BAILEY, CHIEF CLERK March 16, 2021 The Honorable Alejandro Mayorkas Secretary of the Department of Homeland Security Washington, D.C. 20528 Dear Secretary Mayorkas: We write to draw your attention to the “Report on DHS Administrative Review into I&A Open Source Collection and Dissemination Activities During Civil Unrest; Portland, Oregon, June through July 2020,” produced on January 6, 2021, by the Office of the General Counsel of the U.S. Department of Homeland Security. The report raises serious concerns about the Department’s Office of Intelligence and Analysis (I&A) which require a response from Department leadership. The report details a series of problems related to the legality of I&A operations, I&A’s relationships with other federal as well as state and local authorities, the allocation of resources and personnel, management and the internal climate at I&A, and accountability. We request that the Department provide the Congress an explanation of how it will address each of these issues, the extent to which the Department accepts and intends to implement the recommendations included in the report, and any additional reforms the Department may support. -

The History of Redistricting in Georgia
GEORGIA LAW REVIEW(DO NOT DELETE) 11/6/2018 8:33 PM THE HISTORY OF REDISTRICTING IN GEORGIA Charles S. Bullock III* In his memoirs, Chief Justice Earl Warren singled out the redistricting cases as the most significant decisions of his tenure on the Court.1 A review of the changes redistricting introduced in Georgia supports Warren’s assessment. Not only have the obligations to equalize populations across districts and to do so in a racially fair manner transformed the makeup of the state’s collegial bodies, Georgia has provided the setting for multiple cases that have defined the requirements to be met when designing districts. Other than the very first adjustments that occurred in the 1960s, changes in Georgia plans had to secure approval from the federal government pursuant to the Voting Rights Act. Also, the first four decades of the Redistricting Revolution occurred with a Democratic legislature and governor in place. Not surprisingly, the partisans in control of redistricting sought to protect their own and as that became difficult they employed more extreme measures. When in the minority, Republicans had no chance to enact plans on their own. Beginning in the 1980s and peaking a decade later, Republicans joined forces with black Democrats to devise alternatives to the proposals of white Democrats. The biracial, bipartisan coalition never had sufficient numbers to enact its ideas. After striking out in the legislature, African-Americans appealed to the U.S. Attorney General alleging that the plans enacted were less favorable to black interests than alternatives * Charles S. Rural communities are working to set up local emergency operation centers to help manage their response, but face challenges with limited staff capacity. Across many of our states, rural counties are experiencing outbreaks and some communities are already overwhelmed with the challenge. Throughout rural America, the Department of the Interior and the Department of Agriculture employ thousands of federal civil servants who have the relevant experience to assist with emergency response. For example, the U.S. Forest Service and Bureau of Land Management employ thousands of staff across the country who are Incident Command System qualified and have experience rapidly responding to forest fires, mobilizing critical resources, and managing information flow in times of crisis. With this expertise available, it is crucial that the Federal Emergency Management Agency provide the authorities necessary and work with both agencies to deliver effective, coordinated assistance to rural communities. -

The innovative programs established in this bill support currently operating nuclear reactors and the next generation of reactor technologies. ANIA would direct the Nuclear Regulatory Commission (NRC) to continue to modernize its regulatory review processes. Efficiencies in the environmental review process and reviewing new license applications will help enable nuclear energy to deploy at a rapid enough scale to support decarbonization. In addition, preemptively reviewing U.S. Department of Energy sites for demonstration reactors can help companies partner with the National Labs to test out innovative concepts, including advanced methods of manufacturing and construction. February 26, 2021 Support the Earmark Elimination Act, H.R. 1086 On behalf of our activist community, I urge you to contact your representative and ask him or her to cosponsor the Earmark Elimination Act, H.R. 1086, introduced by Reps. Ralph Norman (R-S.C.) and Ted Budd (R-N.C.). The bill would make permanent the temporary moratorium on congressional earmarks put into effect in 2010 by creating a point of order against any provision within a bill that matches the definition of an earmark. Earmarks, called by former Sen. Jeff Flake (R-Ariz.) the “currency of corruption,” are specific line items in a spending bill, such as an appropriations or transportation bill, for a project or program. Not only corruptive in nature, they are also, as the late former Sen. Tom Coburn (R-Okla.) astutely put it, “the gateway drug to spending addiction.” After Republicans faced widespread backlash to their rampant use of earmarks through 2010, the House Republican Conference signed off on a ban of all earmarks. At their peak in the mid 2000s, total earmarks reached nearly 14,000 in a single year (2005), costing upwards of $30 billion (2006). When Democrats took control of the House last Congress, earmarks did not make a return. Now, however, Democratic leadership is seriously considering bringing back earmarks. Proponents of earmarks argue that these extra spending provisions funding often-useless projects “grease the wheels” for legislation by persuading individual members to come on board for the sake of earmarked spending for their districts, and come at a small monetary price to taxpayers. -

