CAWV SCHOLARSHIP FOUNDATION KICKS OFF FUNDRAISING CAMPAIGN AT ANNUAL MEETING

The CAWV Scholarship Foundation kicked off a fundraising campaign at this year’s CAWV Annual Meeting July 13-16 at The Greenbrier. During the President’s Banquet, the foundation received a $50,000 contribution from the Orders Family Trust. Members at the meeting were so moved by the generous donation, they quickly generated an additional $56,000, totaling $106,000 in contributions.

“What a wonderful evening it was,” stated CAWV President Scott Pierson. “When members found out what Bob Orders had done, they quickly stood to pledge matching contributions to the Scholarship Foundation. There was another $56,000 donated in a matter of minutes. This speaks volumes to caliber of members in this organization. Their generosity will provide the future workforce for West Virginia’s construction industry.”

CAWV Scholarship Foundation Chairman Gene Thompson said the CAWV scholarship program has been instrumental in helping keep countless construction and engineering students in the state after graduation. “The CAWV Scholarship Board of Trustees has developed an in-depth selection and screening process of the candidates that leads to some hard choices when it is time to select on overall winner once the field is narrowed down to the top group of candidates,” said Chairman Thompson. “Over the past several years the CAWV has been able to not only award the top prize, which is now $6,000, but has averaged awarding five to six other students smaller amounts to help them with their education expenses. This has led to the CAWV having great success in getting our finalist into either internships or permanent positions with members from all over the state, and several finalists have gone on to start their own companies and have become successful dues paying members of the CAWV.”

The CAWV Scholarship Foundation was established in 1989. The scholarship is available to sophomores, juniors and seniors enrolled, or planning to enroll, in civil engineering or a construction related four year degree program in a West Virginia college or university. Eligible schools include West Virginia University, West Virginia University Institute of Technology, Fairmont State University, Bluefield State College or Marshall University. Hundreds of thousands have been given in scholarships since the foundation’s inception.

“The generosity of Bob Orders and our members at the Annual Meeting is what sparked this campaign,” said Chairman Thompson. “We know there are number of members who will want a chance to donate.” The board is developing a campaign that will go out to the full membership in the coming weeks. THE NEW YORK TIMES RELEASES ARTICLE ON WEST VIRGINIA’S PUSH ON VOCATIONAL EDUCATION

The New York Times this week released the article, “Seeing Hope for Flagging Economy, West Virginia Revamps Vocational Track,” which highlights West Virginia’s heavy push on vocational education. The push comes as leaders of both political parties have talked about making it a priority, a shift from the No Child Left Behind era of education reform, in which college for everyone was often the goal. CAWV member Ron Foster, president of Foster Supply Inc., and Kathy D’Antoni, state director for career and technical education, are quoted in the article. We are saddened to report that long time member Lee Reger passed away at United Hospital Center on June 21, 2017. In 1985 he founded Lee Reger Builds, Inc., Shinnston, where he worked until his retirement in 2012. He served on Shinnston City Council as well as numerous civic and professional organizations. He was former chairman of the National Frame Builders Association. SCHOOL BUILDING AUTHORITY FORMS COMMITTEE TO REVIEW CONSTRUCTION MANAGEMENT POLICY

The School Building Authority of West Virginia has formed a committee to discuss the authority’s recent practice of hiring construction management (CM) firms to help manage construction and renovation projects funded by the SBA. The committee held its first meeting August 4 and listened to speakers, pro and con, on the use of CM services. The governor’s office formed the committee after county boards of education, including Logan County and Monroe County, have sought to get out of the hiring requirement. SBA committee members noted that they have heard county superintendents are upset about the amount of money spent on the CM process. Other members expressed concern that the SBA is forcing counties to use construction managers.

An article in the August 7 WV Gazette Mail wrote that SBA Director of School Planning and Construction Scott Raines, along with other SBA staff Thursday, defended hiring construction management firms. “We would have errors and omissions in the construction drawings and the architect wouldn’t — couldn’t be held accountable, and the contractor would ask for change orders or the contractor would be delayed on projects, and without any given justification, and nothing would be done about it,” the article quotes Raines as saying. “The architect wouldn’t hold the contractor’s feet to the fire and, as owners [of the school being constructed,] the counties don’t have the ability either.”

He said county public school systems don’t have breach of contract coverage, “so whenever they refuse a change order, or if they try to hold someone’s feet to the fire, then they’re in breach of contract, the contractors and the architects come after [the school system]. If the architect doesn’t recommend to the county [school system] that you don’t pay it, and [architect employees] sign off on that pay application, then they have to pay it,” Raines said, or else the school system will be accused of breach of contract. Raines said the construction management process has saved $11.4 million so far.

