June 26, 1991 Reclassification of Certain FM Facilities Pursuant to MM Docket No. 88-375 In the First Report and Order in MM Docket 88-375, 54 Fed. Reg. 16363 (April 24, 1989), the Commission created a new FM station class (Class C3) in Zone II effective June 1, 1989. In the Second Report and Order in MM Docket 88-375, 54 Fed. Reg. 35335 (August 25, 1989), the Commission increased the maximum effective radiated power (ERP) for commercial Class A stations to 6 kilowatts. Existing Class C2 facilities with an ERP of 25 kW or less and an antenna height above average terrain (HAAT) such that the distance to the 1 mV/m contour is less than or equal to 39 km were subject to reclassification to the new Class C3 or revised Class A as appropriate. Also, certain Class C facilities with an ERP greater than 100 kW but with an antenna HAAT such that the distance to the 1 mV/m contour is less than or equal to 72 km were subject to reclassification to Class C1 or C2 as appropriate. Affected parties had until the close of business on Monday, June 3, 1991 to apply for at least the minimum facilities of their current class as set forth in 47 C.F.R. Section 73.211 of the Rules. Stations for which applications to retain their current classifications had not been filed were automatically reclassified, with the new class determined in accordance with Sections 73.210 and 73.211, effective June 3, 1991, by operation of law pursuant to the above referenced Report and Orders. An explanation of the administration of the reclassification process, including an example, is contained in an earlier Public Notice Reclassification of FM Facilities Pursuant to BC Docket 80-90, FCC 87-93 March 24, 1987, mimeo 2459. The administrative processes used in the BC Docket 80-90 reclassification were followed in the reclassification which took place on June 3, 1991. This Public Notice contains the list of allotments and assignments that have been reclassified. Also included on the list are additional allotments which would be subsequently reclassified should their applications to meet the minimum class C2 or Cl facilities be returned or dismissed and/or existing construction permits expire. Each allotment listed contains a group of entries including any - 1 - license, construction permit or application associated with the allotment as they existed as of the close of business on June 3, 1991. The list is arranged in order by channel number, and then alphabetically by state and city. An allotment group appears on the list if the class of any facility included in the group changes. The new class of a license, construction permit, or application was determined from the listed ERP and HAAT values and the zone of the transmitter site. The new class of the allotment, in most situations, was determined from the highest new class of the group of entries. The allotment changes listed here are for information purposes only. An Order amending the FM Tables of Allotments (Sections 73.202 and 73.505) will be issued as soon as possible. (See Public Notice FCC 87-93 released March 24, 1987, which further explains how the Commission administered the reclassification process) . Noncommercial educational facilities were also reclassified. The distance separation requirements between noncommercial educational facilities on channels 218, 219, and 220 or noncommercial facilities separated in frequency by 10.6 or 10.8 MHz (53 or 54 channels) from allotments or assignments on the non-reserved channels will be based on these reclassifications and the distance obtained from Table A, B, or C, of 47 C.F.R. Section 73.207, as appropriate. For other noncommercial educational facilities, the rec1asssification was for administrative purposes only. The class change for any license, construction permit, or application indicated on the attached list constitutes a modification of that facilities' authorization by the Commission. Licensees or permittees will not be issued a new authorization solely because of reclassification. When a new authorization is issued for any other reason, the new class will appear. The inclusion on this list of any application, construction permit, or license is only for the purpose of determining the class of the allotment or assignment, and should not be construed as a determination on any other issues that may be pending for any application, construction permit, license or allotment. These situations include, but are not limited to: (1) Applications which have been returned and for which petitions for reconsideration are pending are included on the list. The inclusion on the list does not mean that the petition for reconsideration has been granted; rather, it means only that the application will have the listed class if the petition for reconsideration is granted. (2) Waiver requests not to reclassify the allotment are included on the list. The classes in the allotment group have not been changed because of these requests. This does not mean that the waiver of reclassification has been granted;-rather, it means that the classes will remain the same pending action on the waiver request. - 2 - (3) Construction permits which have expired but have applications for reinstatement pending are included on the list. The inclusion on the list does not mean that the construction permit has been reinstated; rather, it means only that the construction permit will have the listed class if the construction permit is reinstated. (4) Licenses for which renewals have not been granted are included on the list. The inclusion on the list does not mean that the renewal has been granted; rather, it means only that the license will have the listed class if the renewal is granted.
