1. RECOMMENDATIONS

The Planning Department respectfully submits the following recommendations:

2. PURPOSE AND BACKGROUND

The purpose of this report is to provide information with respect to the subject application and the related public meeting.

A pre-consultation meeting with Township staff and other agencies with respect to this application was held on September 1, 2016. A pre-consultation meeting letter prepared by

Township Planning staff, dated November 8, 2016 was provided to the applicant. The application was originally submitted in February 2017, however the vast majority of the supporting documentation was not submitted at that time and the application was deemed to be incomplete and was not advanced further into the review process. Since that time the applicant has submitted the required materials, with the exception of the Natural Heritage Evaluation which is discussed further below.

3. PROPOSAL

The subject application has been submitted to the Township in accordance with section 22 of the Planning Act and proposes to amend the Township's Official Plan (King City Community Plan/KCCP) to facilitate subsequent and future related applications for approval of a Draft Plan of Subdivision and Zoning By-law Amendment. The lands to which this amendment applies (refer to Figure 1) constitute primarily those lands designated "Low Density Residential 2 Area" and "Estate Residential 1 Area" by the KCCP. More specifically, the proposed Official Plan amendment application proposes:

• alternative environmental buffer/minimum vegetation protection zones in specific identified areas; • re-designation of the "Low Density Residential 2 Area" and "Estate Residential 1 Area" to "Low Density Residential 5 Area" to allow for increased maximum gross residential density of 7 units per hectare, increased from the existing permissions of 5 units per hectare (LDR 2) and 1 unit per hectare (ER 1) respectively; and • to permit semi-detached and townhouse units and seniors housing in addition to single detached residential units within the "Low Density Residential 5 Area" designation, and to permit those dwelling types to front onto collector roads;

4. PROPERTY DESCRIPTION

The official plan amendment application applies to the lands shown on Figure 1, and are located on the east side of Jane Street, south of King Road. The subject lands are currently used for agricultural, rural, and residential purposes, and contain various environmentally sensitive areas and/or related buffers. The surrounding lands are as follows:

5. PUBLIC NOTICE/COMMENTS

Notice of the July 9, 2018 public meeting was mailed and circulated to the surrounding property owners, interested parties and agencies. The Township published a notice of application and public meeting in the local newspaper.

In accordance with the Township's protocol for applications for official plan amendment, the Township encourages the applicant to host a public open house. To date, the public open house has not been arranged. While such an open house is not a statutory or mandatory

Planning Department Report Page 7 of 75 Number P-2018-33 Planning Department Report P-2018-33 Page 3 requirement, the Township encourages such open houses in an effort to provide as much opportunity as possible for public input and participation and to enable the sharing of information.

At the time of the writing of this report, Planning staff has been contacted by one resident requesting an opportunity to review the information submitted with the application and to meet with Planning staff to discuss general concerns regarding the overall density, number of units, environmental protection and other issues. Planning staff will be meeting with this resident to discuss these and other matters in advance of the public meeting.

6. AGENCY COMMENTS

Circulation of the application to various external agencies and internal Township departments is currently unden/vay. At the time of the writing of this report, comments have not yet been received from all agencies, including the Region of York and the and Region Conservation Authority, and Township departments. Planning staff will require these comments in order to advance the review of the application.

7. DISCUSSION AND ANALYSIS

7.1 Planning Act

The Planning Act is provincial legislation that sets out the ground rules for land use planning in Ontario. Section 2 of the Planning Act speaks to matters of provincial interest and requires all decision makers to have regard to, among other matters, matters of provincial interest. Section 3(5) of the Planning Act requires all planning decisions to be consistent with provincial policy statements and conform to provincial plans. The Provincial Policy Statement is discussed below in Section 7.2.

7.2 Provincial Policy Statement

The Provincial Policy Statement (PPS) provides policy direction on matters of provincial interest related to land use planning, policy and development. All decisions that affect a planning matter "shall be consistent with" the policy statements issued under the Planning Act.

Settlement areas, including viliages are identified to be the focus of growth and development, including intensification and redevelopment. The PPS further identifies that land use must consider appropriate development to meet current and future needs while creating efficient development patterns which protect environmental sensitive areas and avoid risk to public health and safety. The following PPS policies are of particular relevance to the proposed official plan amendment:

"1.1.3.1 Settlement areas shall be the focus of growth and development, and their vitality and regeneration shall be promoted."

