93-107 d) Subdivision and Water Connections- Foothills Development (Notice of Motion given by Councillor Coulson on January 22,2018) WHEREAS 7401 Aulds Road (Lot 8, Block 471 - owned by William Colclough) and Lot 1, Block 471 (owned by M.Banting) is part of the development package submitted to the District of Lantzville as part of the Foothills development, AND WHEREAS 7401 Aulds Road (Lot 8, Block 471 - owned by WiUiam Colclough) and Lot 1, Block 471(owned by M.Banting) is currently zoned RSIL as noted in Bylaw 60,2005 Zoning and Subdivision Map, AND WHEREAS a co-development agreement exists between Lone Tree Properties, M.Banting, and W.Colclough, AND WHEREAS the Phase 1 map for the FoothUls subdivision application (on behalf of the three property owners Lone Tree Properties/M. Mayor & Councillors - Verbal Updates a) Councillor Swain provided an update on meeting today with members of the "Save Lantzville Forest", the Province's response to the Nanaimo & Area Land Trust (partnering with "Save Lantzville Forest") considering extending recreational trail network in the Knarston Creek Forest Corridor in Woodlot 1475, noted this does not protect any additional trees in the Woodlot except for riparian zones, and the opportunity for members of the public to write to the Honourable Doug Donaldson, Minister of Forests, Lands, Natural Resource Operations and Rural Development, about protection in Woodlot 1475. b) Mayor Haime extended congratulations to the newly-elected Council ofthe Nanoose First Nation (Chief Councillor Gordie Edwards, and elected Council members: Brent Edwards, Lawrence Mitchell, Tom Bob, and Natasha Bob), noting that Nanoose First Nation and the District of Lantzville are neighbours, share a school and are an integral part of each other's community.

Members of Council asked staff to identify the Official Community Plan changes fi*om version 2 to version 3 by highlighting the changes. Opposed: Councillors Colclough, Coulson, Haime, and Swain DEFEATED Mayor Haime advised he will establish a Special Committee of the Whole meeting date early in February for further review ofthe draft Official Community Plan.

2. Proposed Investigation - Subdivision Advice MOVED and SECONDED,THAT Council investigate who on Council or staff encouraged Mr. Sinclair that subdivision to quarter acre lots would be "okay" as the existing OCP and zoning does not allow that density.

MOVED and SECONDED,THAT the main motion be amended to add "AND FURTHER, THAT Council also investigate who Gordon Shumway is who published a defamatory letter on social media against Councillor Colclough in 2016." Pursuant to Section ICQ ofthe Community Charter, Councillor Colclough declared a potential conflict ofinterest as he is named in the amendment motion, and therefore he was unable to speak or vote on this item; he immediately left the meeting at 8:27 pm. THAT the main motion be amended to add "AND FURTHER, THAT Council also investigate who Gordon Shumway is who published a defamatory letter on social media against Councillor Colclough in 2016." SCHEDULE 'B' DISTRICT OF LANTZVILLE BYLAW NO.26

WATER SYSTEM BYLAW NO. 140, 2018 FEES & CHARGES

INTERPRETATION

1. In this Schedule,

"billing period" means a quarterly (3-month) period within a calendar year;

"Campground","Commercial", "Dwelling Unit","Gross Floor Area","Industrial", "Institutional","Mobile Home Park","Multi Family","Single Family" and "Service Connection" have the same meanings as defined in the City ofNanaimo Water Supply Development Cost Charge Bylaw 2008 No. 7070, as amended or replaced from time to time; and

"residential purpose" means the occupation of a dwelling unit as the usual home residence of individuals permanently residing in , and does not include accommodation within a hotel, motel, strata resort unit, or any other parcel or strata development used for tourist or other temporary accommodation; and

unless otherwise indicated, terms used in this Schedule have the same meaning as defined in the District ofLantzville Water System Bylaw No. 140, 2018.

CONNECTION FEES

2. The following fees are payable for connection to the water system:

Use Connection Fee Campground $ 849.74 per service connection Commercial $ 34.36 per square metre of Gross Floor Area Industrial $ 8.77 per square metre of Gross Floor Area Institutional $ 34.36 per square metre of Gross Floor Area Mobile Home Park $3,611.38 per service connection Multi-Family Dwelling $ 35.47 per square metre of Gross Floor Area Single Family Dwelling $5,912.26 per Dwelling Unit

INSTALLATION FEES

3. For a property where the service connection has not been installed and paid for as part of a subdivision servicing requirement, the following installation fees, complete with meter, are payable at the time of application for the service connection:

Where the service connection to a property was installed and paid for as part of a subdivision servicing requirement, the following fees are payable, at the time of application, for meter installation and service:

Any latecomer charges that apply to a property must be paid in addition to all other fees and charges applicable under this Schedule and Water Service Bylaw No. 140, 2018.

Where a previous application was made, but the water service was not installed prior to the adoption of the Water System Bylaw No. 140, 2018, or this Schedule, whichever is later, the connection charge previously paid will apply. If the owner fails to connect the water service to the water system within 60 days of the date the application is approved, the owner must reapply and pay an additional fee of $250,00 for administration costs.

DISCONNECTION

7. The fees for disconnecting a service connection shall be the actual cost of disconnection plus an administration fee of $110.00.

8. The fee for turning on or turning off a service at the request of a consumer shall be $35.00.

FIRE HYDRANT

9. The fee for connection of a standard fire hydrant on strata or other private property to the water system is $275.00 per hydrant.

RESIDENTIAL PURPOSE RATES 10. The following rates shall apply for each billing period to each dwelling unit on a parcel, group of parcels or strata development that is used exclusively for residential purposes, including without limitation any single family dwelling, carriage home, duplex, triplex, fourplex, apartment, and each mobile home within a mobile home park used solely for residential purposes:

Base fixed charge for water infrastructure $ 12.6850 Per cubic meter(m3) of water consumed: up to 10 mS $ 0.6524 over 10 m3, up to 20 m3 $ 1.3048 over 20 m3, up to 30 m3 $ 2.1746 over 30 m3, up to 60 m3 $ 3.2620 over 60 m3 $ 1.8265

NON-RESIDENTIAL PURPOSE RATES 11. For any property, parcel, group of parcels or strata development that is used for other than a residential purpose, including but not limited to mixed use buildings with dwelling units, commercial strata properties, resort properties, institutional properties, hotels, motels, campgrounds or care facilities, the following rates per business unit shall apply:

ANNUAL FEE

12. The owner of each parcel or group of parcels must pay an annual fee of$178.88 per parcel or group of parcels.

DETERMINATION OF QUANTITY

13. Where one or more meters service one or more parcels, group of parcels, or strata developments, the quantity of water supplied by the District's water system will be divided:

(a) evenly among the number of dwelling or business units associated with the parcel, group of parcels, or strata developments that are serviced by the meter(s); or

(b) upon approval by the District's Director of Financial Services, as provided by the property owners or strata council, as applicable.

14. The quantity of water supplied by the District to a property shall be determined by the most recent amount recorded by the meter(s) through which water is delivered, less the immediately previous amount recorded.

15. If a meter is not installed, is not operational, or cannot be read, the fees charged will be an amount estimated by the Director of Public Works to have been consumed for the billing period, based on the normal consumption for that use and taking into account any circumstances particular to the use of water at that property.

METER READINGS

16. In relation to a transfer of property, the fee for reading a meter to calculate charges owing for water shall be $40.00.

17. The fee for re-reading or re-inspection of a meter shall be $55.00.

INSPECTION FEES

18. The following fees shall apply to each water service inspection carried out by or on behalf of the District:

WHEREAS the Municipal Council of the District of Lantzville is authorized by sections 8 and 194 of the Community Charter to establish the rates and terms under which water may be supplied and used;

NOW THEREFORE the Municipal Council of the District of Lantzville in open meeting assembled enacts as follows:

PART I - GENERAL PROVISIONS TITLE AND DEFINITIONS

Title

1. This Bylaw may be cited for all purposes as the "District of Lantzville Water System Bylaw No. 140, 2018".

Definitions

2. In this bylaw:

"accessory carriage house" means a dwelling unit which is contained in a building separate from a single-family dwelling on the same lot and which is intended as a fixed place of accommodation and home life and excludes any tourist accommodation;

"Applicant" means an owner or their agent making application for a water service connection;

"backflow" means the flow of water or other liquids, mixtures, or substances into the distribution of pipes of a potable supply of water from any source or sources other than its intended source;

"Building Inspector" means the Building Inspector of the District and their duly authorized representative;

"business unit" means a self-contained unit with a separate entrance intended or used for commercial, institutional or industrial purposes and, without limitation, includes a retail store, office, restaurant, laundromat, service station, car wash, processing plant, beer parlour, campground, hotel, motel, or boarding house;

"consumer" means any person or business to whom water is supplied by the District;

"Corporate Officer" means the employee appointed as the Director of Corporate Administration under section 148 of the Community Charter or a person duly authorized to act in the place ofthe Corporate Officer.

