Tender Bid Document For Providing & Fixing Of Sparkle Filter Press, Schedule -10 SS304 Piping work & 40 micron SS 304 Mesh cover for Gravity Filetrs of Honey Processing Plant

1 TERMS & CONDITIONS

1.0 Providing & Fixing of Sparkle Filter Press, Schedule -10 SS304 Piping work for joining Honey filling line to Sparkle Filter press & Jar Filling machine & 40 micron SS 304 Mesh covers for Gravity Filters for Honey processing. i. All the Auxiliary and Complementary components and interconnections for the said Process Plant Machinery/ Equipments under reference like nozzles, flanges, counter flanges, vents, safety valves, etc. ii Commissioning of the machinery/equipment under reference. iii To offer continued technical backup for maintenance iv To offer guarantees for the technical quality of the MOC and fabrication quality of the supplied machinery/equipment and its performance by way of Performance Guarantee.

2.0 Scope of Work

The vendor's scope of work shall cover Providing & Fixing of Sparkle Filter Press, Schedule -10 SS304 Piping work for joining Honey filling line to Sparkle Filter press & Jar filling machine & 40 micron SS 304 Mesh covers for Gravity Filters for Honey processing plant within the battery limits AS QUOTED FOR on Turn-key basis & the vendor should/shall visit the site to study the work to be executed at site.

3.0 BASIC DATA FOR SYSTEM DESIGN, ENGINEERING AND JOB SPECIFICATIONS

3.1 The following general considerations have to be kept in view for all items for selection and procurement of equipment & auxiliary components: i. Fabrication Quality & Standards and Reliability in service ii. Compliance with standard national and international codes and standards as well as the statutory regulations in existence for the machinery/equipment/system and components of supply. iii. Ease of operation, repairs and maintenance including any necessary measures for ensuring safety of personnel and equipment. iv. Standardization of components like nozzles, flanges, Bends, safety valves and vents etc. wherever feasible. v. Post erection and commissioning, service support for a minimum period of 2 years including replacement parts/components required to be replaced for any

2 manufacturing defect. However, this will not include any consequential damage due to misuse, mishandling and/or sabotage.

3.2 CODES AND STANDARDS

Codes and standards to be followed for equipment fabrication shall meet the requirements of the BIS / ASME/ DIN Standards.

4.0 Other Technical Aspects

The vendor will address on the following technical issues or provide technical assistance to enable the procurement & installation locally. i) The machinery/equipment/system should be compatible to internationally acceptable process and design parameters and finishes, match the desired quality of fabrication and be capable of receiving FDA approvals. ii) Utility / Energy saving/conservation systems should be incorporated wherever possible.

5.0 GENERAL SPECIFICATIONS

The machinery/equipment/system shall conform to high standards applicable for engineering and workmanship of such equipments and shall be suitable for continuous round the clock operation if needed.

5.1 Inspection & Testing

MARKFED reserves the right to carry out the testing/appraisal of Machinery, Material & Equipment after the receiving of same at the MARKFED site.

5.2 Controls

Controls if any shall be of reputed makes and compliant to meet international standards for construction and safety. All machines / systems should have easy operating emergency stop switch.

5.3 INSPECTION

3 The inspections shall be carried out by a representative of Markfed. Scope of work for inspection shall include but not be limited to:

a) Markfed reserves the right for Identification of raw material w.r.t test certificates from any of the Accredited lab.

b) Verification of welding procedures.

c) Inspection of Welding & Fabrication.

d) Final dimensional checks.

e) Hydraulic & pneumatic tests in presence of Markfed representative

f) Any other item of inspection not covered but required as per statutory requirement/safety protocols etc

5.3.1 MARKFED shall have the right to inspect the components equipment/Machines at all stages of commissioning to confirm their conformity to contract specifications at no extra cost to the Markfed.

5.3.2 Should any inspected or tested goods failed to confirm to the specifications, Markfed may reject the goods and the supplier shall either replace the rejected goods or make alterations necessary to meet specification requirements free of cost to the purchaser.

5.3.3 MARKFED will reserve the right to inspect, test and where necessary, reject the goods after the good’s arrival at project site if they fail any tests or not match the specifications as mentioned in the tender”

5.3.4 Test Certificates, Manuals and drawings shall only be in English.

5.3.5 Unless and otherwise agreed, goods and equipment shall be considered to be completed for the purpose of taking over until such documents and Drawings have been supplied to Markfed.

5.4 MANUFACTURING GUARANTEE

The equipment supplied by the vendor shall be strictly in accordance with the specifications laid down in the purchase order and following instructions verbal/written. The vendor has to secure guarantees of the suppliers of the bought out equipments/components. The vendor has to provide a guarantee and free service for a period of 2 years.

6.0 ERECTION & COMMISSIONING

4 i. The Vendor shall be responsible for complete assembly of the process plant machinery /equipment supplied as per the order, and includes connection of utilities and drains wherever required complete in all respects.

ii. Vendor shall be responsible for pressure testing at works as well as site and commissioning. Hydrostatic pressure testing as per appropriate standards (ASME etc.) before commissioning & full load testing for a period of 30 days after commissioning iii. The performance of the equipment / plant & machinery shall be ascertained on the basis of the non-stop operation of the unit for at least 30 days after commissioning. iv. Vendor will impart training to the MARKFED personnel on operation, periodic, maintenance, cleaning, etc.

