Members Present Were: Jerry Swanson, Thomas Brungardt, Kenny Davis, and Max Bilsten

The regular called meeting of the Appeal Board on May l3, 2008 at City Hall in Denison, Iowa was called to order at 8:00 A. M.

Members present were: Jerry Swanson, Thomas Brungardt, Kenny Davis, and Max Bilsten.

Also present were: Richard Petersen, Greg Seefeldt, Jim Gaughan, Sam Baccam, Gary Burk, and Robert Arambula.

A motion to waive the reading of the minutes and approve the same as filed was made by Brungardt and 2nd by Davis. Yes: Brungardt, Davis, Bilsten, and Swanson.

3. The following properties are asking for legal status due to the city down zoning: a. Sam Baccam at 214 S 9th St. b. Bill Gruhn at 28 S 16th St. c. Jim Gaughan at 19 S 12th St. Item (a) was tabled due to the lack of dates on the statement from Rhonda Wessel. Items ( b) and (c) were discussed. A motion was made by Brungardt and 2nd by Davis to approve items (b) and (c). Yes: Brungardt, Davis, Bilsten, and Swanson.

4. Gary Burk request a variance to the violation notice dated 4-3-08. A discussion was held about his progress and the time he needed to complete the clean up. Gary stated that some of the cars are being held for payment of the repairs and some are striped of their parts and then removed. Petersen stated the stripping of the part and removal of the body is a junk yard or salvage yard and isn’t a permitted use in the C-1 zone. Burk asked when he could get a building permit. Petersen responded when you have clean up the property and are in compliance with the C-1 zone for a automotive repair shop.

A motion to adjourn was made by Davis and 2nd by Brungardt at 8:30 A. M. Unanimous.
