REQUEST FOR REVIEW UNDER THE FREEDOM OF INFORMATION (SCOTLAND) ACT 2002 (“THE ACT”)

I refer to your recent request for review which was received by Glasgow City Council (“the Council”) on 4 March 2013.

YOUR REQUEST

In your initial request dated 4 February 2013, you requested the following information:

"I request a copy of the current Joint Memorandum of Understanding between Glasgow City Council and the Glasgow Chamber of Commerce"

THE DECISION

A decision letter was sent to you on 4 March 2013 from Gerry Sheridan, Development and Regeneration Services advising that the Council considered the information that you had requested to be commercially sensitive and, as such, deemed that the information was exempt under Section 33(1)(b) of the Freedom of Information (Scotland) Act 2002 (“the Act”).

THE REVIEW

In your letter received by the Council on 4 March 2013 you sought a review of the Council's decision on the basis that you were dissatisfied with the response provided.

THE REVIEW DECISION

I have now reviewed Mr Sheridan's decision as outlined above and in response to your request I can provide you with the Joint Memorandum between Glasgow and the Chamber of Commerce which I have attached to this letter. Please note that the signatures of the George Black (on behalf of the Council) and the signatory for the Chamber of Commerce have been redacted from the version supplied. We consider these signatures to constitute personal data and that disclosure of them would breach the data protection principles laid out in the Data Protection Act 1998. The information comprising these signatures is therefore exempt from release under FOI as a result of the exemption contained in section 38(1)(b) of the Freedom of Information (Scotland) Act 2012. The copy of the Memorandum attached is complete apart from these signatures.

APPEAL OF THE REVIEW DECISION

If you are not satisfied with the response to your request in terms of the Freedom of Information (Scotland) Act 2002 then you have a right to make an application within 6 months
