Organizational Realization of the Federal Law of the Russian Federation on Assuring the Measurements’ Uniformity, structure in the field of fulfilment of metrological functions according to the Decrees of the President of the Russian Legal Metrology Federation - No. 314 of 9 March, 2004 and No. 649 of 20 May, 2004 and the Government Decrees - No. 294 of 17 June, 2004 and No. 438 of 05 June, 2008, are implemented by the Federal Agency on Technical Regulating and Metrology (Rosstandart) under the Federal Ministry of Industry and Trade (Minpromtorg of ). 1. Minpromtorg of Russia is a Federal Executive body responsible for the development of government policy and state regulation in the field of technical regulating, standardization and ensuring uniformity of measurements. 2. Rosstandart is a Federal Executive body responsible for providing government services and managing state property in the field of technical regulating, standardization and assuring the uniformity of measurements and implementation of federal state metrological supervision. Under the responsibility of Rosstandart are national scientific metrology institutes (NMIs) and state regional centers for standardization, metrology and testing. The main objectives of NMIs are conducting fundamental and applied scientific researches, experimental developments and scientific and technical activities in the field of assuring the measurements’ uniformity; development, improvement, maintenance, comparison and application of national primary measurement standards (NPMS); the transfer of units from NPMS; participation in development of draft regulatory documents in the field of assuring the measurements’ uniformity, conducting mandatory metrological expertise of requirements for measurements, reference materials and measuring instruments contained in draft normative acts of the Russian Federation; creating and maintaining the Federal Information Fund for assuring the measurements’ uniformity (FIF AMU) and providing documents and information from the FIF; participating in international cooperation in the field of Metrology. Metrology institutes of Russian Federation actively collaborate with national metrology centers of Germany, the USA, the United Kingdom, Slovakia, Japan, France, Korea, China, India, Belarus, Ukraine etc. The priority activities of regional centers for standardization, metrology and testing (FBU CSM), are: improvement, maintenance and use of national measurement standards used to ensure traceability; involvement in the provision of public services to ensure the uniformity of measurements in accordance with the scope of accreditation; conducting verification of measuring instruments included in the restrictive list of measuring instruments established by the Government of the Russian Federation; the transfer of measurement units from national measurement standards. At present, there are 74 FBU CSMs located in 8 Federal Districts in the Russian Federation located in 8 Federal districts. Rosstandart directs the work of the following: • State Service of Time and Frequency and Determination of the Earth Rotation Parameters (SSTF); • State Service of Reference Materials of the Composition and Properties of Substances and Materials (SSRM); • State Service of Standard Reference Data of Physical Constants and properties of substances and materials (SSSRD). In the Russian Federation, in order to assure the measurements uniformity, metrological services may be established in Federal Executive bodies; in state corporations, legal entities and individual entrepreneurs engaged in the field of assuring the measurements uniformity. 2. Measurement units In the Russian Federation, the basic units of the International System of Units (SI), derived SI units, and off-system measurement units approved by the Decree of the Government of RF No. 879 of October 31, 2009 “On approval of the Regulations on measurement units allowed for use in the Russian Federation” are applied. 3. Law on metrology The Federal Law “On assuring the measurements’ uniformity” No. 102-FZ of 26.06.2008 (as amended by the Federal Laws of 18.07.2011 No. 242-FZ, of 30.11.2011 No. 347-FZ, of 28.07.2012 No. 133-FZ, of 02.12.2013 No. 338-FZ, of 23.06.2014 No. 160-FZ, of 21.07.2014 No. 254-FZ, of 13.07.2015 No. 233-FZ, of 27.12.2019 No. 496-FZ, of 27.10.2020 No. 348-FZ, of 08.12.2020 No. 429-FZ) https://fgis.gost.ru/fundmetrology/registry/1/items/232725 The amendments introduced by the Federal Law No. 496-FZ of 27.12.2019 (http://publication.pravo.gov.ru/Document/View/0001201912280084), come into force on 24.09.2020. List of measuring 1. The field of state regulation of assuring the measurements’ uniformity (legal metrology) applies to instruments in the field measurements performed when: of legal metrology or − implementing the activities in the field of public health; the field of state regulation − implementing veterinary activities; − implementing activities in the field of environmental protection; − implementing activities in the field of civil defense, protecting the population and territories from natural and technology-related emergencies, ensuring fire safety, safety of people at the waters; − implementing work to ensure safe conditions and labor protection; − implementing industrial inspection to the compliance with the industrial safety requirements established by the legislation of the Russian Federation for the operation of a hazardous production facility; − carrying out trade, performing work on packaging goods; − implementing state accounting operations and accounting of the amount of energy resources; − providing postal services, accounting for the volume of telecommunication services provided by communication operators and ensuring the integrity and stability of the functioning of the public communication network; − carrying out activities in the field of national defense and security; − carrying out geodetic and cartographic activities; − carrying out the activities in the field of hydrometeorology, monitoring the environment and pollution; − conducting banking, tax, customs operations and customs control; − implementing work to assess the conformity of products and other objects to mandatory requirements in accordance with the legislation of the Russian Federation on technical regulation; − holding official sport competitions, providing training for high-class athletes; − fulfilling orders of the court, prosecutor's office, state executive authorities; − implementing measures of state control (supervision); − carrying out activities in the field of atomic energy use; − ensuring road traffic safety. For certain areas of activities, the federal executive authorities that carry out legal regulation in these areas of activities determine measurements related to the sphere of state regulation of assuring the measurements’ uniformity, and establish mandatory metrological requirements for them, including measurement accuracy indicators.

