Hawaii promotes price transparency by maintaining an All-Payer Claims Database, which collects healthcare claims data from commercial payers, Medicaid, and Medicare. Hawaii also continues to use theHawaii Health Information Exchange, the state’s private sector non-profit designee for the receipt of federal funds to create a statewide health information exchange that will ultimately feed into the nationwide eHealth Exchange technology network. Additionally, Hawaii has consistently supported legislation that increase access to telehealth services. State telehealth parity laws require Medicaid and private payers to cover appropriate telehealth services equivalent to reimbursement for the same services provided in-person. In support of the ACA, Hawaii passed legislation that established the Affordable Health Insurance Working Group to plan for and mitigate adverse effects of the potential repeal of the federal Affordable Care Act by Congress. Regardless of what happens on the federal level, the bill calls for the preservation of the primary provisions of the individual mandate, to ensures that certain benefits under the Affordable Care Act are preserved under Hawaii law, including prohibiting health insurance entities from imposing a preexisting condition exclusion and prohibiting health insurance entities from using an individual’s gender to determine premiums or contributions. Hawaii exercises strong antitrust oversight in the healthcare market by mandating that all healthcare transactions provide notice to and obtain approval from the state attorney general and the state Health Planning and Development Agency, with concurrent review by the AG, determines whether the proposed acquisition is in the public interest and if the transaction might significantly impact the accessibility of affordable healthcare services in the community. An Act To Provide Maine Residents Losing Employer-based Health Coverage with Information about Other Coverage Medical Billing Transparency: Enacts new GS 58-3-295 to require all contracts or agreements for participation as an in- network health services facility between an insurer offering health benefit plans in this state and a health services facility at which there are out-of-network providers who may be providing services to an insured person receiving care at the facility, to require that an in-network health services facility give at least 72 hours’ advanced written notice to an insured with a scheduled appointment of any out-of-network provider who will be part of providing care. Sets out alternate requirements for timing of notice in situations in which there is not 72 hours between the appointment and when it is scheduled or when there is an emergency. Requires the notice to include: (1) all of the health care providers that will be rendering services who are not in-network and (2) the estimated cost to the insured of the services being rendered by those out-of- network providers. Sets out the procedure under which an insurer may recover overpayments made to the provider or facility. Defines a health care provider as any individual licensed, registered, or certified under GS Chapter 90, or under another state’s laws, to provide health care services in the ordinary care of business or practice, as a profession, or in an approved education or training program in: (1) anesthesia or anesthesiology, (2) emergency services, (3) pathology, (4) radiology, or (5) rendering assistance to a physician performing any of these services. An Act amending the act of May 17, 1921 (P.L.682, No.284), known as The Insurance Company Law of 1921, in casualty insurance, providing for billing eligible insureds for services by out-of- network provider. Protects people with health insurance from surprise medical bills for emergency and other services by requiring a non- participating health care provider to bill an insured party only for a co-payment, or deductible. Greater Transparency in Health Care Billing: Amends GS 58-3-200(d) regarding services by outside provider networks. Now requires the insurer, upon notice from the insured, to determine whether a health care provider able to meet the needs of the insured is reasonably available to the insured without unreasonable delay by reference to the insured’s location and the specific medical needs of the insured. Requires the amount allowed for services provided under subsection (d) to be calculated using the benchmark amount under GS 58-3-201, as enacted, unless otherwise agreed to by the health care provider and the insurer. Does not require an insurer to make any direct payment to a health care provider. Prohibits health care providers from subjecting an insured to or otherwise requiring prior payment of an amount in excess of the applicable reasonable payment under GS 58-3-201, as enacted, prior to services being rendered to the insured. Enacts GS 58-3-201, setting a benchmark amount, to be calculated at least annually, which is presumed to be a reasonable total payment for services provided by a health care provider outside an insurer’s health care provider network, or for emergency care services provided. Details the calculation of the benchmark amount, and provides for the application of the benchmark amount, deeming payment of the amount to foreclose the health care provider from collecting additional amounts from the insured or any third party. Specifies that the insurer is not required to make payment of any amount owed directly to a health care provider. Deems noncompliance an unfair and deceptive trade practice and actionable under GS Chapter 75. Specifies that the provisions do not foreclose other remedies available. An Act To Ensure Choices in Health Insurance Markets Next | See all Legislation Records Recent Litigation The class action lawsuit filed in North Carolina state court against HCA Healthcare and Mission Health alleges anticompetitive practices in violation of the North Carolina Constitution and antitrust and consumer protection laws. The lawsuit follows HCA’s 2019 acquisition of Mission Health in North Carolina, which was approved with conditions by the North Carolina AG, although none of which were competitive impact conditions. Plaintiffs, who are North Carolina patients, claim that Tennessee-based HCA used market power garnered from the cross-market merger to demand