State House sends compromise higher ed bond bill to Senate by Janice Francis-Smith The Journal Record 3/18/2005

The compromise bill to provide $500 million for capital improvements at Oklahoma col- leges and universities passed the state House of Representatives by a vote of 80-19 on Thursday.

That vote on House Bill 1191 was bipartisan, with members of both political parties voting for and against the measure. When passed, the bill contained the bond package Speaker Todd Hiett, Gov. Brad Henry and Senate Pro Tempore endorsed Wednesday as a bipartisan agreement.

The bill would allow for a $475 million bond issue for higher education, to be repaid with state lottery proceeds. Gross production tax revenues are tagged as a backup funding source in case the lottery doesn't yield enough to pay the debt service on the bonds.

HB 1191 also provides $25 million to start a bond bank for colleges and universities to borrow money from to fund future capital improvements, and allows the University of Oklahoma and Oklahoma State University to initiate their own bond issues, with the ap- proval of the State Regents for Higher Education.

Members of the House Black Caucus debated against a section of the bill that would have the regents examine the expansion of course offerings in Tulsa. Though HB 1191 provides $17 million for Langston University - a university originally created for African- Americans during the era of segregation - one section of the bill eliminates a provision the Legislature created in 1998 to protect Langston University Tulsa.

Though OSU and OU also have Tulsa campuses, the Legislature agreed that only Langston would be able to offer four-year degrees. Enrollment has continued to decline at Langston's Tulsa campus, as students have been "voting with their feet" and enrolling at schools out- side the Tulsa area, said Hiett.

Rep. Opio Toure also objected to the fact that HB 1191, by Rep. , R-Tulsa, was originally filed as a measure directing the Office of State Finance to prepare the state budget. On the House floor, however, the bill was gutted by an amendment that replaced all language with the higher education proposal. State statute requires that amendments to legislation be germane, or deal with the same subject as the original bill. Despite Toure's objections, House Speaker Pro Tempore Susan Winchester, R-Chickasha, ruled the amendment to be germane.

2 Other legislators continued to question the constitutionality of the kind of bond debt the bill would allow, though the latest version of the proposal was designed to resolve earlier questions regarding whether the bonds - particularly those initiated by the universities - would stand up to a constitutional argument.

The $475 million measure is passed on a vote of 80-19, and now goes to the Senate.

OKLAHOMA CITY -- A $475 million bond issue for higher education won approval Thursday in the state House on an 80-19 vote.

Several lawmakers repeated earlier concerns about using lottery money to support bonds, while others said the bill could foretell an end to Langston University's Tulsa campus.

House Speaker Todd Hiett, R-Kellyville, has insisted that leaders make a commitment to allow all higher education institutions in the Tulsa area to provide more than a dozen bachelor's degrees now offered only by Langston-Tulsa.

Provisions regarding a Tulsa higher education plan are not spelled out in the bond issue bill, but will be considered in a separate measure.

The bond measure, House Bill 1191, now moves to the Senate. Earlier this week, the gov- ernor and leaders from both houses announced agreement on a bond plan.

Before the vote, Rep. Jabar Shumate, D-Tulsa, said: "I hope we won't make a decision that could close Langston-Tulsa."

Enrollment on the Langston-Tulsa campus has steadily declined in the past several years, and is now less than 600 students.

Rep. , R-Claremore, said Langston is being treated well in the bond proposal. Langston's overall enrollment is about 3,000 students and it would receive about $18 mil- lion.

Although the University of Central Oklahoma at Edmond has an enrollment of about 15,000 students, Jones said, it will be allotted about $19 million.

Rep. Opio Toure, D-Oklahoma City, said that Langston University President Ernest Hol- loway wanted the lawmaker to say in House floor debate Thursday that "it is treachery in- deed to make a commitment to citizens," but not keep it.

3 Jones pointed out several other provisions in the compromise bill endorsed by Hiett, Gov. Brad Henry and Senate President Pro Tem Cal Hobson, D-Lexington.

The final package is close to the original $500 million plan proposed by college presidents and supported by both Henry and Hobson, Jones said.

Other main features, he said, are an ongoing financing plan that would help colleges and universities to float bonds for capital needs as they materialize over the years.

