Keno to Go Policy

I. Purpose

Keno to Go allows customers to purchase Keno tickets and then view the game results remotely as opposed to viewing the results on a Sales Agent’s Keno monitor. Due to the need for increased flexibility to effectuate Keno sales, the State Lottery Commission (“MSLC” or “Lottery”) will activate Sales Agents to offer and sell Keno via Keno to Go in the same manner that it activates Sales Agents to sell Lottery draw games.

II. Definitions

a. Keno to Go. The sale of the game of Keno at Sales Agent locations that do not operate Keno (i.e., Sales Agent locations that do not have a Keno monitor and are not contemplated to have floor space devoted for solely for Keno sales).

b. License to operate Keno. Issued by the Lottery to Sales Agents to sell Keno at locations with a Keno monitor and contemplated to have devoted floor space for Keno sales.

III. Policy

a. Beginning on the effective date of this policy, the Lottery will activate its Sales Agents to offer and sell Keno via Keno to Go without providing the notification and notice that is required before issuing licenses to operate Keno. This is consistent with how the Lottery enables its Sales Agents to offer and sell Lottery draw games.

b. A Sales Agent’s sale, and a customer’s purchase, of a Keno ticket via Keno to Go is the functional equivalent of a transaction of a Lottery draw game (e.g., , , Mass Cash) and distinguishable from a Keno transaction from a fully operational Keno location.

c. If the Lottery is made aware of applicable zoning by-laws, ordinances, special permits, etc., that restrict Keno to Go, the Lottery will review and abide by such restrictions where appropriate.

d. Municipalities that are aggrieved by a Sales Agent selling Keno via Keno to Go may utilize G.L. c. 10, § 27 to object to a Sales Agent’s Lottery license by having “[a]ny three persons object[]” to the license and request

and be granted a public hearing by the Commission under the provisions of G.L. c. 30A.

IV. Background

The Lottery has offered the game Keno since September 1993. The operation of Keno requires a Lottery Sales Agent to utilize a Keno monitor and contemplates devoted floor space for Keno sales. The Lottery issues license to Sales Agents to operate Keno and prior to any such issuance, the Lottery is statutorily obligated to send notification to the municipality where the Sales Agent is located and to publish, in an appropriate newspaper, notice that an application for a license to operate Keno has been submitted. A local licensing authority may object to the issuance of a license to operate Keno and in such instance, the license may not issue unless the MSLC Chairperson or designee determines that the license is in the public interest.

The Lottery has offered Keno to Go since March 2008. Prior to activating Sales Agents to sell Keno via Keno to Go, the Lottery has previously provided the notification and notice that is required before issuing licenses to operate Keno. The Lottery is modifying this practice through the enactment of this policy.

The effective date of this policy is February 1, 2021.
