(a) whether the Municipal Corporation of Delhi (MCD) has started High End Toilet Scheme on built and operate basis through the private operators with advertising rights;

(b) if so, whether these toilets are being maintained by them;

(c) if not, the reasons therefor;

(d) whether the MCD has changed the policies from wall wraps to roof tops for advertising purpose and if so, the details thereof;

(e) whether Mayor and Commissioner are competent to change the policy; and

(f) if so, the details thereof along with the details of the beneficiaries under the scheme and their investment and earnings therefrom?

(a) to (c): MCD had started a project for allotment of contracts for construction of High-End Toilets at various places in the city. For this purpose, Expression of Interest was invited and the interested tenderers were asked to build live-models of the High-End Toilets at the sites allotted to them. Live Models were constructed by 8 intending tenderers, but in the meantime, a decision was taken at the level of competent authority to scrap the project and the project could not materialize.

DATABASE FOR EMERGENCY MANAGEMENT 12th March 2013

STATEMENT IN REPLY TO PARTS (a) To (d) OF LOK SABHA STARRED QUESTION NO-210 FOR 12.03.2013

(a) to (d):- Yes Madam. The project National Database for Emergency Management (NDEM) has been conceived by the Government of as a Geographical Information System (GIS) based repository of data to support disaster management in the country in real/ near real time. Its implementation has been entrusted to Indian Space Research Organization (ISRO). Department of Space has made necessary arrangements and allocated resources for the implementation of NDEM under the umbrella of Disaster Management Support (DMS) Programme. The DMS programme has been allocated a sum of Rs. 200 crore in the 12th Plan. So far, ISRO has incurred an expenditure of Rs.6.45 crore on the database organization and computer infrastructure and Rs. 9.60 crore for civil work for constructing facility for housing NDEM at the National Remote Sensing Centre ( NRSC), Hyderabad.

A portal which enables search, browse and visualization of the geospatial database and online data submission is operational at NRSC, Hyderabad. The databases available/generated under different national projects in ISRO have been made available to NDEM and essential computer infrastructure is being set up at NRSC, Hyderabad.

ASSISTANCE OF SDRF NDRF 12th March, 2013

(a) the norms for assistance under the State Disaster Response Fund (SDRF) and the National Disaster Response Fund (NDRF) and the amount of assistance sanctioned, released and utilised during the 12th Five Year Plan, State- wise;

(b) whether the Government has made any review/proposes to review the list of items and norms of assistance being given from the aforesaid funds;

(c) if so, the details thereof;

(d) whether any discussion has been held with various State Governments in this regard; and

(e) if so, the details and the outcome thereof?

(a): As per existing scheme of financing relief assistance, the State Governments concerned are primarily responsible for taking necessary measures in the wake of natural calamities. Government of India supplements efforts of States by providing requisite financial and logistic support. At present the financial assistance for natural calamities is channelized through the State Disaster Response Fund (which consists of contributions from the Centre and State in the ratio 75:25 in case of General category States & 90:10 ratio in case of Special Category States) and the National Disaster Response Fund (NDRF) which is fully funded by the Government of India. For this purpose the Government of India has issued guidelines for administration of the SDRF and NDRF on 28th September 2010. The guidelines relating to both the funds are available on the website of this Ministry; http://ndmindia.nic.in.

A statement showing State-wise allocation and releases of funds from SDRF and NDRF to States during 2012-13 (being the 1st financial year of 12th Five Year Plan) is given in Annexure.

As per the scheme of SDRF the State Government is responsible to ensure that money drawn from the SDRF account is actually utilized for the purposes for which the SDRF has been set up and only on item of expenditure and as per norms approved by the GOI. The State Accountant General is required to monitor the expenditure as per the items and norms of assistance. The Comptroller and Auditor General of India conducts audit of SDRF every year.

(b) to (e): With regard to the revision of the list of items and norms of assistance, it has generally been a practice to review these after the award of successive Finance Commissions are accepted by the Government. Following the implementation of recommendation of XIII th Finance Commission with regard to its awards of grant to the States for response and relief, the Government of India constituted an Expert Group. The Expert Group consulted all the State Governments and concerned Central Ministries/ Departments. on the basis of all such inputs, the Expert Group submitted their report. Further, taking into account various factors including the report of the expert group and price rise, Government of India issued order on revised items and norms of assistance under NDRF and SDRF on 16th January 2012. As partial modifications was on 28th September 2012. These norms are available on the Ministry of Home Affairs website: www. ndmindia.nic.in.

EARTHQUAKE PRONE AREAS 12th March 2013

(a) & (b): The National Disaster Management Authority has published guidelines on management of earthquakes, which indicates that the country has been divided into four seismic risk zones.

In addition, Building materials & Technology promotion Council under the Ministry of Housing & Urban Poverty Alleviation has developed vulnerability Atlas of India 2006, which gives state-wise seismic hazard map and district wise housing types based on census 2001 data and degree of their vulnerability to earthquakes.

(c) whether any study has been conducted for the preparation of better crisis management during such disasters and if so, the details thereof; and

(d) whether the Government has any mechanism to identify such disaster prone places/areas to take precautionary measures and if so, the details thereof?

(a) & (b): National Institute of Disaster Management (NIDM) has started compiling and publishing India Disaster Report, documenting major disasters from 2011.

However, as per the damage reported by the States/UTs due to cyclones/heavy rains/ floods/ landslides/ earthquakes and cloud burst during the last three years and current year, state-wise details of damage is given at Annexure-I.

(c) to (d): A Project, namely, National Database for Emergency Management (NDEM) has been conceived by the Govt. of India as a Geographical Information System (GIS) based repository of data to support Disaster Management in the country in real/near real time. WATERLOGGING PROBLEM 19th March, 2013

(a) whether people are facing problems of waterlogging in the National Capital Territory (NCT) of Delhi;

(a) & (b): In the areas, wherever drains have been constructed, no waterlogging problem is faced during the monsoon season. However, Delhi Government has intimated that there are 70 places where waterlogging problem is noticed during the monsoon season.

