MINUTES OF THE FREMINGTON PARISH COUNCIL MEETING HELD ON MONDAY JULY 9th 2007 AT FREMINGTON PARISH HALL AT 7.00pm

0707/01 Prayers The Chairman led the Council in prayers.

0707/02 Apologies for Absence Apologies were received from Cllrs Mrs Bennett, Mrs Holland, Hockin, and Jury and County and District Councillor Cann.

0707/03 Declarations of Interest Cllr Mrs McCormack-Hole declared a personal interest in planning application 44489 as a business owner.

0707/04 Chairman’s Announcements The Chairman announced that Fremington School is holding a 50th Birthday Party on Friday 13th July 2007 to which Councillors are invited. Information on a website with topics for Councillors to discuss was given.

0707/05 To agree the agenda between Part A and Part B (confidential information) It was resolved to agree the agenda as published.

0707/06 Police Report The Police gave a report and advised that there had been no major incidents; however there appears to be a spate of arson attacks. It was agreed that the Police would attend alternate full council meetings in person and the other months they would submit a written report. Cllr Harris left the meeting

0707/07 To receive questions and/or deputations or petitions from parishioners. All deputations or petitions to be referred without discussion to the Clerk for action, or to the next Council Meeting for discussion as appropriate. Any question requiring an answer at the Meeting to be submitted at least five working days before the Meeting No questions were received. Cllr Harris returned to the meeting Page 33

0707/08 To confirm and sign the minutes of meetings previously circulated It was resolved with no votes to the contrary to confirm and sign the minutes of the following meetings as a correct record: - Fremington Parish Council Meeting held on Monday 11th June 2007 at 7.00pm - Supplementary & Planning Meeting held on Monday 25th June 2007 at 7.00pm

0707/09 To consider and adopt the minutes of committees and sub-committees previously circulated It was resolved with no votes to the contrary to confirm and adopt the minutes of the following meetings as a correct record: - Parks and Playing Fields Committee held on Thursday 7th June 2007 at 10.45am - Finance & Personnel Committee meeting held on Monday 25th June 2007 at 6.45pm

0707/10 To receive reports on matters of policy or major decisions affecting North Devon and this parish in particular from the County Councillor or District Councillors  Cllr Cann submitted a report (attached) which was read out to the meeting  Cllr Brailey reported that the Sticklepath Community Fun Day is on July 13th. He also advised that progress is being made with young people in Ellerslie who would like a Youth Shelter. Consultation with local residents is about to start  Cllr McCormack-Hole attended the Police Liaison Committee and advised that Police are concentrating their efforts on criminal damage for the next six months. There were many concerns expressed at the poor response to the 0845 telephone number and the lack of local knowledge when police do attend an incident  Cllr Gill had no report  Cllr Jones advised he had been appointed Chair of Barnstaple Fremington and Instow Area Committee

0707/11 Highways issues – update including correspondence There were no reports or correspondence.

0707/12 Flooding issues – update There had been correspondence received from a resident in Mill Road, which had been circulated.

0707/13 To consider parking issues at Roundswell Following considerable discussion it was resolved to write to the Chief Inspector of the area, requesting a letter be prepared advising local residents of the fact they were committing offences in regard to parking. There could then be a letter drop followed by police visits to issue tickets where offences were being committed.

0707/14 To consider an apparent change of use of a property in Roundswell Councillors were updated on the present situation and after discussion it was resolved to write to the Chief Planning Officer asking why this matter was taking so long to resolve. It had first been raised as long ago as February 2007. Page 34

0707/15 Matters to Note It was resolved to note the following correspondence: - Letter from NDDC regarding full postal addresses at John Smale Road (19 June 2007) - Devon County Council- Devontalk magazine – Summer 2007 (available in office) - Devon Association of Parish Councils – Newsletter July/August 2007 - Local Council Review – July 2007 (available in office)

0707/16 North Devon District Council – Planning Applications North Devon District Council, the determining Authority, has asked for comments from this Parish Council on the following planning applications: It was formally noted that participation of the Councillors who are also members of NDDC in both the debate and subsequent vote (in respect of any of the above, were preliminary taking account of the information matters) was on the basis that the views expressed made available at the time to the Parish Council. The District Councillors were reserving their final views on the applications until they were in full possession of all the relevant arguments for and against

44489 Proposal: Erection of smoking shelter Location: Old Barn Inn, Tews Lane, Bickington, Barnstaple Applicant/Agent: Mr S English Cllr Mrs McCormack-Hole declared a personal interest as a business owner It was resolved to recommend to North Devon District Council that this application be APPROVED subject to there being no adverse comments from neighbours.

44564 Proposal: Extension to dwelling Location: 24 Wester-Moor Drive, Roundswell, Barnstaple Applicant/Agent: Mr & Mrs Down It was resolved to recommend to North Devon District Council that this application be APPROVED subject to there being no highways or parking issues.

44565 Proposal: Relocation of & improvements to main customer entrance Location: Sainsbury’s Store, Gratton Way, Roundswell Business Park, Barnstaple Applicant/Agent: Sainsbury’s Supermarkets Ltd It was resolved to recommend to North Devon District Council that this application be APPROVED.

44566 Proposal: Siting of 7 internal illuminated fascia signs Location: Sainsbury’s Store, Gratton Way, Roundswell Business Park, Barnstaple Applicant/Agent: Sainsbury’s Supermarkets Ltd It was resolved to recommend to North Devon District Council that this application be APPROVED.

44577 Proposal: Extension to dwelling & conversion of loft to form additional living accommodation Location: 5 Allenstyle Drive, Yelland, Barnstaple Applicant/Agent: Mr Paul Wareing It was resolved to recommend to North Devon District Council that this application be APPROVED subject to no overlooking and there being no adverse impact on neighbours. 44726 Proposal: Application for consent to carry out works to trees protected by Tree Preservation Order in respect of removal of 1 limb from Oak tree Location: 72 Lagoon View, West Yelland, Barnstaple Applicant/Agent: Mrs H Fenton It was resolved to recommend to North Devon District Council that this application be APPROVED subject to the agreement of the Planning Officer.

44742 Proposal: Application for consent to carry out works to trees protected by Tree Preservation Order Location: 48 Redlands Road, Fremington, Barnstaple Applicant/Agent: Mr J C O’Mara It was resolved to recommend to North Devon District Council that this application be APPROVED.

0707/17 Devon County Council – Planning Decisions It was resolved to note that Devon County Council, the determining Authority, has APPROVED the following application with conditions as filed: Town and Country Planning General Regulations 1992 – Regulation 3 Construction of new children’s centre and associated works. Erection of temporary classroom for the duration of the works Location: Sticklepath Primary School, Woodville Estate, Barnstaple