2. Measuring instruments used in the field of state regulation (legal metrology) are subject to mandatory type approval and verification. Measuring instruments used by legal entities and individual entrepreneurs in their activities outside the scope of state regulation (legal metrology) are subject to verification or calibration on a voluntary basis.

3. Measuring instrument type approval tests are carried out by accredited legal entities, verification- by accredited legal entities and individual entrepreneurs, the verification of measuring instruments from the restrictive list approved by the Government of the RF is carried out by FBU CSMs only.

5. Type approval 5.1 Legal and technical requirements for type approval 1. The procedure for type approval and tests for the purpose of type approval are established by the regulatory legal act of the Ministry of Industry and Trade of Russia. 2. The type approval of the measuring instruments or the type of reference materials is subject to measuring instruments intended for use in measurements in the field of metrology, as well as of reference materials intended for use in measurements in the field of legal metrology. 3. Type approval of MI or CRM is carried out on the basis of positive test results for type approval of MI or CRM.

5.2 The bodies responsible for type approval Rosstandart makes decisions on the type approval of MI and RM, enters the information into the FIF for AMU and issues type approval certificates. 5.3 The bodies responsible for the type approval testing Tests for measuring instruments and reference materials for type approval are carried out by accredited legal entities. 5.4 Recognition of OIML Certificates The Russian Federation is a full OIML member state. Russia participates in the OIML-CS. 6. Verification 6.1 Legal and technical requirements for initial and periodic verification The procedure for verification of measuring instruments is established by the regulatory legal act of the Ministry of Industry and Trade of Russia. 1. When approving the type of measuring instrument, the time interval between verifications is established and the procedure of verification of the measuring instrument for the approved type is approved. 2. Verification is carried out before the commissioning of the measuring instruments, as well as during their operation. 3. The results of the verification are certified by the information on the results of the verification in the FIF for AMU (from 24.09.2020). At the request of the MI owners, verification certificates based on the results of verification can be issued, an entry in the MI passports with a verification mark can be made, and (or) verification marks can be made on the MI itself. 6.2 Verification authorities 1. Verification of measuring instruments included in the restrictive List, approved by the Government of the Russian Federation, is carried out only by FBU CSM. 2. Verification of MI that are not included in the restrictive List is carried out by accredited legal entities and individual entrepreneurs. 6.3 Verification Interval for 20 categories of MI 1. Relevant intervals between verifications are set for a specific approved type of measuring instrument and are given in the section "approved types of measuring instruments" in FIF for AMU (https://fgis.gost.ru/fundmetrology/registry). 2. In the Russian Federation are relevant the following intervals between verifications (in years) for the following MI:

1. induction electrical energy meters 16 - single phase - three phase 2. electronic electrical energy meters 16 - single phase - three phase 3. membrane gas meters for domestic use 10 4. mechanical water meters for domestic use 4 or 6 5. heat meters 3 or 6 6. weights 1 or 2 7. non-automatic weighing instruments 1 8. automatic weighing instruments 1 9. motor-truck scale 1 10. liquid-in-glass thermometers 2 or 3 11. clinical thermometers 1 or 2 digital/limitless – glass (initial verification at release from production) 12. thermometers for pipelines and storage tanks 2 or 3 13. mechanical instruments for measuring length 1 14. capacity measures for trade - 15. metal measures 1 or 2 16. fuel dispensers 1 or 2 17. radar equipment for the measurement of the speed of 1 or 2 vehicles 18. taximeters - 19. alcoholometers 1 20. moisture meters for cereal grains 1

6.4 Other national requirements for verification – 7. Conformity 7.1 Brief description of the system assessment of MI 7.2 Bodies for the assessment of conformity to type At present In the Russian Federation conformity assessment applies to measuring instruments (similar to directives 2014/31 / EU (NAWID) and 2014/32 / EU (MID). The conformity assessment of the MI is also carried out for compliance with the requirements of the applicable technical regulations of the Customs Union (TR CU 004, TR CU 020, TR CU 012). Note: For other countries, information on Directives 2014/31 / EU (NAWID), and 2014/32 / EU (MID) or other national requirements may be given. 8. Prepackages 8.1 Legal requirements for prepackage control State regulation applies to measurements performed when determining the amount of prepackaged goods. The Ministry of Industry and Trade of Russia establishes mandatory requirements for measurements when determining the quantity of packaged goods, including accuracy indicators for packaging. 8.2 Documents establishing requirements for Prepackages - The Order of the Ministry of Industry and Trade of Russia of July 18, 2017 No. 2321 (valid until 01/01/2021, from 01/01/2021 the List of measurements established by the Decree of the Government of the Russian Federation is coming into force); - GOST 8.579-2019 “State system for assuring the measurements uniformity. Requirements for the number of prepackaged goods during their production, packaging, sale and import”. 8.3 The bodies providing control for prepackages When conducting Federal state metrological supervision (FGMN), the activities of legal entities and individual entrepreneurs engaged in prepackages are monitored by Interregional territorial administrations (MTU) Rosstandart. 8.4 Other national requirements for prepackages - 9. Metrological 1. Federal state metrological supervision (FGMN) is carried out by Rosstandart (interregional supervision territorial administrations of Rosstandart), authorized By the Government of the Russian Federation to implement FGMN, in the form of scheduled documentary and field inspections of legal entities and individual entrepreneurs, depending on the risk category assigned to their activities (risk-oriented approach).

2. FGMN is carried out by MTU officials who are state inspectors.

3. FGMN applies to the activities of legal entities and individual entrepreneurs engaged in: - measurements related to the sphere of state regulation of assuring the measurements uniformity (LM); - production of standards of units of quantities, standard reference materials and measuring instruments intended for use in the sphere of state regulation of assuring the uniformity of measurements (LM), as well as their import into the territory of the Russian Federation, sale and use on the territory of the Russian Federation; - packaging of goods.