(c): Public Works Department(PWD), New Delhi Municipal Council (NDMC), Delhi Municipal Corporations (DMCs), Delhi Cantonment Board, Irrigation and Flood Control Department of Govt. of NCT of Delhi etc. provide suitable drainage system at the places from where waterlogging problem is reported. Further, during the monsoon period Irrigation & Flood Control Department of GNCTD deploys pumps of suitable capacity to drain out the water stagnated in low lying areas.

(a) As of now, ten battalions of National Disaster Response Force (NDRF) are operational for providing response to the various natural and manmade disasters in the country.

(b) & (c) Yes, madam. It has been proposed to raise two additional battalions of National Disaster Response Force.

(d) & (e) A proposal to set up National Disaster Communication Network (NDCN) has been sent by National Disaster Management Authority. A committee has been constituted by Ministry of Home Affairs to study the technical feasibility of the project. The approval of the project and its functions will depend upon the report of the committee and techno financial feasibility.

(f) & (g) A scheme for National Earthquake Risk Mitigation Project (NERMP) has been approved by the Government for Rs.24.87 Crore.

The major components of the project are Techno-legal Regime, Institutional Strengthening, Capacity Building of practicing architects, engineers and masons and Public Awareness & Sensitization.

TRAINING IN DISASTER MANAGEMENT 30th April, 2013

(a) & (b): The National Institute of Disaster Management (NIDM) does not conduct courses on Security threats. However, NIDM has been conducting training programmes on various aspects of disaster management where the participants also include officials from State Police and Central Police Organizations. In the past, the Institute has conducted the following courses which were attended by Police/Para military officials:-

(i) 6 Basic Courses on Disaster Management for supervisory officers of National Disaster Response Force with total of 106 participants.

(ii) 4 courses on Chemical, Biological, Radiological & Nuclear Emergencies (CBRNE) with total of 94 participants.

(iii) 3 courses on Management of Serial Bomb Blasts with total of 81 participants.

(iv) 4 courses on Role of Police in Disaster Management with total of 84 participants.

(c) to (d): Further, inclusion of such courses in future will depend upon the demand for such courses by various stakeholders.

As per the scheme of SDRF/NDRF, the State Government is responsible to ensure that mone-y drawn from the SDRF/NDRF account is actually utilized for the purposes for which the same has been set up and only on item of expenditure and as per norms approved by the GOI. The State Accountant General is required to monitor the expenditure and Comptroller & Auditor General of India causes audit of SDRF/ NDRF every year in terms of the scheme of the SDRF/ DRF.

In addition, the Government of India approved an assistance of Rs. 1000 crore from Special Plan Assistance (SPA) under Prime Minister`s package for post- earthquake reconstruction/rehabilitation activities, which is to be implemented during 2011-12 to 2014-15. For this purposes, GOI has released an amount of Rs. 400.00 crore from SPA to the State Government, as under:-

FIRE SAFETY IN BUILDINGS 7th May, 2013

(c) the details of the owners of the buildings who have complied/not complied with the orders of the High Court, as on date; and

(d) the steps taken by the Government in this regard?

(a) & (b): The Delhi Fire Service has informed that the Hon’ble High Court in the matter titled Dr. B.L. Wadhera Vs. Govt. of NCT of Delhi in Writ Petition (Civil) No. 2710/1998 has passed the direction to ensure fire safety provisions in the buildings covered under clause 6.2.4.1 of Building Bye-Laws, 1983.

(C): As per the direction passed by the Hon’ble High Court, the Delhi Fire Service inspected 2377 buildings to verify the status of fire safety system.

Out of which 527 buildings had been issued ‘No Objection Certificate’ from fire safety points of view, electricity and water disconnection orders were issued to 690 buildings for noncompliance of the fire safety norms and 747 buildings were declared as low rise category buy the MCD.

(d):The Govt. of NCT of Delhi has enacted Delhi Fire Service Act, 2007 and Delhi Fire Service Rules, 2010, which are more comprehensive legislation concerning fire safety in the buildings. The aforesaid Act and Rule came into force w.e.f. 01.07.2010.

On completion of construction of buildings, an inspection is carried out by the officers of Delhi Fire Service to verify the compliance of fire safety requirements and to issue Fire Safety Certificate.

In case of a disaster of ‘severe nature’ when available resources under the SDRF account are inadequate, additional assistance is extended from the National Disaster Response Fund (NDRF) after following the laid down procedure which includes visit of Inter- Ministerial Central Team.

The States of Jammu & Kashmir, Kerala, Himachal Pradesh and Uttarakhand have submitted memoranda during 2013-14 seeking additional central assistance from the National Disaster Response Fund (NDRF) for supplementing their relief efforts. The State-wise details of the assistance sought, visit of the Central Teams, status of team’s reports and assistance approved, are given at Annexure-II.

(e) the details of areas prone to natural calamities, calamity/region-wise and the preparedness measures for disaster management along with the measures taken/ proposed to be taken for strengthening disaster management in the country?

Statement STATEMENT IN REPLY TO PARTS (a) to (e) OF LOK SABHA STARRED QUESTION NO. 33 FOR ANSWER ON 06.08.2013. a & b: The primary responsibility for management of disaster rests with the State Government concerned. The institutional mechanism put in place at the Centre, State and district levels helps States to manage disasters in an effective manner. As per Disaster Management Act, 2005, the National Disaster Management Authority (NDMA) has the responsibility for laying down policies, plans and guidelines for disaster management for ensuring timely and effective response to disaster. Further, as per the DM Act, 2005 National Disaster Response Force (NDRF) has been raised for the purpose of specialized response to a threatening disaster situation or disaster, with its general superintendence, direction and control vested in NDMA. At present there are 10 Battalions of NDRF. In the case of Uttarakhand, NDRF personnel were deployed for immediate rescue and relief operations. Apart from the above, with respect to responding to the Uttarakhand disaster, a member of NDMA has been entrusted with the task of coordination with all the Ministries/ agencies concerned.

