Contract for 7th Annual NMT Socorro Mud Bog

The following is a contract between New Mexico Tech (NMT) and the NMT Mud Bog Organizers for the use of bleachers owned by NMT. The New Mexico Tech Automotive Racing Club and the New Mexico Tech Off-Road Club are equal partners in the Mud Bog and equally share the responsibilities of being the Mud Bog Organizers.

The Mud Bog Organizers would like to thank New Mexico Tech for allowing the use of the bleachers at this event.

The Organizers promise that the Organizers or their agents will perform the following tasks:

1) Transport the bleachers from the Original Location to the Event. 2) Assemble and disassemble the bleachers at the Event. 3) Clean the bleachers of any trash or excessive mud. 4) Transport the bleachers to the Original Location before 9am on Monday, April 19th, 2004.

New Mexico Tech promises that:

1) The bleachers will be made available to the Organizers no later than 9am on Thursday, April 16th, 2004. 2) No charge will be incurred to the Organizers or their agents for use of the bleachers.

Additionally, the Organizers and NMT make the following promises relating to the condition of the bleachers.

1) Superficial damage is likely to occur any time these bleachers are in use. This includes, but is not limited to, scrapes, scuffs, and minor dings. NMT will not hold the Organizers responsible for any superficial damage to the bleachers. 2) Any structural damage incurred during the transportation, assembly, use, or disassembly incurred by the event Organizers or their agents will be repaired by the Organizers to the satisfaction of NMT by no later than 60 days after the event. NMT will not hold the Organizers financially responsible for any damage repaired within this time frame. 3) The Mud Bog involves heavy machinery and accidents may happen. In the event that any structural damage is caused to the bleachers by anyone not associated with the Organizers, NMT will not hold the Organizers responsible. The Organizers make the following promises to help insure this type of damage does not happen: a. The bleachers will be placed such that there is little likelihood that any accident during the Event will cause the bleachers to be damaged. b. Only the Organizers and their agents will be responsible for transporting, assembling, and disassembling the bleachers. c. An overnight watch will be kept on the bleachers by the Organizers prior to the Event. 4) The bleachers will be cleaned of any trash and excessive mud before they are returned. NMT understands that a small amount of dirt is incident to transportation and storage of the bleachers and the Organizers will not be held responsible for cleaning this. 5) NMT is welcome to inspect the transportation, assembly, and disassembly of the bleachers. 6) The Organizers will handle the bleachers in good faith.