"cross-connection" means any temporary, permanent or potential water connection between the potable public water supply and a source of contamination or pollution;

"curb stop" means a shut off valve installed by the District on a service connection with a protective housing to the ground surface;

"Director" means the Director of Public Works for the District or a person duly authorized to act in the place ofthe Director;

"Director of Financial Services" means the Director of Financial Services for the District or a person duly authorized to act in the place ofthe Director;

"distribution system" means all water mains and appurtenances thereto, including fire hydrants, pumping stations, reservoirs, pressure reducing stations, meters and service connections installed within any highway, municipal right of way or easement, or municipal property;

"District" means the District of Lantzville;

"District Standards" means the standards set out in the Subdivision & Development Bylaw, and Schedule "B" of this Bylaw, as applicable;

"dwelling unit" means a self-contained suite ofrooms, including kitchen and bathroom facilities, used or intended to be used as a residence;

"Fees and Charges Bylaw" means the District ofLantzville Fees and Charges Bylaw;

"Fire Chief means the municipal Fire Chief of the District or a person duly authorized to act in the place ofthe Fire Chief;

"fire hydrant" means a device equipped with special threaded connections installed by the District within a highway, municipal right of way, easement, statutory right of way, or on municipal property, connected to a water main to supply water for fire protection purposes; "fire line" means a pipe that is intended solely for the purpose of providing a stand-by supply of water for fire protection;

"group of parcels" means two or more contiguous parcels which have been assessed as one folio for the purpose of municipal taxation;

"institutional building" means a building intended for public use on a non-profit basis to provide health, educational, recreational or government services, and specifically includes schools, hospitals, rest rooms, places of worship, and government offices;

P16 District of Lantzville Water System Bylaw No. 140, 2018 - DRAFT Page 3 of 22 "latecomer's charge" means a charge levied against a property for the right to connect to a water, sewer or drainage system provided by a private developer and deemed to be "excess or extended service" by the District pursuant to section 508 of the Local Government Act\

"main" means a water pipe, including valves, fittings, and other appurtenances in the water system other than a water service connection, pumping station, treatment plant or reservoir;

"meter" means a device used to measure and indicate the volume of water passing through the device and includes remote reading accessories;

"metered account" means an account with the District of which the water consumption by a consumer is measured through a meter;

"mixed use building" means a building or complex that has both business and residential imits within the building or complex, where both are serviced by the same water meter;

"Official Community Plan Bylaw" means the District ofLantzville Official Community Plan Bylaw No. 50, 2005, as amended or replaced from time to time;

"owner" shall have the meaning assigned to it by section 5 of the Community Charter, and in relation to common property within a strata development, means the strata corporation;

"parcel" shall have the meaning assigned to it by section 5 of the Community Charter;

"person" means and shall include not only a natural person, but also a corporation, firm, or partnership;

"residential property" means a self-contained unit with a separate entrance, intended for year-round occupancy, and includes a single dwelling unit, one-half of a duplex, apartment building units, each townhouse, whether rented or owned, mobile home, or any other self- contained residential dwelling;

"service connection" means a water pipe and the necessary valves and protective boxes, connections, thaw wires, meters and any other material necessary and actually used to connect a parcel or unit to the water main to a curb stop;

"strata development" means a multiple lot complex created by the deposit of a strata plan in the Land Title Office pursuant to the Condominium Act;

"Subdivision and Development Bylaw" means the District ofLantzville Subdivision and Development Bylaw,

"unit" means a business unit, institutional building or residential dwelling;

P17 District of Lantzville Water System Bylaw No. 140,2018 - DRAFT Page 4 of 22 "water restriction stages" means a level or stage of water conservation measures, including all restrictions, limits, prohibitions and conditions for the use of water included in that level, as identified in Schedule "C";

"water service" means a pipe, including all valves, connections and taps, connecting a curb stop to any building or structure and includes the tail nut ofthe curb stop; and

"water system" means the entire water supply and distribution system of the District.

3. Except as otherwise noted, any statute referred to herein is a reference to a statute of British Colximbia and any reference to a statute, regulation, code, bylaw or other enactment refers to that enactment as amended, revised, consolidated or replaced from time to time.

4. If any part, section, sentence, clause, phrase or word of this bylaw is for any reason held to be invalid by the decision of any court of competent jurisdiction, the invalid portion shall be severed and the decision that it is invalid shall not affect the validity of the remainder, which shall continue in full force and effect and be construed as if the bylaw had been adopted without the invalid portion.

PART 2 - USE OF WATER SYSTEM

Conditions of Service

5. The supply of water by the District may be subject to increases or decreases in water pressure from time to time, and may be interrupted temporarily to allow for maintenance, repairs, extensions, alterations, replacements or improvements to the water system. The District may change operating water pressure and turn off the water supply for these purposes. The Director will give prior notice to affected consumers where possible, but a decrease or turn off may be without notice if necessary to address an urgent matter of public safety.

6. It is a condition of the supply of water that:

(a) In the event that the supply of water to any consumer shall fail, whether from natural causes or accident or from any other cause whatsoever, the District shall not be liable for damage by reason of such failure.

(b) The District shall not be liable for any injury or damage to any person or property arising or occurring from the use of water from the water system.

(c) The District does not guarantee that water supplied by it is free of any impurity that could affect a manufacturing or commercial process.

7. The Director may refuse to supply water to a property if, in the opinion of the Director:

(b) doing so would adversely affect existing consumers; or

(c) the water system would not effectively be protected from any potential or actual cross- connections existing at, or within, a water service on the property to be connected.

Tampering with Water System

8. A person must not, without first obtaining written permission from the Director:

(a) make any connection to the water system; or

(b) in any way tamper with, operate, remove, or make any alteration to any hydrant, meter, curb stop, valve, pumping station, reservoir, chamber or other fixture or appurtenance connected with the water system; or

(c) use a hydrant, except as authorized by the District's Fire Rescue Department.

9. A person must not break, damage, destroy, uncover, deface, mar, or tamper with any part of the water system.

Discontinuance of Water Supply

10. Where the Director has determined that a consumer has not complied with a provision of this Bylaw or has not paid fees or taxes owing in relation to the water system, the Director may:

(a) order the owner or occupier of the parcel or premises to correct the violation at their expense within a specific time period; and

(b) if the person to whom such an order is directed cannot be contacted within a reasonable time or fails to comply, the Director may cause the water service to be discontinued until the violating condition is remedied to the satisfaction of the Director.

11. On taking an action under paragraph 10 (a), the Director will make reasonable attempts to notify the owner and occupier before discontinuing the service, and will inform the District's Corporate Officer of the action taken, and the reason.

12. Any person whose water supply has been discontinued pursuant to this Bylaw may arrange with the Corporate Officer to make representations to Council about the matter. After considering any such representations, and any other information Council deems relevant to their decision. Council may confirm, vary, add restrictions or conditions to, or cancel the decision to discontinue the water service.

If a person subject to an order under this Bylaw fails to take the required action, the District's Chief Administrative Officer may arrange for the District or a contractor to fulfill the requirement at the expense of the owner or occupant of the property where the violation occurs. The District may recover the costs incurred from the owner or occupant as a debt. If the debt has not been paid by December 31®^ the District may collect the amount owing fi-om the property owner in the same manner as for collecting unpaid property taxes.

Sale of Water

14. A consumer must not, in relation to water supplied by the water system:

(a) sell, dispose of, or give away the water for use other than on that property; or

(b) permit, suffer or allow the water to be taken or carried away by any person unless the consumer has a metered account for that water, and the consumer is conducting a business from the premises in compliance with the bylaws of the District.

Water Conservation

15. The Director may issue a notice stating that a water restriction stage will take effect within the District, as set out in Schedule "C", which notice may be delivered, broadcast by a local radio or television station, or advertised in a newspaper circulating within the District. If the effective date is not stated in the notice, the applicable measures of that water restriction stage take effect the day after the notice is delivered, broadcast or advertised.

16. When a water restriction stage is in effect, a person must not use or cause or allow to be used water from the water system except in accordance with the restrictions, prohibitions, limits and conditions of that water restriction stage as set out in Schedule "C".

17. A person must not waste or cause or allow water from the water system to be wasted, and without limiting the generality of this restriction, must not cause or allow water to be discharged wastefully fi-om their property onto a highway, into a storm sewer system, or onto an adjacent property.

PART 3 - SERVICE CONNECTIONS

18. All service connections shall be constructed in accordance with District Standards and permit applications will be considered on a first come first serve basis.

Illegal Connections

19. A person must not cause, suffer or allow a water service to be connected, or to remain connected to the water system fiom any property or premises except in accordance with the provisions of this Bylaw.

20. Prior to making a service connection to the water system, the owner of the parcel or premises must submit an application for a service connection, in the form set out in Schedule "A", to the Director, and pay the applicable fees prescribed in the Fees and Charges Bylaw, and must not cause the connection to be made except as approved by the Director and in accordance with any conditions for approval set out by the Director.

21. On being satisfied that the application is complete and the proposed water service will meet the requirements of this Bylaw, the BC Plumbing Code, and any other applicable enactments, the Director may approve the application and within ninety(90) days, weather and time availability permitting, will arrange for a service connection to be provided and installed for the subject property. If such connection is not approved, the Director will so notify the Applicant and the District will refund the charges or fees paid by the Applicant.

22. Following the date of approval of an application, the Applicant must, at the Applicant's own expense, connect to the water system within six (6) months unless otherwise approved by the Director.

Individual Connections

23. Each parcel for which a water service is approved, other than parcels within a strata development, shall have its own service connection, which shall be installed by the District.

24. Each building shall have only one service connection, except:

(a) when a separate connection is required for fire protection purposes; or

(b) when a building expansion or zoning or use change makes the addition of a further connection necessary; or

(c) where a separate connection is requested to service an accessory carriage house, and where two or more buildings exist on one parcel of land and where such parcel of land can be subdivided, each building shall have a separate service connection.

Connection Location

25. Service connections will be located as specified by the District Standards unless otherwise approved by the Director.

Size of Service Connection

26. The minimum inside diameter of a service connection shall be 19mm (3/4 inch). The size of the service connection for any premises shall be approved by the Director. If the requested service connection exceeds the current capacity of the waterworks, the Director may limit the size ofthe connection.

Depth of Bury and Protection against Settlement

27. All water services on any parcel or premises shall be laid and maintained at a depth of not less than 0.9 meters, or such greater depth as may be required by the Director, below the surface of the ground. Where water services pass under or near other excavations, they must be properly protected against settlement. In all cases, water services must be effectively protected against frost.

Approval by Building Inspector

28. All water services on a consumer's premises must be inspected and approved by the Building Inspector before the water services are covered, and no water shall be supplied to any parcel or premises until such approval has been obtained.

Protection of Water Service

29. Every Applicant and other person responsible for installing a water service must ensure that the water service is not laid through, in, or into any body of water, slough, drain, ash-pit, cesspool, manure heap or other place such that in the event of decay or injury to such water service, the water is likely to be fouled or to escape. Where the course of any water service leads unavoidably through any such place as is mentioned in this section, the matter must be brought to the attention of the Director. The Director may grant permission for the water service to be laid, provided that the water service be passed through an appropriate exterior casing of wrought or cast-iron pipe, or other approved material of sufficient length and strength to afford effective protection to the service pipe and to facilitate detection of any leakage or waste. The cost of such protection to the service pipe shall be bome by the Applicant for the water service connection and paid for before the water service is turned on.

Work to be done by Municipal Employees

30. All connections to the District's water mains or service pipes shall be made by employees or contractors of the District xmless otherwise approved by the Director.

31. The District will install the portion of the water service between the curb stop and property line. Any fittings required to join the District's pipe to the Applicant's pipe shall be the Applicant's responsibility.