(c): Funds related to response for relief and immediate restoration have been established by way of National Disaster Response Fund (NDRF) and State Disaster Response Fund (SDRF). The total provisions for all the States during 2013-14 under SDRF is Rs.7035.22 crore. In case of a disaster of severe nature when available resources under SDRF are inadequate, additional assistance is extended from NDRF after following the laid down procedure which includes visit of Inter-Ministerial Central Team. There is no financial ceiling for assistance under NDRF. For long term reconstruction and rehabilitation, the State Governments are required to approach Planning Commission and sectoral central Ministries/Departments for assistance. During 2013-14, NDMA has been provided with a non-Plan budget of Rs 31.46 crore and a Plan budget of Rs 356 crore that includes Rs 250 crore for National Cyclone Risk Mitigation Project.

(d): As per Section 4 of the DM Act the National Authority shall meet as and when necessary and at such time and place as the Chairperson of the National Authority may think fit. Four meetings of NDMA have been held on 25.10.2007, 12.09.2008, 18.01.2010 and 01.06.2011.

(e): India, due to its unique geo-climatic and socio-economic conditions, has been vulnerable in varying degrees, to various disasters like floods, droughts, cyclones, tsunamis, earthquakes, landslides, avalanches and forest fire. Out of 35 States and Union Territories (UTs) in the country, 27 are disaster prone. Almost 58.6% landmass is prone to earthquakes of moderate to very high intensity; 12% land is prone to flood and river erosion; out of 7,516 km. coast line, 5,700 km. is prone to cyclones and tsunamis; 68% of the cultivable land is vulnerable to drought and hilly areas are at risk from landslides and avalanches.

COMPENSATION FOR NATURAL CALAMITIES 6th August, 2013

(b) whether any representation has been received to revise the said criteria; and

(a) to (c): ‘Relief’ means help to reduce the level of suffering and mitigate the distress so as to bring out the affected people from the shock and trauma of suddenly losing their means of livelihood. Further, the main objective of the relief fund is to assist the affected persons to start their economic activities again. On the other hand, compensation would be towards replacement of the damage in financial terms. Compensation would be a part of contractual agreement whereby unnatural dispossession of wealth and property. Insurance is one of such instruments. On the other hand, relief is by way of gratuitous assistance as an immediate help to overcome the stress. The present guidelines of State Disaster Response Fund / National Disaster Response Fund are not for compensation of loss.

However, Financial assistance in the wake of notified natural calamities is provided to States through the State Disaster Response Fund (SDRF), which is supplemented by the National Disaster Response Fund (NDRF) in cases of calamities of a severe nature.

Further, the expenditure from relief fund is to be incurred in accordance with the items and norms of assistance approved by the Government of India for the notified natural calamities only.

With regard to the revision of the norms of assistance, it has generally been a practice to review these after the award of successive Finance Commissions are accepted by the Government. Following the implementation of recommendation of XIII th Finance Commission with regard to its awards of grant to the States for response and relief, the Government of India constituted an Expert Group. The Expert Group consulted all the State Governments and concerned Central Ministries/ Departments. On the basis of all such inputs, the Expert Group submitted their report. Further, taking into account various factors including the report of the expert group and price rise, Government of India issued order on revised items and norms of assistance under NDRF and SDRF on 16th January 2012. As partial modifications was on 28th September 2012. The Government of India has recently approved the norms of certain items related to fully damaged pucca houses, gratuitous relief, agriculture input subsidy, fodder/ feed concentrate in cattle camps of assistance from SDRF/ NDRF, which was further modified on 21.6.2013. These norms are available on the Ministry of Home Affairs website: www.ndmindia.nic.in.

The Extant norms inter-alia provide for assistance to the farmers in the form of Agriculture input subsidy for damage caused to cropped areas due to the notified natural calamities only. As such under the SDRF/ NDRF norms assistance is provided in the form of input subsidy towards cropped areas-wise and not specific crop-wise assistance. Details of assistance admissible to Small & Marginal Farmers (SMF) as per extant items & norms are under:-

The team has submitted its preliminary report which mentions that the area has been denuded to a great extent due to deforestation and tree cutting for road construction, building construction, mining, hydel projects, etc., which has also resulted into increased surface flow and rise of river bed due to disposal of debris into the rivers.

(c) if so, the reasons for not declaring it as a National Calamity;

(d) whether the Government provides any special assistance to the affected States during a National Calamity; and

(e) if so, the details thereof including special assistance to Uttarakhand in this regard?

(a) to (c): With regard to declaring a calamity of sever nature as national calamity, it is informed that there is no provision to declare a natural disaster as a ‘national disaster’ in the guidelines. However, Government of India adjudges a calamity of ‘severe nature’ on case-to-case basis taking into account inter-alia the intensity and magnitude of the calamity, level of relief assistance, capacity of the State Government to tackle the problem, the alternatives and flexibility available within the plan to provide succor and relief etc. The priority is immediate relief and response assistance in the context of a natural calamity. As such there is no fixed prescribed norms. However, for calamity of a ‘severe nature’, additional assistance is also considered from the National Disaster Response Fund (NDRF), after following the established procedure. Keeping in view of the intensity & magnitude of Flash flood/ landslide/ cloudburst of June 2013 in Uttarakhand, it has been adjudged a calamity of a ‘severe nature’ for all practical purposes.