7.0 FACILITIES PROVIDED

i. MARFKED will only provide the free supply of water and electricity during erection, testing and commissioning whereas all the welding equipment, grinding wheels & cutters, labor & all other machinery/equipment required to complete the work in all aspects shall be in scope of tenderer. .

5 TECHNICAL SPECIFICATIONS

All connected parts and non- connected parts in SS- 304 with filtering area 3.43Sqm with capacity 6500lts/hr including complete A assembly with pumps and trolley with the bottle filling line including the cost of SS nut bolts, bends, washers, valves, motors, loading, unloading, carriage, welding, grinding etc complete in all respects to the entire satisfaction of Engineer-in-Charge.

Providing and fixing Schedule -10 SS 304 pipe line (80NB), SS Flange, SS Blind Flanges, SS matching flanges, SS Bend, SS valves, SS Tee, SS Nuts B & Bolts, Gaskets, Nipples etc. for joining the Honey filling line to sparkle filter press & jar filling line, loading, unloading, carriage, welding, grinding complete in all respects to the entire satisfaction of Engineer-in-charge.

Providing and fixing frame made of SS-304 and fixed with SS mesh of 40 micron on this frame including cost of SS nut bolts, washers, loading, C unloading, carriage, welding, grinding etc. complete in all respects to the entire satisfaction of Engineer-in-Charge.

2. Scope of Supply

i) Designing, fabrication, Sourcing, Manufacturing, Delivery shall be on turnkey basis ii) Testing and Commissioning iii) Imparting Training to the Operators at site on Start-up, Operation, Cleaning, Maintenance and critical control

3. Documentation

The vendor shall be obliged to submit all the following technical documents

i) Test Certificates for Materials of Construction ii) Cleaning and Maintenance Manual iii) Operational Manual

6 INSTRUCTIONS FOR COMMERCIAL BID

1.0 BIDDING DOCUMENT

1.1 The bidder is expected to examine the Bidding Document, including all instructions, forms, terms, specifications and other documents and requirements of the Bidding Document. Failure to furnish all information required by the Bidding Document or submission of a bid not substantially responsive to the Bidding Document in every respect may result in the rejection of the Bid.

1.2 Tenderers are advised to visit e-Tendering portal etender.punjabgovt.gov.in for details. For participating in the above E-tendering process, the tenderers shall have to get themselves registered with etender.punjabgovt.gov.in and get user ID, password. Class-3 digital signatures are mandatory to participate in the E-tendering process.

2.0 LANGUAGE OF BIDS

The Bid prepared by the bidder, all correspondence and documents relating to the bid exchanged by the bidder and the MARKFED, shall be written in English language only. Any printed literature furnished by the bidder may be written in another language provided that this literature is accompanied by an authenticated English translation, in which case, for purpose of interpretation of the Bid, the English translation shall govern.

3.0 PREPARATION/SUBMISSION OF BIDS

3.1 The Bid shall be submitted in two parts viz. Technical Bid & Financial Bid

PART - 1 : Technical Bid:

3.1.1 Filling of techno commercial/ unpriced bid: The vendor shall fill the technical bid proforma in prescribed format as mentioned in Tender & shall submit the self- attested/ duly signed scanned copies of the documents as mentioned.

PART - 2 : Financial Bid: 7 3.2 The vendor shall fill the financial bid proforma in prescribed format as mentioned in tender & the price quoted should be all inclusive in nature on F.O.R Site basis including cost of the all components of the Sparkle Filter press, Schedule -10 SS304 Pipe line & 40 micron SS304 Mesh cover, auxiliary and complementary equipment, packing and forwarding, carriage, insurance and freight, supervision of erection, testing and commissioning and all taxes as applicable.

4.0 NON- INVOLVEMENT OF AGENT:

Each bidder is required to submit along with his bid, a declaration as per that 'no agent is involved in the transaction, only exclusive representatives of the bidders shall be involved. Supporting documents should be submitted along with the bid.

5.0 EARNEST MONEY

5.1 Each bidder shall, as part of its Bid will furnish Earnest Money for an amount of Rs.20,000 ( Rupees Twenty Thousand Only) online/E-payment mode only.

5.2 The earnest money of unsuccessful bidders will be returned, as per terms of E- Tendering on award of CONTRACT to the successful bidder. The successful bidder's earnest money shall be discharged or returned upon furnishing of the Performance Bank Guarantee.

5.3 The Earnest Money will be forfeited:

(a) If a bidder withdraws its bid during the period of Bid validity. Or

(b) If a bidder modifies his bid during the period of Bid Validity after award.

(c) In case of a successful bidder, if the bidder fails, within the specified period:

(i) To furnish the Bank guarantee, no interest shall be payable by MARKFED on the earnest money.

6.0 PERIOD OF VALIDITY OF BIDS

6.1 Bids shall remain valid for 2 (two) months after the deadline for bid submission as specified in Invitation for Bid. A bid valid for a shorter period shall be rejected by the MARKFED as non-responsive.

