Minutes of Fairview City Planning Commission meeting, Thursday, June 9, 2016 Minutes of Fairview City Planning Commission Meeting held on Thursday, June 9, 2016, at 7:30 p.m. at 85 South State Street, City of Fairview, County of Sanpete, State of Utah. Present were Alyson Lee, Mike Jarman, Kyle Durrant, Evelyn Morris, and Dave McFarland. City employees present were Dave Taylor and Jan Anderson. Citizens present were Jared Livingston, Rae Lohmeyer, Kimberly Jackman, and Chris DeRosier. Chair Alyson Lee called the meeting to order at 7:37 p.m. The invocation was offered by Dave McFarland.

Approval of Minutes. Minutes from May 12, 2016, was approved by Member Mike Jarman with the second by Member Evelyn Morris. The voting was unanimous in favor of.’

Appearances. Business Approval – Jared Livingston. Mr. Livingston would like to put in resale/drink shop. The location is 45 East 300 North, the same property as his storage units across the street from Big Pine Sports. The building will be 14’x22’, it will have a bathroom but not for public use. All the utilities are there to the property. The placement of the building is on the southeast corner just off the storage building edge. Access is off 300 North. Five cars can fit from serving window to the road. Most of the people Mr. Livingston has talked with stated they would rather have the cars pull in on 89 than come on to 89. He has not established a name as-of-yet. He was asked if he would sell homemade treats. The food will be prepared cottage style. He was asked about the trailers that he sells that have been on the property. They have been moved over to Big Pine Sports. He was asked if he had thought about duel drive throughs. He has, but the City would have to allow him to do that because, somewhere on the property, people need to be able to turn their vehicle around—cannot turn around in the middle of the block. He will have entrance and exit signs. It was asked if there would be any issue with people trying to get into their storage shed. There may be one person a week who will come to their storage unit. He eventually wants to asphalt this area. He plans on 10- to 12-youth employees. There will be three shifts. Minimum of two employees there at a time and no more than three. It will be opened year-round. He was asked if he could move any further to the south, the answer was the ordinance does not allow him to do that. He was asked if he had any plans to go mobile. He may want to sell at activities such as the 24th of July. Commission Member Evelyn Morris moved to pass this on to the city council for their approval. Commission member seconded the motion. The voting was unanimous in favor of. Chris DeRosier Business Approval. Mr. DeRosier is trying to get funding for opening an auto parts store. He is hoping to get into Katie Shell’s building, 111 South State. He asked if the Planning Commission knew of any grants he may apply for. He was encouraged to visit with the banks to see if about their financing. Councilman Bob St. Jacques stated he would look into getting some information for him. He wanted to know if the Planning Commission and City would support him in this endeavor. The Commission thought it would be a great idea. He asked about parking. There should not be an issue with parking. -2-

Planning Commission Reports. Commission Chair Alyson Lee asked (1) if the City Council had come back with their thoughts on the definitions, it was stated that they were still looking at them. And, (2) what happened with the pond at the Sawmill Subdivision. Dave Taylor is looking into doing a survey. Mike Jarman asked if the sign on the Shawn Harper property will ever be moved. Dave talked to him a couple weeks back, and he said he would get it moved. If not, then Dave will step in and have it moved. Another concern-- property that abuts the city road, whose responsible for mowing the grass, the property owners or the City. Technically it is a City easement-- shouldn’t they be the ones that mow it. The City does not have the manpower nor the equipment to do it-- hopefully the citizens are able to help out. It was suggested that he talk to the councilman over streets. Councilman Bob St. Jacques stated that the ground is uneven next to the road. He has ruined three mower blades. It would be nice if a backhoe could go and back drag around the corners. One other concern, shipping containers or storage containers were accepted in the old ordinance are they covered in the new zoning book. No, we will need to get verbiage to amend the ordinance. If the container is within the eight-feet, then citizens can have them because they are moveable. Councilman Bob St. Jacques mentioned that there is Land Use 101 meeting this Saturday. What is the rule regarding yard sales? A citizen can have up to three yard sales if they have more than three, they are in violation and must come before the Planning Commission and City Council for a business license. City Planner Dave Taylor asked the Commission to remember the 24th of July. Their help could be used in taking tickets during the events, etc. Burning season is closed, it will open again November 1, 2016.

Adjournment. Commission Member Evelyn Morris moved to adjourn the meeting at 8:27 p.m. Commission Member Mike Jarman seconded the motion.
