Meeting called to order at 10:10 am

Quorum Present - 38 Signed In (need 20 members present)

Prior to the start of the official meeting President Tompkins asked for all individual property owners in attendance who had paid their Association Dues for 2013 to raise their hands. Kris informed the group that a quorum of 20 individual property owners must be present. After a count of hands and verifications President Tompkins declared a quorum was present. She asked that those in attendance sign the sheet being passed around. She introduced the Board members and asked if any new property owners were in attendance. Ken and Bobbie Bailey identified themselves as the new owners of Lot #39. They were welcomed to the lake.

President Tompkins then read the Meeting Agenda.

The first agenda item was the approval of the September 2, 2012 meeting minutes. The minutes are posted on the website and paper copies are available at the entrance sign. Matthew Finnigan moved to approve the September 2, 2012 Meeting minutes. Motion seconded by Mel Savage. There were no additions, deletions or discussion. Upon vote, motion carried.

EXECUTIVE REPORT President Tompkins provided the following timeline of her activities since the last meeting.

9/14/12 Attended Court Hearing on the Mason County Aquatic Vegetation Removal Permit 10/11/12 Attended Judge ruling on the Vegetation Removal Permit 10/30/12 Sent email blast regarding break-ins & thefts 11/21/12 Sent email blast regarding Haven Lake calendars for sale 12/2012 Delivered and mailed calendar orders – Calendars are still available Jan-May Worked on Haven Lake Telephone Directory 3/12/13 Attended meeting with WDFW regarding Haven Lake Dam 4/20/13 Participated with 20 others on Community Litter Pick-Up and got over 500 pounds 4/21/13 Special Board meeting to meet with WDFW on Dam

 2008 set out to get formal written agreement with WDFW  2009 WDFW Habitat Division told WDFW Fish Division that permit was needed to adjust weir boards, that included an engineering study  Last adjustment was by Fish Division in fall 2009  HLPOA has continued to provide Lake height data to WDFW  2011 Brent Williams & Rob Campbell got involved with asking WDFW questions, walking the river looking at culverts and visiting other lakes with dams  2012 all parties met at Mason County Public Works to discuss the dam & culvert  March 2013 Steve Kalinowski, WDFW Habitat Program Manager of the Region Six Habitat Program came out to the Lake and met with several property owners  Steve had read the WDFW code and determined that permits were only needed for new construction not for the adjustment of weir boards and we should have been able to continue that practice.  The State wanted HLPOA to take ownership of the Dam, by having it transferred by deed.  If an owner other than the State could not be found, WDFW would remove the Dam and build a spillway maintaining current Lake levels.  WDFW proposed having an interim agreement with HLPOA for adjustment of the weir boards.  April 2013 Steve met with the HLPOA Board and brought an “Agreement for the Transfer of Ownership and Responsibility for Operation and Maintenance of Haven Lake Dam” that had been prepared by the Attorney General’s office.  The Board is not recommending that we take on ownership of the dam. We would need insurance and there could be a large liability.  Rob Campbell had provided the State a draft Memorandum of Agreement for adjusting the summer and winter lake levels at Haven Lake as had been done in the past.  Steve was going to have the AG’s office return the MOA to us with their changes. To date we have not received it back.  The ball is in WDFW’s court. Kris has called and left several messages to get more information for this meeting but had not heard anything back.

Discussion: Russ Hill asked what might happen if we do not take ownership? The response was that the State would then put in a spillway. Cathy Backlund asked what a spillway was. The response was it would be a solid concrete structure with no boards for adjustment of the lake level. If we would continue to adjust the Boards like we did in the past we would essentially be trespassing. At one time we had the blessing of Fisheries and now we do not have that authority. Don Ninneman pointed out that in the big rain storm of 2003 we did take boards out May 26, 2013 Page 4 of 6 to avoid flooding at our Lake; however there was contact made by a downstream location that threatened a lawsuit due to the damages they incurred. Matthew Finnigan asked where Salmon Enhancement stood on this issue. The response was that piece is unknown. Mark MacCubbin said that the bottom line is that Fisheries does not want the dam anymore. To them it is a small dam with no real value, so to them the spillway makes more sense. It was noted that a spillway would need to be engineered and would be much larger, taking out part of the boat launch parking. It was again asked why Salmon Enhancement had not been at the table for these discussions. It was noted that Salmon Enhancement is also under budgetary restraints and did not even come out to do their count at the dam this year. Helen Schrader asked how we set the lake level if we are not adjusting the boards. Ken Giese said that the State has said there would be meetings with property owners following the engineering study to determine those levels. Right now Fisheries has been bombarded by Haven Lake issues and really want to move forward and get these issues resolved.

