RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2007-00672 INDEX CODE: 107.00 COUNSEL: NONE HEARING DESIRED: NO MANDATORY COMPLETION DATE: 4 SEPTEMBER 2008 ______APPLICANT REQUESTS THAT: His records be corrected to show that he was awarded the Air Medal (AM) w/7 Oak Leaf Clusters and the Korean Service Medal (KSM) w/6 Battle Stars. ______APPLICANT CONTENDS THAT: He was in receipt of a DD 214 circa 1954 which indicated his correct medals; however, he no longer has it. His records were destroyed by fire in 1973 at the Records Center in St Louis. He flew 73 combat sorties and the policy at that time was to award an AM for every 10 sorties flown. His eighth AM was for a dangerous pickup behind enemy lines while under fire. He is not alleging an injustice but wants his record to be accurate, as a matter of principle. In support of the application, the applicant submits his personal statement, a copy of his discharge certificate, and a copy of his DD 214. The applicant's complete submission, with attachments, is at Exhibit A. ______STATEMENT OF FACTS: The applicant’s military personnel records were destroyed by fire in 1973. Therefore, the facts surrounding his Air Force military service cannot be fully verified. The following is the only known information concerning his service and was extracted from separation documents submitted by the applicant.

He was honorably discharged in the grade of staff sergeant on 1 Aug 52. He served 4 years, 9 months and 2 days on active duty to include 2 years 4 months and 17 days of Foreign Service.

______2 AIR FORCE EVALUATION: NO AIR STAFF ADVISORY (Exhibit B). ______THE BOARD CONCLUDES THAT:

1. The applicant has exhausted all remedies provided by existing law or regulations.

2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file.

3. Insufficient relevant evidence has been presented to demonstrate the existence of error or injustice concerning the above requested medals. Other than his own assertions, the applicant has provided no documentary evidence that would establish his entitlement to these additional devices. While we appreciate and honor the applicant’s service to his country, in view of the above and in the absence of evidence by the applicant showing his entitlement to the awards, we have no basis on which to favorably consider this request. ______

THE BOARD DETERMINES THAT:

The applicant be notified that the evidence presented did not demonstrate the existence of material error or injustice; that the application was denied without a personal appearance; and that the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application. ______The following members of the Board considered this application in Executive Session on 17 Apr 07, under the provisions of AFI 36-2603:
