Robert Engeseth, Albert Bekaert, Mary Peterson, John Jenson, Darwyn Engesser, Clark Dessler - $50 per regular meeting. Mayor, Aldermen, and Finance Officer - $25 per special meeting Vera Meyer – Librarian - $10.82 per hour Marion Denekamp – part-time internal control - $19.67 Jim Keimig - Seasonal Employee-$11.65 Robert Wynn - Part time Landfill Operator - $11.65 per hour Maita Mueller - Janitor/bathrooms@City park, ball fields, cemetery, golf course, Community Center - $11.26 per hour Robin Lanners - Liquor Store Manager - $17.63 per hour Rachel Bindert - Full time Liquor Store Employee-$13.01 per hour. All members voted aye, motion carried. Employee Christmas Party will be held Sunday, January 3, 2016 at the 109 Club, catered by Rob Deslauriers beginning at 6 p.m. Motion by Jenson, second by Darwyn Engesser to allow 109 Club to be open Sunday evening, January 3, 2016. All members voted aye, motion carried. Motion by Dessler, second by Bekaert to approve a building permit for Jeff Nordseth to build a new home on his property at 1322 Lac Qui Parle St. All members voted aye, motion carried. Motion by Dessler, second by Jenson to have Mike check with Robin and if they feel a larger battery back-up for the security system is needed, to go ahead and get one. All members voted aye, motion carried. The next regular council meeting will be Monday, February 1, 2016, at 7:30 p.m. at the Gary City Hall. Motion by Darwyn Engesser, second by Dessler to adjourn. All members voted aye, motion carried.
