Suffering: Miss Quashie says she has gone through 'three years of hell' since mounting her court claim

A former £200,000-a-year Stringfellows lap dancer has won a crucial court ruling in her landmark legal battle against the Covent Garden gentlemen’s club.

Nadine Quashie claims that club owner Peter Stringfellow exploited strippers by forcing them to give his friends free nude dances.

The 29-year-old from Greenford, west , also alleges the club took up to 25 per cent of what she earned before sacking her.

This week Ms Quashie - a women's rights campaigner and former accountancy student - won a crucial court ruling from the Employment Appeal Tribunal. The victory granted her the right to appeal a previous tribunal’s decision that she was self-employed and could not therefore sue Stringfellows.

If she succeeds in her appeal next March, Ms Quashie will become the first stripper allowed to sue for unfair dismissal.

The case could benefit thousands of strippers, who are currently unable to sue even when they work long, regular hours under their club’s direct control.

But Miss Quashie says that since mounting her landmark court claim, she has suffered ‘three years of hell’, including death threats in anonymous phone calls.

In the latest judgment, Judge Jeremy McMullen QC noted that Miss Quashie was rostered to work for Stringfellows.

He said that suggested a corresponding obligation on the club's part to allow her to work on set dates and pay her accordingly.

Miss Quashie says that the club did not allow her to work anywhere else and that the mutual obligations prove she was a Stringfellows employee.

After this week's judgment, she said: ‘I have a reasonable chance of success. I wouldn't have gone through three years of hell for nothing. I genuinely do believe there are issues that need to be addressed. Not even the death threats are scaring me any more.’

She added that she hopes to show that dancers should have the same employment rights as others and that a positive outcome will help improve regulation of the industry.

Single mother Ms Quashie took home up to £1,265 a night for dancing topless wearing only a G- string on stage and naked in private.

Wealthy customers would stuff prepaid vouchers called Heavenly money into a garter.

Miss Quashie, who was a women's rights campaigner while studying accountancy and finance at Thames Valley University, originally told Central London Employment Tribunal how up to 25 per cent of the money she earned each night was taken in commission with a further £85 deducted in 'fees'.

She said she had to perform free dances for customers ‘on the hour every hour’ whenever the Motley Crue song 'Girls, Girls, Girls' was played - and was fined £50 if she failed to appear.

She began her action against Stringfellows after she was sacked in December 2008 over drugs allegations.

Stringfellows denies any wrongdoing and her claims that she was forced to perform for free.

It says that the stripper had the same employment rights as a market trader.

It insists that she signed a contract saying she was self-employed, so cannot go to a tribunal for a job she never had.

The club's barrister Caspar Glyn told the original tribunal her case was ‘constructed on lots of little lies’.

Ms Quashie’s solicitor Shah Qureshi, of law firm Bindmans, said: ‘This decision is a small victory for common sense.

‘His Honour Judge McMullen accepted that there were good arguments to support the case that my client was an employee at Stringfellows.

‘This was irrespective of the working arrangements insisted upon by Stringfellows. Dancers in clubs are often exploited due to their lack of employment status.

‘The clubs insist on them being self-employed despite the fact that they have obligations like any other employee including the provision of services, set working hours and financial penalties for not working. ’

To be self employed you have to make a declaration to HMRC. On her level of earnings she would have to charge VAT and submit tax returns and also pay their won national insurance. As a self employed person you cannot work for just one out business. That is illegal. So how come she is saying she was self employed and only working for Stringfellows?

Report abuse The Inland Revenue told me that where a master and servant relationship existed, you were employed NOT self employed. Does the revenue know how much she took home? No mention of the sad mugs who paid her.