"Today we saw all sides come together to embrace the best plan for Oklahoma's colleges and universities," Hiett said. "This agreement provides Oklahoma with a businesslike ap- proach to higher education needs."

Higher education bond projects for area

NSU-Broken Arrow: The bond issue would give the campus about $5 million to finish rooms and add parking. The added classrooms would give the campus room to expand such popular programs as education, business and criminal justice.

OSU Center for Health Sciences: The campus is requesting $4.4 million for a new heat- ing and cooling system, campus beautification efforts and renovations to the Dunlap Audi- torium.

OSU-Tulsa: About $14 million in bond proceeds would complete Phase II of the Ad- vanced Technology Research Center at OSU-Tulsa. Construction of Phase I is expected to begin in April. If the Legislature passes the bond issue, the two phases would be completed as one, allowing the university to save money and time on architectural services and other aspects of the project, said President Gary Trennepohl.

TCC: The bond issue would provide just more than $16 million for TCC's top two priori- ties: a distance-learning center on the Metro Campus and a math and science building on the West Campus. The first would house TCC's computer hub, laboratories, classrooms, television production studios and distance-education training space for faculty members, President Tom McKeon said. The second would allow science labs to move from con- verted lecture rooms and art rooms, he said.

OU-Tulsa: The school has had to cap enrollment in several programs and not add new de- grees because it does not have the necessary classroom space, said President Ken Levit. OU-Tulsa's $14 million share of bond proceeds would also pay for a parking garage and a new library, which would include a community health care resource center.

4 House backs $500 million college bond bill By Ryan McNeill The Oklahoman 3/18/2005

A $500 million higher education bond issue was approved Thursday by the House, despite black caucus members objecting to language in the bill they say could close Langston Uni- versity.

Some of the more conservative Republicans joined with liberal Democrats to vote against House Bill 1191, which passed 80-19. It now goes to the Senate.

The measure includes $475 million in construction projects and a $25 million "bond bank" for small colleges and universities.

The House was able to move the bill after Gov. Brad Henry and legislative leaders reached an agreement this week on the issue.

House Speaker Todd Hiett, R-Kellyville, said the bill "offers fundamental reform in the way we address infrastructure needs of our colleges and universities."

If the bill becomes law, Oklahoma State University and University of Oklahoma regents will have the power to issue their own debt for projects, ending what Hiett said is the re- quirement of college presidents to periodically "go for broke" to get money from the Legis- lature for improvements.

Every college and university -- except OSU and OU -- can access the bond bank funds by pledging money from revenue, such as student fees.

Supporters said the bond issue will attempt to increase Oklahoma's economic strength by creating jobs, luring federal research dollars and increasing the number of people with uni- versity degrees.

"We can't make one person go to college," said Rep. Tad Jones, R-Claremore, who handled most of the bill's floor questions. "But we can provide opportunities."

Black lawmakers aren't happy with the bill, which includes language asking state regents to consider expanding course offerings at some schools in Tulsa.

Rep. Opio Toure, the senior black lawmaker in the House, said it's a direct attempt to close Langston University, which depends on its Tulsa campus to remain financially viable.

Toure, D-Oklahoma City, called the language "a buried stake in the hearts of African- Americans."

5 Freshman Rep. Mike Shelton, D-Oklahoma City, read the words of the Langston fight song on the floor and said it's unlikely black lawmakers would oppose the bill if it didn't include language he thinks will cause closure of the traditionally black college.

"I don't expect any of you all to understand what Langston University means to African- Americans," Shelton said. Freshman Rep. Jabar Shumate, D-Tulsa, said Langton's enrollment in Tulsa already is de- creasing because of the increasing role of OSU and Northeastern State University cam- puses.

Langston's Tulsa enrollment has decreased from 1,551 to 756 during a three-year span. OSU-Tulsa's enrollment has increased from 1,425 to 2,333 during the same period.

"We all know the decisions we make today will close Langston in Tulsa," Shumate said.

Supporters of the measure countered that Langston is getting $18 million in projects under the bill, despite its declining enrollment.

"That's more per pupil than most of the universities are getting," said Rep. Daniel Sullivan, R-Tulsa.