4. When performing supervision, the following is checked: - compliance of the units of quantities used with the units of quantities approved for use in the Russian Federation; - compliance with mandatory requirements for measurements carried out in the field of state regulation of assuring the uniformity of measurements (LM); - compliance of measuring instruments, standard reference materials and standards of units of quantities with mandatory requirements in the field of state regulation of assuring the uniformity of measurements (LM); - availability and performance of the certified measurement procedures; - compliance by a legal entity or individual entrepreneur engaged in the production of standards of units of quantities, standard reference materials and measuring instruments intended for use in the field of state regulation of assuring the unity of measurements (LM), as well as their import into the territory of the Russian Federation and sale, with the established procedure for notification of such activities.

5. The Procedure for conducting FGMN is established by the Decree of the Government of the Russian Federation No. 1643 of 26.12.2017 "On the implementation of Federal state metrological supervision". To the relations connected with FGMN implementation, the organization and conduct of inspections of legal entities and individual entrepreneurs apply uniform provisions used when implementing all types of supervision and control established by the Federal Law of 26 December 2008 No. 294-FZ "On protection of rights of legal entities and individual entrepreneurs when exercising state control (supervision) and municipal control». 10. Specialists in the Work in the field of state regulation of assuring the uniformity of measurements (LM) is performed by field of legal metrology specialists of accredited organizations that meet the accreditation criteria. Accreditation criteria which contain requirements for specialists are established by the Order of Ministry of Economic Development of Russian Federation of 30.05.2014 No. 326 "On approval of accreditation criteria, the list of documents confirming compliance of the applicant, the accredited person to accreditation criteria and list of documents in the field of standardization, compliance with which applicants, accredited persons ensures their compliance with the accreditation criteria». 11. Sanctions Code of administrative offences of the Russian Federation of December 30, 2001 No. 195-FZ: Article 19.19. Violation of legislation on assuring the uniformity of measurements 1. Violation of legislation on assuring the uniformity of measurements in terms of measurements relating to the area of state regulation of assuring the uniformity of measurements, without application of the certified measurement procedures, compliance with the requirements of the certified measurement procedures, or non-observance of the established procedure of notification about the activities on release from manufacture intended for application in sphere of state regulation of assurance of measurement uniformity of measurement standards, standard reference materials and (or) measuring instruments or on their importation into the territory of the Russian Federation and sale, or non-observance of the procedure of testing standard specimens or measuring instruments for the purposes of type approval, the procedure of verification of measuring instruments or applications in the field of state regulation of assuring uniformity of measurements of standard reference materials of non-approved type of measuring instruments of non-approved type, and (or) not undergone approved calibration, or non-observance of obligatory metrological and technical requirements for measuring instruments, and obligatory requirements to conditions of their operation or non- observance of an order of approval, maintenance, comparison and application of national primary measurement standards, the procedure for transferring units from state standards, procedure of establishment of obligatory requirements to measurement standards used to assure the uniformity of measurements in sphere of state regulation of assuring the uniformity of measurements, evaluation of compliance with these requirements and their application, or use in the sphere of state regulation of assuring the uniformity of measurements of units of quantities not approved for use in the Russian Federation entails the imposition of an administrative fine on officials in the amount of twenty thousand to fifty thousand rubles; on legal entities - from fifty thousand to one hundred thousand rubles. 2. Establishment by officials performing state metrological supervision of requirements that do not comply with the legislation on assuring the uniformity of measurements in terms of testing standard reference materials or measuring instruments for the purpose of type approval, verification of measuring instruments, certification of measuring procedures, entails a warning or imposition of an administrative fine in the amount of twenty thousand to thirty thousand rubles. 3. Violation of the officials performing functions on rendering state services and managing state property in the field of assuring uniformity of measurements, terms of decision-making on the attribution of technical means to measuring instrument type approval standard reference materials and (or) the type of measurement or violation by officials, responsible for accreditation in the field of assuring the uniformity of measurements, terms of making a decision on accreditation of a legal entity or individual entrepreneur to perform works and (or) provide services in the field of assuring the uniformity of measurements entails the imposition of an administrative fine in the amount of twenty thousand to thirty thousand rubles. These norms are currently being refined, taking into account the preparation of a new version of the Code of administrative offences of the Russian Federation.