PART 4 - WATER SERVICES

Maintenance

32. Every property owner must maintain and keep the water service in good working condition at the owner's sole expense. In the event any defect is suspected in the service connection or water service, the consumer must immediately notify the District. If a defect is found, and determined by the Director to be located in the water service within the private property, the owner must remedy the defect within the time specified by the Director or if not specified, within ten (10) days after being notified of the Director' determination.

33. In order to facilitate repairs to the water service, the District will, upon request, and at its earliest convenience during normal working hours, open or close the curb stop at no cost to the property owner.

34. If the property owner requires a curb stop to be operated during hours when the District's waterworks personnel are not normally on duty, the owner must pay for the actual cost, including allocated overhead, for calling out crews and operating the valve, in the amount indicated on the invoice from the District.

35. In the event the property owner fails or neglects to carry out repairs within the specified time as required by this Bylaw, the Director may have the work done by District employees or contractors at the expense of the owner, and the District may recover the costs incurred thereof with interest at the rate charged for municipal taxes in arrears.

Turn On and Turn Off

36. When an owner wishes to turn on or turn off the water supply at the curb stop, the owner shall advise the District and the Director will cause the work to be carried out. If the turn on or turn off is for purposes other than maintenance or the commissioning of a new service, the owner must pay applicable fees for such tum on or turn off as prescribed in the Fees and Charges Bylaw. This charge is due and payable prior to the water service being turned on or off.

Abandonment

37. When any water service is abandoned, the owner must notify the District and the Director will cut off the service connection at the junction with the main. The owner must pay the disconnection fee as specified in the Fees and Charges Bylaw.

Frozen Service

38. Pursuant to section 32, if it is determined that the defect is a fi-ozen water service, it is the owner's responsibility to thaw the pipe. The owner shall be fully responsible for any damage caused by this thawing method.

Cross-Connection and Backflow Prevention

39. In the event an owner has more than one District service connection from different distribution pressure zones, underground irrigation systems, sprinkler systems, or other systems, or when the possibility of contamination of the District water system by backflow exists for any reason, the owner shall ensure premise isolation with approved cross- connection control devices to the current CAN/CSA B64.10 "Manual for the Selection and Installation of Backflow Prevention Devices" standard. Where a cross-connection control device is required, the device shall be submitted to the District for approval and conform to the District Standards.

40. No new service connection for any building, irrigation system or sprinkling system will be approved unless the Director is satisfied that cross-connections do not exist, or unless an approved cross-connection control device has been installed by an approved installer.

41. After a cross-connection control device has been installed, the owner must promptly arrange for it to be inspected and approved by the Building Inspector and tested by a Certified Tester of cross-connection control devices, and the test results, including any repairs performed, must be submitted to the District following that test and then on an annual basis, or as required by the Director.

42. The owner is responsible for the installation, repair and maintenance of all cross-connection control devices, and must ensure that:

(a) the devices are in proper working order at all times and promptly repaired or replaced as necessary; and

(b) any direction by the Director related to the prevention of cross connection or backflow is promptly carried out.

Fire Protection Connection

43. Approved water connections required solely to supply a fire protection system shall be installed based on the rates set out in the Fees and Charges Bylaw.

44. A fire protection system shall consist of an automatic sprinkler system, fire main loop with hydrant or connected hose stand pipes located inside or outside of the building, fire protection monitors, or any other equipment used solely for emergency fire protection and suppression and approved by the Fire Chief.

PART 5-METERS

Installation of Meters

45. Every owner of a parcel or premises having water service connected to the water system must have installed, at the expense of the owner, a water meter complete with bypass and isolation valves in a location easily accessible to the Director for inspection and reading ofthe meter; and must ensure it is maintained in good working order. If the water service is to a distribution system not solely for fire protection purposes, the meter shall be located upstream ofthe connection to the District main and as close as possible to the property line. If no building or structure exists at the location where the meter is to be installed, the property owner must arrange and be responsible for constructing and maintaining the meter vault in accordance with District Standards.

46. The following requirements shall apply to water services connected to the water system:

(a) Meters are required on all domestic services;

(b) Fire meters are required on all services where domestic and fire flows are conveyed through a common pipe;

(c) Fire meters are required for all connections off a common main to on-site fire hydrant; and

(d) Tattle tale meters are required on all fire mains where metered domestic flows are conveyed through a separate domestic water service.

Meter Size and Type

47. The owner must obtain approval by the Director for the size and type of meter required for the intended use.

Access to Meter

48. The owner shall allow access to the water meter for the purpose of reading the meter and for maintenance during the District's normal working hours. Failure to provide this access for meter reading and maintenance shall result in an extra charge for each call after the first call as prescribed in the Fees and Charges Bylaw.

Operation of Bypass

49. A person must not in any way tamper with, operate or remove the water meter or sealed bypass valves after installation without first obtaining the permission ofthe Director.

PART 6 - CHARGES FOR SERVICE

Connection and Abandonment Fees

50. The owner must, on making application for a service connection, a turn on or turn off, or the abandonment of a service connection, pay to the District the applicable fee prescribed in the Fees and Charges Bylaw.

Addition to Taxes

51. All fees and other amounts that the District may recover in relation to the water service charges imposed under this Bylaw and all charges for work done or services provided by the District, whether on default or otherwise, if unpaid on December 3l®Mn any year, may be treated as taxes in arrears by the Director of Financial Services.

User Fees

52. The consumer whose property is connected to the water system must pay to the District, in addition to any other rates, charges and fees for the use of the water system imposed under other enactments, the fees established in the Fees and Charges Bylaw for that property on the date specified on a bill or invoice fi^om the District.

53. The user fees established for a property shall apply as ofthe date of occupancy, except that for un-metered accounts, the rate charged for the first and the final billing period shall be prorated to the nearest full month of service.

54. Non-receipt of the utility bill will not be recognized as a valid excuse for failure to pay the fees when due.

55. Every owner of land or real property in the water service area identified in the District's Official Community Plan Bylaw, that fronts or is within 20 meters of a watermain, and is connected to the water system, shall pay applicable fees for connection and installation as established in the Fees and Charges Bylaw.

Strata Properties

56. If a strata development is used solely for storage and has either no water or sewer facilities available, the rate otherwise payable under this section is not applicable.

57. If a strata development is provided with water service through one or more water meters, at the option of the District, the District shall bill either:

(a) the individual owners of the strata lots the user rates, which are payable under this bylaw;

or

(b) the strata corporation at the user rates payable under this bylaw for the number of units within the strata corporation.

58. If the District bills the strata corporation under section 57(b) and any portion of the user rates are past due on December 31®* in any year, the Director of Financial Services will divide the rates equally among all the strata lots, unless the strata council has provided the Director of Financial Services with a resolution identifying the strata lots whose owners have not contributed to a partial payment of user rates by the strata corporation.

59. A strata council resolution delivered to the Director of Financial Services under section 58 may specify the unit entitlements for the strata lots whose owners have not contributed, in which case the Director of Financial Services will divide the unpaid rates in accordance with the unit entitlements. If the unit entitlements are not provided, the Director of Financial Services shall divide the unpaid charge equally among the strata lots identified in the resolution.

Extended Water Services

60. In the event an Applicant within the District boundary wishes to proceed with a distribution system extension, which has or has not been identified within the District's Long Term Capital Plan, the Director may proceed with the extension, provided that the Applicant shall enter into a Works and Services Agreement with the District as identified in Schedule D of the Subdivision and Development Bylaw and pay to the District, in advance, 125% of the total cost of construction as estimated by a professional engineer or the Director. The final cost to the Applicant will be 100% ofthe actual cost plus an administration fee as identified in section 5 ofthe Subdivision and Development Bylaw.

61. The service connection costs for each parcel of land owned by the Applicant to be served by such an extension shall be as set out in the Fees and Charges Bylaw, and shall be in addition to the said construction costs.

Extension Limits

62. Where a water distribution system is extended by other than Council Resolution, the minimum inside diameter shall be 150 mm and shall extend fi*om the most convenient existing water main having sufficient surplus capacity to supply the additional water demand resulting from the said extension, to a point opposite the furthest boundary of the last parcel ofland to be served by the extension.

No Extension of Main Outside District Boundary

63. The District will not provide any water main extensions outside the municipal boundaries.

PART 7- INSPECTION

Inspection

64. Prior to a water service being connected to a private property, the owner of the parcel or premises must arrange for an inspection by the Building Inspector, and must not connect until approval by the Inspector is obtained.

65. In accordance with section 16 of the Community Charter, the Director, an employee of the District, or a Bylaw Enforcement Officer of the District, or any combination ofthem, may enter on any real property to ascertain whether the property is in compliance with the requirements of this bylaw.

66. A person must not obstruct or interfere with a person employed or authorized by the District to administer, enforce or carry out work under this Bylaw.

PART 8- OFFENCE AND PENALTIES

67. Any person who:

(a) contravenes or violates any provision of this bylaw; or

(b) suffers or permits any act or thing to be done in contravention of or in violation of any provision of this bylaw; or

(c) neglects to do or refrains from doing anything required to be done by any provision of this bylaw;

commits an offence, and, where the offence is a continuing one, each day that the offence is continued shall constitute a separate offence.

68. Upon being convicted of an offence under this bylaw, a person shall be liable to pay a fine of not more than $10,000.

SCHEDULE"C" WATER RESTRICTION STAGES

A. Special Watering Permits

i. A person who has installed a new lawn, either newly seeded or new sod, may apply to the Director for a permit, which will allow the new lawn to be sprinkled outside of permitted days. The permit shall be conspicuously displayed at the premises for which it is issued.

ii. New sod or newly seeded lawn may be sprinkled for 14 days after installation, provided a permit has been issued for the premises at which the new lawn has been installed.

iii. After expiration of a permit, a person may apply for and may obtain subsequent permits.

iv. Permits will not be issued or be valid during the Water Restriction Level 4 restrictions.

B. Special Cases and Exemptions

i. Strata developments may vary hours of use as required, with prior written permission from the Director, to accomplish maintenance and upkeep in cases where developments have all irrigation systems separately metered and can demonstrate that inadequate times exist within water restriction stages to sustain plant stock.

ii. Nurseries, turffarms and tree farms are exempt from water restriction stages.

iii. Car dealerships, car washes and other commercial enterprises, which require water use to facilitate normal business activities (e.g. power washing and window washing companies).

iv. Watering of public parks, open space, and sports fields are exempt from restriction stages as necessary to accomplish proper upkeep of public places.

