The Committee resolved that application UTT/1000/01/OP Stansted be deferred for further clarification and negotiation, and for a report on the feasibility of commissioning an independent environmental impact study. 31 July 2002 Report on the proposals to the Development Control and Licensing Committee Committee resolved that officers should negotiate with the applicants on a wide range of issues. 12 September 2002 Outcome of negotiations with the applicants reported to the Development Control and Licensing Committee. The Committee resolved that the application be approved subject to planning conditions and the satisfactory conclusion of legal agreements under section 106 of the Town and Country Planning Act, 1990, and section 278 of the Highways Act. 16th December 2002 Report to the Development Control and Licensing Committee setting out the terms of the legal agreement with cross references to the resolution of the meeting of 12th September 2002. Members resolved to defer consideration for a special meeting of the Committee to examine the draft legal agreement in detail. Members also instructed the Chairman and the Head of Planning and Building Surveying to meet with UDC/1/F Appeal ref: 2032278 the Applicants and to seek tighter controls over the whole night flying regime, including shoulder periods. 9 January 2003 Special Meeting of the Development Control and Licensing Committee. It was reported that everything required by the Committee is incorporated into the draft legal agreement, except the matter of a reduction in night flights and revisions of shoulder periods. The legal agreement does contain a clause that limits night flights and use of the shoulder period to the current quotas imposed by the Secretary of State, as set out in paras 6 and 7 of part 1 of the fourth schedule of the draft agreement. The Committee was advised that, unless Members consider, and are able to demonstrate, that the agreement materially fails to address the terms of the resolution of the meeting of 12th September, then the permission should be issued. The meeting lasted 6 hours and 20 minutes and ultimately resolved that the draft Section 106 Agreement as set out in the report, and amended at the meeting, be approved. Six Members voted for the motion, five against and three abstained.