(d) & (e): the State Governments concerned are primarily responsible for undertaking necessary rescue & relief measures in the wake of natural disasters. For this purpose, a State Disaster Response Fund (SDRF) has been constituted with an allocated amount for each State. The State Governments are expected to take relief measures of immediate nature to the victims of notified natural calamities including flood, landslides and cloudburst, out of the funds available in the SDRF in accordance with the approved items & norms of assistance. Additional expenditure, if any, incurred over and above or on other than approved items/ norms, is required to be met by the States from their own resources and not from SDRF/NDRF. The Government of India has released an amount of Rs. 145 crore from State Disaster response Fund (SDRF) to the State on 20.6.2013 to enable relief and restoration works. In addition, GOI has released an amount of Rs. 250 crore on an ‘on account’ basis from the National disaster Response Fund (NDRF) to the State Government on 19th July, 2013.

(a) & (b): The State Governments concerned are primarily responsible for undertaking necessary relief, reconstruction and rehabilitation measures in the wake of natural calamities. The Government of India supplements the efforts of the State Governments by extending financial and logistical support, wherever required. In the immediate aftermath of the natural disaster in Uttarakhand in June, all the concerned Ministries of Government of India played their supporting roles in search, rescue and relief efforts. Government of India has constituted a Cabinet Committee under the Chairmanship of the Prime Minister, for providing broad guidance to re-construction and rehabilitation efforts in Uttarakhand. Government of India has also constituted Inter-Ministerial Group (IMG) under the chairmanship of Cabinet Secretary for drawing up time bound Action Plan for supporting rehabilitation and reconstruction efforts in Uttarakhand.

(c): The financial assistance from State Disaster Response Fund (SDRF)/ National Disaster Response Fun (NDRF) is towards relief and not for compensation of loss. Ex-gratia to the next of kin of the deceased persons/ persons feared to be dead is being paid @ Rs. 1.50 lakh from SDRF/ NDRF, @ Rs. 1.50 lakh from the State Government, @ Rs. 2.00 lakh from PM Relief Fund per person. As on 7th August 2013, the Government of Uttarakhand has paid ex- gratia to the next of kin of about 798 persons dead/ feared to be dead @ Rs. 5.00 lakh per person.

(e): The National Disaster Response Force (NDRF) has been constituted under Section 44 of the DM Act, 2005 by up-gradation/ conversion of standard battalions of the Central Armed Police Forces, as a specialist force to deal with disaster or a threatening disaster situation are positioned in the disaster prone areas. The 10 battalions of NDRF are trained for response to various types of disasters. Each NDRF battalion is equipped and trained for rendering effective response to any threatening disaster situation or disaster. Based on vulnerability profile of different regions of the country, these specialist battalions have been presently stationed at various locations. (a) to (b): The Scientists of National Geophysical Research Institute as a part of research project from Department of Science and Technology carried out detailed seismological investigation of Uttarakhand region for over 3 years. The aim of the project was to provide a detailed structural framework for the region with reference to earthquake genesis. Researchers found a significantly different structural feature compared to earlier projections. This feature at depth may hold strain (energy) at the location. One of the many possibilities of releasing the stored energy is in the form of a major earthquake.

The National Disaster Management Authority (NDMA) has issued guidelines on Management of Earthquakes. Given the high seismic risk and earthquake vulnerability in India, these Guidelines require all stakeholders to ensure that, hereafter, all new structures are built in compliance of earthquake resistant building codes and town planning byelaws.

The Bureau of Indian Standards (BIS) has brought out Indian Standards for earthquake resistant design and construction of buildings and structures. Various provisions contained in the relevant Indian Standards / Codes / Specification/ Guidelines for earthquake design and construction of buildings are required to be followed for safety, stability and durability of such buildings. It is the responsibility of the State/UT Governments to strengthen their technolegal regimes to make the provisions of above Indian Standards and Codes mandatory.

(a) & (b): Smuggling of animals is not rampant along the entire Indo-Bangladesh Border, except at certain areas. (c):Steps taken by the Government to prevent cattle smuggling on the Indo-Bangladesh Border are as under :- i) Vulnerability mapping of the Border Out Post(BOPs), which are prone to smuggling of cattle along the Indo- Bangladesh Border, have been carried out. 23 BOPs vulnerable to cattle smuggling have been identified (List attached as Appendix-‘A’). These BOPs have been strengthened by deploying additional manpower, special surveillance equipments, vehicles and other infrastructure support. ii) Effective domination of the borders by carrying out round the clock surveillance of the borders, viz; patrolling, laying nakas, establishing of observation posts all along the International Border(IB) and strengthening of existing defence of the BOPs. iii) Fencing along the Indo-Bangladesh Border. iv) Installation of border Floodlights along the Indo-Bangladesh Border. v) Use of water crafts/boats and floating BOPs for domination of riverine area of IB. vi) Introduction of Force multipliers and Hi-Tech Surveillance equipments such as Long Range Reconnaissance & Observation system (LORROS), Battle Field Surveillance Radars(BFSR), Hand Held Thermal Imager(HHTI), Night Vision Device/ Goggles(NVDs/NVGs) etc. vii) Up-gradation of intelligence network and co-ordination with the agencies concerned. viii) Conduct of special operations along the border. ix) Frequent visit to the border by unit Commandants and senior officers to supervise effective domination of the border. x) Better coordination with including simultaneous coordinated patrol in these areas.

xi) In addition to the above, Government of India has sanctioned 2 Frontier Headquarters, 3 Sector Headquarters and 16 Battalions to augment BOPs in riverine/hilly/vulnerable segment & on the Indo-Bangladesh Border.