V. The District's water utility is exempt from restriction stages to allow for proper operations and maintenance of the water utility system.

To have a transparent process, you should really wait until AFTER the Public Hearing on the Final Draft of the Plan before rightfully making presumably minor adjustments based on Hearing feedback and correcting any inadvertent errors! As far as the attempts by some of you to increase the densities, and thereby the growth, enabled by the Plan even further, there is already a great disconnect between what the residents said in the originai questionnaire input and what was sanctioned by the 56% majority selection of Scenario 'C in the Community-wide survey that has not been openly addressed. T he 'simple' growth rate (on a base of the current population) of <=l%/yr over 15 years favoured by 67% of those responding to the questionnaire compared to the 'simpie' growth rate of 7.7%/yr predicted by Scenario 'C is a staggering difference, made even greater if the densities, and thereby, the enabled growth, are now increased by you even further partway through the public process! ! have raised this huge contradiction with the Community Planner but his expianation of growth 'ebbing and flowing' over the life of the Updated OCP makes no sense to me! The average over the 15-20 year life of the document is still predicted by the "population at build-out" numbers at the bottom of each column of the 'Community-Wide Scenarios' table so, if 'simple' growth is actually <=1% in one or more years, it would need to be significantly higher than the 7.7% in other years to match the Scenario 'C growth prediction! Until this discrepancy in community wishes is properly addressed, I firmly believe that the vast majority of Lantzville residents do not support the further significant increasing of densities in the Draft Plan over what would already be a huge increase in population in our community, if implemented.

I can't overstress the importance of Council's need to thoroughly disGi|Sf,§^ri(jl implement any necessary changes to the draft OCR. As I said, this will be the single most important d^(;;jsion making process that a Lantzville Council will have had since becoming a municipality. RIease give it the attention we deserve. Take the time that is required for all of you to be informed. I would suggest starting with the existing OCR and its ultimate buildout and getting a full understanding about where and how proposed changes in the current draft OCR would be allowed to unfold in future. Keep in mind unintended consequences.

There are no ideal formats for this process, especially since the draft is a radical departure from the previous OCR. If it was simply a case of a few tweaks here and there it wpyld be easier. Some residents are leaning towards Liz Wiley's suggestion that the draft be "binned" and th^t we live with the 2005 document for a few more years. Most, I believe, are willing to accept some changes. Most, however, are unwilling to accept the radical aspects, especially where they concern higher densities. Lantzville is Lantzville because it has lower densities. Almost no householder on a single large lot (the majority of the population) is in favour of the proposed higher densities of the draft, let alone the Colclough amendments. Most voices in favour of the draft densities have something to gain. For some, including some members of Council and staff, density itself seems to be the reward. For others the sheer financial windfall that upgrading the densities of their properties allows is a compelling incentive. What about the rest of us, the majority?

Back to formats. If we are going to accept a modified draft, that modification process is the responsibility of Council and needs to be discussed at length by council members in a setting conducive to productive work, even compromise. A single COW meeting seems inappropriate. Time constraints and public pressure are daunting when considering the importance of the result which is nothing less than the future of our community. Rerhaps a Council workshop or series of workshops would be a better format. Your public are unlikely to attend a lengthy non-participatory process in great numbers. It remains important that public observance is allowed for legitimacy in such an important deliberation. A final meeting where Council discusses and votes on changes should take place in a large, well- advertised, public venue such as Costin Hall.

It was obvious on Jan 22"'' that some Council members are in a great rush to push a finished OCR through. What is the rush? The householders I talk to are not in a rush. Rerhaps development deadlines and big money are in a rush. The existing draft and the insulting Colclough amendments are a gift to development interests so it is to their advantage for this process to be rushed and rubber-stamped. RIease slow this down and give it the sober second thoughts we deserve.

P40 Who should be involved In the process of reviewing and revising the draft OCP? In my opinion this activity should be undertaken only by elected Council members. The ball is now in your court. The committee, their "consultant" and our planner have had their input. The responsibility is now yours and yours alone. You can seek all the consultation you require - outside of your Council deliberation process. The decision making discussions are too late for learning the details of a complex document. If Council is not up to this task then I recommend the Liz Wiley solution. The prospect is daunting because it is so radical and complex and it derived from a flawed and pre-determined (and therefore suspect) process.

My concern with further involvement of the consultant and planner are that they are both obvious supporters of the draft document as it stands because they had an inordinate role in creating it, unlike the 2005 process where there was no planner and the consultant was a consultant, not a director and every section of the document was discussed and voted on by the committee. This time the consultant and planner are invested in "their" draft OCP and they seem motivated to discourage Council members from changing its provisions. There would be no professional consultative entity to provide any tempering advice for less density for example. Mr. Limshue particularly has demonstrated a preference for higher densities in what most householders perceive as inappropriate locations. His communication skills also seem unhelpful. A recent example was his response to a question from a member of the public gallery on Jan 22"'' about what is meant by "emergency access". The short answer is "firetrucks, ambulances and police" but Mr. Limshue went off on a confusing bafflegab that left the public scratching their heads and Council embarrassed.(Check it out on the video) At another meeting he was asked to explain why a property owner was exempted from CDC charges and was unable to do so. The Mayor had to step in and make the simple explanation that the equivalent charge was already paid under a previous set of rules. For efficiency and balance I would recommend leaving the planner and the consultant out of these discussions. Take responsibility, put your animosity aside and give your constituents an OCP document that reflects what they want.

COUNCIL COMMITTEE SYSTEM POLICY

POLICY Pursuant to section 141 of the Community Charter, the Mayor must establish Standing Committees for matters the Mayor considers would be better dealt with by Committee, and pursuant to section 142 of the Communit}' Charter, Council may establish and appoint Select Committees to inquire into any matter and to report its findings and opinions to Council.

DEFINITIONS "Alternate" means a Council member appointed by the Mayor for Standing Committees or by Council for Select Committees to attend Committee Meetings when the appointed Council member for the Committee is unable to attend a Committee meeting.

"Standing Committee" is an advisory body to Council established by the Mayor pursuant to section 141 of the Community Charter to which the Mayor shall appoint Council representatives and may appoint citizen members. The Community Charter requires that at least half the members be members of Council.

"Select Committees" are established by Council resolution pursuant to section 142 of the Community^ Charter, and to which Council may appoint citizens. At least one member of a Select Committee must be a Council member. Council may also establish short-term Select Committees to inquire into a specific issue within a bounded time period and report its findings and opinions to Council, after which the Committee will have concluded their work and will be disbanded. A Council member does not have to be appointed to a short-term Select Committee.

"Statutory Committee" means boards. Commissions, or Committees established pursuant to a specific enabling statute including a Library Board established pursuant to ihQ Libraiy Act, a Police Board established pursuant to the Police Act, a Commission including a Parks Commission, Recreation Commission, and Heritage Commission, etc., established pursuant to section 143.(1) (a) of tlie Community Charter, a Family Court Committee established pursuant to the Provincial Court Act and any other body established pursuant to enabling legislation which serves in an arms- length capacity on behalf of or in cooperation with Council.

"Staff Liaison" is the staff member assigned by the Chief Administrative Officer to assist a Committee in a non-voting advisory and resource capacity.

"Committee Clerk" is a person under contract to or employed by the District of Lantzville to provide administrative and clerical support to Council Committees, Commissions or boards.

PROCEDURE

1 Membership

1.1 Diversity

Membership of Committees will be diverse, and broadly reflective ofthe community.

Membership, when possible, will reflect desired experience, knowledge and expertise. Geographic location in the community is required unless otherwise waived by Council.

1.2 Appointments

1.2.1 Annually, the opportunities for appointment of members of the public to Committees will be widely advertised so that any citizen who is interested may apply. Depending on the requirements ofthe terms of reference specific areas of the community may be targeted or members may be directly solicited. 1.2.2 Recommendations for Committee members will be sought from Council members. 1.2.3 The Mayor will appoint members to Standing Committees. The Mayor will recommend to Council establishment of Select Committees and may recommend the appointment of the Chair, Vice-Chair and members. Council may establish Select Committees and will appoint members to Select Committees, upon recommendation ofthe Mayor or from applicants, having been considered at a Closed meeting of Council, at a Regular Council meeting. 1.2.4 Appointments to Standing and Select Committees will be made in December of each year, except in an election year when the timing of appointments may be varied by the Mayor. 1.2.5 Appointments to Statutory Committees/Commissions will be made in accordance with the relevant enabling statute or establishment bylaw. 1.2.6 The terms ofreference of individual Committees will specify the number of members to be appointed to the Committee but membership shall normally not be more than seven(7) (including Council Members). 1.2.7 Committee members shall serve without pay at the pleasure of Council, imless otherwise provided in the enabling statute or establishment bylaw.

1.3 Applications for Membership are Confidential

All applications for membership on Committees shall be kept in confidence when submitted to the District.

1.4 Terms of Appointment for Standing, Select Committees

1.4.1 The term of appointment is one year, unless specified otherwise in the Council approved terms of reference. 1.4.2 An individual can serve for up to four(4) consecutive one(1) year terms on any one Committee. 1.4.3 When considering re-appointments for a consecutive term. Committee stability and membership continuity will be considered. 1.4.4 All members remain in office until their respective successors are appointed. 1.4.5 Notwithstanding clause 1.4.4, all Committee appointments expire on October 31 in the year of a general local election.

1.5 Terms of Appointment of Short-term Select Committees

The term of appointment of members to short-term Select Committees is concurrent with the time frame provided to the short-term Select Committee to complete its work; after which the members terms expire unless extended by Council resolution.

1.6 Terms of Appointment of Statutory Committees

The term and conditions of appointment of members to Statutory Committees is as provided in the enabling statute or establishment bylaw.

1.7 Committee Vacancy Replacement Term

In the event of a vacancy, the person appointed to fill the vacancy shall hold office for the remainder of the term ofthe vacated office.

1.8 Attendance of Members at Meetings

Unless otherwise provided in the enabling statute or establishment bylaw, any member who is absent from two (2) consecutive regular meetings without leave of absence from the Committee or without reason satisfactory to the Committee shall forthwith cease to be a member of the Committee, and Council shall be advised by the Committee.

1.9 Removal of Member from Committee

Council may remove or request the resignation at the request of the Committee or on its own initiative any of its Committee appointees for malfeasance in office, or any good and sufficient cause.

