का.का.का.आका. आआआ.... 34343434((((अ)अ)अ)अ)....————अिधसूचना का िनƄिलिखत Oाďप , िजसे केLीय सरकार, पयाϕवरण (संरϓण ) अिधिनयम, 1986 (1986 का 29) कƙ धारा 3 कƙ उपधारा (2) के खंड (v) और खंड (xiv) तथा उपधारा (3) के साथ पƗठत उपधारा (1) ůारा Oदē शिŎयĪ का Oयोग करते ćए , जारी करने का Oताव करती है, पयाϕवरण (संरϓण ) अिधिनयम, 1986 के िनयम 5 के उपिनयम (3) कƙ अपेϓानुसार , जनसाधारण कƙ जानकारी के िलए Oकािशत Ƙकया जाता है; िजनके उससे Oभािवत होने कƙ संभावना है, और यह सूिचत Ƙकया जाता है Ƙक उŎ OाĐप अिधसूचना पर, उस तारीख से, िजसको इस अिधसूचना को अंतƞवϕट करने वाले भारत के राजपJ कƙ Oितयां जनसाधारण को उपल ध करा दी जाती हġ, साठ Ƙदन कƙ अविध कƙ समािƁ पर या उसके पचा त् िवचार Ƙकया जाएगा;

अतःअतः,,,, अब, केLीय सरकार, पयाϕवरण (संरϓण ) अिधिनयम, 1986 के िनयम 5 के उपिनयम (3) के साथ पƗठत पयाϕवरण (संरϓण ) अिधिनयम, 1986 (1986 का 29) कƙ उपधारा (1) तथा धारा 3 कƙ उपधारा (2) एवं उपधारा (3) के खंड (v) और खंड (xiv) ůारा Oदē शिŎयĪ का Oयोग करते ćए, तिमलनाडु राϤय के इरोड िजला के वेलोड पϓी अभयारय कƙ सीमा के चारĪ ओर 0.5 Ƙकलोमीटर तक िवताƗरत ϓेJ को पाƗरिथितकƙ संवेदी जोन (िजसे इसमĞ इसके प चा त् पाƗरिथितकƙ संवेदी जोन कहा गया है) के Đप मĞ अिधसूिचत करती है, िजसका िववरण िनƄानुसार है, अथाϕत् :-

1. पाƗरिथितकƙ संवेदी जोन काकाका िवतार औरऔरऔर सीमासीमाएं एंएंएं....-(1) पाƗरिथितकƙ संवेदी जोन का िवतार वेलोड पϓी अभयारय कƙ सीमा के चारĪ ओर 0.5 Ƙकलोमीटर है और पाƗरिथितकƙ संवेदी जोन का ϓेJफल 3.40 वगϕ Ƙकलोमीटर है।

(2) वेलोड पϓी अभयारय और इसके पाƗरिथितकƙ संवेदी जोन कƙ सीमा का िववरण उपाबंधउपाबंध----IIII के Đप मĞ संलŐ है।

(3) सीमा िववरण और अϓांश और देशांतर के साथ पाƗरिथितकƙ संवेदी जोन के वेलोड पϓी अभयारय के मानिचJ उपाबंधउपाबंध----IIIIIIIIकककक,,,, उपाबंधउपाबंध----IIIIIIIIखखखख,,,, उपाबंधउपाबंध----IIIIIIIIगगगग और उपाबंधउपाबंध----IIIIIIIIघघघघ के Đप मĞ संलŐ है।

(4) पाƗरिथितकƙ संवेदी जोन और वेलोड पϓी अभयारय कƙ सीमा के भू-िनदğशांकĪ कƙ सूची उपाबंधउपाबंध----IIIIII के सारणी ककक और सारणी खखख मĞ दी गई है।

(5) मुϞय ƚबंदुĸ के भू-िनदğशांकĪ के साथ पाƗरिथितकƙ संवेदी जोन के अंतगϕत आने वाले =ामĪ कƙ सूची उपाबंध IVIVIV के Đप मĞ संलŐ है।

222.2... पाƗरिथितकƙ संवेदी जोनजोनजोन केकेके िलएिलएिलए आंचिलक महायोजना .–(1) राϤय सरकार, ůारा पाƗरिथितकƙ संवेदी जोन के Oयोजन के िलए, राजपJ मĞ अंितम अिधसूचना के Oकाशन कƙ तारीख से दो वषϕ कƙ अविध के भीतर, थानीय ƆिŎयĪ के परामशϕ से और इस अिधसूचना मĞ Ƙदए गए अनुबंधĪ का पालन करते ćए , राϤय सरकार के सϓम Oािधकारी के अनुमोदनाथϕ एक आंचिलक महायोजना बनाई जायेगी। 4 THE GAZETTE OF INDIA : EXTRAORDINARY [P ART II—SEC . 3(ii)]

(2) राϤय सरकार ůारा पाƗरिथितकƙ संवेदी जोन के िलए आचंिलक महायोजना इस अिधसूचना मĞ िविनƠदϕ ट रीित से तथा Oासंिगक कĞLीय और राϤय िविधयĪ के अनुĐप तथा कĞLीय सरकार ůारा जारी Ƙदशा िनदğशĪ, यƘद कोई हĪ, के अनुसार बनायी जाएगी।

(3) आंचिलक महायोजना मĞ पाƗरिथितकƙ और पयाϕवरण संबंधी सरोकारĪ को शािमल करने के िलए इसे राϤय सरकार के िनƄिलिखत िवभागĪ के परामशϕ से बनाया जाएगा, अथाϕत्:-

(i) पयाϕवरण ;

(ii) वन और वयजीव ;

(iii) कृिष;

(iv) राजव ;

(v) शहरी िवकास;

(vi) पयϕटन ;

(vii) =ामीण िवकास;

(viii) ƚसंचाई और बाढ़ िनयंJण ;

(ix) नगरपािलका;

(x) पंचायती राज;

(xi) लोक िन माϕण िव भाग;

(xii) राजमागϕ; और

(xiii) तिमलनाडु राϤय Oदूषण िनयंJण बोडϕ।

(4) जब तक इस अिधसूचना मĞ िविनƠदϕƍ न हो , आंच िलक महायोजना मĞ वतϕमान मĞ अनुमोƘदत भू-उपयोग, अवसंरचना और Ƙ;याकलापĪ पर कोई Oितबंध नहĕ लगाया जाएगा तथा आचंिलक महायोजना मĞ सभी अवसंरचनाĸ और Ƙ;याकलापĪ मĞ सुधार करके उहे अिधक दϓ और पाƗरिथितकƙ -अनुकूल बनाने कƙ Ɔवथा कƙ जाएगी।

(5) आंचिलक महायोजना मĞ वनरिहत और अव;िमत ϓेJĪ के सुधार, िवźमान जल िनकायĪ के संरϓण , आवाह ϓेJĪ के Oबंधन , जल-संभरĪ के Oबंधन , भू-जल के Oबंधन , मृदा और नमी के संरϓण , थानीय जनता कƙ आवयकताĸ तथा पाƗरिथितकƙ एवं पयाϕवरण के ऐसे अय पहलुĸ कƙ Ɔवथा कƙ जाएगी िजन पर यान Ƙदया जाना आवयक है।