(a) to (d): The State Governments are primarily responsible for undertaking relief measures at ground level in the wake of natural calamities. The Government of India supplements the efforts of the State Governments by providing logistical and financial support. The relief in the various sectors including agriculture crops loss caused by the floods is provided under the guideline of State Disaster Response Fund (SDRF) and National Disaster Response Fund (NDRF), in accordance with the items & norms approved by the Government of India. These norms inter-alia provide for assistance to the formers for desilting of agricultural land, agriculture input subsidy for damage caused to crops. In addition to regular schemes of crops damage, the farmers are also entitled for compensation under the National Agricultural Insurance Scheme, which is implemented by the State Government.

However, the financial assistance from response fund is towards relief and not for compensation of loss. The main objective of the response fund is to assist the affected persons to start their economic activities again. The relief is by way of gratuitous assistance as an immediate help to overcome the stress.

In the instant case, the Government of Maharashtra had submitted a memorandum projecting the demand of Rs.2841.78 crore for floods during 2013. The High Level Committee (HLC) in its meeting held on 24.10.2013, inter-alia, considered the memorandum of the State, the report of Inter-Ministerial Central Team (IMCT) and recommendations of the sub-committee of National Executive Committee (NEC) thereon as well as the extant items and norms of assistance from SDRF/NDRF, and approved Rs.921.98 crore from NDRF, subject to adjustment of 75% of balance available in the State SDRF amount for instant calamity. This included an amount of Rs.836.37 crore towards damages in agriculture sector due to the floods of 2013. The entire approved amount of Rs.921.98 crore (Rs.192.175 crore, from SDRF=Rs.729.805 crore from NDRF) has already been released to the State of Maharashtra by Government of India on 20.11.2013.

CYCLONE AFFECTED STATE 10th December, 2013

(c) whether any Central team has visited the affected areas to assess the damage caused by the said cyclone;

(d) if so, the details of the recommendations of the team and the follow up action taken thereon;

(e) the number of persons evacuated from the affected areas and the measures taken by the Union Government in consultation with the State Governments to rehabilitate the displaced persons; and

(f) the financial and other assistance provided to the affected States by the Union Government so far, State/UT- wise?

(a)&(b): Yes Madam. As per the information received from India Meteorological Department, cyclone ‘Phailin’ hit the Odisha coast near Gopalpur of Ganjam District at night of 12th October, 2013 and affected the States of Odisha and Andhra Pradesh.

The State Governments of Odisha and Andhra Pradesh, have reported the loss of lives, injuries to the persons and damages to the crops as well as houses caused by the above Cyclone as given below:-

(c)&(d): Upon receipt of the memorandum from the State Government of Odisha and Andhra Pradesh, Inter- Ministerial Central Teams (IMCTs) visited the affected areas of Odisha from 28th to 31st October 2013 and Andhra Pradesh from 17th – 21st November 2013 for an on-the-spot assessment of damages caused by the cyclone ‘Phailin’ and subsequent flood of 2013. The reports of the IMCT are being placed before the sub-committee of the National Executive Committee (NEC) and High Level Committee (HLC) for consideration in its meeting to be held shortly.

(e): More than 11 lakh people in Odisha and more than 1 lakh people in Andhra Pradesh were evacuated from low lying/ vulnerable areas. On receipt of warning from IMD, the concerned State Governments were alerted to take necessary precautionary measures to deal with the Cyclone. The National Executive Committee reviewed the preparedness on daily basis. Steps were taken to mobilize essential logistics and resources required for the purpose of rescue and response. Beside, site mobilizations of personnel from Navy, Army NDRF, IAF helicopters were also stationed at strategic locations to support the local authorities.

(f): In order to support the affected people of these two States, the Government of India have been released an amount of Rs.1000 crore (Rs. 250 crore from SDRF + Rs.750 crore on account basis, from NDRF) to the State Government of Odisha and Rs.1000 crore (Rs. 300 crore from SDRF + Rs.700 crore, on account basis, from NDRF) to the State Government of Andhra Pradesh.

NATURAL CALAMITY IN UTTARAKHAND 10th December, 2013

MINISTER OF STATE IN THE MINISTRY OF HOME AFFAIRS (SHRI MULLAPPALLY RAMACHANDRAN) (a): As per the information received from the Government of Uttarakhand, 4364 people have lost their lives due to the natural disaster caused by heavy rainfall, cloudbursts, flash floods and landslides in June 2013 in Uttarakhand. This includes 4119 missing persons, who are feared to be no more. These figures are provisional, as the verification process is still on.

(b):The State Government has informed that road connectivity has been restored in the disaster affected areas. Electricity and drinking water supply have also been restored. Further the State Government has prepared a housing policy for disaster affected families. The process of reconstruction of houses is on.

(c): The State Government has provided an amount of Rs. 150.13 crore to the disaster affected families under various heads of relief/ ex-gratia. Apart from this, Rs. 77.28 crore has been provided to the next of kin of the missing persons, who belong to States other than Uttarakhand.

INCLUSION IN LIST OF NOTIFIED CALAMITIES 10th December, 2013

(a) to (d): The issue of inclusion of any calamity in the list of notified natural calamities has traditionally been considered by the successive Finance Commissions. Presently, the natural calamities identified for the purpose of relief assistance are cyclone, drought, earthquake, fire, flood, tsunami, hailstorm, landslide, avalanche, cloud burst, pest attack and cold-wave/ frost. As for as the events of `lightning` and `coastal erosion` are concerned, these, are not included in the list of eligible calamities for assistance from SDRF/ NDRF. As such, the concerned State Governments are required to provide relief from their own resources, to the people affected due to lightning and coastal erosion as per their relief codes/ manual.

However, on demand of several States, a Group of Ministers (GoM) has been constituted by the Government of India for the said purpose. In its meeting held on 21st August 2013, the GOM considered the matter and inter alia decided that State Disaster Response Fund (SDRF)/ National Disaster Response Fund (NDRF), which is meant for immediate response, could not be an appropriate means to address the concern of ‘erosion’, The issue of river bank erosion and sea-erosion however are definitely important one, as these have been affecting quite a large number of villages, The State Governments are therefore required that they take up for assistance from existing mitigation programmes like Flood Management Programme of the Ministry of Water Resources, Gal etc.

