Decision: The AGRI Committee reappoints Ms Petir (EPP), Mr Nekov (S&D) and Ms McIntyre (ECR) as AGRI representatives on the STOA panel Efforts should be made to avoid scheduling STOA events related to agriculture at the same time as meetings of the AGRI Committee

7.2. BREXIT

Decision: The Secretariat is instructed to prepare draft paragraphs for an AGRI contribution to the future EP resolution on the Brexit negotiating mandate (guidelines) and launch a consultation process with political groups with a view to agreeing on the text to be submitted to the CCC

Subject: Opinion on petition No 2715/2014 on tax discrimination in the Italian truffle industry and distortions to the EU market

Dear Ms Wikström,

Thank you very much for your letter of 29 November 2016, with which you forwarded the above-mentioned petition to the Committee on Agriculture and Rural Development for its opinion.

The petitioner claims that, in breach of Annex I to the TFEU and of Regulation 1308/2013 on the CMO, truffles are not classified as agricultural products in Italy and are therefore subject to a VAT rate of 22%, whereas the Italian VAT rate for agricultural products is only 4%. Furthermore, he claims that Italian legislation on tax deduction and exemption is at odds with EU legislation. Therefore, he asks Parliament to call on the Commission to acknowledge that Italy has violated rights concerning the free movement of goods and that Italy’s discriminatory tax policy fails to comply with the EU guidelines provided for in Directives 2004/7/EEC and 77/388/EEC. Finally, he requests the Commission to call on Italy to classify truffles as agricultural products, as well as to bring infringement proceedings against Italy.

The AGRI Coordinators considered the issue raised in this petition at their meeting of 25 January 2017.

The Commission has, first, contacted the Italian authorities to obtain further information. Regarding the application of the higher VAT rate to truffles, the Italian authorities explained that, in their view, the specific characteristics of truffles are such that they are not in competition with other types of fungi, and that specific tax arrangements for them are therefore justifiable. Also, they argued that the VAT Directive of the Union (Directive 2006/112/EC of 28 November 2006 on the common system of value added tax) allows Member States, under certain conditions, to apply the reduced VAT rate selectively: hence, it was in their discretion not to apply to truffles the reduced VAT rate. Nevertheless, as regards the taxation of transactions between ‘amateur or occasional gatherers’ and the first purchasers of truffles, the Italian authorities acknowledged, in essence, that their system was at odds with the VAT Directive. They recognised, in fact, that what was being levied in that case was actually a tax on income, although it was termed VAT, and the VAT system was used, to some extent, to levy it.

Finally, the Italian authorities, after they had been contacted by the Commission, did modify PE597.618v01-00 12/21 PV\1115162EN.docx EN the tax rules applying to truffles. Article 29 of the so-called “European law 2015-2016” brought Italian national law in line with EU law. The Commission, therefore, dismissed the petitioner’s complaints.

As you know, the petition was considered again at the PETI committee meeting of 10 October 2016. The petitioner insisted that there were still problems comparing national and EU legislation; in particular, he pointed out that in several other Member States (e.g. France and Spain) the VAT rate on truffles is 4% or 5%. He added that, even though the new Italian legislation had indeed reduced the VAT rate on truffles from 22% to 10%, he still considered this to be discriminatory. Also, he stressed that in Italy truffles were still not recognised as agricultural products.

The Commission representative at the meeting stated that Member States are free to establish their own VAT rates, so that the application of a different VAT rate to truffles in Italy is not against EU legislation. In the ensuing discussion, it was reminded by some PETI Members that the issue of recognition, or not, of truffles as agricultural products in Italy seemed to remain open, whereas this issue does have consequences as regards taxation and industry certification. Thus, PETI finally decided to ask the Commission’s DG on Agriculture to give its opinion whether truffles should be considered as agricultural products under EU legislation.

On this, the Commission gave a clear reply: Truffles are indeed covered by Annex I of the Treaty (TFEU) as agricultural products. They are also covered by Regulation (EU) No 1308/2013 establishing a common organisation of the markets in agricultural products.

The AGRI committee, with a view to adopting its present opinion on this petition, has also asked the Italian authorities for information. On this, the Italian Ministry on Agriculture transmitted an information note that confirmed the modifications of the Italian legislation on tax deduction and exemption, which is now in line with EU provisions (as the Commission had already confirmed with its reply of 23 September 2016). Regarding the concern with the VAT rate -now reduced from 22% to 10%-, the Italian Ministry pointed out that the request for a further reduction to 4% could not be satisfied, as the VAT Directive does not allow for the application of reduced rates lower than 5%, with the only exception of rates introduced prior to 31 December 1993. Moreover, a reduction of the rate on truffles to 5% could be considered contrary to the same VAT Directive which allows each Member State to provide for a maximum of two reduced rates (in Italy, these two reduced rates are currently 4% and 10%).

In view of the above argumentation, the Committee on Agriculture can agree with the Commission and the Italian authorities that the petitioner’s complaints have been settled. Namely, the above-mentioned new Italian legislation has brought the taxation system on truffles in compliance with the VAT Directive, whereas the reduced rate of 10% is also in line with EU legislation. Finally, it has become obvious, in the meantime, that truffles are now recognised as agricultural products in Italy.
