TERMS AND CONDITIONS OF ENTRY FOR RADIO CLYDE’S CASH FOR KIDS SCHOOLS CHALLENGE 2020 (the “Competition”)

These terms and conditions should be read together with and are in addition to the Promoter’s (as defined below) general competition terms and conditions available online at https://www.bauerlegal.co.uk/competition-general- terms-and-conditions-20170529/ and the fundraising terms and conditions available at http://cfk.bauermedia.co.uk/general-fundraising-terms (together the “Rules”).

By entering the Competition, applicants agree to be bound by these Rules.

This Competition is promoted by Limited (the “Promoter”) (on behalf of Radio Clyde’s Cash for Kids) whose registered office is at Media House, Peterborough Business Park, Lynch Wood, Peterborough, United Kingdom, PE2 6EA and registered under company number 01394141 and its affiliated charity, Radio Clyde’s Cash for Kids (the “Charity”), which is a Scottish registered charity (registered charity no. SC0 03334 and registered company number SC365231). The Rules are available on request from the Promoter and may be downloaded from its website at www.clyde1.com/cashforkids (the “Website”).

The Competition is open to UK Schools but excludes employees of the Promoter and its associated companies, their immediate families and anyone else professionally connected with the Competition. Previous Schools who have taken part are eligible to enter the Competition again.

Entries which are not in accordance with the Rules will not be valid and the Promoter reserves the right in its sole discretion, to disqualify such entries at any time during the Competition. Applicants found to be breaking the Rules will be disqualified. By entering the Competition, applicants agree to be bound by these Rules and any other terms and conditions that are notified to the applicants at the briefing day or otherwise.

1. THE CHALLENGE

1.1 Radio Clyde’s Cash for Kids is looking for local schools who are in need of a helping hand with funding.

1.2 Each school that takes part in the Competition (a “Participating School”) shall use their best endeavours to raise money for Cash for Kids between 5pm on Thursday 24th September 2020 and 5pm on Friday 23rd October 2020 (the “Fundraising Period”), with a fundraising target of £2,000 (the “Target”).

1.3 The top three Participating Schools that meet the Target and raise the most money overall will win the following top up grants (the “Prize”):

• 1st Top Fundraising School will receive a £5,000 top up grant and 100% of their fundraising total. • 2nd Top Fundraising School will receive a £2,000 top up grant and 100% of their fundraising total. • 3rd Top Fundraising School will receive a £1,000 top up grant and 100% of their fundraising total.

1.4 For example: If you raise £5,000 and this is the highest fundraising amount out of all Participating Schools, you will receive the £5,000 top up grant for the highest fundraising total along with a funding grant of 100% of the amount you raised. In this example a £10,000 grant would be awarded to your School. 1.5 The remaining schools that did not win the prize at (clause 1.3 above) (whether they reach the Target or not) will receive 50% of their fundraising total back as a grant from the Charity. For example, if you raise £3,000 and you are not the 1st, 2nd, or 3rd Top Fundraising School, you will receive a funding grant of 50% of the amount you raised i.e. £1,500.

1.6 Also, there are 6 x £250 awards (the “Awards”) up for grabs to the school that demonstrates the best:

• Social Media interaction (tagging Radio Clyde Cash for Kids on twitter, Facebook and Instagram) • PR exposure (coverage in press or other media) • Creative fundraising idea • Team work • Star Pupil x 2 (nominated by their school for going over and above for the challenge)

1.7 It is the responsibility of the Participating School to adhere to Government regulations on social distancing and outdoor social gathering rules which are subject to change from time to time. We accept no responsibility for the Participating School’s failure to do so.

2 ENTRY CRITERIA

2.1 Radio Clyde Cash for Kids exists solely to help children up to and including the age of 16.

2.2 Schools applying for the Competition must be applying to help children in the Radio Clyde broadcast area ( & the West of Scotland).

2.2 Each school that wishes to enter the Competition must nominate a representative (the “Representative”) who will complete the registration form (details in section 3 below) and who will be responsible for managing their school’s fundraising page.

2.3 To enter the Competition, the Representative must be entering on behalf of a school that:

(a) Is within the Radio Clyde broadcast area (for the avoidance of doubt, this means they must have a postcode beginning [PA, G, ML) (b) Intends to spend the grant received through the Competition in connection with helping children under 16 years old who are disadvantaged, disabled or ill; and (c) Agrees to use the Prize, Top-Up or Award (if they win one or more of these) for a cause in line with the criteria in (b) above.

2.4 Details of things Cash for Kids will not fund are as follows:

(a) Salaries/volunteer expenses (b) Furniture that will not be used specifically by children (c) General operational costs (d) Rent/rates for premises (e) CIs (Community Interest Companies)

2.5 Employees of the Promoter and its associated companies, their immediate families and anyone else professionally connected to this Competition may not enter this Competition.