Aquatic Vegetation Survey Leslie Cole said she would once again be mapping the vegetation in the Lake just as it has been done for the past couple years. This year’s survey will happen sometime in June.

Water Testing and Buoys Rick Crabtree reported that he will again be doing the water testing in late July- early August. He will take samples from the same locations for comparison and will report the results at the September meeting.

He further stated that he is continuously working on buoy placement. He noted that he saw a lot of people on opening day tying up to the buoys which contributes to relocating them and encouraged folks not to do that. It was reported there is a dark green buoy in the Lake that is of some concern for night-time boating as it is not visible.

Wi-Fi Leslie Cole and Keith Croover said the issue was basically tabled as the band width and location do not make it conducive. Keith said the original idea was to create an environment unattractive to thieves. Keith said Costco has a $200.00 system that with a smart phone you can monitor your property. Century Link is the only available option at this time. Mark MacCubbin said he thought they were bringing out cable on the line to upgrade their speed.

ANNOUNCEMENTS -Kris Tompkins reported that there had been a near drowning incident at the Lake, where a fisherman in full gear capsized his small boat. He was rescued by John Williams and Steve Ates. May 26, 2013 Page 5 of 6

-4th of July Boat Parade starts at 7 pm, meet in front of Giese’s dock for formation. -Kayak and Paddle Boat Races on July 6, Diana Sweeney noted that again Brent and LeAnn Williams were hosting the races to benefit the Juvenile Diabetes Research Foundation. Races for all ages begin at 1 pm in the cove. -5th Annual Golf Tournament benefitting the Juvenile Diabetes Research Foundation will be held at Gold Mountain on August 4th. Diana Sweeney noted there were flyers available on the table and interested parties should contact Mark MacCubbin. It will be an 8:00 am shotgun start, limited to the first 48 players. -Haven Lake Telephone Directory was put together by Kris Tompkins and Ruth Nelson. The Directory is listed both by lot# and by name. These Directories are free to dues paying members. Non-members can acquire Directories by paying $3.00 for one or $5.00 for two. Directories are available after the meeting. -Fund Raising T-Shirts, Diana Sweeney noted and thanked the group for their continued support of her Haven Lake shirts which are sold for JDRF and LeAnn Williams who also sells Haven Lake related items. They have joined together and have a couple new shirts from which the proceeds will go to the HLPOA General Fund. Real Housewives of Haven Lake t-shirts and full zip hooded sweatshirts are available as well as “mmm…motor boatin, PARTY IN SLOW MOTION”, Haven Lake t-shirts and hoodies. They are $35.00 for the sweatshirts and pajama sets and $25 for the t-shirts. See Diana after the meeting to purchase or e-mail the Board. -Recipe Book Kris said now that the Directory is completed, folks should be expecting contact from her as she solicits recipes for the upcoming Recipe Book. -Haven Lake 2012 Calendars are still available for sale at half-price since half the year is over. See the Board after the meeting for purchase. We are soliciting photos for next year’s calendar so think about your submissions. (Due by October 1, 2013.)

BUSINESS Aquatic Vegetation Kris Tompkins reported the Judge ruled that Mason County should not have issued a permit for the manual removal of vegetation when there is a dispute over who owns the bottom of the lake. Therefore, it is up to individual property owners to legally deal with their own vegetation. Kris noted that she has contacted Mason County to ascertain the exact permitting process necessary for each action requested of them. She has yet to receive a response.

OTHER BUSINESS -Sharon McKenzie reminded everyone of the Sunshine Committee. Please let the Board know if someone has either a sad or happy event which the Association should recognize with a card. May 26, 2013 Page 6 of 6

-It was asked if we could restrict usage of the Community Lot to those with the Haven Lake clings on their vehicles. Kris did not see how we could police or enforce such a mandate as the Lot is for use by all Haven Lake property owners. -Keith Croover suggested having a party or picnic where we have a charge as a fund raising idea.

There being no further business, Russ Hill moved to adjourn the meeting. Motion seconded by Matthew Finnigan. Upon vote, meeting adjourned at 10:58 am.