"1.1.3.2 Land use patterns within settlement areas shall be based on: a) densities and a mix of land uses which: 1. efficiently use land and resources; 2. are appropriate for, and efficiently use, the infrastructure and public service facilities which are planned or available, and avoid the need

Planning Department Report Page 8 of 75 Number P-2018-33 Planning Department Report P-2018-33 Page 4 for their unjustified and/or uneconomical expansion; 3. minimize negative impacts to air quality and climate change, and promote energy efficiency; 4. support active transportation; 5. are transit-supportive, where transit is planned, exists or may be developed; and 6. are freight- supportive; and b) a range of uses and opportunities for intensification and redevelopment in accordance with the criteria in policy 1.1.3.3, where this can be accommodated."

"1.6.6.6 Subject to the hierarchy of services provided in policies 1.6.6.2, 1.6.6.3, 1.6.6.4 and 1.6.6.5 planning authorities may allow lot creation only if there is confirmation of sufficient reserve sewage system capacity and reserve water system capacity within municipal sewage services and municipal water services or private communal sewage services and private communal water services. The determination of sufficient reserve sewage system capacity shall include treatment capacity for hauled sewage from private communal sewage services and individual on-site sewage services."

"2.1.1 Natural features and areas shall be protected for the long term."

"2.1.2 The diversity and connectivity of natural features in an area, and the long-term ecological function and biodiversity of natural heritage systems, should be maintained, restored or, where possible, improved, recognizing linkages between and among natural heritage features and areas, surface water features and ground water features."

"2.1.3 Natural heritage systems shall be identified in Ecoregions 6E & 7E1 , recognizing that natural heritage systems will vary in size and form in settlement areas, rural areas, and prime agricultural areas."

"2.1.4 Development and site alteration shall not be permitted in: a) significant wetlands in Ecoregions 5E, 6E and 7E1 ; and b) significant coastal wetlands."

"2.1.5 Development and site alteration shall not be permitted in: a) significant wetlands in the Canadian Shield north of Ecoregions 5E, 6E and 7E1 ; b) significant woodlands in Ecoregions 6E and 7E (excluding islands in Lake Huron and the St. Marys River)1 ; c) significant valleylands in Ecoregions 6E and 7E (excluding islands in Lake Huron and the St. Marys River)1 ; d) significant wildlife habitat; e) significant areas of natural and scientific interest; and f) coastal wetlands in Ecoregions 5E, 6E and 7E1 that are not subject to policy 2.1.4(b) unless it has been demonstrated that there will be no negative impacts on the natural features or their ecological functions."

"2.1.6 Development and site alteration shall not be permitted in fish habitat except in accordance with provincial and federal requirements."

"2.1.7 Development and site alteration shall not be permitted in habitat of endangered species and threatened species, except in accordance with provincial and federal requirements."

"2.1.8 Development and site alteration shall not be permitted on adjacent lands to the natural heritage features and areas identified in policies 2.1.4, 2.1.5, and 2.1.6 unless the ecological function of the adjacent lands has been evaluated and it has been demonstrated that there will be no negative impacts on the natural features or on their ecological functions."

"3.1.1.b) Development shall generally be directed to areas outside of hazardous lands adjacent to river, stream and small inland lake systems which are impacted by flooding hazards and/or erosion hazards;"

7.3 Region of York Official Plan and Provincial Policy/Plans

The subject lands are designated "Towns and Villages" and "Regional Greenlands System" as shown on Maps 1 and 2 of the York Region Official Plan (2010), and are within the "Settlement Area" designation as per the Oak Ridges Moraine Conservation Plan.

The Regional Plan indicates that the Township is required to plan for population growth from 20,300 people in 2006 to 34,900 people in 2031, an increase of 14,600 people. This additional population is to be provided by a combination of development within the existing built up areas (intensification) and development within designated greenfield areas. The target set for intensification growth is 920 units. As established through the Township's Official Plan review exercise, the existing permitted densities in the existing greenfield areas will not achieve the 2031 population target, even after growth from intensification is taken into consideration.

The Province's "Places to Grow" Plan promotes intensification and sets specific targets for residential intensification. It should be noted that the targets set by the Growth Plan are to be considered in a broader community and regional context. The Growth Plan recognizes that one size does not fit all and that municipalities are to develop their own policies and phasing strategies to achieve the targets in a manner that respects and compliments the community's character.

It is recognized that the proposed official plan amendment will assist in achieving the above noted growth targets set by the Growth plan and the Region of York Official Plan.