2.6 Previous fundraisers for the Charity are eligible to enter the Competition.

2.7 All Participating Schools consent to publication of their names and photographs on the Website and agree for copies of the same to be used and stored by the Promoter, in any medium, for exploitation in any and all media for promotional purposes (please also see the intellectual property clause at 6.10 below).

2.8. Participating Schools may be asked to take part in publicity for the challenge and warrant that whilst they are participating in any publicity they will not say anything or behave in any way which could be considered inappropriate or offensive, which might cause harm to the Promoter or to the reputation of the Promoter’s group of companies, or which might otherwise bring the Promoter or the Promoter’s group of companies into disrepute. Should any Participating School breach this warranty then the Promoter reserves the right not to give any grant to the Participating School and to suspend use of the fundraising page set up for the Participating School.

3 HOW TO ENTER

3.1 Registration for the Competition opens at 9am on Monday 31st August 2020 (the “Opening Time”) and closes at 5pm on Friday 18th September 2020 (the “Closing Time”), but please note that fundraising cannot start until the beginning of the Fundraising Period (Thursday 24th September 2020). Any entries made before the Opening Time or after the Closing Time will not be eligible.

3.2 Representatives can enter on behalf of a Participating Schools which is either a primary / secondary / specialist school.

3.3 Representatives can enter their school into the Competition by completing and submitting a registration form online at www.clyde1.com/cashforkids.

3.4 The Fundraising Period begins at 5pm on Thursday 24 September 2020 and closes at 5pm on Friday 23 October 2020.

3.5 There should be only one Representative per Participating School, and only one entry will be accepted per Representative.

3.6 To be eligible to participate, Representatives must adhere to the Rules.

3.7 Representatives must complete the registration form and it is their responsibility to ensure that the information entered is correct and accurate. Incomplete registrations will not be accepted, and the Promoter shall not be responsible for any information which has not been entered correctly.

3.8 The Representatives will be responsible for ensuring parental permission has been secured for any children taking part in publicity in relation to the Competition or any element of the fundraising.

4 FUNDRAISING

4.1 Participating Schools must engage in fundraising initiatives and use their best endeavours to raise as much money for Cash for Kids as they can during the Fundraising Period (between Thursday 24th September 2020 to Friday 23rd October 2020) in accordance with the Rules.

4.2 Participating Schools must not deposit funds raised from events that occurred outside of these dates.

4.3 An online fundraising page will be created by the Promoter for each Participating School. Each Participating School must deposit all funds raised onto their fundraising page or into the Cash for Kids bank account by 5pm on Friday 23rd October 2020. Any funds not declared on the Participating Schools’ fundraising pages will not be valid and only the final total on the page and money banked with Cash for Kids will be taken into consideration for the Competition.

4.4 Whilst donations to the fundraising page may be eligible for Gift Aid, any additional amount raised though Gift Aid will not be taken into account when match funding or for the purposes of deciding which Participating School has raised the most money. Any Gift Aid claimed by Cash for Kids will remain with Cash for Kids to support our local grant giving. Participating Schools must spend all grants awarded by the Charity in line with the Rules.

4.5 After the Fundraising Period is complete additional funds will be awarded as follows:

• £250 will be awarded to the School with the most Social Media interaction (tagging Radio Clyde Cash for Kids on twitter, Facebook and Instagram) • £250 will be awarded to the School who gains the most PR exposure (in the press / other media) • £250 will be awarded to the School that has the most creative fundraising idea • £250 will be awarded to the School that illustrates the best team work • £250 x 2 will be awarded to the School/s Star Pupil for going over and above (nominated by the school and judged by the CFK team)

4.6 Further details on the criteria for the Awards will be given to the Participating Schools at the briefing day on Thursday 24th September 2020. To be eligible of receiving the above Awards, evidence must be submitted to [email protected] before 5pm on Friday 23rd October 2020 in the requested format (as explained at the briefing day).

4.7 In all fundraising efforts, Participating Schools must agree to abide by the Promoter’s fundraising terms and conditions which also form part of these Rules. Failure to abide by the Promoter’s fundraising terms and conditions may result in a Participating School being disqualified. All Participating Schools will receive a fundraising pack at the briefing day and further information on the Promoter’s fundraising guidelines.

4.8 All money submitted and banked by Participating Schools will be donated to Cash for Kids and is non- refundable, regardless of whether the particular Participating School wins or loses the Competition.

5 THE WINNER

5.1 The grant of money that each Participating School receives will be based on the total on each Participating School’s fundraising page along with monies paid into the Cash for Kids bank account and cash in hand by 5pm on Friday 23rd October 2020.

