Summary Of Refusal

The proposal by reason of its height, width, bulk and overall design is unacceptable within the street-scene resulting in a poor relationship with the neighbouring properties in terms of design and scale. As such the proposal is contrary to policies DBE2 of the Adopted Local Plan 1998, Policies DM9 and DM10 of the SVLP 2017 and the NPPF 2019. The proposed basement by reason of its overall size and design with large light well is not a subordinate addition to the main house and is at odds with the character of the proposed building and surrounding area contrary to policy DM12 of the SVLP 2017 and the NPPF 2019. The proposed rear first floor balcony and second floor terrace results in an unacceptable loss of privacy (actual and perception) to the occupiers of neighbouring properties to the detriment of the amenity currently enjoyed by these properties contrary to Policy DBE9 of the Adopted Local Plan and Alterations and to Local Plan (Submission Version) 2017 Policy DM9 which are consistent with the NPPF.

Summary Of Refusal

The proposal would cause undue harm to the special significance of the Listed Building, contrary to Policies HC10 of the Adopted Local Plan and Alterations (2008) and DM7 of the Epping Forest District Local Plan (Submission Version) 2017. It is recommended that Listed Building Consent is refused. Due to the lack of sufficient information it has not been possible for a full assessment of how the scheme would affect the historic fabric of the listed building. The proposal would be contrary to Local Policies HC10 and DM7 of the Adopted Local Plan and Alterations 2006 and the Epping Forest District Local Plan (Submission Version) 2017.

Summary Of Refusal

The proposal represents a cramped, excessive form of development within a limited site resulting in a poor layout of Unit 1 in particular due to poor amenity to the living area and garden, out of character with the pattern and form of development in the locality and resulting in a poor standard of amenity for future occupiers. The proposal is therefore contrary to policies DBE1, DBE5, DBE8 and DBE9 of the adopted Local plan and Alterations, policies DM9 and DM10 of the Local Plan Submission Version 2017, and the NPPF. The proposal, by reason of its design, scale, proximity and site level differences, would have an overbearing and detrimental impact on the amenities of the adjoining dwellings to its rear at 22 - 26 Gravel Lane. The proposal is therefore contrary to policies CP2, DBE2 and DBE9 of the adopted Local Plan and Alterations (1998 & 2006), policies DM9 and DM10 of the Epping Forest District Local Plan (Submission Version) 2017 and the NPPF 2019. By reason of its excessive height and siting the proposed raising of the roof ridge height would be incongruous to the street-scene and detrimental to the character and appearance of the wider area. Comments of the Parish Council

The Council STRONGLY OBJECTS to this application, because the proposed change of use, is highly inappropriate for this locality and Vicarage Lane does not have the capacity to cope with the likely increases in traffic. Further, this council wishes to advice the planning authority that a large Marquee has already been erected on the site, at which social gatherings have previously occurred.

Summary Of Refusal

The proposed development would constitute inappropriate development harmful to the Green Belt and would also harm the openness of the Green Belt and conflict with its fundamental purpose. No very special circumstances have been put forward that clearly outweigh the harm from the proposal. Therefore, the development is contrary to the guidance contained within the National Planning Policy Framework, policies GB2A and GB7A of the Adopted Local Plan, with policy DM4 of the Epping Forest Local Plan (Submission Version) 2017 and the Green Belt objectives of the National Planning Policy Framework. Music and noise generated by use of the marquee for social functions and weddings is likely to cause significant nuisance, to residents in the nearby Puckeridge Cottages and properties on Vicarage Lane, and in this context a marquee provides insufficient insulation to suppress noise and amplified music. Additional noise will be generated by the significant traffic activity and noise and disturbance associated with these movements. In addition, insufficient information has been provided as to how general noise and disturbance on the site would be controlled. Retention of this marquee and change of use to a function venue would therefore be contrary to policies DBE9 and RST1 of the adopted Local Plan and Alterations, Policy DM9 and DM21 of the Local Plan Submission Version, 2017 and contrary to the National Planning Policy Framework. The proposed development is poorly located with regard to access by pedestrians, cyclists or by public transport. Consequently, the proposed level of parking provision for the use is not considered to be sufficient and could lead to vehicles parking and manoeuvring dangerously on the highway, to the detriment of highway safety. As such, the proposal is not considered to be sustainable development and is contrary to policies CP1, CP3, ST1, ST2 and ST4 of the Adopted Local Plan (1998/2006), policy SP1 and T1 of the Local Plan Submission (2017) and the policies of the National Planning Policy Framework. The proposed use will intensify the use of an existing access that has insufficient visibility for the speed of the road. The lack of such visibility would result in an unacceptable degree of hazard to all road users to the detriment of highway safety. Therefore, this proposal is contrary to the aims and objectives contained within the Highway Authority's Development Management Policies, adopted as County Council Supplementary Guidance in February 2011, policy ST4 & ST6 of the Local Plan and policy T1 of the Local Plan Submission Version 2017. The applicant has failed to demonstrate that the development will not have an adverse impact on the Epping Forest Special Area of Conservation in terms of air pollution, or that suitable mitigation for such impacts will be provided. The development is therefore contrary to Policies CP1 and CP6 of the Epping Forest Local Plan, Policies DM2, and DM22 of the Epping Forest District Local Plan Submission Version 2017 and the requirements of the Habitats Regulations 2017.