The subject lands are also located within the Greenbelt area. However, they are located within a designated settlement area of the Oak Ridges Moraine Conservation Plan (ORMCP) and, therefore, not subject to the Greenbelt Plan, but rather are to be governed by the King City Community Plan and the ORMCP. The subject lands are also designated "settlement" by the ORMCP and, therefore, their development for residential purposes, in accordance with the King City Community Plan is permitted. The application is currently under review by both the Township and the TRCA with respect to the requirements of the ORMCP. In particular, it is noted that the subject application is seeking a reduction in the extent of the environmental buffer/minimum vegetation protection zone identified by the ORMCP. As noted above. Planning staff's review of this element of the subject application is ongoing and we also await the comments of the TRCA.

7.4 King City Community Plan (KCCP)

7.4.1 Existina and Proposed KCCP Policies

The KCCP (refer to Figure 2) designates the subject lands "Low Density Residential 2 Area" (LDR2), "Estate Residential 1 Area" (ER1), and "Environmental Protection Area" (EPA).

The existing KCCP policies for which the amendment is proposed permit a maximum gross density of 5 units per hectare on the majority of the subject lands (LDR2) and 1 unit per hectare

Planning Department Report Page 10 of 75 Number P-2018-33 Planning Department Report P-2018-33 Page 6 on the south-west portion of the subject lands located immediately adjacent to Jane Street (ER1).

The applicant's draft official plan amendment (Appendix 1) proposes the following:

• alternative environmental buffer/minimum vegetation protection zones in specific identified areas; • re-designation of the "Low Density Residential 2 Area" and "Estate Residential 1 Area" to "Low Density Residential 5 Area" to allow for increased maximum gross residential density of 7 units per hectare, increased from the existing permissions of 5 units per hectare (LDR 2) and 1 unit per hectare (ER 1) respectively; and • to permit semi-detached and townhouse units and seniors housing in addition to single detached residential units within the "Low Density Residential 5 Area" designation, and to permit those dwelling types to front onto collector roads;

The Environmental Protection Area (EPA) designation also applies to the subject lands. More specifically, environmentally sensitive areas on the subject lands, the boundaries of which have been established on site in consultation with the TRCA and the Ministry of Natural Resources, reflect the EPA designation. It is important to note that the environmental buffers/minimum vegetation protection zone (MVPZ) component of the environmental areas are included within the EPA designation. In general, the KCCP policies, in accordance with the Oak Ridges Moraine Conservation Plan, require a minimum vegetation protection zone/buffer of 30 metres from the environmental features to be incorporated into the future plan of subdivision and no development and/or lots are permitted to encroach into that buffer area. The proposed official plan amendment seeks reductions to these buffers. Based upon the concept plan (Figure 3), these buffer encroachments comprise a total of 0.13 ha in area and are located within the eastern portion of the subject lands in five locations as shown on Figure 3. More information is required from the applicant with respect to the precise extent and depth of these encroachments. In general. Planning staff has expressed concerns, as noted in more detail below, with respect to reductions to the MVPZ buffers within the KCCP, with the exception of minor adjustments to reflect isolated "pinch point" areas. The Township has consistently emphasized the "environment first" principle of the KCCP and the need to reflect this principle in the planning and consideration of new development.

The proposed CPA is currently under review by Township Planning staff. As discussed in more detail below, the proposed CPA and resulting increase in developable area and residential density will be considered in regard to implications to the overall planned population for King City and the Township as a whole, and conformity with the Region of York Official Plan and consideration as an element of the Township's on-going overall Official Plan review.

7.4.2 Township Official Plan Review

In June, 2014, the Township identified a need to review and update the Township's Official Plan which was approved in 1970, as amended over time. The purpose of the review is to:

• develop a new Official Plan that will replace the current parent Official Plan which dates originally from 1970; • establish consistent policies through the updating of Secondary/Community Plan policies,

including the King City Community Plan which directly relates to the subject application; • ensure that the Official Plan conforms to Provincial policies, Provincial Plans and the Region of York Official Plan; • address longer-term growth management issues to 2031; • establish new policies to support additional economic growth; • entrench sustainable development principles, and • address other key issues identified through the review.

Planning staff together with the Township's Official Plan review consultants (Meridian Planning) made a series of recommendations to Council (Planning Report P-2015-42) regarding policy directions and recommendations relating to Growth Management and Greenfield Densities. The recommendations, which have now been incorporated into the draft Official Plan which was released for public review and comment in December 2017, provide for a proposed increase to the densities permitted within King City's designated greenfield area to 7 units per hectare on average to ensure that the Township meets it's 2031 population target established by the Region of York.

