REFERENCE: The Soldier Marathon, Soldier Half Marathon, Soldier Relay Marathon, Soldier 5K Race or Kids Soldier Marathon starting and finishing at the National Infantry Museum and running on Ft. Benning, Georgia and Columbus, Georgia and Phenix City, Alabama on Friday, November 17, 2017 or November 18, 2017 (collectively the “2017 Soldier Marathon Races”).

I, ______(Name of registered runner) desire to access Ft. Benning for the purpose of participating in the 2017 Soldier Marathon Races on the installation on 17 November 2017 or 18 November 2017. Therefore, in consideration for the benefit to me participating in this event, I agree to release and hold harmless the United States from any damages to property or injuries which I may suffer incident to my participation. (or) I, the parent or guardian of ______(Name of runner who is a dependent or minor) desire to have said dependent or minor participate in the 2017 Soldier Marathon Races on the installation on 17 November 2017 or 18 November 2017 Therefore, in consideration for the benefit of having said dependent or minor participate in the event, I agree to release and hold harmless the United States from any damages to property or injuries which said dependent or minor may suffer incident to his/her participation.

Specifically, I agree to release and hold harmless the United States, its officers and its agents, from any and all liability and claims for damages to property or injuries to myself or to said dependent or minor that may arise or be incident to my or his/her participation in the Soldier Marathon Races. I agree to release and hold harmless the United States, its officers and its agents, against any claims, demands, actions, debts, liabilities, judgments, costs, or attorney’s fees arising out of, claimed on account of, or in any manner predicated upon the use of Fort Benning facilities and/or equipment including any loss or damage contributed to by the United States, its officers, or its agents.

Also in consideration of my benefit or the benefit of said dependent or minor to participate in the 2017 Soldier Marathon Races, I hereby agree to release and hold harmless the United States, Columbus, Georgia, Phenix City, Alabama, the Columbus Parks and Recreation, the Soldier Marathon and Half Marathon, the Soldier Relay Marathon, the Soldier 5K Race, the Kids Soldier Marathon, Soldier Marathon, Inc., the Race Director, all members of the Race Committee of the Soldier Marathon Races, the National Infantry Museum and Soldier Center, the National Infantry Foundation, Inc., the House of Heroes, Inc., the Columbus Roadrunners, Inc., Road Runners Club of America, Inc., and all volunteers, officers, employees, departments, sponsors and agents of any of the above, USA Track & Field, Inc. and its employees, directors, assigns and USATF Certified Officials (collectively the “Released Parties”) from any damages to property or injuries or death to my person or to said minor or dependent which I or said minor or dependent may suffer incident to my or his/ her participation in the 2017 Soldier Marathon Races, or from and against any claim, demand, action, debt, liability, judgment, cost or attorney’s fee arising out of or claimed on account of my or said minor’s/dependent’s participation in the 2017 Soldier Marathon Races, or use of facilities or equipment of any of the Released Parties. I also covenant not to sue any or all of the Released Parties for any injury, liability or claim for damages to property or injury or death to me or to said minor or dependent that may arise from or be incident to my or his/her participation in the 2017 Soldier Marathon Races. I understand there are risks in running a long distance marathon or half marathon and I declare that I have trained or that said dependent or minor has trained and am or he/she is in physical condition to participate in the 2017 Soldier Marathon Races. BY SIGNING, I DECLARE THAT I HAVE READ AND VOLUNTARILY ENTER INTO THE TERMS OF THIS WAIVER AND HOLD HARMLESS AGREEMENT AND COVENANT NOT TO SUE.