(a) Yes, Madam.

(b) The recommendations of the Task Force are Annexed.

(c) The Union Government has undertaken various measures like development and strengthening of institutional mechanism, capacity building of stake holders, financial arrangements etc. for the purpose of strengthening the disaster management system in the country such as: i. A paradigm shift brought in the approach to Disaster Management from relief-centric to a holistic one. ii. Setting up of a legal framework for Disaster Management by enacting the Disaster Management Act (DM Act), 2005 & Civil Defence (Amendment) Act, 2009. iii. Institutional framework created by establishment of the National Disaster Management Authority (NDMA) for policy & planning, National Institute of Disaster Management (NIDM) for capacity development, National Disaster Response Force (NDRF) for specialized response as provided under the Disaster Management Act. iv. National Disaster Management Policy formulated and enforced. v. Disaster specific and thematic guidelines for guidance of States/UTs in tackling different kinds of disasters issued. vi. National Disaster Response Fund and State Disaster Response Fund constituted for meeting any threatening disaster situation or disaster. Based on the recommendations of 13th Finance Commission, corpus of Fund to the tune of Rs. 33580.93 crore for State Disaster Response Fund has been earmarked for the period 2010-11 to 2014-15 and released to them as per guidelines. vii. Programme for Institutional Strengthening and Capacity Building for Disaster Risk Reduction under Government of India- UNDP Disaster Risk Reduction Programme (2009-12) implemented. viii. To mitigate the vulnerability of the coastal people from the cyclone, Phase-I of National Cyclone Risk Mitigation Project (NCRMP) under implementation in Andhra Pradesh & Odisha from 2010-11 to 2015-16. ix. A Centrally Sponsored Scheme on National School Safety Programme - Demonstration Project at a cost of Rs. 48.47 crore under implementation from 2011-12 to 2013-14. x. Two Schemes namely Revamping of Civil Defence and Strengthening of Fire and Emergency Services in the States / UTs at a cost of Rs. 100 crore and Rs. 200 crore respectively were implemented during 2009-10 to 2012-13. xi. In order to strengthen the States / UTs for preparation of their respective Disaster Management Plans, an amount of Rs. 3.20 crore given by Govt. of India to the States/UTs through NDMA during the financial year 2009-10. xii. Rs. 525 crore allocated to the States as Grant for Capacity Building for Disaster Response during 2010-11 to 2014-15. The guidelines to this effect as well as Rs. 230 crore has been released to the States during 2010-11 to 2013-14 (up to 30th November, 2013). xiii. Financial assistance extended to Administrative Training Institutes and other training institutes in States / UTs for strengthening the Capacity Building measures in the States / UTs through National Institute of Disaster Management (NIDM) during 2007-08 to 2011-12.

1 The role and functions of NDMA should be broadened. MHA should coordinate the Disaster Response functions with States and UTs. 2 Some functions of NEC (Section 10 of the Act), like preparation of National Plan, Mitigation and Preparedness measures, specialised training programmes, etc. may be assigned to NDMA. 3 NDMA will prepare the National Plan at the official level and place it before the National Authority for their approval. 4 NDMA should not have more than four full time Members including VC. Ministers for Home, Defence, Finance, Agriculture and Urban Development should be ex-officio Members. 5 Full time Members should have experience, domain knowledge and credible accomplishment in disaster management. Tenure and age limit to be specified. 6 Selection of Members should be open and transparent through a Search cum Selection Committee. 7 PM should be the Chairperson of the Search cum Selection Committee. Full time Members should hold the office for five years. 8 High Level Committee (HLC) and Inter Ministerial Group (IMG) should be incorporated in the Act. 9 National Executive Committee may be discontinued. National Crisis Management Committee (NCMC) may be included in the Act substituting NEC. Cabinet Secretary shall be Chairperson of the NCMC and Home Secretary a Member. 10 NCMC should be coordinating and monitoring body, implementing agency for National Plan, evaluating agency for preparedness and coordinating the response. 11 DM Division should function as Secretariat to NCMC. 12 NIDM should function autonomous with respect to its activities and HR Practice and not as subordinate to NDMA or MHA. 13 NIDM should be able to specify the numbers, nature and categories of officers / employees, may appoint consultants, keep salaries / allowances as may be specified with the approval of Central Govt. 14 State Governments should accord priority to creating a state level organizational arrangement for this purpose and NIDM should have some organic linkages with state level DM institutions. 15 NDRF has done well. No need to amend existing provisions with respect to it in the Act. 16 Some of NDRF personnel should be allowed to continue or NDRF may recruit some of its personnel so that there is continuity and institutional memory in respect of some types of expertise. DG NDRF & CD should not be given any additional duties. DG should be under administrative control of NDMA as an officer on deputation. 17 Role and functions of SDMA should be broadened. 18 Some functions of State Executive Committee like preparation of State Plan, examine the vulnerability of different part of State and awareness generation should be given to SDMA. 19 State Plan will be prepared by SDMA and submitted to the State authority for approval. 20 Members of SDMA may be ex-officio and part time, should not be more than 2 full time Members. 21 Ministers of relevant departments, Chief Secretaries, DG Police and to eminent experts as a part time or full time may be included as Members. 22 CEO of the rank of Principal Secretary should head SDMA. The Relief Commissioner should function as additional CEO. 23 Full time Members should have experience, domain knowledge and credible accomplishment in disaster management. 24 Tenure and age limit of full time Members to be specified. 25 Selection of full time Members should be open and transparent through a Search cum Selection Committee. 26 Chairperson of State Authority when State is under President’s rule should be provided in Act. 27 Chief Minister should be Chair Person of State Authority, he will also be the Chairperson of the Search cum Selection Committee. Full time Members should hold the office for five years.

