THE EXECUTIVE COMMITTEE RECOMMENDS THAT 4.79 hectares (11.84 acres), more or less, of vacant land, being Block 129 on draft M-Plan by J.D. Barnes, Reference No. 10-21-239-00-MP, located south of Bethesda Side Road and west of Ninth Line, Town of Stouffville, Regional Municipality of York, be purchased from Villa Parso Home Corporation;

THAT the purchase price be $2.00;

THAT Toronto and Region Conservation Authority (TRCA) receive conveyance of the land free from encumbrance, subject to existing service easements;

THAT TRCA solicitors, Gardiner Roberts LLP, be instructed to complete the transaction at the earliest possible date. All reasonable expenses incurred incidental to the closing for land transfer tax, legal costs, and disbursements are to be paid;

As a condition of site plan approval, the valleylands are to be transferred to TRCA for the nominal fee of two dollars ($2.00).

Negotiations have been conducted with Mike McLean of Fieldgate Developments.

Attached is a plan showing the location of the subject lands.

RATIONALE The subject property falls within TRCA’s approved master plan for acquisition for the Rouge River watershed as outlined in the approved Greenlands Acquisition Project for 2011-2015. Through the review of the plan of subdivision (19T(W)-11.003), TRCA staff established the limits of the valleylands (i.e. Part 29 on M-Plan).

574 TAXES AND MAINTENANCE The estimated annual property taxes for the subject property is $1,940.00. The addition of the subject parcel of land will not significantly impact TRCA's maintenance costs at this location.

RATIONALE The subject property falls within TRCA’s approved master plan for acquisition for the Rouge River watershed as outlined in the approved Greenlands Acquisition Project for 2011-2015. Through the review of subdivision 19T-97010 for a proposed residential development of this site, TRCA staff established the limits of the open space lands (i.e. Block 10 on the draft M-Plan) which is comprised of valleylands. Further, the owner will grant TRCA an easement on Parts 9, 10, 13 & 14 as per Registered Plan 65R-33448 for access to the open space lands. There is also a barn and asphalt driveway on Block 10 which will be removed at the owner's expense to TRCA's satisfaction prior to transfer.

577 TAXES AND MAINTENANCE Based on preliminary review of the environmental criteria for lands that are eligible to receive a property tax exemption under the provincial Conservation Land Tax Incentive Program, it would appear that all of the subject property would be eligible for exemption for the 2014 taxation year. The Town of Richmond Hill has agreed to maintain the property.

Negotiations have been conducted with Mr. Robert Blunt, Land Use Planner, of Dentons Canada LLP, acting as agent on behalf of the owner.

Since TRCA does not presently own any adjoining property, a temporary access easement across the internal road network of the health care facility (i.e. via Arnott Avenue) will be granted to TRCA as part of this transaction in order that TRCA staff and staff of the City of Toronto Parks, Forestry & Recreation Department are able to inspect and maintain the subject lands.

580 RATIONALE The subject property falls within TRCA's approved master plan for acquisition for the Don River watershed as outlined in the Greenlands Acquisition Project for 2011-2015. Through our review of Site Plan Application 11 244148 NNY 10 SA and Zoning By-Law Amendment Application 04 166416 NNY 10 OZ (as circulated for comment by the City of Toronto) for a continuing care retirement facility, TRCA staff established the limits of the open space lands identified as, Part 1 on the Draft Plan of Survey, which are located partially within the Regional Storm Flood Plain and entirely within the Regulated Area of the West Don River valley corridor. As part of the planning approval process, staff staked the valley top of bank which is the limit of the subject land being acquired by TRCA. An additional 5 metre tableland buffer, beyond the top of bank, is being transferred to the City of Toronto, which will be used for a trail that will be constructed by the City at a later date.

TAXES AND MAINTENANCE It is proposed that the lands be turned over to the City of Toronto for management per the existing management agreement.

THAT the purchase price be $2.00;

As a condition of subdivision registration, Marshall Homes (Riverside) Ltd. is to transfer the valleyland buffer lands to TRCA. Further, Marshall Homes (Riverside) Ltd. will construct a recreational trail over a portion of the lands. TRCA's Planning and Development staff is currently reviewing the trail plans. A management agreement for the subject property will be negotiated between TRCA and the Town of Ajax upon acquisition of the land.

Negotiations have been conducted with Mr. TJ Cieciura, Planner, of Design Plan Services Inc.

RATIONALE The subject property is composed primarily of valleyland buffer lands and falls within TRCA’s approved master plan for acquisition for the Duffins Creek watershed as outlined in the approved Greenland Acquisition Project for 2011-2015.