1.10 Resignation of Member

Any member of a Committee wishing to resign from the Committee is requested to provide the resignation in writing to the Committee Chair with a copy to the Staff Liaison.

2 Council Liaison/Council Membership

2.1 The Mayor shall designate the members of Council to serve as Chair and Vice- Chair of the Standing Committees.

2.2 Both the Chair and the Vice-Chair of a Committee shall be entitled to vote. 2.3 The Mayor may appoint alternate (s) Council member to Standing Committees and Council may appoint alternate (s) Council members for Select or Short-term Committees. 2.4 Any member of Council not appointed to a Standing or Select Committee may attend the Committee meetings as an observer but is not entitled to enter into the discussion unless requested to by a majority vote ofthe Committee. Any Council member not appointed to the Committee, but attends Committee meetings, are not entitled to vote. 2.5 Council may appoint individual Council members to Select Committees and may designate the Chair and Vice-Chair. 2.6 Council representatives serve for a one(1) year term. 2.7 The Council representative's role on Committees is:

2.7.1 to be a voting member of the Committee to which they are assigned; and

2.7.2 to serve as a communication liaison to Council.

3 Staff Support

3.1 A Staff Liaison shall be appointed to each Standing or Select Committee by the Chief Administrative Officer. The Staff Liaison is not a member ofthe Committee and therefore is not entitled to vote. The role of the Staff Liaison includes:

3.1.1 providing information and professional advice; 3.1.2 supporting the chairperson in developing agendas, arranging meetings, and promoting effective Committee functioning; 3.1.3 writing report/recommendation to Council as requested by the Committee when reporting to Council; 3.1.4 providing an annual orientation of the work of the Committee, the structure of the Municipality and Council's annual goal setting and budgeting processes; and 3.1.5 assisting with the annual membership recruitment. 3.2 Any other projects or tasks to be assigned to the Staff Liaison requires the approval of the Chief Administrative Officer.

New 3.3 is the Renumberedformer 3.4 3.3 A Committee Clerk may be appointed to each Standing or Select Committee in addition to the Staff Liaison by the Chief Administrative Officer in consultation with the Director of Corporate Administration. The Committee Clerk is not a member of the Committee and therefore is not entitled to vote. The role ofthe Committee Clerk includes:

3.3.1 providing administrative and clerical support to the Staff Liaison; 3.3.2 under the direction of the Staff Liaison, preparing the agenda, arranging meetings and notifying participants; 3.3.3 recording the Committee minutes and submitting them within two days of the Committee meeting to the Director of Corporate Administration for review. Once approved by the Director of Corporate Administration, circulates minutes as required by the Director of Corporate Administration and 3.3.4 preparing report/recommendations and other correspondence as required by the Staff Liaison.

4 Meeting Schedule

4.1 Standing and Select Committees will establish their own meeting schedules, in consultation with the Staff Liaison and subject to the availability of resources, to hold meetings as required with a minimum of two(2) meetings per year. Once the meeting schedule is established it is to be provided to the Director of Corporate Administration.

4.2 Statutory Committees meet as provided in their enabling statute or establishment bylaw. The meeting schedule shall be provided to the Director of Corporate Administration.

5 Quorum

Unless otherwise provided in a Committee's/Commission's enabling statute or establishment bylaw, a majority of the members of a Committee/Commission constitute a quorum provided that one Council member is in attendance. For Standing Committees, at least half of the quorum must be made up of members of Council.

6 Chair

Each Committee shall, at its first regular meeting in January or as soon thereafter as possible, or as provided in its enabling statute or establishment bylaw, elect a Chair and Vice-Chair if the Mayor or Council has not already done so, each of whom hold office for a period of one year, to carry out the duties normally attributed to such office in conducting the business of the Committee.

Agendas

The Staff Liaison or an appointed Committee Clerk is responsible, in consultation with the Committee chair, for the preparation of the Committee agenda in a format as required by the Director of Corporate Administration. The completed agenda is to be provided to the Director of Corporate Administration for distribution and posting.

8 Minutes

8.1 Committee minutes, setting out the recommendations made at all meetings of Committees shall be legibly recorded in accordance with the requirements of the Director of Corporate Administration.

8.2 Following the adoption of the minutes by the Committee the Staff Liaison or Committee clerk shall:

8.2.1 provide the adopted minutes to the Director of Corporate Administration for circulation to Council on the public agenda for information; and 8.2.2 following adoption of the minutes at the next meeting of the Committee, shall be signed by the Chair, or other member presiding at the meeting to which the minutes apply and provided to and signed by the Director of Corporate Administration. 8.3 The Staff Liaison or an appointed Committee Clerk shall provide adopted Committee minutes to all members of the Committee and the original signed copy as well as an electronic version to the Director of Corporate Administration for proper retention and distribution.

Rules of Procedure

9.1 Each Committee shall prescribe its own rules, providing they are not inconsistent with its enabling statute, establishment bylaw, the Local Government Act, Community Charter, Council policy and Councils Procedure Bylaw. The Committee may rely for reference upon the advice of the Staff Liaison.

9.2 Questions of procedure which cannot be resolved by the Committee upon the advice of the Staff Liaison shall be referred to the Director of Corporate Administration.

10 Voting

All members of a Committee, including the Chair and Vice-Chair, shall have a vote on any question before it, and in all cases in the event of a tie vote, the motion shall be defeated. Any member who abstains from voting, without having declared a conflict ofinterest and leaving the meeting, shall be deemed to have voted in the affirmative. Proxy votes are not permitted.

11 Conflict of Interest

Committee members are subject to sections 100 to 104 of the Community Charter.

12 Working Groups

Committees may establish working groups comprised of their members, however, if the committee wishes to appoint a working group of citizen members, prior Coimcil approval is required.

13 Reporting

13.1 Establishment and Authority

Members will not misrepresent themselves as having any authority beyond that delegated by Council.

13.1.1 Standing and Select Committees must refer recommendations to Council for authority to act.

13.1.2 Short-term Select Committees shall conduct their task within the time prescribed by Council following which they report their findings and opinions to Council for consideration. 13.1.3 Statutory Committees shall conduct their business in accordance with the terms of their enabling statute, establishment bylaw and the policies of the authority which established the Committee. 13.2 Reporting on Issues

When responding on an issue referred to it by Council, Standing and Select Committees, with the assistance ofthe Staff Liaison, Committee Clerk or Director of Corporate Administration will submit reports to Council in accordance with Council policy and Council's Procedure Bylaw. If deemed appropriate by the Chief Administrative Officer, Committee reports will be accompanied by a staff report.

Committees shall not reconsider a decision of Coimcil except with a referral fi-om Council.

13.3 Timing of Reports and Minutes to Council

Reports and minutes fi*om Committee meetings scheduled in the week prior to a Council meeting will be submitted for the agenda for the next Council meeting, or as soon as reasonably possible.

14 Authority

Except as may be provided in their enabling statute or establishment bylaw, Committees/Commissions do not have the authority to communicate with other levels of government, to pledge the credit of the Municipality, or to authorize any expenditures to be charged against the Municipality.

The Committee Chair is the spokesperson for the committee.

Committees shall not report out to the media or provide media releases without the prior approval of Council or Ae Chief Administrative Officer

15 Budget

15.1 Unless otherwise provided in their enabling statute or establishment bylaw, Committees/Commissions may request budget funds fi*om Council in accordance with Council's budget preparation schedule and procedure.

15.2 Any solicitation of funds fi-om other levels of government and other organizations requires the prior approval of Council.

15.3 Committee(s) shall have reasonable use of the Municipality's miscellaneous services such as photocopying, paper supplies, meeting areas, etc. which are primarily provided through the Staff Liaison and only during office hours unless otherwise arranged by the Staff Liaison.

16 Personal Liability

No member of a Committee shall be liable in their personal capacity for any debt or liability of the Committee except in cases of gross negligence or unlawful acts. It is the responsibility of Council to insure the members of Committees against all liabilities related to fulfilling their responsibilities as a member of the Committee.

17 Orientation

17.1 An orientation package for newly appointed members will be provided by the Director of Corporate Administration to the Committee members upon their appointment.

17.2 An orientation session will be provided by the Staff Liaison to each Committee at the first meeting after annual Committee appointments are made, where such orientation is deemed necessary by the Staff Liaison or Committee.

18 New Committees

In considering the formation of a new Select Committee, Standing Committee, or Statutory Committee, the Council or Mayor will request staff to prepare terms of reference or bylaw for consideration and approval by Council prior to establishing the Committee.

19 Meetings Open to Public

All meetings of Council Committees are open to the public and no person shall be excluded except for improper conduct, or where the Committee is considering an item where, in accordance with section 90 ofthe Community Charter^ the exclusion ofthe public is permitted.

1.8 Attendance of Members at Meetings Unless otherwise provided in the oiabling statute or establishment bylaw,any member who is absent fiom two(2) consecutive regular meetings without leave ofabsence firom the Committee or without reason satisfactory to the Committee shall forthwith cease to be a member ofthe Committee, and Council shall be advised by the Committee.

1.9 Removal of Member from Committee

Council may ranove or request the resignation at the request ofthe Committee or on its own initiative any ofits Committee appointees for mdfeasance in office, or any other good and sufficient cause.

1.10 Resignation of Member Any member ofa Committee wishing to resign fiom the Committee is requested to provide the resignation in writing to the Committee Chair with a copy to the Staff Liaison. 2 CouncU Liaison/Coiincil Membership

2.1 The Mayor shall designate the membos of Council to serve as Chair and Vice- Chair ofthe Standing Committees.

3 Staff Support

3.4 A Committee Cleric may be appointed to each Standing or Select Committee in addition to the Staff Liaison by the Chief Administrative Officer in consultation with the Director ofCciporate Administration. The Committee Clerk is not a m«nber ofthe Committee and therefore is not entitled to vote. The role ofdie Committee Clerk includes; 3.4.1 providing administrative and clerical support to the Staff Liaison; 3.4.2 under the direction ofthe Staff Liaison, prqiaring the agenda, arranging meetings and notifying participants; 3.4.3 recording the Committee minutes and submitting them within two days ofthe Committee meeting to the Director ofCoiporate Administration for review. Once approved by the Director ofCorporate Administration, circulates minutes as requir^ by the Director of Corporate Administration and 3.4.4 prqiaring report/recommendations and other correspondence as required by the Staff Liaison. 4 Meeting Schedule 4.1 Standing and Select Committees will establish their own meeting schedules, holding meetings as required with a minimum oftwo (2) meetings per year. Once the meeting sdiedule is established it is to be provided to ffie Director of Coiporate Administration.