28 SEC may be discontinued and SCMC may be included in DM Act, 2005. 29 In the composition of SCMC, DG Police, Senior most officer of armed forces and NDRF, if any unit of NDRF is in the State. 30 Functions of SCMC may be modified and broadened in the Act. 31 DM Department or O/o Relief Commissioner to provide secretariat assistance. 32 DDMA should include two eminent persons with experience and knowledge of DM. 33 Separate secretariat of DDMA, with Additional Collector as its CEO. 34 DDMA should get some powers to recruit personnel on line of NDMA and SDMA. 35 Regulatory/administrative activities of section 34 be vested in DM/DC. Title, District Authority should be replaced by Collector/DM/DC. 36 Autonomous District Councils be added to the definition in 2(h) of Act. 37 In functions of local authorities, there should be mention of: (i) ensuring compliance with the laws, codes and rules relating to building safety and fire safety, (ii) a reference to the preparation of DM plan. 38 Constitution of DM Authority for large cities. Mayor of the Municipal Corporation may be the Chairman with Municipal Commissioner, Police Commissioner, District Collector and two experts as Member. The Authority would function in close coordination with DDMA. 39 DM Division may be strengthened to equip it to undertake the activities assigned by the Act. 40 NCMC with Secretarial Assistance of DM Division should monitor activities of different Ministry with respect to provisions of the Act. 50 State Govt. to decide whether to keep mitigation funds at district level or keep separate mechanism. 51 In Section 46, National Disaster Response Fund should be replaced by National Fund for Disaster Response (NFDR). Similarly for SFDR. 52 National Authority should meet twice a year or more often, as necessary. 53 NDMA should have the power to recruit officers and employees once the posts and the service rules proposed by it are approved by the central govt. NDMA should be able to specify the numbers, nature and categories of officers / employees, may appoint consultants, keep salaries / allowances as may be specified with the approval of Central Govt.

54 Section 6(2)(i) may be amended as under: Take such other measures including providing technical assistance to State Governments for disaster prevention, mitigation or preparedness and capacity building for dealing with a threatening disaster situation or disaster as it may consider necessary. 55 Inclusion of “National Policy” word in section 10(2)f. 56 Full time CEO of the State Authority, of the rank of Principal Secretary. 57 State Authority shall meet twice a year or more often as and when necessary. 58 State Authority should have the autonomy and flexibility to recruit and appoint appropriate personnel. State Authority should be able to specify the numbers, nature and categories of officers / employees, may appoint consultants, keep salaries / allowances as may be specified with the approval of State Govt. 59 District Authority shall meet once in a quarter and more often as and when necessary. 60 District Authority to be given some power to identify appropriate personnel. 61 Response activities of section 36 f (ii to iv) be placed under section 36 g (vi to viii). 62 Local Authority may take measures for ensuring compliance with the laws and rules of building safety and fire safety and other measures as may be necessary for disaster management. 63 Under Section 42(2) the word institute may be replaced by General Body or Governing Body. In case of the latter the Governing Body provided in Section 42(4) may be called Executive Committee. 64 In Section 48(1), State Govt. may establish DDRF and DDMA. If it is decided not to have separate funds for response and mitigation at district level, Section 48(1)(b) 48(1)(d) and 48(2)(III) will have to be deleted.

65 A panel provision to be provided for negligence and noncompliance of safety regulations. 66 In Section 54, “Alarm or Warning” may be replaced by “prediction”. 67 NDMA, SDMA and DDMA may be given power to delegate its power, functions to any Member/Officer. 68 NDMA should be given similar power like NIDM to make regulations so that it can frame regulations for conduct of business, service conditions of personnel, etc. 69 The Act should specifically mention women, children, the disabled and weaker sections. 70 The Act should incorporate the duties, responsibilities and role of citizens and the community and their rights also. 71 Community based disaster preparedness may be included with the provisions relating to local authorities. 72 The roles and responsibilities of Civil Defence, Home Guards and Fire Service may be included. 73 The Act should include the role, responsibility and liability of the private sector. 74 There should be a provision for a grievance redressal mechanism in the context of relief, rehabilitation and reconstruction. 75 Provision to encourage the participation of volunteers in disaster management. 76 Provision for promoting adequate risk-transfer, risk-sharing and cost sharing mechanisms. 77 An independent exercise to be taken to analyse the administrative structure and profession competence of DM Division, NDMA, SDMA, DDMA, setting up of National Cadre for National Cadre of DM Professionals, training and education facilities in the area of DM.

(a) All the States/UTs, except the State of Gujarat, have implemented Disaster Management Act, 2005. The State of Gujarat is following the Gujarat State Disaster Management Act, 2003, which was made prior to enactment of DM Act, 2005.

(b) to (c) As per Section 23(1) and 23(2) of the Disaster Management Act, 2005, every State/UT has to prepare State Disaster Management Plan (SDMP) which is to be prepared by their State Executive Committee (SEC) and it has to be approved by their State Disaster Management Authority (SDMA) as per Section 18(2). So far 14 States/UTs viz Arunachal Pradesh, Assam, Chhattisgarh, Gujarat, Nagaland, Punjab, Mizoram, Sikkim, Odisha, Karnataka, Himachal Pradesh, Jharkhand, Manipur & West Bengal have finalized their SDMPs and SDMPs of 9 other States/UTs viz Andhra Pradesh, Goa, Haryana, Rajasthan, Tamil Nadu, Tripura, Uttar Pradesh, Delhi and

Puducherry are at Draft Stage. Preparation and updation of SDMPs is a continuous process. The rest of the States/UTs are in the process of preparing their SDMPs.