At the start of Thursday’s meeting, the article stated, committee member Steve Burton, who is vice president of the SBA and is the retired president of the West Virginia State Building and Construction Trades Council union organization, said he has been against construction managers since “day one.” He said he has heard unions are also against the current construction management process.

Fellow committee members Victor Gabriel and Steve Paine also said at the outset they have heard county school superintendents are upset about the money spent on construction management firms. Paine, who is also the state schools superintendent and asked to be on the committee, said the superintendents he has spoken with “thought that that money should be put back into the project for square footage for kids.” “Nobody said that they added value,” Paine said.

“West Virginia is not in financial shape right now, or in a state that we can afford to spend this kind of money to make sure the project gets done,” Gabriel said, adding that about $5 million of the $50 million the SBA granted in the last funding cycle was projected to go to construction managers, with $5 million more going to architects. The fourth committee member, SBA board chairman Nick Casey, didn’t express a clear opinion Thursday, though he said “it seems like the SBA is kind of paternalistic” to school systems by forcing them to use construction management firms.

The CAWV Joint Architects Committee presented its recommendations to the SBA a few years ago stating that the construction management process has value when it’s utilized on a project of a certain size and scope, but not on projects in the $5 million to $25 million range. The SBA did not accept the CAWV’s recommendation and CMs are being used on projects less than $10 million in scope.

Q&A: OSHA REGULATIONS ON CONCRETE SILICA DUST

On September 23, the U.S. Department of Labor will begin to enforce its reduction in the amount of silica that construction workers can be exposed to over an eight-hour day. The U.S Department of Labor will start enforcing its new concrete silica dust ruling for construction on September 23, 2017 (moved from June 23, 2017). With those new OSHA regulations coming up, it’s important to be up to date on all the new changes regarding the OSHA standards. But do facility owners and executives, and project managers know how to comply?

Q: What is the new silica dust regulation and why is it happening? A: When the U.S. Department of Labor issued its ruling aimed at better protecting workers from respirable silica dust, no one was surprised. Compliance with the new rule went into effect June 23, 2017, and enforcement begins September 23, 2017. The upgraded regulation substantially reduces the permissible exposure limits (PEL) for workers in the construction industry. The Department of Labor’s Occupational Safety and Health Administration (OSHA) will enforce a reduction in the amount of silica that workers can be exposed to over an eight-hour day from 250 micrograms per cubic meter of air to 50 micrograms.

Q: What exactly is silica? What kind is OSHA so concerned about? A: Silicon (Si) is the second most common element on Earth, making up 28% of the planet’s crust. Oxygen is the most common element at 47% and aluminum is a distant third at 8% Silicon combines with oxygen to form quartz (SiO2) — an example being sand. Silica is a component in a wide range of the Earth’s rock.

Q: Is respirable crystalline silica a threat to life? A: Inhalation of respirable crystalline silica is a threat to life. Particles can be created by natural forces such as wind, which causes particles to collide and form smaller particles. According to OSHA, it’s estimated that 2.3 million U.S. workers are exposed to respirable silica dust at work each year.

Q: But aren’t there already OSHA regulations in place to limit silica exposure? A: OSHA set limits on respirable crystalline silica dust exposure in 1971, shortly after the agency was created. These regulations, based on research from the 1960s and earlier, soon showed that they didn’t adequately protect workers. The limits were imposed as formulas that many people found difficult to understand. The new rule limits the amount of silica dust that workers can be exposed to on the job to 50 μg/m3 averaged over an eight-hour shift for all industries covered by the rule. That’s about 1/20th the size of a grain of salt.

Q: So what should contractors and people on the jobsite do to avoid silica dust exposure? A: Employers are required to use “engineering controls” such as vacuum dust collection systems and water-delivery systems to limit worker exposure to respirable silica dust and use respirators as required. Specified exposure control methods are referenced in OSHA Table 1.

Q: How do I know what tools I need for the job I’m doing? A: At the heart of the new silica dust control regulations for the construction industry is OSHA Table 1, mentioned above. Table 1 matches common construction tasks with effective dust control methods for those tasks. The table has three columns: the task or equipment being used, a column describing the method for controlling dust and a third column stating what type of respiratory protection is needed when performing the task. By finding a work activity on the table, it’s easy to determine what steps are necessary to ensure compliance.

