Nigel Evans said evidence was being cherry-picked in “too many cases” after Britain’s biggest police force ordered a review of all current rape and sexual abuse cases yesterday. The Tory MP, who was cleared in 2014 of raping a student, called for the review to be expanded after a second rape case collapsed within a week. He told BBC Radio 5 Live: “It seems to be in too many cases that police are cherry-picking the evidence that is there in order to get a prosecution. That is not what the justice system is about; it should follow the evidence. Because of the failures in the system . quite frankly, lives have been ruined.” Charges against Isaac Itiary, 25, of rape and sexual activity with a child were dropped yesterday after text messages from the alleged victim showed she lied about her age. This is curious since, if successful, the individual can avoid punishment altogether or mitigate its impact where greater state intervention would otherwise be justified. This paper explores the potential for such legal malingering and examines some cases where it may have occurred, but concludes that the fear of legal malingering may be more powerful than the reality of its occurrence. It also observes, paradoxically, that the legal system is more at fault in failing to spot those whose impaired capacities should protect them from the full rigour of the criminal law; and that mental disorder is most likely overestimated as a cause of offending, but undervalued as a mitigating factor.

It argues that this presents a fatal challenge to the existing fields of knowledge and practice on either side of the discursive divide in terms of how alleged victims in UACSA cases are conceptualised and measured and how they are acted upon. It concludes with a call for an open-minded approach which prioritises the pursuit of truth in investigations to try to ensure that criminal justice system interventions in such an inherently problematic area are just and that they do not cause or compound the forms of harm and injustice currently at play.

    Savile, Operation Yewtree and related events Timeline to May 31st, 2017 October 31, 1926 James Wilson Vincent Savile born in Leeds, the youngest of seven children. 1955 The earliest incident of abuse recorded by the police, which took place in Manchester, where Savile was managing a dance hall. 1960 In one of the handful of example cases given by police, a 10-year-old boy asked Savile for his autograph outside a hotel. Savile allegedly took the boy inside and seriously sexually assaulted him. January 1, 1964 Savile presented the first ever Top of the Pops for the BBC. He had previously become a DJ at Radio Luxembourg in 1958. 1965 The first recorded instances of abuse by Savile took place at the BBC, at Leeds General Infirmary, where Savile was a long-term volunteer porter, and at Stoke Mandeville hospital, where he also volunteered. 1966 The start of what police have identified as Savile's peak period for abuse, which lasted for a decade. 1970 The first recorded abuse at Duncroft girls' school near Staines, Surrey, where Savile was a regular visitor. 1972 In another example offence listed by police, Savile indecently assaulted a 12-year-old boy and his two female friends who were attending a recording of Top of the Pops. 1980s At some point in the decade a female victim is believed to have told the Metropolitan police she had been assaulted in Savile's camper van in a BBC car park. The police file cannot be located and the investigating officer is now dead. August 1988 Savile appointed by Junior Health Minister Edwina Currie as Chair of an interim task force overseeing the management of Broadmoor Hospital, after its board members had been suspended.