(6) आंचिलक महायोजना मĞ सभी िवźमान पूजा थलĪ, =ामĪ एवं शहरी बितयĪ, वनĪ कƙ XेिणयĪ एवं ƘकमĪ , कृिष ϓेJĪ , ऊपजाऊ भूिम, उźानĪ एवं उźानĪ कƙ तरह के हƗरत ϓेJĪ , बागवानी ϓेJĪ , बगीचĪ , झीलĪ और अय जल िनकायĪ कƙ सीमा का सहायक मानिचJ के साथ िनधाϕरण Ƙकया जाएगा । और Oतािवत भू-उपयोग कƙ िवशेषताĸ का यौरा भी Ƙदया जाएंगा।

(7) आंचिलक महायोजना मĞ पाƗरिथितकƙ संवेदी जोन मĞ होने वाले िवकास का िविनयम न Ƙकया जाएगा और सारणी मĞ यथा सूचीबŵ पैरा=ाफ 4 मĞ Oितिषŵ एवं िविनयिमत Ƙ;याकलापĪ का पालन Ƙकया जाएगा। इसमĞ था नीय जनता कƙ आजीिवका कƙ सुरϓा के िलए पाƗरिथितकƙ -अनुकूल िवकास का भी सुिनƇय एवं संवधϕन Ƙकया जाएगा । ¹Hkkx IIµ[k.M 3(ii)] Hkkjr dk jkti=k % vlk/kj.k 5

(8) आंचिलक महायोजना, ϓेJीय िवकास योजना कƙ सह -कािलक होगी ।

(9) अनुमोƘदत आंचिलक महायोजना , िनगरानी सिमित के िलए एक संदभϕ दतावेज होगी ताƘक वह इस अिधसूचना के उपबंधĪ के अनुसार िनगरानी के अपने कतϕƆĪ का िनवϕहन कर सके ।

3. राϤय सरकार ůारा ƘकएƘकएƘकए जाने वाले उपायउपाय....---- राϤय सरकार इस अिधसूचना के उपबंधĪ को Oभावी बनाने के िलए िनƄिलिखत उपाय करेगी, अथाϕत्:-

(1) भूभूभू-भू---उपयोग.उपयोग.उपयोग.–––– (क) पाƗरिथितकƙ संवेदी जोन मĞ वनĪ , बागवानी ϓेJĪ , कृिष ϓेJĪ , मनोरंजन के िलए िचिहत उźानĪ और खुले थानĪ का वृहद वािणिϤयक या आवासीय पƗरसरĪ या औźोिगक Ƙ;याकलापĪ के िलए Oयोग या संपƗरवतϕन अनुϔात नहĕ Ƙकया जाएगा :

परंतु पाƗरिथितकƙ संवेदी जोन के भीतर भाग (क), मĞ िविनƠदϕƍ Oयोजन से िभž Oयोजन के िलए कृिष और अय भूिम का संपƗरवतϕन , मानीटरी सिमित कƙ िसफाƗरश पर और सϓम Oािधकारी के पूवϕ अनुमोदन से ϓेJीय नगर यो जना अिधिनयम तथा यथा लागू केLीय सरकार एवं राϤय सरकार के अय िनयमĪ एवं िविनयमĪ के अधीन तथा इस अिधसूचना के उपबंधĪ के अनुसार थानीय िनवािसयĪ कƙ िनƄिलिखत आवासीय जĐरतĪ को पूरा करने के िलए अनुϔात Ƙकया जाएगा जैसे:-

(i) िवźमान सड़कĪ को चौड़ा करना, उहĞ सुदृढ करना और नई सड़कĪ का संिनमाϕण करना ;

(ii) बुिनयादी ढांचĪ और नागƗरक सुिवधाĸ का संिनमाϕण और नवीकरण ;

(iii) Oदूषण उपž न करने वाले लघु उźोग ;

(iv) कुटीर उźोग एवं =ाम उźोग ; पाƗरिथितकƙ पयϕटन मĞ सहायक सुिवधा भडार , और थानीय सुिवधाएं तथा =ह वास ; और

(v) बढ़ावा Ƙदए गए पैरा =ाफ -4 मĞ उिलिखत Ƙ;याकलापः

परंतु यह भी Ƙक ϓेJीय शहरी िनयोजन अिधिनयम के अधीन सϓम Oािधकारी के पूवϕ अनुमोदन के िबना तथा राϤय सरकार के अय िनयमĪ एवं िविनयमĪ एवं संिवधान के अनुϢछेद 244 के उपबंधĪ तथा तसमय Oवृē िविध, िजसके अंतगϕत अनुसूिचत जनजाित और अय परंपरागत वन िनवासी (वन अिधकारĪ कƙ मायता ) अिधिनयम, 2006 (2007 का 2) भी आता है, का अनुपालन Ƙकए िबना वािणिϤयक या औźोिगक िवकास Ƙ;याकलापĪ के िलए जनजातीय भूिम का Oयोग अनुϔात नहĕ होगा:

परंतु यह भी Ƙक पाƗरिथितकƙ संवेदी जोन के अंतगϕत आने वाली भूिम के अिभलेखĪ मĞ ćई Ƙकसी JुƗट को, मानीटरी सिमित के िवचार OाƁ करने के पƇात्, राϤय सरकार ůारा Oयेक मामले मĞ एक बार सुधारा जाएगा और उŎ JुƗट को सुधारने कƙ सूचना कĞLी य सरकार के पयाϕवरण , वन और जलवायु पƗरवतϕन मंJालय को दी जाएगी:

परंतु यह भी Ƙक उपयुϕŎ JुƗट को सुधारने मĞ, इस उप-पैरा मĞ यथा उपबंिधत के िसवाय, Ƙकसी भी दशा मĞ भू-उपयोग का पƗरवतϕन शािमल नहĕ होगा।

(ख) अनुOयुŎ या अनुपादक कृिष ϓेJĪ मĞ पुन: वनीकरण तथा पयाϕवासĪ और जैव - िविवधता कƙ बहाली के Oयास Ƙकए जाएंगे।

(2) Oाकृितक जल Zोत ...- आंचिलक महायोजना मĞ सभी Oाकृितक जलमागĬ के आवाह ϓेJĪ कƙ पहचान कƙ जाएगी और आंचिलक महायोजना मĞ उनके संरϓण और बहाली कƙ योजना सि म िलत कƙ जाएगी और राϤ य सरकार ůारा जल आवाह Oबंधन योजना इस रीित से बनाई जाएगी Ƙक उसमĞ आवाह ϓेJĪ मĞ िवकास Ƙ;याकलापĪ को Oितिषŵ और िनबİिधत Ƙकया गया हो । 6 THE GAZETTE OF INDIA : EXTRAORDINARY [P ART II—SEC . 3(ii)]