THE EXECUTIVE COMMITTEE RECOMMENDS THAT WHEREAS Toronto and Region Conservation Authority (TRCA) is in receipt of a request from the City of Toronto to provide a permanent easement for the replacement of a portion of the Burke Brook Ravine Sub Trunk Sanitary Sewer located east of Bayview Avenue and north of Glenvale Boulevard, City of Toronto (North York Community Council Area), Don River watershed;

AND WHEREAS it is in the best interest of TRCA in furthering its objectives as set out in Section 20 of the Conservation Authorities Act to cooperate with the City of Toronto in this instance;

THEREFORE LET IT BE RESOLVED THAT a permanent easement containing a total of 0.21 hectares (0.52 acres), more or less, be granted to the City of Toronto for the replacement of a portion of the Burke Brook Ravine Sub Trunk Sanitary Sewer, said land being Part of Lot 3, Concession 2 EYS, City of Toronto (North York Community Council Area), designated as Parts 1 to 10 on a Draft Plan of Survey prepared by KRCMAR Surveyors Ltd., under their Job No. 04-063, Drawing 04-065RP03, dated October 22, 2013;

THAT consideration be the nominal sum of $2.00, plus all legal, survey and other costs to be paid by the City of Toronto;

THAT the City of Toronto is to fully indemnify TRCA from any and all claims from injuries, damages or costs of any nature resulting in any way, either directly or indirectly, from the granting of this easement or the carrying out of any construction;

AND FURTHER THAT authorized TRCA officials be directed to take the necessary action to finalize the transaction including obtaining needed approvals and signing and execution of documents. CARRIED

586 BACKGROUND The City of Toronto has formally requested a permanent easement for the replacement of the eastern portion of the Burke Brook Ravine Sub Trunk Sanitary Sewer, located east of Bayview Avenue and north of Glenvale Boulevard. Due to the redevelopment of the Canadian National Institute for the Blind (CNIB) site, the Holland Bloorview Kids Rehabilitation Hospital (formerly Bloorview MacMillan Children's Centre (BMCC)) and a new high rise residential development by Daniels Midtown Corporation (DMC) on vacant property between the CNIB and BMCC, it was identified by City of Toronto staff that there was a need for additional servicing capacity for the existing sub trunk sanitary sewer located within the Burke Brook ravine; the CNIB, BMCC and DMC shared the cost of the project.

In addition to upgrading the eastern portion of the sub trunk sanitary sewer, a re-alignment of the pipe was required as the existing sewer and its service manholes became exposed within the Burke Brook channel due to constant down cutting and erosion. The draft Reference Plan has recently been completed for the as constructed section of sub trunk sewer, which details the new location of the permanent easement required for the re-aligned pipe.

The entire site is located within the regulated area and valley corridor of Burke Brook, which is a tributary of the West Don River. The installation of the replacement pipe was initiated in 2004, with construction completed in 2007. A permit (No. C-04189) pursuant to former Ontario Regulation 158 was approved at Executive Committee Meeting #4/04, held on May 7, 2004, for commencement of construction; a revision to the permit was issued on October 16, 2007 for revised plans and additional drawings to complete the work and to restore / revegetate all disturbed areas.

The subject TRCA-owned lands were acquired from the Governing Council of the University of Toronto on December 8, 1978, under the Don River Flood Plain Lands Acquisition Project.

Plantings All lands disturbed by construction were stabilized and, where deemed appropriate by TRCA staff, revegetated with native woody and herbaceous plant material in accordance with existing TRCA landscaping guidelines. A landscape plan was prepared and formed part of Permit No. C-04189, as revised.

A plan illustrating the permanent easement location is attached.

FINANCIAL DETAILS The City of Toronto has agreed to assume all legal, survey and other costs involved in completing this transaction.

THE EXECUTIVE COMMITTEE RECOMMENDS THAT WHEREAS Toronto and Region Conservation Authority (TRCA) is in receipt of a request from the City of Toronto to provide a permanent easement for a new watermain located west of Rockcliffe Boulevard and south of Alliance Avenue in the City of Toronto (Etobicoke York Community Council Area), Humber River watershed;

AND WHEREAS it is in the best interest of TRCA in furthering its objectives as set out in Section 20 of the Conservation Authorities Act to cooperate with the City of Toronto in this instance;

THEREFORE LET IT BE RESOLVED THAT a permanent easement containing a total of 0.09 hectares (0.22 acres), more or less, be granted to the City of Toronto for a new watermain, said land being Part of Lots 37 and 38, Concession 3 FTB, City of Toronto (Etobicoke York Community Council Area), designated as Parts 1 through 6 on Plan 66R-21397;

CARRIED BACKGROUND The City of Toronto has formally requested a permanent easement for a new watermain located to the west of Rockcliffe Boulevard and south of Alliance Avenue in the City of Toronto. There was no permanent easement granted across TRCA property for the previous watermain. The former watermain, which was suspended from the Black Creek flood control channel bridge, required replacement, as it had structural deficiencies which caused concern for public safety.

