National Anthem National Anthem was played. 11-01 a.m. 2. Announcement regarding the Leader of the Opposition The Chairman made the following announcement:— “I have to inform Members that I have accorded recognition to Dr. Manmohan Singh, Member and Leader of the Indian National Congress Party in the Rajya Sabha, as the Leader of Opposition in the Rajya Sabha with effect from the 15th June, 2001 consequent upon his re-election to the Rajya Sabha on the 15th June, 2001.” 11-02 a.m. 3. Oath or Affirmation The following Members made and subscribed oath and took their seats in the House:— ASSAM 1. Dr. Manmohan Singh, Leader of the Opposition 2. Obituary References The Chairman made references to the passing away of: — 1. King Birendra Bir Bikram Shah Dev and other members of the Royal Family of Nepal; 2. Shri R.K. Narayan (ex-Member); 3. Shri G.Y. Krishnan (ex-Member); 4. Shri Jagan Nath Kaushal (ex-Member); 5. Shri Mohammad Yunus (ex-Member); 6. Shri Niren Ghosh (ex-Member); 7. Shri V.C. Ganesan (ex-Member); and 8. Shri S.S. Bhalerao (ex-Secretary-General, Rajya Sabha). The House observed silence, all Members standing, as a mark of respect to the memory of the departed. 11-16 a.m. 5. Reference regarding Train accident near Kozhikode in Kerala The Chairman made a reference to the great tragedy that took place on the 22nd June, 2001 when four bogies of the Mangalore-Chennai Mail jumped the tracks and fell into overflowing Kadalundi river near Kozhikode in Kerala killing over 50 persons and leaving hundreds of others injured in the accident and expressed the heartfelt condolences of the House to the affected families in their hour of grief and prayed for the early recovery of those who had been injured. The House observed silence, all Members standing, as a mark of respect to the memory of those who lost their lives in the tragedy. 23RD JULY, 2001 11-17 a.m. 6. Reference by the Chairman The Chairman made the following reference:— “Hon’ble Members, it is with utmost grief and sorrow that I refer to the tragic deaths of 13 persons including 6 pilgrims during this year’s Amarnath Yatra at Sheshnag and also in Doda District on the 21st July, 2001. The Yatra which symbolizes peace and harmony is however continuing and devotees in large numbers are visiting the holy shrine. I am sure the whole House will join me in condemning this barbaric act which has shocked the entire civilized world, and would join me in offering condolences to the bereaved families. I request Members to rise in their places and observe silence as a mark of respect to the memory of those who lost their lives in this tragedy.” (As a mark of respect to the memory of King Birendra Bir Bikram Shah Dev, the House adjourned at 11-18 a.m. till 11-00 a.m. on Tuesday, the 24th July, 2001.) ____________ RAJYA SABHA TUESDAY, THE 24TH JULY, 2001 (The Rajya Sabha met in the Parliament House at 11-00 a.m.) 1. Proclamation under Article 356 of the Constitution Shri Chennamaneni Vidya Sagar Rao (Minister of State in the Ministry of Home Affairs) on behalf of Shri L.K. Advani laid on the Table a copy each (in English and Hindi) of the following papers:— (i) Proclamation [G.S.R. No. 410(E)], issued by the President on the 2nd June, 2001, under article 356 of the Constitution in relation to the State of Manipur, under clause (3) of the said article. 24TH JULY, 2001 (ii) Order [G.S.R. No. 411(E)], dated the 2nd June, 2001, made by the President under sub-clause (i) of clause (c) of the above Proclamation. (iii) Reports of the Governor of Manipur dated the 31st May, 2001, to the President recommending the issue of the Proclamation. 