Q: Then what’s the alternative? A: The best way to control respirable crystalline silica dust is to remove it as it’s created. Power tool manufacturers have developed products and systems to help meet OSHA requirements for limiting silica dust exposure. The focus is on developing better dust extractors and attachments, such as shrouds, to capture dust at the source.

Q: How are concrete workers supposed to capture dust so it doesn’t become airborne? A: For most concrete applications, tool attachments that confine dust are connected to vacuums to prevent particles from becoming airborne. These systems represent a primary method for keeping the air clean. Attachments include shrouds for grinders and dust extraction attachments that fit around chipping hammer bits and hammer drill bits.

Another component specifically for drilling concrete are dust extraction bits. The bit allows dust created at the bottom of a hole being drilled to be sucked through the center of the bit and collected in the dust extractor. These bits are both OSHA and code approved for use with epoxy anchors. In addition, employers must create processes that minimize release of respirable silica dust into the environment during maintenance of tools and employee change of work clothes.

Q: So, I just connect these accessories to my regular vacuum in the shop? A: No. The vacuum needs to have a high amount of CFM suction (+150), a filter cleaning feature built in and it is ideal for them to be HEPA compliant. To qualify as HEPA, U.S. government standards require that the air filter remove 99.97% of particles with a size of three microns or less. HEPA filters are expensive, but necessary for removing small particles. When looking for a HEPA vacuum filter that meets OSHA requirements, it must state on the filter that it will remove particles three microns in size or less. As a filter removes smaller and smaller particles, the power and airflow of the vacuum, as measured in cubic feet per minute (cfm), must increase.

Q: How do you clean these specialty filters to make sure the vacuum still functions properly? A: OSHA requires vacuum filters to function properly at all times. For vacuums intended for concrete/fine dust collection, certain vacs provide a feature that automatically cleans the filter every 15 seconds with reverse blasts of air to ensure the filter maintains its utility. Other manufacturers employ different filter-cleaning methods. Filters should never be washed out, especially when concrete dust is involved because it will harden in the filter pores and render the filter useless.

Q: This is a lot to digest (enforcement date is September 23). How will this affect productivity when we’re trying to finish a job? A: The enforcement date varies by state, but for the majority September 23 is the date. This entire effort ties back to keeping people safe. There is no cure for silicosis or other silica-related diseases, so worker health depends on limiting exposure. Although regulation is sometimes viewed as limiting productivity, in this instance it can actually be enhanced. The respirable silica dust regulations require use of already accepted control methods that make implementation easier.

CAWV CONTACTS CONGRESSIONAL DELEGATION TO SUPPORT DRINKING WATER BILL

The CAWV is contacting West Virginia’s congressional delegation to get their support for HR 3387, the “Drinking Water System Improvement Act,” and asking them to consider becoming a co-sponsor of the legislation. America’s water systems are in dire need of repair, and The Drinking Water System Improvement Act would facilitate much-needed upgrades to drinking water systems across the country. Sponsored by Mississippi Congressman Gregg Harper, HR 3387 would authorize up to $8 billion for the Drinking Water State Revolving Fund over the next five years, in addition to approving up to $750 million for the Public Water System Supervision grant program.

This bipartisan bill is timely, and over a decade in the making. The State Revolving Funds are the primary source of funding for the repair and replacement of our nation’s water systems, yet they have not been fully authorized since 2001. In late June, HR 3387 was unanimously approved by the House Committee on Energy and Commerce and now heads to the floor for a full vote. The CAWV will ask Reps. David McKinley, Alex Mooney and Evan Jenkins to sign-on to this bipartisan effort to help ensure that every American has safe and healthy water to drink.

The Drinking Water System Improvement Act would facilitate much-needed upgrades to drinking water systems across the country by authorizing up to $8 billion for safe drinking water over the next five years, in addition to approving up to $750 million for the Public Water System Supervision grant program. Passing HR 3387 would be the first reauthorization of the SRF since 2001 and the first to move forward with bipartisan support. It provides $8 billion in capitalization grants for FY 2018 through FY 2022. Specifically, it authorizes:

 $1.2 billion in FY 2018  $1.4 billion in FY 2019  $1.6 billion in FY 2020  $1.8 billion in FY 2021  $2.0 billion in FY 2022

