1. Boat owner agrees that Lighthouse Marina has not made any warranty or representation as to the fitness of the facilities as to the use for which they were designed and provided. Boat owner agrees that Lighthouse Marina is not responsible for any injury or damage, or loss of equipment, to the vessel, the boat owner or his guests, servants, agents or representative, from whatever cause. The boat owner agrees to save harmless, protect and indemnify Lighthouse Marina from and against any and all losses, costs, damages, claims, suits, actions at law and judgments, including attorney's fees, which may arise or grow out of any injury to, or death of, persons, damages to property or any other matter or thing, caused by acts of God, fire, windstorm, explosion, flood, burglary, theft or by any other casualty. It is the intent of Lighthouse Marina and boat owner that only a lease is created hereby, revocable at the will of Lighthouse Marina; no bailment is created. Lighthouse Marina does not assume expressly or implied any duty or responsibility regarding the care or control of the boat owner's boat.

2. The boat owner shall be responsible for the watertight integrity of his/her boat immediately upon launching and thereafter shall also be responsible for care of his/her boat. 3. Boats not launched by June 1 will be charged $75.00 weekly. 4. All storage batteries must be removed from the boat. 5. Use of open flame touches or flammable removers is prohibited.

6. Boat owner shall have on file with Lighthouse Marina a copy of the boat owner’s boat insurance outlining both the property coverages and the general liability coverages afforded by the policy. 7. Due to DEM & EPA regulations pressure washing of boat bottoms is forbidden on the marina property.

8. Storage charges and all other fees are due when billed. Interest of 1-1/2% per month is made on any account past due. No boat is launched until all charges are paid. Should it become necessary to collect any amounts due hereunder by legal process, including referral to an attorney for collection, the buyer will pay all costs incurred, including reasonable attorney's fees.

9. Boat owner agrees that Lighthouse Marina shall have a security interest in, and a lien upon, the vessel for any and all monies due to Lighthouse Marina which are then outstanding. “Owner shall also BEWARE--THE VESSEL AND ITS CONTENTS MAY BE SOLD AT PUBLIC AUCTION FOR FAILURE TO PAY STORAGE CHARGES.” Lien and/or security interest may be enforced by sale of the vessel in accordance with procedures set forth in Title 34, Chapter 35, of the General Laws of the State of Rhode Island and Providence Plantations of 1956, and any amendments thereto, or in accordance with the procedures set forth in Title 6A, Chapter 9 of the General Laws of the State of Rhode Island and Providence Plantations and any amendments thereto.