(3) पयϕटन एवं पाƗरिथितकƙ पयϕटन. ––– (क) पाƗरिथितकƙ संवेदी जोन मĞ सभी नए पाƗरिथितकƙ पयϕटन Ƙ;याकलाप या िवźमान पयϕटन Ƙ;याकलापĪ का िवतार पाƗरिथितकƙ संवेदी जोन स बंधी पयϕटन महायोजना के अनुसार अनुϔात होगा। (ख) पाƗरिथितकƙ पयϕटन महायोजना राϤय सरकार के पयाϕवरण और वन िवभा ग के परामशϕ से पयϕटन िवभाग ůारा बनायी जाएगी। (ग) पयϕटन महा योजना आंचिलक महायोजना का घटक होगी।

(घ) पयϕटन महायोजना पाƗरिथितकƙ संवेदी जोन कƙ वहन ϓमता के आधार पर तैयार कƙ जायेगी ;

(ङ) पाƗरिथितकƙ पयϕटन संबंधी Ƙ;याकलाप िन ना नुसार िविनयिमत Ƙकए जाएंगे, अथाϕत्: -

(i) पϓी अभयारय कƙ सीमा से एक Ƙकलोमीटर के भीतर या पाƗरिथितकƙ संवेदी जोन कƙ सीमा तक, इनमĞ जो भी अिधक िनकट हो, Ƙकसी होटल या Ɨरजॉटϕ का नया सिžमाϕण अनुϔात नहĕ Ƙकया जाएगाः

परंतु यह, पाƗरिथितकƙ पयϕटन सुिवधाĸ के िलए पϓी अभयारय कƙ सीमा से एक Ƙकलोमीटर कƙ दूरी से परे पाƗरिथितकƙ संवेदी जोन कƙ सीमा तक पूवϕ पƗरभािषत और अभीिहत ϓेJĪ मĞ पयϕटन महायोजना के अनुसार , नए होटलĪ और Ɨरजॉटϕ कƙ थापना अनुϔात होगी ;

(ii) पाƗरिथितकƙ संवेदी जोन के अदर सभी नए पयϕटन Ƙ;या -कलापĪ या िवźमान पयϕटन Ƙ;याकलापĪ का िवतार , केLीय सरकार के पयाϕवरण, वन और जलवायु पƗरवतϕन मंJालय ůारा जारी ƘदशािनदğशĪ तथा पाƗरिथितकƙ पयϕटन , पाƗरिथितकƙ -िशϓा और पाƗरिथितकƙ -िवकास पर बल देने वाले राƎीय Ɔा> संरϓण Oािधकरण ůारा जारी पाƗरिथितकƙ पयϕटन संबंधी ƘदशािनदğशĪ (समय -समय पर यथा संशोिधत) के अनुसार होगा;

(iii) आंचिलक महायोजना का अनुमोदन होने तक, पयϕटन के िवकास और िवźमान पयϕटन Ƙ;याकलापĪ के िवतार को वातिवक थल -िविशƍ संवीϓा तथा मानीटरी सिमित कƙ िसफाƗरश के आधार पर संबंिधत िविनयामक OािधकरणĪ ůारा अनुϔात Ƙकया जाएगा और पाƗरिथितकƙ संवेदी जोन मĞ Ƙकसी नए होटल/ Ɨरजॉटϕ या वािणिϤयक OितƏान का संिžमाϕण अनुϔात नहĕ होगा ।

(4) Oाकृितक िवरासत ...–.––– पाƗरिथितकƙ संवेदी जोन के अंतगϕत आने वाले बćमूय Oाकृितक िवरासत के सभी थलĪ जैसे Ƙक जीन पूल Ɨरजवϕ ϓेJ , शैल संरचना, जल Oपात , झरने, दरğ, उपवन, गुफाएं, थल , वनपथ, रोहण मागϕ, उOपात आƘद कƙ पहचान कƙ जाएगी और उनकƙ सुरϓा एवं संरϓण के िलए आंचिलक महायोजना के भाग के Đप मĞ एक िवरासत संरϓण योजना बनायी जाएगी।

(5) मानव िनƞमϕत िवरासत थ ल.ल.ल.-ल. --- पाƗरिथितकƙ संवेदी जोन मĞ भवनĪ , संरचनाĸ , कलाकृित-ϓेJĪ तथा ऐितहािसक, थापय संबधी , सĭदयाϕमक और सांकृितक महव के ϓेJĪ कƙ पहचान कƙ जाएगी और उनके संरϓण के िलए आंचिलक महायोजना के भाग के Đप मĞ एक िवरासत संरϓण योजना बनायी जाएगी। (6) वविन व िन Oदूषण. - पयाϕवरण अिधिनयम के अधीन विन Oदूषण (िविनयमन और िनयंJण) िनयम, 2000 मĞ िनयत उपबंधĪ के अनुसार मĞ पाƗरिथितकƙ संवेदी जोन मĞ विन Oदूषण के िनयंJण के िलए िविनयमĪ को कायाϕिवत करेगा ।

(7) वायु Oदूषण ...- पाƗरिथितकƙ संवेदी जोन मĞ, वायु Oदूषण के िनवारण और िनयंJण का वायु (Oदूषण िनवारण और िनयंJण ) अिधिनयम, 1981 (1981 का 14) और उसके अधीन बनाए गए िनयमĪ के उपबंधĪ के अनुसार अनुपालन Ƙकया जाएगा ।

(8) बिहZाव काकाका िनसारण ...- पाƗरिथितकƙ संवेदी जोन मĞ उपचाƗरत बिहZाव का िनसारण, साधारणĪ मानकĪ के अतगϕत पयाϕवरण अिधिनयम और उसके अधीन बनाए गए िनयमĪ के अधीन आने वाले पयाϕवरणीय Oदूषण के िनसारण के िलए साधारण मानकĪ या राϤय सरकार ůारा िनयत मानकĪ, जो भी अिधक कठोर हो, के उपबंधĪ के अनुसार होगा।

(9) ठोसठोसठोस अपिशƍ ...-.--- ठोस अपिशƍ का िनपटान एवं Oबधन िनƄानुसार Ƙकया जाएगा :-

(क) पाƗरिथितकƙ संवेदी जोन मĞ ठोस अपिशƍ का िनपटान और Oबंधन भारत सरकार के पयाϕवरण, वन और जलवायु पƗरवतϕन मंJालय कƙ समय -समय पर यथा संशोिधत अिधसूचना सं. का.आ. 1357(अ), Ƙदनांक 8 अOैल , 2016 के तहत Oकािशत ठोस अपिशƍ Oबंधन िनयम, 2016 के उपबंधĪ के अनुसार Ƙकया जाएगा। अकाबϕिनक पदाथī का िनपटान पाƗरिथितकƙ संवेदी जोन से बाहर िचिहत Ƙकए गए थानĪ पर पयाϕवरण -अनुकूल रीित से Ƙकया जाएगा ;

(ख) पाƗरिथितकƙ संवेदी जोन मĞ माय OौźोिगƘकयĪ (ईएसएम) का Oयोग करते ćए िवźमान िनयमĪ और िविनयमĪ के अनुĐप ठोस अपिश ƍ का सुरिϓत और पयाϕवरण अनुकूल Oबंधन अनुϔात Ƙकया जायेगा।