anticompetitive terms in contracts with insurers, including tying, all-or-nothing, anti-steering, and gag clauses, driving up prices and insurance premiums. Plaintiffs point out in the complaint that even prior to the merger, Mission Health was shielded by a state-administered certificate of public advantage (COPA) and used similar anticompetitive tactics. The COPA ended in 2016 and the further consolidation with HCA has culminated in making Mission Health the most expensive hospital system in North Carolina for many procedures. Plaintiffs seek damages and an injunction to prevent future anticompetitive activity. Ohio’s Healthcare Price Transparency Law, passed in June 2015 (HB 52) by the Ohio Legislature, has been challenged by health care providers arguing that the law’s requirements are too broad and would delay patient care. The law requires providers to supply patients with a “good faith” estimate of how much non- emergency, elective health care services would cost individuals after accounting for health insurance. The price transparency law was scheduled to take effect in January 2017 but has been suspended from enforcement pending the legal challenge. The Williams County Court of Common Pleas issued a temporary injunction against the law. In February 2020, the 6th Circuit affirmed the lower court’s summary judgment ruling and issued a permanent injunction, ruling that the law violated the Ohio Constitution’s one- subject rule which requires that no bill may contain more than one subject, which must be clearly stated in its title. Here, the original bill was intended to regulate and fund the Bureau of Worker’s Compensation, and the transparency provision was an “unnatural,” unrelated addition to the bill intended to cover another subject. Additionally, the court held the transparency provision also violated the Ohio Constitution’s three- reading rule, which requires every bill to be considered by each house on three different days. The court said the entire legislative history of that bill had been about workers compensation, and when it passed both the House and Senate, it contained no reference to health care price transparency. Thank you for allowing me the opportunity to testify. My name is Josh Archambault, and I am a Senior Fellow at the Foundation for Government Accountability (FGA), a non-partisan think tank focused on health care and welfare issues at the state level. While FGA is located in Florida, I am based in Boston, and have spent nine years studying the successes and failures of the 2006 Massachusetts health reform law (Chapter 58 of the Acts of 2006) commonly called “RomneyCare.” My research has often focused specifically on the state- based exchange, called the Connector in the Bay State. In that light, I come today to share with you some of my thoughts on H. 7817 “The Rhode Island Health Benefits Exchange Act.” I would like you to takeaway three overarching messages when considering whether to advance this bill: 1) Rhode Island officials join numerous other states facing the fiscal reality of paying to keep the doors open at a state-based exchange with lower than expected enrollment. 2) Keeping the doors open for HealthSource RI will have unintended consequences and therefore must demonstrate a good return on investment and added value to the marketplace to justify additional taxpayer money. 3) Funding questions that surround HealthSource RI do not take place in a vacuum, as the Affordable Care Act (ACA) adds other state budgetary considerations to this discussion. For example, the previously eligible but not enrolled “woodwork” Medicaid population will add $55-100 million dollars to the Rhode Island state budget every year.

Blumberg, Erik Wengle, Ian Hill, Rebecca Peters and Patricia Solleveld With support from the Robert Wood Johnson Foundation (RWJF), the Urban Institute is undertaking a comprehensive monitoring and tracking project to examine the implementation and effects of the Patient Protection and Affordable Care Act of 2010 (ACA). The project began in May 2011 and will take place over several years. The Urban Institute will document changes to the implementation of national health reform to help states, researchers and policymakers learn from the process as it unfolds. Reports that have been prepared as part of this ongoing project can be found at www.rwjf.org and www.healthpolicycenter.org. The quantitative component of the project is producing analyses of the effects of the ACA on coverage, health expenditures, affordability, access and premiums in the states and nationally.     September 2013 | Issue Brief Getting into Gear for 2014: An Early Look at Branding and Marketing of New Health Insurance Marketplaces As of September 2013, states and the federal government are on the eve of their October 1st launch of open enrollment for the new Health Insurance Marketplaces, where consumers will be able to shop for and purchase private coverage and potentially receive subsidies to lower the cost of that coverage. Achieving adequate enrollment through these Marketplaces will be important for fulfilling the Affordable Care Act’s (ACA’s) goal of reducing the nation’s uninsured rate. Moreover, sufficient enrollment, particularly among young and healthy individuals, will be important for ensuring the financial sustainability of the Marketplaces over time. Recognizing the importance of enrollment, the federal government and the 17 states operating State-based Marketplaces have invested resources and conducted extensive consumer research to inform the branding and marketing campaigns for their Marketplaces. Based on a review of publicly available materials as of September 2013, this brief provides an examination of the Marketplace branding strategies, websites, and marketing materials, providing insight into how consumers will be introduced to the Marketplaces and some of the key messages and approaches the Marketplaces will utilize to encourage individuals to enroll. BACKGROUND The ACA seeks to reduce the number of uninsured through two key coverage expansions: the creation of new Health Insurance Marketplaces and an expansion in Medicaid eligibility. The Health Insurance Marketplaces will provide consumers with a choice of qualified health plans, offering similar benefits, so they can select the one that best meets their needs.