EPA BACKS $56.5M PLAN BY WEST VIRGINIA FOR WATER INFRASTRUCTURE PROJECTS

The U.S. Environmental Protection Agency this week announced it has approved and helped fund a $56.5 million plan by West Virginia to implement key water infrastructure projects, including new and upgraded wastewater treatment plants to better serve residents, increase efficiency and reduce pollution. The Intended Use Plan includes an award of $20.66 million from EPA's FY 2017 Clean Water State Revolving Fund (CWSRF). The plan by the West Virginia Department of Environmental Protection is also funded with a $4.1 million state match, repayments from prior CWSRF loans, and interest earnings. WVDOH REVERSES POLICY ON PUBLISHING BID TABULATIONS AND BID RESULTS

The WV Division of Highways will again be publishing bid tabulations following award of highway construction projects, a practice discontinued in the latter part of 2016. A number of members, including prime contractors, subcontractors, M/WDBE firms and suppliers, have been expressing concern over the policy, most who felt the tabulations were public information and necessary for effectively conducting business, and to provide the division with the best possible bids. The WVDOH will reportedly also be restoring the practice of providing the association a summary of bid results immediately after the opening and reading of the bids.

The CAWV appreciates the WVDOH management for restoring these policies and practices which have served the state well for several decades. The CAWV also looks forward to reestablishing the committee and subcommittee structure that was eliminated last year. PARKWAYS AUTHORITY GETS STARTED ON NEW DEBT, TOLLING PROGRAM FOR TURNPIKE

The West Virginia Parkways Authority approved a resolution Thursday that puts into motion plans to sell up to $500 million in revenue bonds to pay for road construction projects in 10 southern West Virginia counties. The plan, proposed by Gov. Jim Justice and approved by state lawmakers, calls for an entire reworking of the Turnpike’s tolling system. A traffic and revenue report is expected to be done by the end of the calendar year, Parkways Authority General Manger Greg Barr. “Once that revenue study is completed then that’s when we’ll start being able to calculate what the potential size of the bond issue will be,” Barr said.

The new state law calls for a single-pay annual pass to be offered to both in-state and out-of- state residents for passenger vehicles anywhere from $8 to $25, which is much less than the current annual discounted toll rates. Barr said that will likely result in toll increases for those who don’t have the passes. Parkways-hired traffic and revenue engineers will determine through surveys and other statistical information toll increase options and bonding capacity. “They’re going to use web-based surveys for the EZ pass customers and postcards, handouts by the toll collectors, for the cash paying customers, so we can get these people to respond to the survey,” Barr said.

Barr said one option is to transition to the higher toll. Gov. Justice has mentioned a possible doubling of the current $2 toll, Barr said. “To me the governor is thinking somewhere between a 50 percent and 100 percent increase but that’s without a study,” Barr said. The law requires public meetings in the Turnpike counties to gain input before final decisions are made about the annual pass and future tolls, Barr said. Once the bonds are sold the tolls will pay the debt payment and the money from the bonds will be placed in a special road fund account controlled by the state Division of Highways for projects in 10 southern counties.

The bonds for the Turnpike were approved when legislators voted for S.B. 1003 in the special session of the WV Legislature. The bill was part of Governor Jim Justice’s $2.8 billion highway funding packing to improve and build new roads and to create thousands of jobs.

TRANSPORTATION CONSTRUCTION DRIVERS NEED REGULATORY EXEMPTION, AGC AND ARTBA SAY

Federal hours of service regulations to address long-haul trucker fatigue should not apply to transportation construction drivers, whose road time is usually limited by project geography, ARTBA has told the U.S. Department of Transportation. Over-application of hours of service rules increases the cost of transportation projects by disrupting materials delivery and efficient worker schedules. That’s a particular problem when public agencies and motorists expect transportation projects to be completed as quickly, and as inexpensively, as possible. ARTBA’s Aug. 9 comments were made as part of a submission supporting an exemption for the Pipe Line Contractors Association. ARTBA also noted multiple other groups had been exempted from the regulatory requirements, including fireworks shippers. Rather than exempting one segment of commerce at a time, ARTBA has long held that all transportation construction drivers should not be subject to the rule.

Dec. 18 is the deadline for motor carriers to comply with a U.S. Department of Transportation mandate to install and use electronic logging devices on trucks to record drivers' hours of service. The Federal Motor Carrier Administration (FMCSA) issued the mandate for all motor carriers required to maintain Records of Duty Status (RODS) for Hours of Service (HOS) compliance. AGC has sought an exemption from this requirement for construction industry truck drivers but that request has not been accepted.

Rep. Brian Babin (R-Texas), a member of the House Transportation and Infrastructure Committee, has introduced legislation to delay the mandate for two years. AGC is supporting this legislation in the hope that the delay will allow the necessary time to make the case with FMCSA that this requirement is unnecessary for construction.