(10) जैव िचƘकसा अपिशट ...- जैव िचƘकसा अपिशट का Oबंधन िनƄानुसार Ƙकया जाएगा :-

(क) पाƗरिथितकƙ संवेदी जोन मĞ जैव िचƘकसा अपिशƍ का िनपटान भारत सरकार के पयाϕवरण, वन और जलवायु पƗरवतϕन मंJालय कƙ समय –समय पर यथा संशोिधत अिधसूचना सं.सा.का.िन 343 (अ), तारीख 28 माचϕ, 2016 के तहत Oकािशत जैव िचƘकसा अपिशƍ Oबंधन िनयम, 2016 के उपबंधĪ के अनुसार Ƙकया जाएगा ।

(ख) पाƗरिथितकƙ संवेदी जोन मĞ माय OौźोिगƘकयĪ का Oयोग करते ćए िवźमान िनयमĪ और िविनयमĪ के अनुĐप ठोस अपिश ƍ का सुरिϓत और पयाϕवरण अनुकूल Oंबंधन अनुϔात Ƙकया जायेगा।

(11) लािटक अपिशƍ का Oबंधन ...-.--- पाƗरिथितकƙ संवेदी जोन मĞ लािटक अपिशƍ का Oबंधन, भा रत सरकार के पयाϕवरण, वन और जलवायु पƗरवतϕन मंJालय कƙ समय -समय पर यथा संशोिधत अिधसूचना सं.सा.का.िन 340(अ), तारीख 18 माचϕ, 2016 के तहत Oकािशत लािटक अपिशƍ Oबंधन िनयम , 2016 के उपबंधो के अनुसार Ƙकया जाएगा।

(12) िनमाϕण और िववंस अपिशƍ का Oबंधनधनधन.धन ...---- पाƗरिथितकƙ संवेदी जोन मĞ िनमाϕण और िववंस अपिशƍ का Oबंधन, भारत सरकार के पयाϕवरण, वन और जलवायु पƗरवतϕन मंJालय कƙ समय -समय पर यथा संशोिधत अिधसूचना सं.सा.का.िन 317(अ), तारीख 29 माचϕ, 2016 के तहत Oकािशत संिनमाϕण और िववंस अपिशƍ Oबंधन िनयम, 2016 के उपबंधĪ के अनुसार Ƙकया जाएगा।

(13) ईईई–ई–––अपिशƍ. --- पाƗरिथितकƙ संवेदी जोन मĞ ई –अपिशƍ का Oबंध न, भारत सरकार के पयाϕवरण, वन और जलवायु पƗरवतϕन मंJालय ůारा Oकािशत तथा समय-समय पर यथा संशोिधत ई–अपिशƍ Oबंध न िनयम, 2016 के उपबंधĪ के अनुसार Ƙकया जाएगा।

(14) सड़कसड़क----यातायातयातायातयातायात....---- सड़क-यातायात को पयाϕवास -अनुकूल तरीके से िविनयिमत Ƙकया जाएगा और इस संबंध मĞ आंचिलक महायोजना मĞ िवशेष उपबंध शािमल Ƙकए जाएंगे। आंचिलक महायोजना के तैयार होने और राϤय सरकार के सϓम Oािधकारी से अनुमोƘदत होने तक , मानीटरी सिमित Oासंिगक अिधिनयमĪ और उनके तहत बनाए गए िनयमĪ एव ं िविनयमĪ के अनुसार सड़क-यातायात के अनुपालन कƙ मानीटरी करेगी।

(15) वाहन जिनत Oदूषण. --- वाहन जिनत Oदूषण कƙ रोकथाम और िनयंJण लागू िविधयĪ के अनुसार Ƙकया जाएगा। वϢछ तर Ĳधन के उपयोग के िलए Oयास Ƙकए जा एंगे ।

(16) औźोिगक ईकाइयां. --- (i) सरकारी राजपJ मĞ इस अिधसूचना के Oकाशन कƙ तारीख को या उसके बाद पाƗरिथितकƙ संवेदी जोन मĞ Ƙकसी नए Oदूषणकारी उźोग कƙ थापना अनुϔात नहĕ होगी।

(ii) जब तक इस अिधसूचना मĞ िविनƠदϕƍ न हो , पाƗरिथितकƙ संवेदी जोन मĞ कĞLीय Oदूषण िनयंJण बोडϕ ůारा फरवरी, 2016 मĞ जारी ƘदशािनदğशĪ मĞ Ƙकए गए उźोगĪ के वगĖकरण के अनुसार केवल गैर-Oदूषणकारी उźोगĪ कƙ थापना अनुϔात होगी। इसके अितƗरŎ , गैर-Oदूषणकारी कुटीर उźोगĪ को बढ़ावा Ƙदया जाएगा।

(17) पहाड़ी ढलानĪ काकाका संरϓण. --- पहाड़ी ढलानĪ का संरϓण िनƄानुसार Ƙकया जाएगा:- 8 THE GAZETTE OF INDIA : EXTRAORDINARY [P ART II—SEC . 3(ii)] (क) आंचिलक महायोजना मĞ पहाड़ी ढलानĪ के उन ϓेJĪ को दशाϕया जाएगा िजनमĞ Ƙकसी भी संिनमाϕण कƙ अनुϔा नहĕ होगी ।

(ख) िजन ढलानĪ या िवźमान खड़ी पहाड़ी ढलानĪ मĞ अयिधक भू-ϓरण होता है उनमĞ Ƙकसी भी संिनमाϕण कƙ अनुϔा नहĕ होगी ।

444.4... पाƗरिथितकƙ संवेदी जोन मĞमĞमĞ Oितिषŵ यायाया िविनयिमत Ƙकए जाने वाले Ƙ;याकलापĪ कƙकƙकƙ सूचीसूची- --- पाƗरिथितकƙ संवेदी जोन मĞ सभी Ƙ;याकलाप , पयाϕवरण अिधिनयम के उपबंधĪ और तटीय िविनयमन जोन अिधसूचना, 2011 एवं पयाϕवरणीय Oभाव आकलन अिधसूचना, 2006 सिहत उसके अधीन बने िनयमĪ और वन (संरϓण ) अिधिनयम, 1980 (1980 का 69), भारतीय वन अिधिनयम, 1927 (1927 का 16), वयजीव (संरϓण ) अिधिनयम, 1972 (1972 का 53) सिहत अय लागू िनयमĪ तथा उनमĞ Ƙकए गए संशोधनĪ के अनुसार शािसत हĪगे और नीचे दी गई सारणी मĞ िविनƠदϕƍ रीित से िविनयिमत हĪगे, अथाϕत्:-

(ख) खनन संƘ;याएं, माननीय उŔतम यायालय कƙ Ɨरट यािचका (िसिवल) सं. 1995 का 202 टी.एन. गौडाबमϕन िथďमूलपाद बनाम भारत संघ के मामले मĞ आदेश तारीख 4 अगत, 2006 और Ɨरट यािचका (सी) सं. 2012 का 435 गोवा फाउंडेशन बनाम भारत संघ के मामले मĞ तारीख 21 अOैल, 2014 के आदेश के अनुसरण मĞ Oचालन होगा ।