Republican members can only use seniority to bump sitting chairs/ranking members when the control of the Senate switches parties. • Committee leadership for the Senate Aging; Agriculture; Appropriations; Banking; Environment and Public Works (EPW); Health Education, Labor, and Pensions (HELP); Indian Affairs; Intelligence; Rules; and Veterans Affairs Committees are unlikely to change. Notes • Current Armed Services Committee (SASC) Chairman John McCain (R-AZ) continues to receive treatment for brain cancer in Arizona. Senator James Inhofe (R-OK) has served as acting chairman and is likely to continue to do so in Senator McCain’s absence. If Republicans lose control of the Senate, Senator McCain would lose his top spot on the committee because he already has six years as ranking member. • In the unlikely scenario that Senator Chuck Grassley (R-IA) does not take over the Finance Committee, Senator Mike Crapo (R-ID), who currently serves as Chairman of the Banking Committee, could take over the Finance Committee. -

Coburn, M.D. United States Senate Written Testimony Committee on Oversight and Government Reform U.S. House of Representatives “Government 2.0: GAO Unveils New Duplicative Program Report” February 28, 2012 Chairman Issa, Ranking Member Cummings, and Members of the Committee: Thank you for the opportunity to participate in today’s hearing on the release of the Government Accountability Office’s (GAO) second annual report on duplicative federal programs. Director Dodaro and the staff at GAO are to be commended for their excellent work and dedication to such a large endeavor, one few others in Washington are willing to undertake, but the topic of which is of upmost importance. Federal duplication and the mismanagement of taxpayer funding in the current labyrinth of government programs is one of the most critical matters currently facing Congress. We must eliminate duplication immediately wherever we find it, and stop making the maze more tangled with our shortsightedness by continuing to create new, unnecessary and duplicative programs. If we do not, Congress will be unable to reign in federal spending and our financial situation will only continue to worsen, while thousands of ineffective government programs continue to fall short of meeting the needs of those we intend to help. My testimony today will examine some of the primary pitfalls of our current state as a nation of duplication, and provide a look at past and present efforts to eliminate duplication including the comprehensive deficit reduction plan I released last year, and also discuss ways Congress can prevent duplication in the future. DUPLICATION NATION The findings of GAO’s 2012 report, as detailed by Director Dodaro, are a sobering reminder and a revealing look at a government grown far beyond what many imagined possible, funding hundreds of programs decidedly outside the scope of the Enumerated Powers as enshrined in the Constitution. -

As Congress works to move a WRDA bill into the conference process and ultimately pass a bipartisan bill in 2020, we submit the following comments on the House and Senate Water Resources Development Act bills. We support the following provisions in the House WRDA bill: Section 109: This section directs the Army Corps to issue final agency procedures for the Principles, Requirements, and Guidelines (PR&G). These new guidelines would serve as the basis for the Corps’ evaluation of project benefits and costs. We strongly support the section’s requirement that the Army Corps carry out a public comment period prior to the release of PR&G guidelines and review its PR&G guidelines every five years. Section 110: This provision amends the Corps’ Floodplain Management Service program to provide more robust technical assistance, including assistance that would help to avoid repetitive flooding impacts.
