Justin City Council Regular Session Meeting– November 13, 2017

The Justin City Council Meeting convened into a Regular Session being open to the public the 13th day of November 2017 at 5:00 PM .in the Court Room at the Justin Municipal Complex, and notice of said meeting giving the time, place, date and subject thereof having been posted as prescribed by Article 5 of the Texas Government Code, with the following members present and in attendance to wit:

Mayor David Wilson, Council Members: Alan Woodall, Teri Addington, Charlotte Moore, Lynn Crites, and John Mounce. City Staff: City Secretary, Brittany Andrews, and City Manager, Cori Reaume

I. CALL TO ORDER

Invocation and Pledge of Allegiance

II. WORKSHOP ITEMS

1. Discuss the appointment of Derek Anthony to the Justin Economic Development Board.

EDC Director, Shani Ihnfeldt expressed she would prefer someone who lives in Justin to be on the boards. Councilwoman Moore, he is an outgoing person who has insight on commercial real estate, and feels the more they reach out around us, the better is could be.

2. Discuss City Manager Ordinance update.

City Manager- prior we spoke to move the Police Chief under City Manager, we are bringing this back to council to suggest possibly moving the City Secretary under City Manager, as well, as this is the norm for smaller cities.

3. Discuss the Landscape and Buffer Zone Ordinance 634-17.

CITY COUNCIL MEETING NOVEMBER 13, 2017 PAGE 1 City Manager, Cori Reaume went over the changes that were made earlier this year by both the Planning and Zoning Commission, and prior council. Council discussed things they feel would be a benefit to the city, and what they would like to see be incorporated into this Ordinance.

4. Discussion on calling the public hearings regarding GB-OT, schedule of uses update.

Discussion on the dates suggested were agreed upon for action during the regular meeting.

5. Discuss the Gym Rental Fee Resolution 517-17.

Councilmembers discussed, what they felt would be reasonable fees to charge for the various rental options for the Gym.

III. PUBLIC COMMENT

In order to expedite the flow of business and to provide all the citizens the opportunity to speak, the Mayor may impose a three-minute limitation on any person addressing the Council, however, the Texas Open Meetings Act prohibits the City Council

from discussing issues which the public has not been given seventy‐

two (72) hour notice. Issues raised may be referred to City Staff for research and/or placed on a future agenda for possible future action.

Jeffrey Gastineau, 1104 Hillside Dr.- For the tree and bush requirements discussed prior, who is paying to water and maintain the tree? Jeri Beckham and Cathy Green 815 W. 5th St.- Purchased property and is asking for help on waiving fees, asking that the city rebate, and/or refund some of the fees due to other financial surprises that have come up since her initial meeting with the city in May.

6. Discuss, consider and act on the appointment of Derek Anthony to the Justin Economic Development Board. No Action Taken

7. Discuss, consider and act on City Manager Ordinance update.

Councilman Crites made the motion to approve the Ordinance 635-17 update as is.

Seconded by: Councilman Woodall Aye votes: Councilmembers Woodall, Moore, Mounce, Addington, and Crites Motion carries

8. Discuss, consider and act on the Landscape and Buffer Zone Ordinance 634-17.

No Action Taken

9. Discuss, and consider calling the public hearings regarding GB-OT, schedule of uses update.

Councilman Woodall made the motion to call for public hearings for a zoning ordinance text change for Tuesday, November 21, 2017 at 7:15 pm and Monday, December 11, 2017 at 7:00 pm at Justin City Hall.

Seconded by: Councilwoman Addington Aye votes: Councilmembers Woodall, Moore, Mounce, Addington, and Crites Motion carries

10. Discuss, consider and act on the Gym Rental Fee Resolution 517-17.

Councilman Mounce made the motion to approve Resolution 517-17 setting the rental fees to $20, Councilman Woodall made an amendment to have a deposit fee set to $100 to be added to the resolution, as well as have a separate fee of $ 30 for non-residential renters, Councilman Mounce accepted Councilman Woodalls’ amendment.

Seconded by: Councilman Woodall Aye votes: Councilmembers Woodall, Moore, Mounce, Addington, and Crites Motion carries

V. CONSENT ITEMS

11. Consider and act on City Council Regular meeting minutes dated October 30, 2017, and City Council Retreat minutes dated November 4, 2017.

Councilwoman Addington made a motion to accept consent item 11, as is.

VI. EXECUTIVE SESSION

Any item on this posted agenda could be discussed in Executive Session as long as it is within one of the permitted categories under sections 551.071 through 551.076 and Section 551.087 of the Texas Government Code.

As authorized by Section 551.071 (2) of the Texas Government Code, the City Council may adjourn into closed executive session to seek confidential legal advice from the City Attorney.

 Update from City Attorney regarding the status of the Northlake appeal

Pusuant to Texas Government Code, Annotated, Chapter 551, subchapter D, Section 551.087.

 Deliberation regarding economic development negotiations; (1) to discuss or deliberate regarding commercial or financial information that the City has received from a business prospect that the City seeks to have locate, stay, or expand in or near the territory of the City and with which the City is conducting economic development negotiations; or (2) to deliberate the offer of a financial or other incentive to a business prospect described by Subdivision (1).

Convene into executive session at 7:41 PM Adjourn into open meeting: 8:41 PM

12. Discuss, consider and act on items discussed in Executive Session.

VII. ANNOUNCEMENTS

 City Hall will be closing at 12:00PM on Wednesday, Novemer 22-24, 2017 and will resume normal business hours on Monday, November 27, 2017.