The draft new Official Plan also includes significant emphasis on environmental protection policies and overall sustainable development. The requirements of the Oak Ridges Moraine Conservation Plan with respect to the natural heritage/environmental features and the related MVPZ/buffers continue to be included and emphasized in the new draft Official Plan consistent with the existing Oak Ridges Moraine conservation and environmental protection policies of the KCCP. The 30 metre MVPZ requirements continue to apply.

As noted above, the 7 units per hectare being considered through the Official Plan review is based on being applied as an average density throughout the community. We note that the draft Official Plan Amendment for the subject application is seeking an amendment to the KCCP to allow a maximum gross residential density of 7 units per hectare, increased from the existing permissions of 5 units per hectare (LDR 2) and 1 unit per hectare (ER 1) respectively. While the draft official plan amendment appears to be generally consistent with the density being contemplated as part of the Official Plan review. Planning staff requires further opportunity to continue to assess the subject application in this regard.

The subject application also seeks to amend the KCCP policies to permit an alternative minimum vegetation protection zone (MVPZ) adjacent to environmental features. The subject application is seeking a reduction of the MVPZ to varying degrees. Township staff has a general concern with respect to the reduction of the MVPZ. TRCA and Region comments have not yet been received. The Oak Ridges Moraine Conservation Plan and the Region of York Official Plan include policies which enable reductions to the MVPZ within settlement areas such as King City. However, the Township has consistently maintained the full MVPZ requirements of the ORMCP. CPA 89 does provide for some limited reduction in the MVPZ, however, it does so in a very limited and minor fashion in order to enable more regular lot boundaries in five specific locations only where the boundary of the feature/buffer results in unique configurations and challenges to the adjacent lot fabric. The minor flexibility provided by CPA 89 enables more regular lot boundaries in these anomaly type situations. In addition, CPA 89 also permits the reduction in the MVPZ subject to limitations including, the necessary technical supporting studies being completed, all feasible options to avoid the reduction being explored, compensation in the form of plantings or expanded buffers elsewhere, and a restriction to a maximum of a 20% reduction of the MVPZ. Planning staff is reviewing the subject application in

Planning Department Report Page 12 of 75 Number P-2018-33 Planning Department Report P-2018-33 Page 8 this context and seeking confirmation that the MVPZ reductions being proposed are consistent with this approach.

Planning staff will continue to review the subject applications in coordination with the above matters and report back to Council at a later date with respect to a recommendation for a decision on the subject applications.

7.5 Development Concept

The applicant has submitted a development concept which illustrates the potential layout of the residential development enabled by the proposed official plan amendment (Figure 3). The review and approval of this more detailed and design element of the development will largely be addressed through the future and related applications for Draft Plan of Subdivision and Zoning By-law Amendment. As such, only preliminary level of design review is underway and will primarily focus on broader issues which are related to the official plan amendment (eg. park/community facility needs, environmental limits, traffic implications, etc.). The following generally identifies these matters:

The requirement for the Natural Heritage Evaluation (NHE) has been discussed with the applicant. While Planning staff continues to require the submission of the NHE during the OPA application review process, the applications can proceed on the basis that sufficient information has been provided for the purpose of deeming the OPA application complete. Information has been provided with respect to the extent of the natural features limits and corresponding buffers as shown on the development concept and the survey of staked feature limits by the Ministry of Natural Resources and Toronto and Region Conservation Authority. However, Planning staff continue to require the submission of the NHE as the review of the OPA advances and before it is considered for approval. It is also noted that the additional information arising out of the NHE may result in changes to the development concept which trigger the need for an additional public meeting.

Planning staff notes that the TRCA has previously identified violations with respect to filling and site alteration on the subject lands, particularly in regard to various wetlands on the subject lands. Planning staff attended site meetings with the TRCA and the applicant's consultants at which these matters were examined in more detail. It is Planning staffs understanding that these matters remain unresolved at this time. It should be noted that the King City Community Plan includes policies which directly address such alterations to lands designated "Environmental Protection" and require that the disturbed lands will continue to be designated as "Environmental Protection". Planning staff awaits the comments of TRCA. As noted at the time of pre-consultation. Planning staff notes that an opportunity to further review and consider these matters may be required as the TRCA's review advances.