(b) whether foreign funds received by such NGOs/VOs are allegedly being misused in the absence of strict monitoring oil receipt and utilisation of such funds;

(c) if so, the details thereof and the steps taken to monitor the functioning of NGOs and utilisation ot funds by such NGOs/VOs as well as scrutiny of their accounts and records;

(d) the steps taken for ensuring filing of annual returns by NGOs/VOs and the number of NGOs/VOs which have not furnished their annual returns as per the prescribed rules along with the action taken against them, State-wise; and

(e) the detail of the limit fixed for receiving foreign funds by NGOs/VOs and the cases of violation of guidelines by NGOs/VOs tliiat have been referred to the law enforcement agencies along with the action taken against such NGOs/VOs, State-wise?

(a): As per records available in Ministry, 23063, 22710 and 16557 NGOs received foreign contribution for the years 2010-11, 2011-2012 and 2012-13 respectively. State-wise details of the same are given at Annexure-I. Compiled data of Country-wise details is not readily available.

(b) & (c): The Government monitors the receipt and utilization of foreign contribution received by any `person` including Non-Governmental Organizations in the country in terms of the Foreign Contribution (Regulation) Act, 2010 and the Rules framed thereunder. The Government undertakes random scrutiny of Returns furnished by the registered FCRA associations and those granted prior permission to receive foreign contribution. Besides this, inputs from field agencies or complaints against associations are also received. These are examined and wherever required, inspection of accounts and records of such associations is undertaken. Twenty Four cases of violation have been referred to CBI and 10 cases have been referred to State Police for investigation and prosecution as given in Annexure III and IV respectively.

(d): As peir the laid down procedure, the associations, whose annual return in the prescribed proforma are not received within the stipulated time are issued Show Cause Notice. After stipulated time, association has to pay compounding penalty as per Notification SO 1070 E dated 26.04.2013. After giving them reasonable opportunity,

violation if proved, action to cancel their registration is initiated. In 2011-12, registrations of 4138 associations under FCRA were cancelled due to non-submission of Annual Returns for the period 2006-07 to 2008-09. State- wise data of cancelled NGOs is at Annexure-ll.

(e): There is no limit fixed for receipt of foreign contribution by associations registered under FCRA 2010. Twenty four cases of violation have been referred to CBI and 10 cases have been referred to State Police for investigation and prosecution.

ROW OVER RIVER ISLAND 11th February, 2014

(a) & (b) There is no dispute over any river island in south Tripura along the Indo-Bangladesh Border. However, there is a dispute regarding boundary alignment of about 1.6 km along Muhuri river in Belonia, Tripura. The main point of difference between the two countries is the formation of the Char land having an approximate area of 62.27 acres due to shifting of river Muhuri towards Bangladesh. 44.87 acres of the Char land is currently under the possession of India and the remaining 17.40 acres is under the possession of Bangladesh.

(c) The Protocol to the 1974 Land Boundary Agreement (LBA), signed on 6th September, 2011 by the Foreign Ministers of India and Bangladesh, paves the way for a settlement of the long pending Land Boundary issues between the two countries including demarcation of International Boundary in Muhuri river.

SUPPLY OF ELECTRICITY AND WATER BY NDMC 11th February, 2014

(a) whether the New Delhi Municipal Council (NDMC) has any proposal to provide electricity on concessional rates and water for free to the people residing in areas under its jurisdiction;and

(a) & (b) The New Delhi Municipal Council, at its meeting held on 29.01.2014 has passed a resolution for providing water to domestic consumers using upto 20 KL in a month free of charge. However, consumption beyond 20 KL per month would be billed as per prevailing tariff for full water consumption under the slab system. As per the Resolution, NDMC will place the demand upon Delhi Jal Board for supplying the required quantity of water without charge to implement this scheme. Therefore, implementation of this resolution is subject to acceptance by Delhi Jal Board.

At the meeting held on 29.01.2014, the Council has passed another resolution to implement the decision No.2098 dated 31.12.2013 of the Govt. of NCT of Delhi. It was resolved that 50% targeted subsidy on tariff slabs issued by Delhi Electricity Regulatory Commission (DERC) for the financial year 2013-2014 to all the domestic consumers consuming upto 400 units only per month for the period 1st January, 2014 to 31st March, 2014 would be provided. Further, no subsidy shall be provided to domestic consumers consuming more than 400 units, even on slabs upto 400 units. The decision would be implemented on receipt of acceptance from Power Department of Govt. of NCT of Delhi to provide the subsidy component to NDMC.

(a) & (b): Regulation of Land and Construction of Building has been included as a municipal function in the XIIth Schedule to the Constitution of India in terms of the article 243-W. As such it is the primary responsibility of the State Governments to strictly adhere to safety norms laid down by the Bureau of Indian Standards for Disaster Management namely the National Building Code 2005 (NBC 2005) which is a comprehensive building code and a national instrument providing guidelines for regulation of the building construction activities across the country. It serves as a Model Code for adoption by all agencies involved in building construction works.

(d) if so, the details thereof; and

(e) the manner in which the guidelines for assistance under NDRF and SDRF are revised in view of price rise?

(a)&(b): The guidelines for Constitution and Administration of State Disaster Response Fund (SDRF) and National Disaster Response Fund (NDRF) are based on the recommendations of 13th Finance Commission. There is no provision for appropriation of surplus funds for State planning sanctioned under SDRF/NDRF.

(c) & (d): In this context, it is stated that the proposal to constitute inter-alia the District Disaster Response Fund (DDRF) was referred to 13th Finance Commission, which were of the view that setting up of this fund be left to the discretion of the states.

(e):In pursuance to the provision of the Disaster Management Act, 2005, the Government of India has notified the constitution of the National Disaster Response Fund on 28th September 2010. Further keeping in view of the various factors including price rise, provision of the DM Act, 2005 and the recommendations of 13th Finance Commission, GOI has framed guidelines on constitution and administration of SDRF and NDRF.