5.2 All Participating Schools will be required to complete a Cash for Kids grant application which must be accompanied by the most recently audited annual accounts of the organisation seeking the grant.

5.3 Participating Schools must be prepared to submit a report and receipts showing how the grant provided by the Charity was spent.

5.4 The winner of the £5,000 Prize will be the one Participating School who fundraises the most during the Fundraising Period (excluding Gift Aid donations, as explained above).

5.5 The winner of the £2,000 Prize will be the Participating School that raises the second highest amount during the Fundraising Period (excluding Gift Aid donations, as explained above).

5.6 The winner of the £1,000 Prize will be the Participating School that raises the third highest amount during the Fundraising Period (excluding Gift Aid donations, as explained above).

5.7 The Promoter has the right to withdraw one or more of the Top-Up grants if there are not three Participating Schools who meet the Target.

5.8 The Panel’s decision as to the winners of the 6 x £250 Awards will be final and no correspondence will be entered into in this regard. The panel have the right to withdraw an Award if they feel there is not a winner suitable to that category.

5.9 In the event that two or more Finalists have the same highest fundraising total the £5,000 grant will be split equally.

5.10 The Prize is subject to the Cash for Kids Board of Trustees approving the grant application, and the Board of Trustees reserves the right to deny the grant.

6. OTHER CONDITIONS

6.1 The Promoter is not responsible for any:

(a) Telephone, computer, hardware, software, programming or network malfunction or error which prevents Representatives or Participating Schools from submitting their entry properly;

(b) Communication disruption or other forces beyond the reasonable control of the Promoter, including disruption related to internet traffic, virus, bug, or non-authorised intervention; or

(c) Damage caused by a computer virus or otherwise arising in any computer as a result of a Representative or Participating Schools access to the Website.

If such malfunction, error, disruption, or damage occurs, impairs the administration, security, fairness, integrity, or proper participation in the Competition, the Promoter may, in its sole discretion, suspend or terminate the Competition by posting a notice on the Website without any liability to Participating Schools. Entries made through any robotic, automatic, mechanical, programmed or similar entry duplication method are void. Entries will be deemed made by the authorised account holder of the e-mail address submitted at the time of entry. The authorised account holder is the natural person who is assigned to the e-mail address by an internet access provider, on-line service provider, or other organisation that is responsible for assigning e-mail addresses or the domain associated with the e-mail address.

6.2 The Promoter reserves the right to cancel, amend, terminate or temporarily suspend this Competition in the event of any unforeseen circumstances outside its reasonable control, with no liability to any Participating Schools, Representatives or third parties.

6.3 Only entries received in accordance with these Rules will be accepted.

6.4 The Promoter is not responsible for late delivery or unsatisfactory quality of the Prize, Top-Up, Award or grant and will not be liable if the Prize, Top-Up, Award or grant cannot be taken up by the Winner.

6.5 The Promoter is not responsible for any costs associated with entering this Competition (or enjoyment of the Prize or any aspect of it) including but without limitation, travel costs or costs associated with accessing the internet.

6.6 Other than for death or personal injury resulting from its negligence and so far as permitted by law, the Promoter hereby excludes all liability for any loss, damage, cost and expense, whether direct or indirect, howsoever caused in connection with the Competition or any element of the Prize.

6.7 This Competition and the Rules are governed by Scottish Law and the courts of Scotland shall have exclusive jurisdiction over any dispute arising out of or in connection with this Competition or the Rules.

6.8 Complaints about this Competition may be made in writing (including via email) to [email protected] or in writing to Grace Reilly, Radio Clyde Cash for Kids, 3 South Avenue, Business, Clydebank, G81 2RX. A complaint will not be considered if it is made more than 14 days after the date the Winner is announced.

6.9 Data protection. Applicant’s names, email addresses, addresses and telephone numbers will be collected and used for the purposes of the Competition. Your details may remain stored after the Competition has ended but will not be used for marketing unless you have ticked an opt-in box on entry. 6.10 Intellectual property. By entering this Competition, you are consenting to the Charity use of any materials produced by you in relation to the Competition (and have obtained all necessary third party consent from anyone appearing in, or involved in, producing such materials) to publicise this Competition. This means that we may use all names, images, descriptions, photographs video footage, and other information, which you have submitted in any media in relation to the Competition, without paying you and without any time restriction. You also agree that we may film, record or photograph you in connection with the Competition. We will own these films, recordings or photographs and we may use them publicly, including on the internet, for our radio broadcasts and/or for any promotional purposes. You will also (and will have obtained consent from anyone appearing in, or who has been involved in producing materials related to the Competition) have waived any moral rights or right to payment that you may have had.