2. Oदूषण (जल , वायु, मृदा, विन पाƗरिथितकƙ संवेदी जोन मĞ कोई नया उźोग लगाने और वतϕमान आƘद) उपž करने वाले उźोगĪ कƙ Oदूषणकारी उźोगĪ का िवतार करने कƙ अनुमित नहĕ होगीः थापना । जब तक Ƙक इस अिधसूचना मĞ िविनƠदϕƍ न हो, पाƗरिथितकƙ संवेदी जोन मĞ फरवरी, 2016 मĞ कĞLीय Oदूषण िनयंJण बोडϕ ůारा जारी ƘदशािनदğशĪ मĞ Ƙकए गए उźोगĪ के वगĖकरण के अनुसार केवल गैर - Oदूषणकारी उźोगĪ कƙ थापना होगी। इसके अितƗरŎ , गैर-Oदूषणकारी कु टीर उźोगĪ को Oोसाहन Ƙदया जाएगा।

3. बड़ी ताप एवं जल िवźुत लागू िविधयĪ के अनुसार Oितिषŵ (अयथा उपबंिधत के िसवाय) हĪगे। पƗरयोजनाĸ कƙ थापना । 4. Ƙकसी पƗरसंकटमय पदाथϕ का Oयोग लागू िविधयĪ के अनुसार Oितिषŵ (अयथा उपबंिधत के िसवाय) हĪगे। या उपादन या Oसंकरण । 5. Oाकृितक जल िनकायĪ या भूिम ϓेJ लागू िविधयĪ के अनुसार Oितिषŵ (अयथा उपबंिधत के िसवाय) हĪगे। मĞ अनुपचाƗरत बिहZावĪ का िनसारण । 6. नई आरा िमलĪ कƙ थापना। पाƗरिथितकƙ संवेदी जोन के भीतर नई और िवźमान आरा िमलĪ का ¹Hkkx IIµ[k.M 3(ii)] Hkkjr dk jkti=k % vlk/kj.k 9

िवतार अनुϔात नहĕ होगा । 7. Ĳट भŝĪ कƙ थापना करना। लागू िविधयĪ के अनुसार Oितिषŵ (अयथा उपबंिधत के िसवाय) हĪगे ।

8. जलावन लकड़ी का वािणिϤयक लागू िविधयĪ के अनुसार Oितिषŵ (अयथा उपबंिधत के िसवाय) हĪगे । उपयोग । 9. सतही और भूजल का वािणिϤयक लागू िविधयĪ के अनुसार Oितिषŵ (अयथा उपबंिधत के िसवाय) हĪगे । Oयोग एवं िनकषϕण ।

खखख.ख...िविनयिमत Ƙ;याकलाप 10. होटलĪ और Ɨरजॉटϕ कƙ वािणिϤयक पाƗरिथितकƙ पयϕटन Ƙ;याकलापĪ हेतु लघु अथायी संरचनाĸ के थापना । िनमाϕण के िसवाय , संरिϓत ϓेJ कƙ सीमा से एक Ƙकलोमीटर के भीतर या पाƗरिथितकƙ संवेदी जोन कƙ सीमा तक, इनमĞ जो भी अिधक िनकट हो, नए वािणिϤयक होटलĪ और Ɨरजॉटϕ कƙ थापना अनुϔात नहĕ होगी : परंतु, संरिϓत ϓेJ कƙ सीमा से एक Ƙकलोमीटर बाहर या पाƗरिथितकƙ संवेदी जोन कƙ सीमा तक, पयϕटन महायोजना और लागू ƘदशािनदğशĪ के अनुसार इनमĞ जो भी अिधक िनकट हो, सभी नए पयϕटन Ƙ;याकलाप करने या िवźमान Ƙ;याकलापĪ का िवतार करने कƙ अनुϔा होगी । 11. संिनमाϕण Ƙ;याकलाप । (क) संरिϓत ϓेJ कƙ सीमा से एक Ƙकलोमीटर के भीतर या पाƗरिथितकƙ संवेदी जोन कƙ सीमा तक , इनमĞ जो भी अिधक िनकट हो, Ƙकसी भी Oकार के नये वािणिϤयक संिनमाϕण कƙ अनुϔा नहĕ होगी:

परंतु थानीय लोगĪ को अपनी आवास स बधी िनƄ िलिखत आवयकताĸ को पूरा करने के िलए , पैरा =ाफ 3 के उप-पैरा =ाफ (1) मĞ सूचीबŵ Ƙ;याकलापĪ सिहत अपने Oयोग के िलए , अपनी भूिम मĞ भवन उप-िविधयĪ के अनुसार , संिनमाϕण करने कƙ अनुϔा होगी ।

परतु गैर –Oदूषणकारी लघु उźोगĪ से संबंिधत संिनमाϕण Ƙ;याकलाप लागू िनयमĪ और िविनयमĪ, यƘद कोई हĪ , के अनुसार सϓम Oािधकारी कƙ पूवϕ अनुमित से िविनयिमत Ƙकए जाएंगे और वे यूनतम हĪगे । (ख) एक Ƙकलोमीटर ϓेJ से आगे ये आंचिलक महायोजना के अनुसार िविनयिमत हĪगे ।

12. गैर Oदूषण कारी लघु उźोग। फरवरी, 2016 मĞ केLीय Oदूषण िनयंJण बोडϕ ůारा जारी उźोगĪ के वगĖकरण के अनुसार गैर -Oदूषणकारी उźोग तथा अपƗरसंकट मय लघु और सेवा उźोग, कृिष, पुप कृिष, बागबानी या कृिष आधाƗरत उźोग, जो पाƗरिथितकƙ संवेदी जोन से देशी सामि=यĪ से उपाद बनाते हġ, सϓम Oािधकारी ůारा अनुϔात हĪगे।

13. वृϓĪ कƙ कटाई । (क) राϤय सरकार के सϓम Oािधकारी कƙ पूवϕ अनुमित के िबना वन भूिम या सरकारी या राजव या िनजी भूिम पर वृϓĪ कƙ कटाई नहĕ होगी ।

(ख) वृϓĪ कƙ कटाई कĞLीय या संबंिधत राϤय के अिधिनयम या उसके अधीन बनाए गए िनयमĪ के उपबंधĪ के अनुसार िविनयिमत होगी । 10 THE GAZETTE OF INDIA : EXTRAORDINARY [P ART II—SEC . 3(ii)]