589 The entire site is located within the Regional Storm flood plain and regulated area of Black Creek. The installation of the new pipe was initiated in 2003 under the emergency works provision of TRCA's Valley and Stream Corridor Management Program. Permit No. C-03076 pursuant to former Ontario Regulation 158 was approved at Executive Committee Meeting #2/03, held on April 25, 2003 for the new pipe; all work was completed before the end of November in 2003.

The subject TRCA-owned lands were acquired from the Township of York on September 21, 1962 and the Municipality of Metropolitan Toronto on October 17, 1962, under the Black Creek Channelization Project for flood control purposes.

Plantings All lands disturbed by construction were stabilized and, where deemed appropriate by TRCA staff, revegetated with native woody and herbaceous plant material in accordance with existing TRCA landscaping guidelines. A landscape plan was prepared and formed part of Permit No. C-03076.

A plan illustrating the permanent easement location is attached.

FINANCIAL DETAILS The City of Toronto has agreed to assume all legal, survey and other costs involved in completing this transaction.

CARRIED BACKGROUND The subject property is located at the southeast corner of Highway 48 and Major Mackenzie Drive in the City of Markham. The property is approximately 12.8 hectares and is currently vacant, however, the buildings have been demolished and the materials were crushed and stockpiled on the property.

Neighboring uses include a garden centre and farmland to the north, a number of commercial/industrial buildings to the south, and retail/service and restaurant uses to the west. The GO Transit Rail Line runs along the eastern property line, and residential properties lie further east. Exhibition Creek traverses the site from the northwest to the southeast, and outlets to the properties to the south, into a culvert. A telecommunications tower is currently located at the southern portion of the property, adjacent to Exhibition Creek.

Studies have confirmed that the Regional Storm Floodplain exists across the lower third of the property. A significant amount of grading and earthworks have occurred on site, including the removal of a large stormwater management pond which was located at the southeast corner of the property. This pond was partially regulated, and provided flood storage capacity for the Regional Storm Event. The pond was dredged and backfilled, with the dredged materials deposited within TRCA's regulated area, without the required permits under the Conservation Authorities Act. The landowner was issued orders to comply which remain unresolved at this time.

592 Proposal The proposal includes the construction of a new mixed-use centre consisting of retail, office, entertainment facilities and high rise residential buildings. A new municipal road (Anderson Avenue) is proposed to extend northward, through the subject site, and intersect with Major Mackenzie Drive. The proposal included the removal of the stormwater management pond and the removal of Exhibition Creek.

Through the review of the application, TRCA staff had no objections in principle to the proposed zoning and official plan amendments, subject to the issues with respect to retaining Exhibition Creek as an open channel, and the applicant addressing stormwater management and floodplain storage capacity on site.

The landowner has appealed to the OMB for the municipality's lack of decision with respect the applications. The OMB and the City support TRCA by providing time for the applicant to resolve the outstanding violations, prior to proceeding to a pre-hearing.

RATIONALE An OMB telephone conference was held on May 23, 2013, at which time, the applicant committed to provide the information required to resolve TRCA's violation issues, prior to proceeding to a prehearing conference. To date, these issues remain outstanding, and an OMB pre-hearing has yet to be scheduled. Once scheduled, the dates for a hearing will be determined. Staff consider TRCA's involvement to be critical in this hearing to ensure that TRCA's interests relating to the following are appropriately considered:

 consistency with TRCA's Valley and Stream Corridor Management Program policies;  consistency with the Natural Hazard policies of the Provincial Policy Statement (delegated to conservation authorities)  compliance with TRCA's regulatory requirement with respect to floodplain management;  natural channel restoration and enhancement of Exhibition Creek.

DETAILS OF WORK TO BE DONE TRCA staff is requesting authorization of the Executive Committee to retain legal counsel to ensure TRCA's interests, as identified above, are protected and addressed at the pre-hearing which has yet to be scheduled. TRCA staff and retained legal counsel will continue to work with the parties and participants leading up to the pre-hearing and hearing in an attempt to resolve TRCA's issues prior to the hearing, and to reduce legal fees to the greatest possible extent.