4.2 Statutory Committees meet as provided in their cabling statute or establishment bylaw. The meeting schedule shall be provided to the Director of Corporate AdministratiorL

7 Agendas

The Staff Liaison or an appointed Committee Clerk or in the absrace ofthe Staff Liaison or Committee Clerk the Committee memb^* appointed by the Committee is responsible, in consultation with the Committee chair, for the preparation ofthe Committee agenda in a format as required by the Director of Corporate Administration. The completed agenda is to be provided to the Director ofCorporate Administration for distribution and posting.

8 Minutes 8.1 Committee minutes, setting out the recommendations made at all meetings of Committees shall be legibly recorded in accordance with the requiremrats ofthe Director of Corporate Adrrrinistration.

8.2 Following the completion ofdraft minutes by the Staff Uaison, Committee Clerk or Committee member appointed by the committee diall be:

8.2.1 provided in draft form to the Director of Corporate Administration for circulation to Council on die public agrada for information; and 8.2.2 following adoption ofthe minutes at the next meeting ofthe Committee, shall be signed by &e Chair, or other member presiding at the meeting to which the minutes apply and provided to and signed by the Director ofcorporate Administration. 9 Rules ofProcedure

9.1 Each Committee shall prescribe its own rules, providing they are not inconsistent with its enabling statute, es^lishment bylaw,ihe LocalGcvemment Act, Community Charter, Council policy and Councils Procedure Bjdaw. The Committee may rely for reference iqion the advice ofthe Staff Liaison.

9.2 Questions ofprocedure whidi cannot be resolved by the Committee iqion the advice of the Staff Liaison shall be referred to the Director ofCoiporate Administration.

10 Voting All members ofa Committee, including the Chair and Vice<2iair, shall have a vote on any question before it, and in all cases in the event ofa tie vote,the motion shall be defeated. Any member who abstains from voting, without having declared a conflict ofinterest and leaving the meeting, shall be deemed to have voted in the affirmative. Proxy votes are not permitted.

11 Conflict ofInterest Committee members are subject to sections 100 to 104 ofthe Community Charter.

12 Sub-Conunittees Committees may establish woridng groups comprised oftheir monbers, however,if the committee wishes to appoint a working group ofcitizen members,prior Council approval is required.

13 Reporting

13.1 Establishment and Authority Mmbers will not misr^resent themselves as having any authority beyond that delegated by Council.

13.1.1 Standing and Select Committees must refer recomm^dations to Council for authority to act. 13.1.2 Short-term Select Committees shall conduct their task within the time prescribed by Council following which they r^rt their findings and opinions to Council for considoation. 13.1.3 Statutory Committees shall conduct their business in accordance with the terms oftheir oiabling statute, establishmoit bylaw and the policies ofthe authority which established the Committee. 13.2 Reporting on Issues When responding on an issue referred to it by Council, Standing and Select Committees, with the assistance ofthe Staffliaison. Committee Clerk or Director ofCorporate AdministratiQn will submit rqrorts to Council in accordance with Council policy and Councils Procedure Bylaw. If deemed appropriate by the Chief Administrative Offico*, Corrunittee repoits will be accompanied by a staffreport

Committees shall not reconsider a decision ofCouncil except with a referral fiom Council.

13.3 Timing of Reports and Minutes to Council

Reports and minutes fi-om Committee meetings scheduled in the week prior to a Council meeting will be submitted for the agenda for the next Council meeting, or as soon as reasonably possible.

15 Budget 15.1 Unless otherwise provided in their entdiling statute or establishment bylaw, Committees/Commissions may request budget iimds from Coundl in accordance with Councils budget prqiaration sdiedule and procedure.

15J Committee(s) shall have reasonable use ofthe Municipalities miscellaneous services such as photocopying, paper supplies, meeting areas, etc. which are primarily provided through the Staff Liaison and only during office hours unless oth^wise arranged by the Staff Liaison.

16 Personal Liability No member of a Committee shall be liable in their personal capacity for any debt or liability ofdie Committee excqit in cases ofgross negligence or unlawful acts. It is die responsibility of Council to insure the members of Committee against all litdiilities related to fulfilling freir re^onsibilities as a mmb^ ofthe Committee.

17 Orientation 17.1 An orioitation padcage for newly ^ipointed members will be provided by the Director of Corporate Administradon to the Committee members upon thdr cppointment.

17.2 An orientation session will be provided by the Staff liaison to each Committee at the first meeting after aimual Committee appointments are made, where such orientation is deemed necessary by the Staff Liaison or Committee.

PURPOSE

For Council to receive Mr. Pedisic's letter Re: Water and Sewer Adjustment for 6954 Seaside Terrace, Lantzville BC dated October 10,2017 and to consider his request for a non-leak adjustment to his utility account 005-08135114-000.

BACKGROUND

Mr. Pedisic wrote the District on October 10,2017 requesting an adjustment to his utility accoimt for a non-leak adjustment. The District responded with a letter dated October 24,2017 denying a request as a leak did not occur, as required per Requestfor Leak Adjustment Policy No. 3006-02. Mr. Pedisic requested in person on October 30,2017 that his letter be forwarded to Council for consideration.

DISCUSSION

Mr. Pedisic has requested that his letter dated October 10, 2017 be forwarded to Council with a request for an adjustment to his utility account 005-08135114-000 for 6954 Seaside Terrace.

Requestfor Leak Adjustment Policy No. 3006-02 provides staff with autliority to amend a utility account where a water leak existed under certain condition. In this case no leak existed, and the water was used. As such, staff do not have authority to amend the utility account.

Council has the autliority to authorize staff to amend utility accounts outside of District policy.

There is a cost to the District for all water used and utility fee rates take into account the cost for an expected level of leak adjustments. User fees may need to be increased to compensate for any increase in utility adjustments to ensure the District receives sufficient funds.

FINANCIAL IMPLICATIONS

Water adjustments are not budgeted for in the 2018 Financial Plan. Any adjustment will be a reduction to revenue in the Water and Sewer Funds. User fees may need to be increased to compensate for lost revenue from utility account adjustments.

COMMUNICATION STRATEGY

This report will be available for review by the public in the February 5, 2018 Council meeting agenda package and available on the District of Lantzville website.

I am a widowed senior residing solely at the residence of 6954 Seaside Terrace.

I recently recieved my water and sewer bill. The bill far exceeds my normal rate of usage at my property located at 6954 Seaside Terrace. I am being billed 489.21 dollars for my water usage of which I am being told is for 249 cubic metres of usage. My sewer bill is 252.49 due to the water usage. This bill Is very high and not correct. During this billing period, I was away for 5 weeks of holidays and nobody was residing In the home. I have checked the water and have not located any leaks on my property. The only out of ordinary event that occurred was my outside tap was found running while I was away and possible neighborhood children may have been playing and used the tap or I am really not sure how this tap would have been turned on as when I left for my holidays everything was in order. I had people checking on my home and it was on one of these checks the tap was found running water.

I am not sure how the District of Lantzvilie can justify charging me 249 dollars for sewer as I live on my own and was not even in residence for 5 weeks. There are homes in the neighborhood that have suites and two families living in their residences and their bills are only 100 dollars or less.

i am seeking an adjustment to the bill please. 1 am a senior widower living on my own and live on a seniors budget and cannot afford such a large bill for services I did not use.

PURPOSE To authorize members of Council that staff are authorized to register for the AVICC and UBCM conventions in 2018.

BACKGROUND District of Lantzville Council Remuneration, Benefits and Expenses Bylaw No. 97,2012, as amended, provides the process for reimbursement ofexpenses for Council members, when authorized by Council(by Council resolution) to represent the District, engage in District business, or attend a meeting, course or convention beyond the boundaries ofthe District. It also provides an exception to attend the Union of BC Municipalities(UBCM) and the Association of Vancouver Island and Coastal Communities(AVICC) conventions, as these items are contemplated in conjunction with the financial planning process and as such do not require a resolution of Council for members to attend. Prior to 2015,the financial plan would include funds to enable all seven members of Council, if they so wished, to attend the UBCM and AVICC conventions, and to attend other events authorized by Council motion plus the cost of Council meeting expenses, e.g. if dinner is provided, and other meeting related expenses. In 2015, Council reduced the Council convention and meetings budget by $10,000 on an ongoing basis, therefore, without sufficient funds for all of Council to attend the AVICC and UBCM conventions, a Coimcil motion is required to authorize which members of Council, staff are authorized to register to attend the AVICC and UBCM conventions.

The cost of attending these conventions varies from year to year depending on whether the attendee registers to attend the banquet and additional workshops, and on the location, e.g. if a hotel is required or the cost of hotels. The AVICC convention is held in various cities on Vancouver Island and Sunshine Coast(Courtenay, Parksville/ , , , Sidney, Powell River, etc.) and UBCM is held in one ofthe following locations: Vancouver, Whistler, or Victoria. The 2018- 2022 Financial Plan includes $18,070 for 2018 Council Convention/Meetings. DISCUSSION The 2018 AVICC convention is at the Victoria Convention Centre April 13-15, 2018; the on-line registration will open in mid-February. The attached AVICC January Update (Attacliment #1)includes some basic registration information as well as a reminder about resolutions and nominations deadlines (February 14, 2018). The 2018 UBCM convention is at tlie Whistler Convention Centre September 10-14, 2018. Coincidentally, this will be the last week of the Nomination Period for candidates in the October 20, 2018 General Local Election. UBCM convention registration information will be released later in 2018; however, it is timely now for consideration of who will be authorized to attend.

Staff are seeking Council confirmation of who is authorized to attend these two conventions, so that staff may proceed with finalizing or releasing hotel rooms reserved in 2017 and registering Council members attending before the applicable early bird deadlines.

FINANCIAL IMPLICATIONS Council has allocated $18,070 for all Council conventions and meetings in 2018. Increased participation at conventions would require increased funding.

COMMUNICATION STRATEGY As tliis report is in an open Council meeting, the report ajid attacliments \vill be available on the District's website for review.

