The Pacific ACP Trade Ministers’ Meeting was held on 9 August 2011, at the Crowne Plaza Hotel, in Port Moresby, Papua New Guinea (PNG). Trade Ministers from the following Pacific ACP (PACP) States were present at the meeting: Cook Islands, Fiji, Kiribati, Nauru, Niue, Palau, Samoa, Solomon Islands, Tonga and Tuvalu. The Federated States of Micronesia (FSM), PNG, Republic of the Marshall Islands and Vanuatu were represented by Ambassadors and senior officials. PACP Ambassadors and their representatives based in European Union (EU) Member Countries and representatives from the Forum Fisheries Agency (FFA) and the Parties to the Nauru Agreement (PNA) Office were also present at the Meeting. The list of participants is provided as Annex 1.
2. The Meeting was convened by the Secretariat of the Pacific Community (SPC) and was chaired by Honourable Minister Lisiate ‘Akolo, Minister for Labour, Commerce and Industries, Tonga in his capacity as the Lead Spokesperson of the PACP- EU Economic Partnership Agreement (EPA) negotiations. The objective of the meeting was to consider recent developments in the PACP-EU EPA negotiations, including the outcomes of the PACP Trade Officials’ Meeting (PACPTOM) as summarized in the transmittal letter from the Chair of PACPTOM, with a view to providing further directions to take forward the PACP EPA negotiations.
3. In his opening remarks, Dr. Jimmie Rodgers, Director General of the SPC welcomed the Ministers and urged that the region provide direction to take the PACP-EU EPA negotiations to a conclusion. He said that the EPA must be centered on the objective of reducing and eventually eradicating poverty, consistent with the objectives of sustainable development and the gradual integration of the PACP countries into the world economy. Dr Rodgers said that the completion of negotiations on a comprehensive EPA could take longer than Ministers might prefer, and in this regard it is crucial that the region was strategic in planning and analysing its options. He urged Trade Ministers to take stock of the PACP-EU EPA negotiations thus far, carefully consider the options and recommendations before them, and provide clear policy direction to PACP Regional Negotiating Machinery to take the region 1 PACP EYES ONLY to the conclusion of negotiations.
4. The Secretary General of the Pacific Islands Forum Secretariat, Tuiloma Neroni Slade, in his introductory remarks said that the European Commission indicated several times that they will not be interested in meeting with the Pacific region or offering the region flexibilities on contentious issues unless the region submitted revised market access offers in the required format. The Secretary General said that eight PACP States had submitted conditional market access offers to the EU, and work continues in the remaining four countries to develop their market access offers. He said that this work should create the necessary conditions for the European Commission to show flexibility on contentious issues. He added that the market access offers submitted by the eight PACPS are conditional on the satisfactory resolution of a number of unresolved contentious issues, including the issue of development cooperation provisions, export taxes, infant industry, standstill clause, the Most- Favoured Nation provisions, the non-execution clause, taxation and governance issues, market access and rules of origin for fisheries products, and other matters of great importance to the Pacific. He said that Ministers would also consider a number of issues related to Aid for Trade, including the establishment of the Pacific Trade and Development Facility and the further development of the Pacific Aid for Trade Strategy.
SESSION 1: PACP MARKET ACCESS OFFERS
5. Ministers considered an update on the progress of the market access offers for the PACP-EU EPA negotiations. Ministers noted that the Forum Secretariat has provided technical assistance to twelve PACPS to convert their tariff codes to use the Harmonised System (HS) 2007 classifications and to gather the recent three year trade data to complete market access offers. Ministers noted that eleven PACPS now have HS 2007 compliant nomenclature and recent trade data.
6. Ministers congratulated Cook Islands, FSM, Niue, Palau, Samoa, Tonga, Tuvalu and Vanuatu, which have submitted revised draft conditional market access offers to the EU, and thanked the Forum Secretariat for the assistance provided.
Decisions
7. The Pacific ACP Trade Ministers: (i) noted that eight PACPS have submitted draft offers to the EU in the context of a comprehensive EPA, and that the offers are conditional upon satisfactory resolution of the key contentious issues, including global sourcing for products under HS headings 0304/0305; (ii) urged those PACPS that have not already done so to submit their offers to the Secretariat for technical review no later than 20 August 2011 and, once finalised, that draft offers be submitted to the EU no later than 15 September 2011; and (iii) considered options on SAT benchmarks and liberalisation timeframes and agree to share their positions with the EC at an appropriate time in the negotiations, as determined by PACPS.
SESSION 2: FISHERIES NEGOTIATIONS

8. Ministers considered the recommendations of the Joint PACP Fisheries and Trade Ministers’ Meeting held on 8 August 2011.