14. वन उपादĪ और गैर काƏ वन लागू िविधयĪ के अधीन िविनयिमत हो गा । उपादĪ का सं=हण ।

15. िवźुत और संचार टॉवर लगाने, लागू िविधयĪ के अधीन िविनयिमत होगा । (भूिमगत केबल िबछाने को तार-िबछाने तथा अय बुिनयादी बढ़ावा Ƙदया जाएगा )। ढांचे कƙ Ɔवथा । 16. नागƗरक सुिवधाĸ सिहत बुिनयादी लागू िविधयĪ के अनुसार यूनीकरण उपायĪ िनयम और िविनयमन और ढांचा। उपल ध ƘदशािनदğशĪ के साथ Ƙकए जाएंगे। 17. िवźमान सड़कĪ को चौड़ा करना, लागू िविधयĪ के अनुसार यूनीकरण उपायĪ िनयम और िविनयमन और उहĞ सुदृढ बनाना और नई सड़कĪ उपल ध ƘदशािनदğशĪ के साथ Ƙकए जाएंगे। का िनमाϕण। 18. पयϕटन से संबंिधत अय Ƙ;याकलाप लागू िविधयĪ के अधीन िविनयिमत हो गा । जैसे Ƙक पाƗरिथितकƙ संवेदी जोन ϓेJ के ऊपर से गमϕ वायु के गु बारे, हेलीका टर , Gोन, माइ;ोलाइϧस उडाना आƘद। 19. पहाड़ी ढालĪ और नदी तटĪ का लागू िविधयĪ के अधीन िविनयिमत हो गा । संरϓण । 20. रािJ मĞ वाहन यातायात का लागू िविधयĪ के अधीन वािणिϤयक Oयोजन के िलए िविनयिमत होगा । संचलन ।

555.5... पाƗरिथितकƙ ---संवेदी-संवेदी जोनजोनजोन अिधसूचना कƙकƙकƙ िनगरानी केकेके िलएिलएिलए िनगरानी सिमित.सिमित.---- Oभावी िनगरानी के िलए Oदē शिŎयĪ का Oयोग करते ćए कĞLीय सरकार, पयाϕवरण (संरϓण) अिधिनयम, 1986 कƙ धारा 3 कƙ उपधारा (3) ůारा , एक िनगरानी सिमित का गठन करेगी जो िनƄिलिखत से िमलकर बनेगी, अथाϕत्:-

(vi) राϤय के OितिƏत संथान या िवƉिवźालय से पाƗरिथितकƙ मĞ एक िवशेषϔ सदय ;

(vii) िजला पयाϕवरण इंजीिनयर, तिमलनाडु राϤय Oदूषण िनयंJण बोडϕ, ईरोड सदय ;

(viii) तहसीलदार, पेĐनदुराई सदय ;

(ix) राϤय लोक िनमाϕण िवभाग का एक Oितिनिध सदय ;

(x) िजला वन अिधकारी, इरोड वन Oभाग सदय - सिचव।

6.6.6. िवचाराथϕ िवषय :::-:--- (1) िनगरानी सिमित इस अिधसूचना के उपबंधĪ के अनुपालन कƙ िनगरानी करेगी।

(3) पाƗरिथितकƙ संवेदी जोन मĞ भारत सरकार के त का लीन पयाϕवरण और वन मंJालय कƙ अिधसूचना सं. का.आ. 1533(अ), तारीख 14 िसतंबर, 2006 कƙ अनुसूची मĞ के अधीन सि मिलत Ƙ;याकलापĪ और इस अिधसूचना के पैरा 4 के अधीन सारणी मĞ यथा िविनƠदϕƍ Oितिषŵ गितिविधयĪ के िसवाय आने वाले ऐसे Ƙ;याकलापĪ कƙ दशा मĞ वातिवक िविनƠदϕƍ थलीय दशाĸ पर आधाƗरत िनगरानी सिमित ůारा संवीϓा कƙ जाएगी और उŎ अिधसूचना के उपबंधĪ के अधीन पूवϕ पयाϕवरण अनापिē लेने के िलए केLीय सरकार के पयाϕवरण , वन और जलवायु पƗरवतϕन मंJालय को िनƠदϕƍ कƙ जाएगी।

(4) इस अिधसूचना के पैरा 4 के अधीन सारणी मĞ यथा िविनƠदϕƍ Oितिषŵ Ƙ;याकलापĪ के िसवाय, भारत सरकार के तका लीन पयाϕवरण और वन मंJालय कƙ अिधसूचना संϞया का.आ. 1533(अ), तारीख 14 िसतंबर, 2006 कƙ अिधसूचना के अनुसूची के अधीन ऐसे Ƙ;याकलापĪ , िजहĞ सि मिलत नहĕ Ƙकया गया है, परंतु पाƗरिथितकƙ संवेदी जोन मĞ आते हġ, ऐसे Ƙ;याकलापĪ कƙ वातिवक िविनƠदϕƍ थलीय दशाĸ पर आधाƗरत िनगरानी सिमित ůारा संवीϓा कƙ जाएगी और उसे संबŵ िविनयामक OािधकरणĪ को िनƠदϕƍ Ƙकया जाएगा ।

(5) िनगरानी सिमित का सदय -सिचव या संबŵ उपायुϝ त या संबंिधत उपायुŎ ऐसे ƆिŎ के िवĐŵ , जो इस अिधसूचना के Ƙकसी उपबंध का उलंघन करता है, पयाϕवरण अिधिनयम कƙ धारा 19 के अधीन पƗरवाद दायर करने के िलए सϓम होगा।

(6) िनगरानी सिमित संबंिधत िवभागĪ के OितिनिधयĪ या िवशेषϔĪ , औźोिगक संघĪ के OितिनिधयĪ या संबंिधत पϓĪ को, Oयेक मामले मे आवयकता के अनुसार , अपने िवचार-िवमशϕ मĞ सहायता के िलए आमंिJत कर सकेगी ।

(7) िनगरानी सिमित Oयेक वषϕ 31 माचϕ कƙ िथित के अनुसार अपनी वाƞषϕक कारϕवाई Ɨरपोटϕ राϤय के मुϞय वयजीव वाडϕन को, उपाबंध VVV मĞ Ƙदए गए OपJ के अनुसार , उस वषϕ कƙ 30 जून तक Oतुत करेगी ।

(8) केLीय सरकार का पयाϕवरण , वन और जलवायु पƗरवतϕन मंJालय िनगरानी सिमित को उसके कृयĪ के Oभावी िनवϕहन के िलए ऐसे िनदेश दे सकेगा जो वह उिचत समझे ।

7.7.7. इस अिधसूचना के उपबंधĪ को Oभावी बनाने के िलए कĞLीय सरकार और राϤ य सरकार, अितƗरϝ त उपाय, यƘद कोई हĪ, िविनƠदϕट कर स कĞ गी ।

MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 20th September, 2019 S.O. 3434(E).—The following draft of the notification, which the Central Government proposes to issue in exercise of the powers conferred by sub-section (1), read with clause (v) and clause (xiv) of sub-section (2) and sub- section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) is hereby published, as required under sub- rule (3) of rule 5 of the Environment (Protection) Rules, 1986, for the information of the public likely to be affected thereby; and notice is hereby given that the said draft notification shall be taken into consideration on or after the expiry of a period of sixty days from the date on which copies of the Gazette containing this notification are made available to the public; Any person interested in making any objections or suggestions on the proposals contained in the draft notification may forward the same in writing, for consideration of the Central Government within the period so specified to the Secretary, Ministry of Environment, Forest and Climate Change, Indira Paryavaran Bhawan, Jorbagh Road, Aliganj, New Delhi-110 003, or send it to the e-mail address of the Ministry at [email protected] Draft Notification WHEREAS, Vellode Bird Sanctuary is spread over an area of 0.77185 square kilometres and situated in between 11 015’16.7 N latitude, 77 039’22.9 E longitude Vadamugam Vellode village, Periyakulam lake, Perundurai Taluk of Erode district in the State of Tamil Nadu ; AND WHEREAS, Vellode Bird Sanctuary has been categorized as a breeding habitat of birds and is listed among the top ten breeding sites within the State having partially submerged trees. Species of wetland bird that breed in the Sanctuary are little cormorant ( Microcarbo niger ), Indian shag ( Phalacrocorax fuscicollis ), great cormorant (Phalacrocorax carbo ), darter ( Anhingidae ), little egret ( Egretta garzetta ), grey heron ( Ardea cinerea ), purple heron 24 THE GAZETTE OF INDIA : EXTRAORDINARY [P ART II—SEC . 3(ii)]

(Ardea purpurea ), median egret (Ardea intermedia ) and cattle egret ( Bubulcus ibis ), etc. The flagship species of Vellode Bird Sanctuary are the great cormorant, grey heron and darter, the numbers of which are reported to be declining from the Sanctuary. The great cormorant breeds only in ten sites of the State and is common in Vellode Bird Sanctuary making it an important habitat for the conservation of this species. Further the diversity of Vellode Bird Sanctuary is enhanced by a large number of terrestrial birds found here; AND WHEREAS, the major flora recorded from the Sanctuary are thuthi ( Abutilon indicum), sikakkai ( Acacia arabica), kruvel ( Acacia nilotica), kuppaimeni ( Acacia nilotica ), kuppaimeni ( Acalypha indica), nayuruvi ( Achyranthes aspera), perumpoolai ( Aerva javanica), siru poolai poo ( Aerva lanata.), poolai poo ( Aerva persica), kasu kodi (Alysicarpus monilifer), mookarattai ( Boerhavia diffusa), panai ( Borassus flabellifer ), mudakkathan ( Cardiospermum halicacabum , kaattu pirandai (Cayratia trifolia ), kozhi poo (Celosia argentea), vakkanai (Celtis philippensis), kalluviri (Celtis wightii), pirandai (Cissus quadrangularis), vaelai chedi (Cleome gynandra), naikkaduku (Cleome pentaphylla), sangu poo (Clitoria ternatea), kilukiluppai (Crotalaria verrucosa), mookuthi poondu ( Cyanthillium cinereum ), uttamani (Daemia extensa.), sirupullati ( Desmodium triflorum ), thoyyakeerai (Digera muricate) karisalangkani (Ecliptra prostrata ), Vallarai ( Enicostema littorale ), sarkarai kolli ( Gymnema sylvestre ), trittavu ( Ocimum sanctum ), thulasi (Ocimum tenuiflorum ), oosi paalai ( Oxystelma esculentum ), viza chei ( Parthenium hysterophorus), sidha mutti ( Pavonia zeylanica) , veli paruthi ( Pergularia daemia .), sodakku thakkali (Physalis minima), kodukkapuli ( Pithecellobium dulce), punnai ( Pongamia pinnata) , seemai mull ( Prosopis chilensis ), aadai otti ( Pupalia lappacea ), grandhi nayakam ( Ruellia patula ), etc.; AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of Vellode Bird Sanctuary which are specified in paragraph 1 as Eco-sensitive Zone from ecological, environmental and biodiversity point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone; NOW, THEREFORE, in exercise of the powers conferred by sub-section (1) and clauses (v) and (xiv) of sub- section (2) and sub-section (3) of Section 3 of the Environment (Protection) Act 1986 (29 of 1986) (hereafter in this notification referred to as the Environment Act) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent of uniform 0.5 kilometre around the boundary of Vellode Bird Sanctuary, in Erode district in the State of Tamil Nadu as the Eco-sensitive Zone (hereafter in this notification referred to as the Eco-sensitive Zone) details of which are as under, namely: - 1. Extent and boundaries of Eco-sensitive Zone. – (1) The Eco-sensitive Zone shall be to an extent of uniform 0.5 kilometre around the boundary of Vellode Bird Sanctuary and the area of the Eco-sensitive Zone is 3.40 square kilometres. (2) The boundary description of Vellode Bird Sanctuary and its Eco-sensitive Zone is appended in Annexure-I. (3) The maps of the Vellode Bird Sanctuary demarcating Eco-sensitive Zone along with boundary details and latitudes and longitudes are appended as Annexure-IIA, Annexure-IIB, Annexure-IIC and Annexure-IID. ¹Hkkx IIµ[k.M 3(ii)] Hkkjr dk jkti=k % vlk/kj.k 25

(4) Lists of geo-coordinates of the boundary of Vellode Bird Sanctuary and Eco-sensitive Zone are given in Table A and Table B of Annexure III. (5) The list of villages falling in the proposed Eco-sensitive Zone along with their geo co-ordinates at prominent points is appended as Annexure-IV. 2. Zonal Master Plan for Eco-sensitive Zone.- (1) The State Government shall, for the purposes of the Eco-sensitive Zone prepare a Zonal Master Plan within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval of the competent authority of State. (2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any. (3) The Zonal Master Plan shall be prepared in consultation with the following Departments of the State Government, for integrating the ecological and environmental considerations into the said plan:- (i) Environment; (ii) Forest and Wildlife; (iii) Agriculture; (iv) Revenue; (v) Urban Development; (vi) Tourism; (vii) Rural Development; (viii) Irrigation and Flood Control; (ix) Municipal; (x) Panchayat Raj; (xi) Public Works Department; (xii) Highways; and (xiii) Tamil Nadu State Pollution Control Board. (4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly. (5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention. (6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies with supporting maps giving details of existing and proposed land use features. (7) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and adhere to prohibited and regulated activities listed in the Table in paragraph 4 and also ensure and promote eco-friendly development for security of local communities’ livelihood. (8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan. (9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification. 3. Measures to be taken by the State Government .- The State Government shall take the following measures for giving effect to the provisions of this notification, namely:- (1) Land use.– (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or residential or industrial activities: 26 THE GAZETTE OF INDIA : EXTRAORDINARY [P ART II—SEC . 3(ii)]