Street 'A' is a collector road route which crosses through a Provincially Significant Wetland and will require consideration through a Class Environmental Assessment (EA) process together with the planning approval process. The EA public consultation requirements can be addressed jointly through the future development applications and their related public meetings and consultations. Street 'A' will require completion of either a Schedule 'B' or Schedule 'C Municipal Class EA depending on the costs of the road.

The development concept includes a mix of single detached residential units, townhouse units, and "Lifestyle Residential" units, as well as a park in the central-north area of the plan.

and a road network which provides for connections to adjacent external lands to the north and south of the subject property.

Section 10.3.2 of the KCCP requires a Functional Servicing/Development Area Study (FSDAS) to be completed as a basis for the evaluation of the development of the subject lands. The FSDAS is required to be approved in advance of the approval of individual subdivision/development applications. The FSDAS is to address the component elements of the development such as stormwater management, water and sanitary servicing, transportation connections, trail connectivity, the design and layout of public open space, connections, integration and transition between the subject lands and neighbouring future and existing residential lands, and the overall land use concept in this area. The proposed Official Plan Amendment application process will be required to be completed prior to any approval of the related FSDAS, Draft Plan of Subdvision, and Zoning by-law Amendment.

The Township's Park's, Recreation and Culture Department has provided preliminary comments noting that the park block should be a minimum of 1 hectare in area, as well as seeking clarification with respect to the extent of the park block and the lands included within the total area of 0.5 ha as shown on the Concept Plan. In addition, a trail system through the environmental buffers with connections to future residential and/or employment lands should be included.

8. INTEGRATED SUSTAINABILITY PLAN LINKAGE

The recommendations of this report support the land use planning objectives of the Environmental Pillar, of the Township's Sustainability Plan. However, further analysis in regard to the Township's Sustainability Plan will be addressed in the subsequent recommendation report from Planning staff to Committee on this matter.

9. FINANCIAL IMPLICATIONS

The required application fee has been submitted. In addition, any external costs (peer-review architect, legal, engineering, etc.) incurred by the Township through the processing and review of this application will be recovered from the applicant in accordance with the Township's standard practice and owner's acknowledgement through the application form. Security deposits, levies, development charges, and cash-in-lieu of parkland, if required, will be collected at later stages in the development review process. Further financial implications, if any, will be assessed as the review proceeds.

10. CONCLUSION

The review of the application remains on-going by the Planning Department and other Township Departments and external agencies. Planning staff requires further opportunity to continue to review the application, provide comments, and work with the applicant to review and address the various issues raised in this report as well as by the public and Council. In addition, comments have not yet been received from all departments and agencies. As the review proceeds, Planning staff will report back to Committee of the Whole with respect to a decision

Amendment Structure

PART I - THE PREAMBLE is included for information purposes and is not an operative part of this Official Plan Amendment.

PART II - THE OFFICIAL PLAN AMENDMENT provides specific amendments to the Township of King Official Plan as affected by Official Plan Amendment No. XX, and is the operative part of this Official Plan Amendment.

Purpose

The purpose of this Amendment is to:

(i) Re-designate the Low Density Residential 2 Area and Estate Residential 1 Area lands identified on Figure 1;and 2 of this Amendrhent to Low Density Residential 5 Area as per King City Community Plan Official Plan Amendment No. 54, as amended by Official Plan Amendment No. 540 (Oak Ridges Moraine Conservation Plan Amendment), and as Amended by Official Plan Amendment No. 89;

(ii) permit some semi-detached and townhouse units and seniors housing within the LDR 5 Areas of Schedule 4 to CPA 540 in order to provide some diversity in the new neighbourhoods, while not exceeding a population within that expected if all lunits were single detached homes;

(iii) Permit semi-detached and/or townhouse dwellings or other similar dwelling types fronting onto collector roads within the lands subject to this amendment; and

(iv) Provide the opportunity to implement alternative minimum vegetation protection zones in areas shown on Schedule XX-2 of this Amendment, as per King City Community Plan Official Plan Amendment No. 54, as amended by Official Plan Amendment No. 540 (Oak Ridges Moraine Conservation Plan Amendment), and as Amended by Official Plan Amendment No. 89.

The lands to which this amendment applies constitute those lands designated "Low Density Residential 2 Area" and "Estate Residential 1 Area" on Schedule 4 of the Official Plan Amendment No. 54 - King City Community Plan, as amended by Official Plan Amendment No. 540 and further defined in Schedule XX-2 and shown in Figure 1 and 2 of this Amendment.