12-01 p.m. 4. Shri O. Rajagopal (Minister of State in the Ministries of Parliamentary Affairs and Railways) laid on the Table a copy each (in English and Hindi) of the following Ordinances under sub-clause (a) of clause (2) of article 123 of the Constitution: — (1) The Indian Council of World Affairs (Second) Ordinance, 2001 (No. 3 of 2001), promulgated by the President on the 8th May, 2001. (2) The Food Corporations (Amendment) Ordinance, 2001 (No. 4 of 2001), promulgated by the President on the 22nd May, 2001. (3) The Live-Stock Importation (Amendment) Ordinance, 2001 (No. 5 of 2001), promulgated by the President on the 5th July, 2001. Shri Gingee N. Ramachandran (Minister of State in the Ministry of Finance) laid on the Table the following papers:- I. A copy each (in English and Hindi) of the following Notifications of the Ministry of Finance, (Department of Revenue), under section 159 of the Customs,s Act, 1962, alongwith Explanatory Memoranda thereon:— (1) G.S.R. 231(E) dated 30th March 2001 publishing notification number 35/2001-Customs dated 30.3.2001 seeking to supersede Notification No. 27/2001-Customs, dated 5.3.2001(GSR No.163(E) dated 5.3.2001) and exempt raw pearls, natural or cultured, rough diamonds and other precious or semi-precious stones, unset and uncut, when imported into India against a valid (i) Replenishment Licence; (ii) Diamond Imprest Licence; and (iii) Bulk Licence issued in terms of RAJYA SABHA the specified Exim Policy Provisions (read with the Handbook of Procedures) form the whole of the duty of Customs leviable thereon under the said First Schedule to the Customs Tariff Act, 1975 and the additional duty leviable thereon under section 3 of the said Customs Tariff Act. (2) G.S.R. 295(E) dated 26th April 2001 publishing notification number 44/2001-Customs, dated 26.4.2001 seeking to amend notification No. 17/2001-Customs, dated 1.3.2001. (3) G.S.R. 299(E) dated 26th April 2001 publishing notification number 17/2001-Customs dated 1.3.2001 seeking to prescribe a basic Customs duty rate of 15% advalorem on populated PCBs of transmission apparatus other than apparatus for radio broadcasting or television and populated PCBs of transmission apparatus incorporating reception apparatus. (4) G.S.R. 360(E) dated 16th May 2001 publishing notification number 55/2001-Customs dated 16.5.2001 seeking to provide exemption from payment of Customs duty to cut & polished diamonds when re-imported after certification/grading by the specified laboratories/agencies abroad as detailed in the notification subject to fulfillment of conditions specified in this behalf. (5) G.S.R. 377(E) dated 18th May 2001 publishing notification number 56/2001-Customs dated 18.5.2001 seeking to amend certain notifications so as to align these notifications with the amended provisions of Export and Import Policy, 1997-2002 relating to EOU/EPZ/STP/EHTP/SEZ schemes. (6) G.S.R. 381(E) dated 22nd May 2001 publishing notification number 23/2001-Customs (NT) dated 22.5.2001 seeking to appoint the 1st day of June, 2001 for the purpose of section 106 of the Finance Act, 2001 which reduces the warehousing period under section 61(2) (ii) of the Customs Act, 1962 from six months to thirty days. (7) G.S.R. 412(E) dated 4th June 2001 publishing notification number 61/2001-Customs dated 4. 6. 2001 seeking to amend the notification No.35/2001-Customs dated 30.3.2001 so as to provide exemption from payment of duty of Customs, to raw pearls, natural or cultured, rough diamonds, precious or semi-precious stones, unset or uncut imported against replenishment licenses issued to the DTA unit against supply of cut & polished diamonds, precious or semi precious stones made to EOU/EPZ/SEZ units. 24TH JULY, 2001 (8) G.S.R. 416(E) dated 7th June 2001 publishing notification number 62/2001-Customs dated 7.6.2001 seeking to inset an explanation each to serial number 314 and 315 of the Table to notification 17/2001-Customs dated 1.2.2001 to clarify the scope of term completely built-up Unit (CBU) specified in the entry against said serial numbers.
