MINUTES OF EMPLOYMENT AND APPEALS COMMITTEE MEETING - 5TH MAY 2009

1. EXCLUSION OF THE PUBLIC

Resolved: That under Section 100 (A) of the Local Government Act 1972, the public be excluded from the meeting during consideration of the whole item, including the decisions referred to at Agenda item 2 on the grounds that it would involve the likely disclosure of exempt information as defined in paragraphs 1 and 2 of Part 1 of Schedule 12A of the Act.

2. DECLARATIONS OF INTEREST

Councillors Price and Mrs Rowson declared personal interests in item 2 on the agenda (Appeal Against Dismissal). The nature of their interest being that they were both members of the Adult Social Care and Housing Overview and Scrutiny Committee.

3. APPEAL AGAINST DISMISSAL

The Committee considered a request for a review of the Council’s decision to dismiss an employee of the Council.

The former employee was in attendance at the meeting, together with his Union Representative Mr Marsden.

Mrs S Young, Assistant Director Neighbourhood and Communities and and Mrs S Simister, Human Resources Assistant presented the case on behalf of the Authority.

Mrs C McKeogh, Head of Human Resources and Organisational Development and Mrs C White, Senior Solicitor were in attendance to advise the Committee on matters of policy and procedure and had not taken any part in the original decision.

The Committee carefully considered all the facts put forward by both parties.

Resolved: MINUTES OF EMPLOYMENT AND APPEALS COMMITTEE MEETING - 5TH MAY 2009

1) To uphold the original decision of the disciplinary hearing held on 2nd and 3rd March 2009, to dismiss the employee from Blackpool Council’s employment.

2) To acknowledge the punitive disciplinary action taken by the Disciplinary Hearing Panel to dismiss with notice and award the former employee 12 weeks pay.

3) To request the Head of Human Resources and Organisational Development to review procedures regarding Disciplinary Hearings to ensure that a consistent approach is taken across the Council.