Decisions
9. The Pacific ACP Trade Ministers: (i) congratulated PNG on the ratification of its interim Economic Partnership Agreement with the European Union; (ii) agreed that PACPS continue to seek global sourcing for products of HS headings 0304/0305 in the context of the comprehensive Economic Partnership Agreement; (iii) noted that eight PACPS have submitted their market access offers in the context of a comprehensive EPA, which are conditional upon satisfactory resolution of the contentious issues, including global sourcing rules of origin provisions for products under HS headings 0304/0305; (iv) agreed that global sourcing provisions granted in the interim EPA for products of HS headings 1604/1605 are immutable (binding); (v) agreed that global sourcing should not be restricted to tuna or any other specific species; (vi) directed Officials to consider options to facilitate negotiations in response to EC positions, including by undertaking an assessment of arrangements the EC has in place with other trading partners; (vii) agreed that, in the context of these options, Pacific ACP States could consider a guarantee to negotiate fisheries access on a bilateral basis, conditional on the satisfactory conclusion of negotiations on global sourcing provisions under 0304/0305; (viii) agreed that any guarantee to negotiate fisheries access on a bilateral basis may be limited to those Pacific ACP States that choose to benefit from global sourcing under 0304/0305; (ix) noted that any fisheries access granted to the European Union may be linked to onshore investment, subject to the satisfactory conclusion of bilateral negotiations, and consistent with national laws; (x) noted that access may also be linked to development cooperation, including to assist Pacific ACP States to secure their Exclusive Economic Zones; (xi) affirmed the importance of the early completion of a robust and comprehensive study on the economic and development impacts of securing global sourcing for products of HS headings 0304/0305, and agreed that this study must not delay the progress of the negotiations; (xii) requested the Lead Spokesperson write immediately to the EC to provide a brief overview of PACPS justification for, and actions being undertaken to secure, global sourcing for products of HS headings 0304/0305, and agreed that a small group Ministerial mission to Brussels be undertaken as a matter of urgency to further discuss the matter with the European Commission, with subsequent meetings to be undertaken by Ministers and/or Officials as appropriate; 3 PACP EYES ONLY
(xiii) encouraged the Forum Fisheries Agency and other regional organisations to assist countries to establish and strengthen national Competent Authorities to facilitate exports to the European market, including through subregional approaches; (xiv) endorsed the role of the Forum Fisheries Agency in assisting Pacific ACP States on issues relating to IUU regulations; (xv) requested the European Commission to fully involve Forum Fisheries Agency in future discussions when notified by the formal authority of the Pacific ACP applicant; and (xvi) requested the Secretary General of the Forum Secretariat write to the European Union Resident Representative in Suva and Port Moresby, and to meet with the Resident Representative in Suva, to convey these concerns and to seek European Commission concurrence on the proposed modalities to facilitate Pacific ACP compliance with European Union IUU regulations.
SESSION 3: DRAFT PACP-EU EPA TEXT
10. Ministers considered an update on the contentious and outstanding issues in the draft PACP-EU EPA text with a view to re-assessing PACP mandates and strategies.
11. Ministers considered a number of negotiating options and noted that while the region has made good progress on market access offers and on the legal text, PACPS and the EU have yet to resolve the key contentious issues. Ministers noted that the contentious issues are important to all PACPS and could have serious policy implications. Decisions
12. The Pacific ACP Trade Ministers: (i) noted the draft comprehensive EPA text submitted to the EC on 15 July; (ii) noted the draft comprehensive EPA text as considered by the June 2011 TWG-LICB meeting and the outstanding contentious issues; (iii) agreed to consider revisions at a future time in light of the anticipated EU response to the draft EPA text, and at that time provide guidance to the TWG-LICB to draft and/or finalise the text; (iv) agreed that a meeting of the TWG-LICB be convened before the next JTWG to finalise the text on fisheries issues as well as any other contentious and outstanding issues, in line with the directions of Session 2; (v) agreed that the revised proposals on the fisheries chapter as well as Article 6.6 of Protocol II on global sourcing be forwarded to all PACPS for comments immediately after the TWG-LICB and, once approval is reached by all PACPS on the proposals, they be forwarded to the EC for consideration before the next JTWG; (vi) agreed that Officials be given a degree of flexibility to explore options that would facilitate the conclusion of an agreement and report the results back to Ministers for their consideration; and (vii) agreed that any revisions be discussed with the EC during the JTWG and

at a time considered appropriate by PACPS.
SESSION 4: KAVA PROPOSALS
13. Ministers considered a proposal on kava submitted by Fiji, FSM, Samoa, Solomon Islands and Tonga. Ministers noted that kava is an important product in PACP communities and in recent years it has offered significant export potential because of its special properties both as a beverage and also medicinal uses in the alternative therapies market.
Decisions
14. The Pacific ACP Trade Ministers: (i) supported the Kava Initiative; (ii) agreed that the PACP Lead Spokesperson for the EPA negotiations send the Kava Initiative, including proposed amendments to the EPA legal text to the EU as a matter of urgency; (iii) agreed that the cover letter to the EU specifies that the issues raised by the Kava Initiative represent very important issues for the PACP kava producing countries and request the EU to respond to those issues before the next JTWG in Brussels; (iv) agreed that alternative courses of action, including seeking complementary sources of funding, be considered should the EU respond negatively to PACPS requests; (v) agreed that the PACP Kava Initiative should not cause undue delay to the conclusion of EPA negotiations according to the timeline mandated by PACPTMM in February 2011; and (vi) requested the Forum Secretariat to support the Kava Initiative and take a coordinating role in organising the ACP MTS Kava Project regional meeting.