4. Basis

The purpose of this Amendment is to permit the efficient, cost-effective and sustainable development of the lands located in the southwest quadrant of the King City Community. CPA 89 amended the gross densi^i permitted within the LDR5 lands in the King City Community Plan on the basis that the density limits provided in the King City Community Plan are inconsistent with the policy directives of both the Province and the Region of York. The Provincial Policy Statement, Oak Ridges Moraine Conservation Plan, Growth Plan for the Greater Golden Horseshoe and the York Region Official Plan all emphasize the need to manage growth through the efficient, cost-effective development of land and us^ pf resources. Policy 5.6.22(c) of the York Region Official Plan requires that best efforts be made to achieve a minimum density of 50 residents and jobs per hectarpiwithin Towns and Villages.

The density increase to 7.0 units per hectare on average allows for densities more cphsistentwith those contemplated bythS Region and with the densities anticipated in the Draft One King Official Plan dated November 2017 for new low-density development.

The introduction of sprni-detached and townhouse units within the LDR5 lands would increase the single-fanriily lot frontages and lower the population expectation since the occupancy for townhouses in King City is 2.7 persons per unit vs. 3.1 persons per unit for single family dwellings with Lifestyle Seniors units having an even lower persons per unit of 1.8. OPA 89 provided opportunity for increased density over 7 units per hectare ifthe population generated by the various unit types was within the population expected based on 3.1 persons per single family dwelling unit.

All of this part of the document entitled Part II - The Amendment, consisting of the following text and schedules, constitutes Amendment XX to the King City Community Plan, also known as Amendment No. 54 to the Official Plan of the Township of King, as Amended by Official Plan Amendment No. 89, and as amended by Amendment No. 540, also known as the Oak Ridges Moraine Conservation Plan Amendment.

The Clerk advised that correspondence has been received and circulated prior to this evening’s meeting for: Council Public Meeting Item #6 6.1 – Planning Department Report Number P-2018- 25 – Draft Plan of Subdivision and Zoning By-law Amendment, File Nos.: 19T-17K02 and Z-2017- 11, Sycamore Construction Ltd.

5. MAYOR’S COMMENTS

Mayor Pellegrini highlighted the recently held and upcoming community events in the Township of King, being; the 2018 King City Heritage Awards, the Schomberg Main Street Residents Survey, the MS Car Show, Canada Day celebrations in Kettleby, and the Schomberg Horticultural Society Garden Tour.

Mayor Pellegrini commented that York Regional Police have made an arrest in the recent rash of break and enters in Nobleton and are asking residents who may have had property stolen to contact them to see if any of the items they have obtained in their search belongs to King residents.

Mayor Pellegrini announced that it is his extreme honour and privilege to welcome to King Township two (2) special guests this evening, the newly elected MPP’s , Stephen Lecce for King-Vaughan and Caroline Mulroney for York-Simcoe. Mr. Lecce and Ms. Mulroney thanked Mayor Pellegrini and Members of Council for the warm welcome to King and thanked the residents of King Township for their support.

6. PUBLIC MEETING(S)

6.1 Planning Department Report Number P-2018-25 Re: Draft Plan of Subdivision 19T-17K02 Zoning By-law Amendment Z-2017-11 Part of the East Half of Lot 32, Concession 9 Roselena Drive and Church Street, Schomberg Owners: Sycamore Construction Ltd. & 2395959 Ontario Ltd. Agent: Thorstone Consulting per, Dan Stone

(a) Presentation by Paul Kulyk, Planner II

Mr. Kulyk provided a slide presentation overview on Planning Department Report P-2018-25 and provided information on an application received proposing to amend the Township’s Zoning By-law and to seek approval for a related application for Draft Plan of Subdivision. The applications propose the development of fifty-one (51) residential dwellings comprised of single detached units/lots fronting on both a planned extension of Roselena Drive and fronting on Church Street. The proposed lots are intended to be sold as freehold units and built in a single phase of construction on full municipal water and sanitary services. The development also includes a crossing of an existing tributary of the North Schomberg River, a sanitary pumping station, open space and environmental blocks and woodland/forest addition blocks. The development is identified by name as Forestbrook Hills and represents phase two of the original

Mr. Kulyk further commented on; density, the Township’s Zoning By-laws, property description, public and agency comments, the Provincial Policy Statement (2014), the Provincial Growth Pan (2017), Greenbelt Plan (2017), the Region of York Official Plan (2010), Schomberg Community Plan (OPA#47), access and traffic impacts, natural heritage, road crossing, tree inventory, hydrogeological investigation, hydraulic analysis, functional servicing report (FSR), stormwater management, water and sanitary servicing, environmental site assessment (ESA), archaeological study, and urban design principles. He noted the correspondence recently received from the LSRCA, as part of their required review.

