TOWN BOARD MEETING – Lebanon Town Hall THURSDAY May 4, 2017 7:35 PM to 10:00 PM MINUTES page 1 of 2 Members Present: Chair Lohny Fredrick, Supervisors Greg Fredrick and LeRoy Tietz, Treasurer Jon Schoenike and Clerk Deborah Behl. Pledge of Allegiance was recited.

Public Notice: Clerk reported that agendas were posted on Monday May 1, 2017.

Public Comment: Dennis Robus, W3801 County Road O, asked about the timeline for the issuance of the liquor license to Sugar Island Barn. Clerk read from the minutes from the April 5th Town Board meeting: “After all of the County conditions have been met, the County will issue a Conditional Use Permit (CUP). After Robus has the CUP, the Retail “Class B” license will be issued by the Town Clerk.” Clerk stated that after the CUP, Robus could come into the clerk’s office with a check for $10,000 for the initial issuance fee of a Reserve “Class B” license and the license would be issued immediately since it has already been approved by the Town Board.

Chris Hookstead of Juneau, owner of property on Wiley and Morningside Roads, spoke about his efforts to keep his cattle from getting out of the fences. Hookstead asked the Town Chairman to speak to his neighbors the O’Gormans about fixing their fences. Chairman will speak with the O’Gormans, but he does not expect them to fix the fences until the water recedes and fields dry out. Chairman emphasized to Hookstead that he is responsible to keep his cattle off the roads and off of neighboring properties. This includes keeping the young calves in the fences with the usage of proper fencing materials.

Minutes: MOTION (L.Fredrick, Tietz): To approve the Minutes as distributed from the March 9, April 3, April 5, and April 27, 2017 Town Board meetings. Carried on voice vote with no negatives.

Treasurer’s Report: MOTION (Tietz, G.Fredrick): To accept the Treasurer’s Report with a balance of $3,414.94 in checking and $311, 842.15 in the interest account. Carried on voice vote with no negatives.

Police Report: Emmet-Lebanon Police Chief Dave Beal presented the April police report. Beal commended his officers for a good job in the arrest of one of the perpetrators in a recent robbery in Hidden Meadows. Beal also spoke about a recent litter/dumping complaint. The County issued the ticket but when the party comes before the judge, Beal will collect restitution for the Town.

Thurow Rezone and Land Division: Consensus of the Board to layover the Allen Thurow Rezone and Letter of Intent until the June 1st Board meeting. The Lebanon Planning Committee will review them at their May 30, 2017 meeting and then these requests will come before the Town Board at the June 1, 2017 meeting.

Resolution L-17-G: MOTION (L.Fredrick, G.Fredrick): to adopt Resolution L-17-G: Alternate Members of Board of Review. Carried on voice vote with no negatives.

United Waste use of Class B Highways: Chairman Fredrick received a call from United Waste field supervisor Rick Remington who told him that for this year the waste will be unloaded on County Road R and then pumped across the Muche land over to the Tracy property. Chief Beal invited State Patrol Trooper Randy Kind to speak to the Board about weight limits. The public does have the right to deliver on Class B roads but they must be at 60% weight and take the shortest route in. And while unloading, they must insure the safety of the road. Highway Superintendent’s Report: Highway Superintendent Boyd reported: - Flooding continues to be a problem. - The culvert on Poplar Grove Road between N1412 and the railroad tracks still cannot be located. Water continues to run across the road. MOTION (L.Fredrick, Tietz): to put in a new culvert across Poplar Grove as soon as possible because of safety concerns with water on the road. Carried on voice vote with no negatives. - Another problem area is just south of N2051 Poplar Grove Road where water is washing out the ditch bank. As long as the excavating company is in town, Brent would like to have them clean out this problem ditch. Then fabric and rip rap would be put down. It was the consensus of the Board to go ahead with this project. - On the Crawfish Road project, Wondra Construction is almost finished. They will load test the surface tomorrow.

Fire Department: Chief Brent Boyd reported: - The new grass fire truck is here in service. - They will be holding grain bin rescue training. - The concession stand opens May 14. - Epoxy work will be done in August.

Lebanon EMS: No report.

Park Committee: Tietz of the Park Committee reported that ten trees were recently planted. Boyd gave an update on the steps project at the ball diamond at Firemen’s Park. Parking issues at Trechel Park were discussed.

Board Member Reports: Clerk Behl reported that former Supervisor Vawter has volunteered to continue administering the Town’s Facebook page if the Board so desires. The consensus of the Board was to have Carole Vawter continue in this role as Facebook administrator.

Personal property assessments were discussed. In light of the recent death of the owner/operator of Westside Tool and Grinding, the consensus of the Board was to forgo the 2016 personal property assessment. If a new business should start there, they would be put back on the personal property assessment roll.

A second meeting in June primarily for licensing was set for Thursday, June 22, 2017 at 7:30 pm.

Monthly Bills: Bills for the month were reviewed. MOTION (L.Fredrick, Tietz): to pay bills as presented. Carried on voice vote with no negatives.