SESSION 5: WAY FORWARD
15. PACP Trade Ministers considered a revised road map to conclude negotiations of the comprehensive PACP-EU EPA.
Decisions 16. Pacific ACP Trade Ministers: (i) noted the work undertaken to date, including the submission of eight market access offers and draft legal text to the EC in July 2011; (ii) noted the ongoing work being undertaken by PACPS to complete market access offers; (iii) agreed to finalise all Basket 2 issues at the technical level; (iv) requested the PACP Lead Spokesperson write to the EC Trade Commissioner highlighting the submission of 8 market access offers and other work undertaken by PACPS to progress the PACP-EU EPA 5 PACP EYES ONLY
negotiations, including raising issues with reference to kava, and seek a meeting for a Ministerial delegation with the EC before October, by which time a draft of the fisheries study might become available to inform Ministerial discussion; (v) agreed that the Ministerial delegation comprise Lead Spokesperson (Tonga), the Alternate Spokespersons (Nauru & Vanuatu), a representative of the Freely Associated States (RMI), Fiji and Kiribati; (vi) agreed that the Ministerial delegation seek to clarify expectations regarding key outstanding issues, including the issue of global sourcing for products of HS headings 0304/0305, and that the outcomes of these discussions be considered further by Officials at their next TWG; (vii) requested that, in the interim, individual PACPS submit their positions on the remaining contentious issues to the Secretariat by 31 August; (viii) encouraged PACPS, individually or jointly, to intensify their engagement with the EU to progress the PACP-EU EPA negotiations as a single region, recognizing that bilateral meetings with the EU and individual PACPS could yield positive outcomes and assist in the process; (ix) urged those countries undertaking bilateral discussions to provide records to the Secretariat subsequently to these meetings for dissemination to PACPS; (x) directed the Secretariat to reconvene the Trade Experts Advisory Group, comprising technical experts from key regional organizations and key senior Officials, including Trade Officials; (xi) encouraged the Core Group of Ministers to play an active role in the comprehensive EPA negotiations with a view to engaging with the EU on a more regular basis, with assistance of PACP EU Member state based Ambassadors and Permanent Representatives, whilst considering the advice from the Trade Experts Advisory Group; and (xii) endorsed the Revised EPA Roadmap (Attachment A).
PNG COUNTRY PAPER
17. Ministers considered the PNG country paper on the future management of PACP issues.
Decisions
18. Pacific ACP Trade Ministers: (i) noted the paper from PNG; (ii) recommended that PACP Leaders consider the convening of an Eminent Persons Group to consider matters raised in the paper and make recommendations accordingly; (iii) recommended that final decisions be made by PACP Leaders, subsequent to the findings of the Eminent Persons Group; and (iv) recommended that Leaders consider directing PACP EU-based Ambassadors and Representatives to explore with the ACP Secretariat and 6 PACP EYES ONLY
the European Commission financial and other support for such a Group.
FIJI COUNTRY PAPER
19. Ministers considered Fiji’s country paper on Fiji’s participation in PACP meetings and activities. Ministers noted that further consultation with their Leaders was desirable.
Decisions
20. Pacific ACP Trade Ministers recommended to PACP Leaders consideration, at their next Meeting in Auckland, New Zealand, of feasible arrangements for the participation of Fiji in all PACP meetings and at all levels.
SESSION 6: AID FOR TRADE IN THE PACIFIC REGION
21. Ministers considered the structure and location of the Pacific Trade and Development Facility (PTDF), including a formula for voluntary Pacific island country contributions to the PTDF as well as progress made to further develop Pacific Aid for Trade Strategy and a Roadmap for future work.
Decisions
22. The Pacific ACP Trade Ministers: (i) noted progress made to further develop the Pacific Aid for Trade Strategy; (ii) noted the revised Roadmap to finalise the Strategy and the Pacific TDF; (iii) agreed that endorsement of the Pacific Aid for Trade Strategy will be by PACP Trade Ministers only; (iv) agreed that further consultations be undertaken at the national level to progress work on the Strategy; (v) agreed that national consultations on the Pacific TDF be completed, with any comments provided to the Forum Secretariat by 28 October 2011; (vi) recommended that those countries wishing to do so provide a financial contribution toward the establishment of the Pacific TDF; and (vii) noted that the Facility Manager will be appointed according to the process described in Article 29 of the MOU on entry into force.
OTHER BUSINESS
23. Ministers noted that President Barrosso will be present at the Forum meetings in Auckland, New Zealand, and that this presented an opportunity for further discussion on progress made on PACP-EU EPA negotiations and to explain the specific needs of PACPS with the European Commission. 24. Ministers invited the Office of the Chief Trade Adviser to participate as a special technical observer at PACP Trade Officials’ and Ministers’ Meetings.
