Dear leaseholder

Notice of Intention to enter into an agreement to carry out works, where public notice is required, under Section 20 of the Landlord and Tenant Act 1985 ( as amended by the Commonhold and Leasehold Reform Act 2002).

REFURBISHMENT, REPAIR AND IMPROVEMENT WORKS TO THE ASHMOLE ESTATE INCLUDING BLOCKS, COMMUNAL AREAS TO BLOCKS AND EXTERNAL AREAS

Property: All Leaseholder Units – Bannerman House, Claylands Road, Elias Place, Hanover Gardens, Meadow Road, Shrewsbury House, Sirinham Point, Stoddart House, Wisden House, Meadow Road, Ashmole . Metropolitan Housing Trust (MHT) is your landlord and we write in this capacity. It is the intention of MHT to enter into an agreement to carry out the above works. Landlords must serve notice on leaseholders before entering into any works contract, to which each individual contribution towards the costs may exceed £250.00.

Therefore this notice is served on you in accordance with Section 20 of the Landlord and Tenant Act 1985 (as amended by the Commonhold and Leasehold Reform Act 2002).

Description of the Works The works are those outlined in the Formal Consultation Document for Leaseholders (also known as the Leaseholder Offer Document), Section 3C. The works proposed to each section of the estate are listed in the offer document by block, including security and environmental improvements. A copy of the offer document pages which refer to works to your block, and to the whole programme, is enclosed. In general terms the works proposed include security and environmental works, some works to windows and the heating and hot water systems and improvements to some roofs, internal and external areas.

Reason for the Works Residents of Ashmole estate were consulted formally with respect to the proposed works which are outlined in the Formal Consultation Document for Leaseholders. A ballot of residents was held in 2009 and a majority voted to transfer the ownership and management of the estate to MHT. The works set down in the Formal Consultation Document are included in the Transfer Contract between Lambeth Council and Metropolitan Housing Trust, dated 22nd March, 2010. MHT considers it necessary to carry out the works because MHT is obligated under the terms of the Transfer to carry out the works described and the estate will benefit from these works.

Payment Options As advised in the offer document leaseholders who owned their home at the time of the ballot will be charged a maximum of £10,000 for the works included in the initial, six year improvement programme described in the offer document, which will include VAT at the prevailing rate. Leaseholders who did not own their property at the time of the ballot will be charged for their share of the full cost of the works.

MHT will offer leaseholders a range of alternative repayment options to help meet the costs for capital works which leaseholders may be liable for. An information sheet on potential payment options is enclosed.

Is this an Invoice? This is not an invoice. This is a Notice of Intention to notify you that MHT intends to carry out the works. You will be issued with a request for payment once works are completed on your block. Works Programme MHT expects the main contractor to start work on site in the summer of 2011. No leaseholder will be charged for major works prior to this time.

Before works begin on the estate a programme for the works will be issued by MHT. All leaseholders will be notified in writing of the expected date that works will commence on their block.

Making Written Observations MHT invites you to make written observations in relation to the proposals and the proposed works set out in this notice. You are not invited to nominate a person from whom we should try to obtain an estimate for carrying out the works because the proposed works require public advertisement within the European Union and public notice of the works is to be given.

All observations must be received within the consultation period of 30 days from the date of this notice. The date of this notice is Friday 3 September 2010.

The consultation period will end on Monday 4 October, 2010. All observations must be received by 5pm on Monday 4 October, 2010. Any observations received after this will not be considered.