STRATEGIC PLAN ALIGNMENT - Nil

SUMMARY The financial plan includes $18,070 to fund 2018 Council conventions and meetings on the basis that up to four members of Council would be attending each of the AVICC and UBCM conventions. A motion of Council is required to authorize which members of Council will be attending, so staff are authorized to submit registrations and can proceed with finalizing payment or release of hotel reservations. Committees The President may appoint Executive members to adhoc sub-committees as required. The Nominating Committee is currently the only standing committee and is typically comprised of the Past President and the Executive Coordinator.

Overseeing of Association's Regular Activities and Guidance to Contracted Employee The Association contracts with UBCM for the provision of key services that support the Association. An Executive Coordinator based in Victoria's Local Government House provides the key functions. The President or their delegate is responsible for overseeing the regular activities of the Association and providing direction to the Executive Coordinator.

3. EXECUTIVE MEETINGS The full Executive meets in person five times a year, following this general pattern: During the last day of the annual Convention (less than 15 minutes) Mid June End of October Mid January Thursday preceding the Annual Convention (afternoon)

Executive meetings (other than those in conjunction with the Convention) are generally held on a Friday from 10:00 am to 3:00 pm and are typically held in Nanaimo. Meetings via teleconference typically occur 2-3 times per year on an as needed basis (60-90 minutes).

Travel expenses and a per diem for meals and incidentals are provided for in- person Executive Meetings. For the meeting preceding the annual Convention, reimbursement is only for the added expenses that would not normally be incurred for attending the annual Convention.

P87 UBCM ASKS FOR RESOLUTIONS TO BE CONSIDERED BY THE AREA ASSOCIATIONS FIRST

UBCM urges members to submit resolutions first to Area Associations for consideration. Resolutions endorsed at Area Association annual meetings are submitted automatically to UBCM for consideration and do not need to be re-submitted to UBCM by the sponsor.

A resolution should be submitted directly to UBCM only if the resolution addresses an issue that arises after the Area Association annual meeting. In this case, local governments may submit council- or board- endorsed resolutions to UBCM prior to June 30 each year. Should this be necessary, detailed instructions are available under the Resolutions tab on http://www.ubcm.ca.

UBCM RESOLUTIONS PROCESS

1. Members submit their resolutions to their Area Association for debate. 2. The Area Association submits the endorsed resolutions to UBCM. 3. The UBCM Resolution Committee reviews the resolutions for submission to the UBCM Convention. 4. Endorsed resolutions at the UBCM Convention are submitted to the appropriate level of government for responses. 5. Once the provincial responses have been conveyed to the UBCM they are forwarded to the sponsor for their review.

GUIDELINES FOR PREPARING RESOLUTIONS FROM THE UBCM

The Construction of a Resolution: All resolutions contain a preamble and enactment clause. The preamble describes the issue and the enactment clause outlines the action being requested. A resolution should answer the following three questions: What is the problem? What is causing the problem? What is the best way to solve the problem?

Preamble: The preamble commences with a recital, or "WHEREAS", clause. This is a concise paragraph about the nature of the problem or the reason for the request. It should clearly and briefly outline the reasons for the resolution. The preamble should contain no more than two "WHEREAS" clauses. If explaining the problem requires more than two preliminary clauses, then provide supporting documents to describe the problem more fully. Do not add extra clauses.

Enactment Clause: The enactment clause begins with the words "THEREFORE BE IT RESOLVED". It must convey the resolution's Intent, and should propose a specific action by AVICC and UBCM. Keep the enactment clause as short as possible, and clearly describe the action being requested. The wording should leave no doubt about the proposed action.

How to Draft a Resolution:

1. Address one specific subject in the text of the resolution. Since your community seeks to influence attitudes and inspire action, limit the scope of a resolution to one specific subject or issue. Delegates will not support a resolution if the issues it addresses are too complex for them to understand quickly.

P88 2. Use simple, action-oriented language and avoid ambiguous terms. Explain the background briefly and state the desired action clearly. Delegates can then consider the resolution without having to parse complicated text or vague concepts.

3. Provide factual background Information. Even a carefully constructed resolution may not clearly Indicate the problem or the action being requested. Where possible, provide factual background Information to ensure that the "Intent" of the resolution Is understood.

Two types of background Information help to clarify the "Intent" of a resolution: I SuDDlementarv Memo: A brief, one-page memo from the author, that outlines the background that led to the presentation and adoption of the resolution by the local government.

II Council/Board Reoort: A report on the subject matter, presented to council or board In conjunction with the resolution. If It Is not possible to send the entire report, then extract the essential background Information and submit it with the resolution. Resolutions submitted without adequate background Information will not be considered until the sponsor has been consulted and has provided documentation outlining the Intent of the resolution. This could result In the resolution being returned and having to be resubmltted as a late resolution.

4. Construct a brief, descriptive titie. A title assists to Identify the Intent of the resolution and eliminates the possibility of misinterpretation. It Is usually drawn from the "enactment clause" of the resolution.

For ease of printing In the Annual Report and Resolutions Book and for clarity of Intent, a title should be no more than three or four words.

5. Check legislative references for accuracy. Where necessary, Identify: • The correct jurlsdictlonal responsibility (e.g., ministry or department within the provincial or federal government); and • The correct legislation. Including the name of the Act. 6. For resolutions that will be debated at UBCM,focus on issues that are province-wide. The Issue Identified In the resolution should be relevant to other local governments across the province. This will support proper debate on the Issue and assist UBCM to represent your concern effectively to the provincial or federal government on behalf of all BO municipalities and regional districts.

7. A void repeat resolutions. In the past, Resolutions have often come back year after year on the same topic. Members and staff are encouraged to search the UBCM Resolutions database available though the website at www.ubcm.ca. Click on the Resolutions and Policy tab at the top of the page. It will be possible to locate any Resolutions on the same topic that have been considered In the past and what the response has been. 8. The UBCM Gold Star and Honourable Mention resolution recognition initiative was launched at the 2003 UBCM Convention, and is intended to encourage excellence in resolutions drafting and to assist UBCM members in refining their resolutions in preparation for submission to the annual UBCM Convention.

To be awarded the UBCM Gold Star or Honourable Mention recognition, a resolution must meet the standards of excellence established in the following Gold Star Resolutions Criteria, which are based on the resolution:

1. Resolution must be properly titled. 2. Resolution must employ clear, simple language. 3. Resolution must clearly identify problem, reason and solution. 4. Resolution must have two or fewer recital(WHEREAS) clauses. 5. Resolution must have a short, clear, stand-alone enactment(THEREFORE) clause. 6. Resolution must focus on a single subject, must be of local government concern province- wide and must address an issue that constitutes new policy for UBCM. 7. Resolution must include appropriate references to policy, legislation and regulation. 8. Resolution must be submitted to relevant Area Association prior to UBCM. 4.3 Parcel Size 1. Minimum parcel size requirements for each subdivision district shall be in accordance with Schedule '4B'.

4.4 Parcels Exempt from Minimum Parcel Size Requirements 1. Where the requirements of the authority having jurisdiction are met with respect to the provisions of water and method of sewage disposal, minimum parcel size and parcel servicing regulations shall not apply to a subdivision: a) combining 2 or more parcels into a single parcel; b) vt^iere the effect of subdivision woukj not be to increase the number of parcels, but to adjust the ix>undary between existl;^ parcels, provided that the boundary change does not result in the reduction of either parcel by 20^<» or more of its original size; c) adding an accretion to a parcel. 2. Parcels which consist of 2 or more parts physically separated by: a) a highway which was dedicated prior to the adoption of this 8ytaw; b) the Nanaimo River, the Englishman River, the Little Qualicum River, or the Qualicum River; c) a railway under jurisdiction of the applicabfe Raifway Act and amendments thereto; may be subdivided along the dividing highway, the natural boundaries of the noted rivers, or the railway even when the newly created parcels fail to meet the minimum parcel size requirements of this Bylaw, provided the requirements of the authorities having jiffisdiction are met with respect to the provision of v^ter, method of sewage disposal and access. 3. This preliminary subdivision layout approval has considered the requirem^ts of the Land Title Act, the Local Government Act, the Community Charter as well as the requirements of any other relevant agency including applicable District of Lantzville bylaws and policies.

1. TERM of PRELIMINARY LAYOUT APPROVAL ffLA)LETTER This PLA of the proposed subdivision is valid for a period of ei^teen (18) months from the date ofthe letter. The Approving Officer may grant an extension to the PLA of one(1) year. If final approval has not been granted to the subdivision within the eighteen (18) month period or the extended period, the application must be resubmitted and shall be considered as a new application. A new application shall be subject to any change in conditions that may have occurred.

2. SURVEY AND LEGAL DOCUMENTATION 1. Survey plans(2 prints and a digital copy) prepared by a BCLS, and all other documents to be registered must be submitted to the Approving Officer for approval or as required for electronic plan registration.

2. All legal survey drawings and legal documents submitted to the Approving Officer will be reviewed for completen^s in accordance with the conditions of this PLA,the District of Lantzville Subdivision and Development Bylaw No. 55, 2005, District of Lantzville Zoning Bylaw No. 60,2005, and other applicable bylaws, and the Provincial and Federal regulations and Statues (including the Land Title Act, the Community Charter, and the Local Government Act).

3. STATUTORY REQUIREMENTS Minimum Perimeter Parcel Frontage Requirements The proposed plan of subdivision show a number proposed parcels do not provide the minimum lot frontage requirement. A table outlining the proposed lots that will not meet the minimum frontage requirement pursuant to section 512 of the Lx>cal Government Act shall be provided. The Approving Officer will review this matter and determine whether it is appropriate to exempt the minimum perimeter parcel frontage. Each parcel will be reviewed to ensure there is sufficient frontage to accommodate the intended uses, provide access to the proposed parcel, and is constructed to the satisfaction of the District of Lantzville.

P100 The submitted plan of subdivision shows that a number of lots are configured as a panhandle lot. Please provide a table confirming which proposed lots are to be accessed via a panhandle.

Provision of Park Land The proposed park dedication was negotiated between the District of Lantzville and the property owner at the time of OCP and Zoning amendment. The commitment to provide parkland has been determined through the Section 219 Covenant FB055607 for the lands zoned Comprehensive Development(CD 24, CD25, CD 26 and CD27). The lands outside of the Comprehensive Development zone (i.e. Zoned RSIL) are subject to the requirements of Section 510 of the Local Government Act wifii respect to the Provision of Park Land. Given the proximity of the proposed park area on the CD lands, the District request a 5% cash-in —lieu.