6.2 Notwithstanding the above, the MARKFED may solicit the bidder's consent to a further extension of the period of bid validity. The request and the responses thereto shall be made in writing.

6.3 If the bidder agrees to the extension request, the validity of the earnest money shall also be suitably extended.

6.4 A bidder accepting the request for extension shall not be permitted to modify its bid because of the extension, unless specifically invited to do so.

7.0 NUMBER OF BIDS: 8 7.1 A bidder shall on no account submit more than one bid either directly or indirectly. However, bidder has to submit bid for Providing & Fixing of Sparkle Filter Press, Schedule -10 SS304 Piping work for joining Honey Filling line to Sparkle Filter press & Jar filling machine & 40 micron SS 304 Mesh covers on Turn-key basis compulsorily.

8.0 FORMAT AND SIGNING OF BID

8.1 The E-tender bids shall be submitted by the tenderers in two parts i.e. one containing ‘Technical Bid’ and the other containing ‘Financial Bid’. The earnest money of Rs. 20,000/- deposited online /E-payment mode only.

8.2 The original e-bid documents and all copies of the bid shall be typed or written in indelible ink and shall be signed by the bidder or a person or persons duly authorized to sign on behalf of the bidder. Power of Attorney authorizing the person/bidder duly supported by valid documents be attached.

9.0 DEADLINE FOR SUBMISSION OF BIDS

9.1 The Original bid, together with required copies must be submitted on e-Tendering portal etender.punjabgovt.gov.in on or before the date and time as specified in the Invitation for Bid.

9.2 The MARKFED may, at its discretion, extend the deadline for the submission of bids by amending the Bidding Document, in which case all rights and obligations of the MARKFED and bidders previously subject to the deadline, will thereafter be subject to the deadline as extended.

10.0 ALL PAGES OF TERMS & CONDITIONS TO BE SIGNED ALONG WITH STAMP

10.1 All the documents to be submitted shall be signed, dated and shall bear a stamp of the bidder.

9 11.0 PRICES TO BE IN FIGURES AND WORDS

11.1 The bidder shall fill the prices both in figures as well as in words in the Price Schedule forming part of the E-Bidding Document, in such a way that interpolation is not possible.

12.0 CORRECTIONS AND ERASERS

No erasers or overwriting and application of white fluid are permissible.

13.0 MARKFED 'S RIGHT TO ACCEPT/ REJECT BIDS

13.1 MARKFED reserves the right to accept or reject any bid and to annul the bidding process and reject all bids at any time prior to award of Contract without thereby incurring any liability to the affected bidder(s) or any obligation to inform the affected bidder(s) of the ground of MARKFED’s action.

13.2 Any deviations or stipulations made and accepted by the MARKFED after acceptance of the bid shall be treated as amendment(s) to the CONTRACT and shall be governed by the conditions relating to amendment of CONTRACT.

14.0 MODE OF PAYMENT

The mode of payment shall be as under: i. The tenderer has to submit a Bank Guarantee of 20% of the quoted amount in Tender from a scheduled bank as security at the time of agreement valid for a period of three months. ii. 50 % payment shall be released after receiving the Complete Material/Machinery/Equipment at Markfed Canneries site (Vill: Chuharwali, Jalandhar). iii. 30% payment shall be released after completion & fixing of all the Machinery & Equipment as per specifications & to the entire satisfaction of Engineer-in-charge. iv. Balance 20% within 90 days of commercial production or within 120 days of successful commissioning whichever is earlier against a performance bank guarantee for equivalent value from a scheduled bank valid for a period of two years. v. The payment of GST amount shall be released to the supplier only when the input credit is made available in the GST portal to the Markfed.

15.0 AGREEMENT

10 i. Signatures on the terms & conditions shall form a legal document for all intents & purposes & no separate agreement needs to be signed.

16.0 Conditional tender will be rejected.

17.0 Corrigendum/Addendum/Corrections if any will be published on the website.

18.0 The department shall not be responsible if it is not possible to upload/submit the tender online due to any fault or malfunctioning of the internet/e-tender site.

19.0 If the date of opening of tender happens to be holiday then the tender will be opened on the next working days without giving any separate notice.

20.0 DELIVERY i. The goods shall be dispatched F.O.R Site. The invoice, consignment note and other documents necessary shall be made available along with receipt of material at site. ii. The entire job shall have to be completed and handed over to MARKFED within stipulated time period fixed after the date of issue of work order or as agreed upon in writing. The period of completion cannot be extended on any pretext what-so-ever except under a genuine force majeure clause, or/on sole discretion of MARKFED.

21.0 PENALTY

For any delay in delivery and completion beyond the scheduled date as agreed upon, the vendor shall be liable to pay a penalty of 1% of the order value every week, subject to maximum of 10 %. The delay beyond which would result in cancellation of order and revoking of Bank Guarantees.

22.0 Resolution of dispute:

In case of any dispute, the matter shall be referred to Managing Director, Markfed Chandigarh for arbitration who will engage himself or appoint his nominee whose decision shall be final and binding on both the parties.