Mr. Kulyk responded to questions from Committee.

(b) Presentation by Applicant/Agent

Dan Stone, Thorstone Planning Consultants, spoke on behalf of the applicant and provided a slide presentation overview on the following: history of Phase I of the development; the Schomberg Community Plan (OPA47); the proposed revised draft plan approval; recent activity in 2016/2017; studies, reports and documents submitted; the current site and proposed site; public and agency comments; and next steps in the process. Mr. Stone advised that this is a low impact development with no stormwater pond proposed.

(c) Public Comments and Concerns

(i) Paul Sacilotto

Mr. Sacilotto spoke on behalf of area residents who are not opposed to the development but do have concerns that the original site design from twenty (20) years ago may not reflect the design the Township wishes to see in King today. Mr. Sacilotto commented on; traffic/speeding concerns, safety issues, current road infrastructure, the effects of adding additional connecting roads through existing neighbourhoods, mature trees affecting sight lines, need for current up- to-date traffic studies, restrictions during construction works, and concerns with the possible precedent setting of approving such development as proposed.

(ii) Joan Anderton

Ms. Anderton advised her property abuts the subject lands and of her opposition to the current application as proposed. Ms. Anderton noted this development, as currently proposed, presents significant risk to the municipality and to all properties along the Schomberg River to the east of the subject lands and commented on the following: environmental protection, features and impacts; the valley system; flood plain for the Schomberg River and risk of flooding; environmental impacts on neighbours; incomplete/missing significant information in the documents; the proposed elimination of one third of a large pond on the west boundary; the proposed road connecting to Church Street through the east end of the current pond; infill of three (3) large wetlands; storm water management; and removal of the natural infiltration function of the existing floodplain, effectively creating a channel turning the Schomberg River into a large culvert. Ms. Anderton advised that the risks in the current proposal are very high both for the Township and for the residents along the river and suggested the plan be amended to take the proposed road around the pond on the west side to present the least damage to the sensitive environmental lands and the Schomberg River on the east side of the pond and encourages the Township to do the ‘right thing’ on this property.

(iii) Sherry Sibio

Ms. Sibio commented on her concerns in relation to the current water supply in Lloydtown, the issues residents have been having with their wells and how this new development could impact the water table supply situation. Ms. Sibio noted that there have been four (4) homes, to her knowledge, that have recently had wells run dry in the Church Street to Lloydtown area. Ms Sibio requested that a water table study be conducted of the Lloydtown area before the application receives approval in addition to the development of an agreement, prior to any approval, with regard to addressing and protecting the area residents’ water supply and quality.

Committee recommends that the above deputations be received.

A. That Planning Report No. P-2018-25 be received;

B. That the applications for Draft Plan of Subdivision 19T-17K02 and Zoning By- law Amendment Z-2017-11, submitted by Sycamore Construction Ltd. & 2395959 Ontario Ltd. to allow the residential development of the lands described as Part of the East Half of Lot 32, Concession 9, consisting of a range of lot sizes for 51 residential dwellings comprised of single detached units/lots fronting on an extension to Roselena Drive and Church Street, be received and referred back to staff together with all agency, applicant, Township departments, Council and public comments for a further report following the receipt of the same and completion of the Planning Department’s review;

Allan Evelyn, Director of Finance and Treasurer commented on the responsibilities the Township of King has to ensure financial statements are produced in accordance with the

Audit Committee Meeting of Page 33 of 75 June 25, 2018 Audit Committee Report - June 25, 2018 requirements in CAS 260, Communication with those Charged with Governance and introduced Giselle Bodkin from BDO Canada.

Giselle Bodkin advised that BDO Canada has now substantially completed its audit of the consolidated financial statements of the Corporation of the Township of King for the year ended December 31, 2017. Ms. Bodkin commented that the Communication of Audit Results provides an overview of the results of the audit including comments on misstatements, significant accounting policies, sensitive accounting estimates and other matters that may be of interest to the Committee. Ms. Bodkin provided a slide presentation and reviewed the following: organizational structure, total revenue, net financial assets, TCA Additions and surplus, 2017 revenue, 2017 expenses, industry comparison, best practice recommendations, and summary of audit process. Ms. Bodkin advised that BDO Canada will finalize the audit report once the Committee has approved the consolidated financial statements.

