A CONCURRENT RESOLUTION Urging the United States Congress to Fully Fund Special Education

A CONCURRENT RESOLUTION urging the United States Congress to fully fund special education. WHEREAS, federal funding for special education programs has been critical to ensuring that more than 1 million children with disabilities receive public education; and WHEREAS, prior to enactment of the Education for All Handicapped Children Act of 1975 only one in five children with disabilities was educated in public schools in the United States; and WHEREAS, despite significant strides in increasing and enhancing public education of children with disabilities, many of these children still do not receive the services and assistance they need to succeed in public schools; and WHEREAS, the United States Department of Education's education initiative in the first session of 107th Congress was entitled the "No Child Left Behind Act of 2000"; and WHEREAS, despite the intent of ensuring all children an opportunity to learn in public schools and providing sufficient funding to assist school districts in meeting the needs of all of these students, the No Child Left Behind Act of 2000 failed to fully fund educational services to children with disabilities by two votes, in essence leaving some of the nation's neediest children behind; and WHEREAS, many states, such as Kentucky, incur significant costs without sufficient ability to provide full state funding for the extensive preschool, elementary, and secondary programs that are mandated in the Federal Individuals with Disabilities Education Act (IDEA) for educating children with disabilities; NOW, THEREFORE, Be it resolved by the House of Representatives of the General Assembly of the Commonwealth of Kentucky, the Senate concurring therein: Section 1. That the 107th United States Congress is hereby urged to fully fund the Individuals with Disabilities Education Act (IDEA) during its session in 2002 to provide sufficient educational service to all children with disabilities by 2007.

Section 2. That the Clerk of the House of Representatives shall transmit a copy of this Resolution to each member of the Kentucky congressional delegation as follows: (1) Senator Mitch McConnell, 361-A Russell Senate Office Building, Washington, DC 20510; (2) Senator Jim Bunning, 316 Hart Senate Office Building, Washington, DC 20510; (3) Representative Edward Whitfield, 236 Cannon House Office Building, Washington, DC 20515; (4) Representative Ron Lewis, 2418 Rayburn House Office Building, Washington, DC 20515; (5) Representative Anne Northup, 1004 Longworth House Office Building, Washington, DC 20515; (6) Representative Ken Lucas, 1237 Longworth House Office Building, Washington, DC 20515; (7) Representative Harold Rogers, 2406 Rayburn House Office Building, Washington, DC 20515; and (8) Representative Ernest Fletcher, 1117 Longworth House Office Building, Washington, DC 20515.
