1. This permit was applied for a residential crisis bed/aftercare in the R-55 Zone. The site has an approved 23x25 2-story residential addition permit application number 19828-2006-RGUW. Update the site plan to show this addition. 9/8/10 - Never did the work per Mr. Ijomah.

2. Provide documentation regarding the day-to-day operation of this use so the correct use can be determined. Include the number of people who will be living in this dwelling and the duration of their stay. “Residential Crisis Beds” is not listed the Residential Table of Uses in the R-55 Zone. Below are uses that are listed in the Ordinance that may fit your proposed use. Prior permit 26818-2006-CU/01 was placed on hold for the same comments. Prior comments were faxed to Ben Ijomah on 11/6/06. Further review and comments may be generated when the appropriate information has been submitted.

Section 27-107.01(54) Congregate Living Facility: A residential facility for four (4) to twenty (20) elderly or physically handicapped residents, within which sheltered care services are provided, which may include, but need not be limited to, living and sleeping facilities, meal preparation, laundry services, housekeeping, personal observation and direction in the activities of daily living, transportation for routine social and medical appointments, and the availability of a responsible adult for companionship or nonclinical counseling. The term shall not include an "Adult Day Care Center," "Hospital," "Nursing or Care Home," "Family," or "Group Residential Facility," as defined elsewhere in this Subtitle. A Congregate Living Facility shall comply with the licensing and other regulatory requirements of Subtitle 12, Division 7, of this Code. Permitted for not more than 8 elderly or physically handicapped residents in the R-55 Zone.

(7) Adult Day Care Center: An establishment in which a program is operated that is designed to provide care and activities (during the daytime) for five (5) or more adults (unrelated to the operator by blood, adoption, or marriage) who are members of a service population that, because of advanced age, or emotional, mental, physical, familial, or social conditions, need assistance in daytime activities. (109) Group Residential Facility: (A) A "Dwelling Unit" or "Foster Home," operated by a responsible individual or organization, which has a program designed to provide a supportive living arrangement for five (5) or more individuals (unrelated to the operator by blood, adoption, or marriage) who are members of a service population that, because of age or emotional, mental, physical, familial, or social conditions, needs supervision. (B) This term includes, facilities for developmentally disabled persons, drug dependent persons, alcoholic persons, juveniles, or persons whose welfare and adjustment within the community are dependent on support from the community. (C) The term does not include: (i) A "Foster Home" where there are four (4) or less persons unrelated by blood, adoption, or marriage to their foster parents; (ii) A "Foster Home" where there are not more than six (6) foster children who are unrelated to their foster parents, but are related by blood or marriage to each other; (iii) A "Hospital" or "Nursing or Care Home"; (iv) A "Congregate Living Facility"; or (v) An "Adult Day Care Center." (D) A "Group Residential Facility" for the "mentally handicapped" for up to eight (8) residents shall be considered a "One-family Detached Dwelling." (E) When a "Group Residential Facility" is limited to serving a "mentally handicapped" population, this term shall include any individual with a primary disability as a result of mental retardation, mental illness, or mental disorder which impairs the person's cognitive ability to live independently (excluding addictive disorders resulting from substance abuse). Permitted for not more than 8 mentally handicapped dependent persons in the R-55 Zone.

(193) Recreational Program, Before- and After-School: Supervised recreation (not operated by a public agency) for children (five (5) to sixteen (16) years of age) during regularly scheduled periods not exceeding two (2) hours daily before school classes begin and four (4) hours daily after the normal school closing time, which is operated in a community-oriented facility, such as a "Church," service club, school, or civic association "Building." Permitted in the R-55 Zone.

9/8/10 – The applicant would like to have a permit where once his congregate living residents are released they are able to come back to this facility and get follow-up doctor visits. I asked the applicant to return to the permits office and revise his permit to Professional Dr. Office. It will be reviewed and additional comments will be sent to him. 9/16/10 - This permit application has been revised to a professional office. The applicant currently has a certificate of occupancy for a congregate living facility for 5 residents 7769-2007-U issued 6/26/07. He would like to have prior patients that are no longer a part of the congregate living facility come back to this location for follow-up doctor visits.

1. The permit application states that the proposed use is a professional office within a single- family dwelling. This property is located in the R-55 Zone. Accountants, architects, clergymen, engineers, lawyers, medical practitioners, and similar recognized and learned professions, as an accessory use in a dwelling is permitted in the R-55 Zone subject to certain requirements. Is the applicant a licensed physician, psychiatrist, or a person in a similar profession?

2. Notes must be placed on the site plan that demonstrate compliance to Section 27-441(b), footnote 19 of the Prince George’s County Zoning Ordinance which states the following: (A) The use is limited to (1) bona fide resident of the dwelling: (B) Not more than two (2) nonresident, nonprofessional assistants may be employed: (C) Professional consultation at a professional’s dwelling with a visiting consultant, or the employment of an alternate professional in the event of the death, disability, illness, temporary absence, or vacation of the resident professional is allowed: (D) The use shall not alter the residential character or appearance of the premises; and (E) The use shall not occupy more than fifty percent (50%) of the gross floor area of the dwelling.

3. The site plan submitted is a location drawing and demonstrates no compliance with zoning regulations. A site and landscape plan must be submitted that demonstrate all required parking spaces, landscaping, and the area of the dwelling that will be used for the professional medical practice.

4. A parking schedule must be placed on the site plan that demonstrates the required and provided parking spaces for the medical office, and the dwelling. The parking for the medical office must be calculated at 1 parking space required for every 100 square feet of area that will be used for the medical practice. The parking required for the dwelling depends on what year the dwelling was constructed. The sizes and types of parking spaces provided must be indicated on the parking schedule.

5. Per A.D.A regulations 1-parking space for the physically handicapped must be provided dimensioned at 16 feet in width by 19 feet in length. Parking and loading spaces must be clearly delineated on the site plan and dimensioned.

6. All adjacent uses and zones must be indicated on the site plan to determine the applicability of Section 4.7 of the Prince George’s County Landscape Manual.

7. Landscape schedules must be provided on the site plan in accordance with Section 2.2(c) of the Prince George’s County Landscape Manual.

8. is authorized by the state to prepare landscape plans in accordance with Section 2.1 of the Prince George’s County Landscape Manual.

9. A plant list must be placed on the site plan in accordance with Section 2.2 of the Prince George’s County Landscape Manual.

10. The right-of-way width and centerline of 69th Avenue must be demonstrated.

11. The zoning of the subject property should be indicated on the site plan.

12. The height, type and location of all fences must be clearly demonstrated on the site plan.

13. Please demonstrate on the site plan where any ramps/drop curbs or other means of access into the building is provided for the physically handicapped.

14. If all the required parking spaces can be demonstrated on the existing paving, and no additional paving or parking area is required to be constructed, the parking compound does not have to meet the requirements of Part 11 of the Prince George’s County Zoning Ordinance. However, all the required parking spaces have to be clearly delineated on the site plan, and these spaces can not be “piggy backed”.

15. If the dwelling was constructed prior to October 1970, the parking spaces can be demonstrated at 10-feet in width by 20-feet in length. If the dwelling was constructed after October 1970, the parking spaces can be demonstrated at 9-1/2 feet in width by 19-feet in length.

I instructed him to go to the permits office and apply for a new permit. A congregate living facility for not more than 8 elderly or physically handicapped residents is permitted in the R-55 Zone.