THAT Toronto and Region Conservation Authority (TRCA) staff be directed to work with municipal staff to identify projects and contribute funding for the implementation of stormwater retrofit projects with stormwater fees that have been collected from private developers;

AND FURTHER THAT staff report back to the Authority in 2015 to provide a summary of stormwater retrofit projects that have been implemented with the funding. CARRIED BACKGROUND Stormwater run-off is the single greatest factor affecting water quality and the health of our rivers. For a 10 year period between 1999 to 2009, TRCA collected cash in-lieu for stormwater management for infill type developments. At the time, municipalities and conservation authorities faced challenges of implementing appropriate stormwater management practices for these types of developments which are often undertaken in areas where storm sewer infrastructure is already in place and the surrounding areas are built up. In many cases the surrounding development was built prior to the implementation of any stormwater controls.

Typically the only options for stormwater control for these infill sites were small stormwater management (SWM) facilities and in-pipe solutions which provides a benefit to water quality at the limit of the site where maintenance is at the discretion of the private landowner. These types of facilities typically provide little benefit to the watershed as a whole, are typically less effective at providing treatment and can create maintenance problems for the municipality. Therefore, it was collectively decided that the money spent on these types of treatment facilities for new infill development could be better spent elsewhere within the watershed on larger retrofit projects and regeneration which will ultimately derive a greater benefit to the watershed as a whole.

In 1999, in consultation with TRCA’s municipal partners and the land development Industry, a stormwater "cash in-lieu" policy was developed and has been successfully implemented for infill developments. The stormwater management fee in lieu of stormwater controls was collected on a site by site basis based on a number of factors including:  the type of development;  size of development;  stormwater management assessment;  municipal retrofit strategy;  municipal, provincial and conservation authority (CA) approvals.

The stormwater management fee was determined based on construction costs for conventional stormwater management ponds which amounted to $23,000 - $26,000 per impervious hectare of development. The total amount collected to date is $1,371,000 and is summarized in Table 1.

In 2009, TRCA stopped collecting stormwater management fees in lieu of controls since many area municipalities developed their own municipal stormwater retrofit programs, and newer technologies in stormwater management such as low impact development made it possible to apply effective stormwater management controls to smaller infill type developments using innovative approaches such as greenroofs, bioswales and permeable pavement which are more effective than the conventional approaches.

TRCA is now in the process of developing a plan to use the funds collected by partnering with the municipalities listed in Table 1 to contribute funding for the implementation of stormwater retrofit projects.

DETAILS OF WORK TO BE DONE Since 1999 TRCA has collected $1,371,000 from private developers to implement stormwater retrofit projects. TRCA would now like to partner with the municipalities in which the funds were collected to contribute funding for the implementation of stormwater retrofit projects. Most municipalities already have stormwater retrofit plans, therefore TRCA staff will work with municipal engineering departments and TRCA’s Restoration Services to identify potential projects and spend the funds (listed in Table 1) based on the following criteria:  funds will be used to implement stormwater projects in existing urban areas;  funds will be used for the construction of new stormwater management facilities (such as ponds, low impact development, stormwater wetlands, underground treatment devices) and/or the retrofit of existing facilities that will improve stormwater treatment for the watershed area;  the funds will be treated as a one time grant contribution to the project.

TRCA staff plan to initiate projects immediately, with the majority of the funds committed or spent by 2015. In 2015, TRCA will report back to the Authority to provide an overview of the projects that have been implemented.

CARRIED BACKGROUND Boyd Conservation Area (CA) is located at 8739 Islington Road, in the City of Vaughan. Boyd CA is an active-use park that offers a number of seasonal amenities including picnic areas, washrooms and trails. The park closes annually each winter and the front entrance gate is locked, leaving the park only accessible to pedestrians. This results in cars being parked along Islington Avenue, which creates annoyances for other motorists and potentially dangerous situations. To mitigate these concerns, York Region requested that TRCA investigate the feasibility of constructing a parking facility immediately at the front entrance of Boyd CA, providing the community a safe location to park vehicles when the interior of the CA is closed to vehicular traffic during the winter months.

596 Staff has since completed the detailed design and secured all necessary approvals to construct a 1,100 square metre parking lot, located immediately within the main Boyd CA entrance, and has requested the services of a qualified contractor to carry out the construction of the detailed design. The scope of work under this contract will include installation of pathway and parking lot paving, installation of a chain link fence that will surround the parking lot, and the installation of three lockable swing gates. Construction will begin this winter with placing the granular base for the parking lot and re-locating the front entrance gates, the rest of the work will be completed in spring 2014.

RATIONALE This project is aligned with leadership strategy number three in TRCA’s new strategic plan. Through thoughtful planning and action this project will create a network of greenspace and green infrastructure that weaves through every community to connect a healthy and resilient landscape.

Request for Tender (RFT) were sent to six contractors as follows:  Appco Paving Limited;  Four Seasons Site Development Limited;  Loc Pave Construction;  Pacific Paving Limited;  Sierra Excavating; and  Serve Construction Limited.