Necessary Approvals This letter does not relief the applicant of the responsibility to obtain all other necessary permits, certificates, licenses, and other approvals from the municipality and other government or regulatory agencies having jurisdiction.

4. PLANNING AND ENGINEERING CONDITIONS AND REQUIREMENTS 1. Bylaw Compliance Confirmation of compliance with "District of Lantzville Subdivision and Development Bylaw No. 55,2005","District of Lantzville Zoning Bylaw No.60,2005", the Land Title Act, the Local Government Act, as well as the requirements of any other relevant agency shall be required.

In addition to this PLA, the applicant will be required to comply with any additional comments provided by the Director of Public Works and the District's consulting Engineers (Koers and Associates Engineering Ltd.). A copy of Technical Memorandum No. 2" issued December 22, 2016, prepared by Koers and Associates Engineering Ltd. is attached for your review and information - see Attachment 2. It is expected that a future meeting will be held to discuss issues identified within the technical memorandum.

2. Road Dedication/Construction / Traffic / Access Traffic Study The subdivision shall comply with the recommendations outlined in both November 28, 2005 and the October 28, 2015 traffic studies prepared by Boulevard Transportation Group. All proposed improvements shall be review^ and approved by the Fred Spears, Director of Public Works.

Dedication and Construction of New Roads The applicant is to dedicate public road in the location as shown on the proposed plan of subdivision. Applicant's Professional Engineer, registered in the Province of BC, is to design and construct the associated roadworks in accordance with the District of

P101 Lantzville Engineering Specifications pursuant to District of Lantzville Subdivision and Development Bylaw No. 55, 2005 and its standards and specifications. Driveway access to each propos^ parcel is to be included in the design and construction and is to be shown on the submitted engineering drawings. Road construction is to include: Examples: • Turnaround to be designed and constructed within the road dedication. • The applicant's professional engineer shall confirm the adequacy of the road width and curb alignment and if inadequate, dedication of the additional necessary width to accommodate road layout is required. • Signage as per Bylaw No. 55,2005. • All driveway accesses are to be designed and constructed in accordance with the District of Lantzville Engineering Standard.

The proposed design is to be submitted to the attention of Fred Spears, Director of Public Works for review and acceptance. Confirmation of design acceptance will be provided in writing by the District of Lantzville. The applicant's professional engineer is to oversee the construction of the road and is to provide certification of the completed works together with record drawings upon completion.

Off Site Roadworks The adjacent Aulds Road is to be constructed in accordance with the District of Lantzville Engineering Specifications pursuant to District of Lantzville Subdivision and Development Bylaw No. 55, 2005 and its standards and specifications. Driveway access to each proposed parcel is to be included in the design and construction and is to be shown on the submitted engineering drawings.

Street Lighting Street lights shall be installed as the District's road design standards. The lifting standard along Harwood Drive and at all intersections within the proposed subdivision shall be further reviewed with the applicant.

3. Off-Site Drainage If drainage is proposed to discharge to Harwood Road and/or Aulds Road, the applicant's professional Engineer is to evaluate the Harwood Road and Aulds Road drainage system to confirm its ability to accommodate additional drainage flow.

4. Potable Water Written certification fi'om a Professional Engineer, with expertise in drinking water and registered in BC, that each proposed parcel including the parent parcel has the capacity to supply potable water from individual wells to satisfy: a) the volume requirements (minimum 3,400 litres/day) as set out in "District of Lantzville Subdivision and Development Bylaw No. 55,2005"; and b) the provincial Drinking Water Protection Act.

P102 Please note that only test results that are current and product by a professional for quantity will be accepted. Quality tests are required to be completed by a laboratory and must be c^ed out by applicant's professional well driller or engineer. Quality testing must consist of a full spectrum testing and results must meet the guidelines for Canadian Drinking Water Quality.

Source Well: Well PW D4-2014 GWS 10" seems to be drilled deeper than needed and have bottom sections of boreholes that do not produce any water. This sump needs to be backfilled following the BC Groundwater Protection Regulation standards. Prior to the District of Lantzville accepting Well PW D4 GWS 10" for the development, the applicant and the District must enter in a Water Well Transfer Agreement that will protect the District's interest with regards to any changes in water quality that has a negative effect on the wells viability for drinking water supply. In addition, the Water Well Tr^sfer Agreement must protect the District from any well capacity loss in the future. This agreement is to be to the satisfaction ofthe Director of Public Works. In addition to above, see comments from Lowen Hydrology Consulting attached as Attachment No. 2. It is understood that Well PW 2-2015 GWS 10" is not part of the Phase 1 application process, therefore no comments are provided.

Community Water A community waterline; complete with individual community service connections and water meters to each proposed parcel, fire hydrant(s), is to be designed and installed within the new road dedication and existing statutory right-of-way pursuant to District of Lant^ille Subdivision and Development Bylaw No. 55, 2005 and its standards and specifications. Applicant's professional engineer is to submit design drawings to the attention of Fred Spears, Director of Public Works for review and Design Acceptance. Confirmation of Design Acceptance will be provided in writing by the District of Lantzville. The ^plicant's professional engineer is to oversee the construction of the works and is to provide certification of the works together with As-Constructed Record Drawings upon completion of works.

Demand The entire area that is to be serviced by the top reservoir at the 342 TWL needs to be identified in order to calculate fire flows. Residential Maximum Daily demands can be identified in the 2015 Ko^ and Associates Water Supply and Distribution Study.

P103 storage The reservoir placed at the 342m TWL elevation will be sized in accordance with the requirements to meet maximum day and fire flow demands of the full service area of this reservoir. This reservoir will be connected via supply and distribution water lines to the reservoir placed at the 159m TWL.

The reservoir placed at the 159 TWL is to be sized in accordance with the requirements to meet maximum day and fire flow demands of the full service area of this reservoir. This service area can be identified by the District's consulting engineers. This reservoir will be connected to the District of Lantzville existing supply and distribution systems.

The pump station that is to be built in conjunction to the reservoir at the 159m TWL will be built to a size that will accommodate both fire flows and maximum day demand for the entire area that is to be serviced by the reservoir at the 342m TWL.

The District of Lantzville will not accept stand-alone systems. The two reservoirs must be interconnected as they will form part ofone system that has many pressure zones.

5. Community Sewer A community sanitary sewer line; complete with individual community service connections to all proposed parcels and tie-in with the existing sewer line located at Aulds Road; is to be designed and constructed within the existing road new road dedication pursuant to District of Lantzville Subdivision and Development Bylaw No. 55, 2005 and its standards and specifications. Applicant's professional engineer is to submit design drawings to the attention of Fred Spears, Director of Public Works for review and design acceptance. Confirmation of Design Acceptance will be provided in writing by the District of L^tzviDe. The applicant's engineer is to oversee the construction ofthe works and is to provide certification of the works together with As-Constructed Record Drawings upon completion of works.

6. Rainwater Management A rainwater management scheme is to be designed to accommodate a building site on each proposed parcel. The design for the Rainwater Management System is to be prepared by the applicant's professional engineer in accordance with the requirements set out in Schedule *D' of the "District of Lantzville Subdivision and Development Bylaw No. 55, 2005". The applicant's professional engineer is to submit design drawings to the attention of Fred Spears, Director of Public Works for review and design acceptance. Confirmation of Design Acceptance will be provided in writing by the District of Lantzville. Upon acceptance, the applicant is to prepare and register, at his cost, a section 219 covenant pursuant to the Land Title Act on Ae titles of the proposed parcels. A copy of the draft covenant is to be submitted to this office for review and acceptance prior to making application for final approval of subdivision. If covenant is to be registered concurrently with plan of subdivision, the aapplicant's solicitor is to submit a letter of undertaking to register the covenant document concurrently with the plan of subdivision at Land Title Office, Victoria.

P104 7. Development Cost Charges Development Cost Charges (DCCs) shall apply in the amount as per the attached calculation sheet — Attachment No. 3. Payment of the development cost charges shall apply prior to the registration oflots with the Land Titles office.

8. Development Permit Requirements The parcels outside the CD zone fall within the DPA 1 - Watercourse Protection and DPA 3 -Ste^ Slopes Protection Development Permit Area(s) pursuant to the District of Lant^lle Official Community Plan Bylaw No. 50, 2005. A development permit is required to be issued and any conditions ofthe permit must be met prior to consideration of final approval.

9. Site Profile The submission of a site profile as per Sec. 85.1 of the Land Title Act; and as described in Sec. 40 ofthe Environmental Management Act is to be submitted to this office.

10. Provision of Park Land Parkland - 730 acres to be dedicated as per the condition of the Section 219 covenant (FB055607) registered on title. In recognition that there may be future adjustments to the park boundaries, parkland shall be provided as a fee simple parcel dedicated to the District of Lantzville.

11. Latecomers Agreement Pursuant to section 939 of the Local Government Act,

5. TAXES AND OTHER ASSOCIATED COSTS CONDITIONS AND REQUIREMENTS 1. Taxes and Billings Confirmation that any outstanding accounts receivable, including property taxes, user rates, billings, etc. are paid in full prior to submission for approval of the subdivision plan. 2. The Applicant shall pay any third party consulting costs associated with the review and approval of this subdivision application. All costs shall be paid in full prior to final approval of any part ofthe subdivision. 3. The Applicant, prior to any construction works on District of Lantzville Property, is required to enter a Works and Services Agreement with the District of Lantzville as per Section 5.a; "Deposits within the municipality a security, in a form compliant with Schedule G,section 10. 1, a, b, c, of Bylaw 55 in the amount of 125% ofthe estimated cost of the works"; and 5.b; "Enters into a Works and Services Agreement with the Municipality substantially in the form of Schedule G", of the District of Lantzville Subdivision and Development Bylaw 55.

The Applicant shall pay to the Municipality an administration and inspection fee equal to 4.5% of the estimated cost of the Works and Services certified by the owner's professional engineer up to a value of $500,000, plus 2.5% of such estimate over $500,000, up to $1,000,000, plus 1.5% of such estimate over $1,000,000.

Any and all costs associated with the subdivision not identified in Works and Services Agreement or in Bylaw 55, including any legal or other costs incurred by the District of Lantzville will be the responsibility of the applicant. Any costs incurred by the District relating to this application will be made available to the applicant and are to be paid in full prior to final approval.