Provided that the conversion of agricultural and other lands, for the purpose other than that specified at part (a) above, within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of Central Government or State Government as applicable and vide provisions of this Notification, to meet the residential needs of the local residents and for activities such as:- (i) widening and strengthening of existing roads and construction of new roads; (ii) construction and renovation of infrastructure and civic amenities; (iii) small scale industries not causing pollution; (iv) cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and (v) promoted activities given under paragraph 4: Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007): Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change: Provided also that the correction of error shall not include change of land use in any case except as provided under this sub-paragraph. (b) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities. (2) Natural water bodies.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas. (3) Tourism or Eco-tourism.- (a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone. (b) The Eco-Tourism Master Plan shall be prepared by the State Department of Tourism in consultation with State Departments of Environment and Forests. (c) The Tourism Master Plan shall form a component of the Zonal Master Plan. (d) The Tourism Master Plan shall be drawn based on the study of carrying capacity of the Eco-sensitive Zone; (e) The activities of eco-tourism shall be regulated as under, namely: - (i) new construction of hotels and resorts shall not be allowed within one kilometre from the boundary of the Bird Sanctuary or upto the extent of the Eco-sensitive Zone whichever is nearer: Provided that beyond the distance of one kilometre from the boundary of the Bird Sanctuary till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for eco-tourism facilities as per Tourism Master Plan; (ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism, eco-education and eco- development. (iii) until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel, resort or commercial establishment construction shall be permitted within Eco-sensitive Zone area. (4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be ¹Hkkx IIµ[k.M 3(ii)] Hkkjr dk jkti=k % vlk/kj.k 27

identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan. (5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part of the Zonal Master Plan. (6) Noise pollution. - Prevention and control of noise pollution in the Eco-sensitive Zone shall be complied in accordance with the provisions of the Noise Pollution (Regulation and Control) Rules, 2000 under the Environment Act. (7) Air pollution.- Prevention and control of air pollution in the Eco-sensitive Zone shall be compiled in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder. (8) Discharge of effluents.- Discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environment Act and the rules made thereunder or standards stipulated by State Government whichever is more stringent. (9) Solid wastes.- Disposal and Management of solid wastes shall be as under:- (a) the solid waste disposal and management in the Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8 th April, 2016; the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone; (b) safe and Environmentally Sound Management (ESM) of Solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-sensitive Zone. (10) Bio-Medical Waste.– Bio Medical Waste Management shall be as under:- (a) the Bio-Medical Waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio- Medical Waste Management, Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R 343 (E), dated the 28 th March, 2016. (b) safe and Environmentally Sound Management of Bio-Medical Wastes in conformity with the existing rules and regulations using identified technologies may be allowed within the Eco-sensitive Zone. (11) Plastic waste management.- The plastic waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18 th March, 2016, as amended from time to time . (12) Construction and demolition waste management.- The construction and demolition waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29 th March, 2016, as amended from time to time. (13) E-waste.- The e - waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change, as amended from time to time. (14) Vehicular traffic.– The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder. 28 THE GAZETTE OF INDIA : EXTRAORDINARY [P ART II—SEC . 3(ii)]

(15) Vehicular pollution.- Prevention and control of vehicular pollution shall be incompliance with applicable laws and efforts shall be made for use of cleaner fuels. (16) Industrial units.– (i) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be permitted to be set up within the Eco-sensitive Zone. (ii) Only non-polluting industries shall be allowed within Eco-sensitive Zone as per the classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, unless so specified in this notification, and in addition, the non-polluting cottage industries shall be promoted. (17) Protection of hill slopes.- The protection of hill slopes shall be as under:- (a) the Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted; (b) construction on existing steep hill slopes or slopes with a high degree of erosion shall not be permitted. 4. List of activities prohibited or to be regulated within Eco-sensitive Zone.- All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment Act and the rules made there under including the Coastal Regulation Zone, 2011 and the Environmental Impact Assessment Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act 1972 (53 of 1972), and amendments made thereto and be regulated in the manner specified in the Table below, namely:-

Setting of industries causing pollution New industries and expansion of existing polluting industries in (Water, Air, Soil, Noise, etc.). the Eco-sensitive Zone shall not be permitted: Provided that non-polluting industries shall be allowed within Eco-sensitive Zone as per classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, unless otherwise specified in this notification and in addition the non-polluting cottage industries shall be promoted. 3. Establishment of major hydro-electric Prohibited (except as otherwise provided) as per the applicable project. laws. 4. Use or production or processing of any Prohibited (except as otherwise provided) as per the applicable hazardous substances. laws. 5. Discharge of untreated effluents in natural Prohibited (except as otherwise provided) as per the applicable water bodies or land area. laws. 6. Setting up of new saw mills. Construction activities. (a) New commercial construction of any kind shall not be permitted within one kilometer from the boundary of the protected area or upto extent of the Eco-sensitive Zone, whichever is nearer: Provided that, local people shall be permitted to undertake construction in their land for their use including the activities mentioned in sub-paragraph (1) of paragraph 3 as per building bye-laws to meet the residential needs of the local residents. Provided further that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any. (b) Beyond one kilometer it shall be regulated as per the Zonal Master Plan. 12. Small scale nonpolluting industries. Nonpolluting industries as per classification of industries issued by the Central Pollution Control Board in February, 2016 and non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Eco-sensitive Zone shall be permitted by the competent Authority. 13. Felling of trees. (a) There shall be no felling of trees in the forest or Government or revenue or private lands without prior permission of the Competent Authority in the State Government. (b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made thereunder. 14. Collection of Forest produce or Non-Timber Regulated as per the applicable laws. Forest produces. 15. 5. Monitoring Committee for Monitoring the Eco-sensitive Zone Notification.- For effective monitoring of the provisions of this notification under sub-section (3) of section 3 of the Environment (Protection) Act, 1986, the Central Government hereby constitutes a Monitoring Committee, comprising of the following, namely:-

Constituent of the Monitoring Committee Designation (i) District Collector, Erode Chairman, ex officio (ii) Project Director, DRDA, Erode Member; (iii) Revenue Divisional Officer, Erode Member; A representative of Non-governmental Organisation working in the field of (iv) Member; wildlife conservation to be nominated by the State Government (v) An expert in Biodiversity nominated by the State Government Member; (vi) One expert in Ecology from reputed institution or university of the State Member;

District Environmental Engineer, Tamil Nadu State Pollution Control (vii) Member; Board, Erode

(viii) Tahsildar, Perundhurai Member;

(ix) A representative from State Public Works Department Member; (x) District Forest Officer, Erode Forest Division Member-Secretary.

6. Terms of reference. – (1) The Monitoring Committee shall monitor the compliance of the provisions of this notification. (2) The tenure of the Monitoring committee shall be for three years or till the re-constitution of the new Committee by the State Government and subsequently the Monitoring Committee shall be constituted by the State Government. (3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14 th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification. (4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533 (E), dated the 14 th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities. (5) The Member-Secretary of the Monitoring Committee or the concerned Deputy Commissioner(s) shall be competent to file complaints under section 19 of the Environment Act, against any person who contravenes the provisions of this notification. (6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis. (7) The Monitoring Committee shall submit the annual action taken report of its activities as on the 31 st March of every year by the 30 th June of that year to the Chief Wildlife Warden in the State as per proforma appended at Annexure V. (8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions. 32 THE GAZETTE OF INDIA : EXTRAORDINARY [P ART II—SEC . 3(ii)]

7. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification. 8. The provisions of this notification shall be subject to the orders, if any passed or to be passed by the Hon’ble Supreme Court of India or High Court or the National Green Tribunal.