Committee recommends that the presentation by Mr. Evelyn and Ms. Bodkin be received.

Committee recommends that the Report to the Audit Committee – Communication of Audit Results for the Year Ended December 2017 be received, and the recommendations therein be approved, as follows:

(a) The Audit Committee receive the Draft Report from BDO Canada LLP and approve the Draft 2017 Audited Financial Statements for the year ended December 31, 2017 for the Township of King.

Correspondence: Re: Maple Leaf Club Request for Exemption to the Noise By-law

DEPUTATION(S)

(i) Arif Shaikh

Mr. Shaikh, President, Robo International Inc., spoke on behalf of the Maple Leaf Cricket Club (MLCC) advising that they are delighted to share that international cricket is returning to Canada and that organizers of global T20 league have chosen the prestigious MLCC fields in King City as home of this tournament. Mr. Shaikh commented that starting June 28 until July 16th, the league is scheduled to host a tournament with many international stars who will be featured in this tournament and will consist of six (6) teams, fifteen (15) members each, playing over fifteen (15) days.

Mr. Shaikh responded to questions and commented that; there will be four (4) grounds being used, 1 as a playing field, 1 for food services, and 2 for on-site parking which will hold approximately 530 spots; arrangements are being made with for additional overflow parking; a meeting will take place tomorrow with Township staff, York Region and York Regional Police staff to address concerns; that permanent netting will be erected on the north side of the field; and security will be on site for the duration of the event.

(ii) Cathy Campione

Ms. Campione commented she is the property owner to the north of the Cricket Club property and advised that during the 2008 event, she experienced considerable problems such as; people accessing her property without permission, parking on the side of the road causing safety concerns, and people refusing to leave her property. Ms. Campione noted that individuals used her property to watch the games, for picnicking, climbing fences and relieving themselves wherever those chose and provided photographs to back up her statements. She advised that Police did come and made an effort to keep people from entering her property with little success. At the end of the games, she was left with cleaning up waste paper, food, and empty liquor and beef bottles. Ms. Campione commented she is concerned for her own well- being due to the 2008 games having demonstrations that took place, including the blocking of traffic on Dufferin Street. She noted that the Club is not enthusiastic about implementing measures to restrict access to surrounding landowners’ properties or keeping the cricket ball on their property nor was she notified of this event taking place.

Ms. Campione noted her opposition to this event and asked that the Township take any necessary steps to provide the prescribed level of compliance with the rules so that the residents are not burdened with avoidable nuisance.

Committee recommends that the above deputations be received.

Staff responded to questions.

Committee noted that while this is a welcomed prestigious event to take place in King Township, the organizers should have provided more advanced notice to the Township inorder to mitigate the many issues/concerns raised so close to opening day of the event and allow time for the Club’s representatives to work with Township staff, York Region and York Regional Police in ensuring this event runs smoothly with no impact on the local residents. Committee also noted their concerns that the Club’s website depicts the CN Tower and Sky Dome in Toronto rather than a playing field on a small property located in King Township.

Committee considered correspondence received from the Maple Leaf Cricket Club (MLCC) requesting an exemption to the Township’s Noise By-law during their International Cricket event being held at the MLCC fields located at 13811 Dufferin Street, King City, from June 28, 2018 until July 16th, 2018.

Committee recommends that the correspondence from the Maple Leaf Cricket Club be received and the following recommendations be approved, as amended, as follows:

a) That Committee receive the correspondence as information;

b) That the Noise By-law Exemption be granted, conditionally, upon satisfaction of the following:

(i) Any/all sign-offs, permits must be to the satisfaction of the Township Clerk and King Fire Chief;

(ii) There must be a parking agreement in place with Seneca College for overflow parking needs;

(iii) There must be York Regional Police Paid Duty Officers (PDO’s) on site at all times during the event;

(iv) There must be a security/safety plan in place;

(vi) Traffic signage must be placed on Bloomington Side road and Dufferin Street;

(vii) Netting must be installed to protect the adjoining landowners’ properties;

(viii) Must ensure the security and privacy of neighbouring properties;

(ix) Must add neighbouring landowners to their insurance, as additional insureds; and

(x) Any other requirements as deemed necessary by the Township Clerk and the King Fire Chief.

The North building addition will measure approximately 2447 square metres and the South building addition will measure approximately 628 square metres. The demolition and removal of four (4) existing buildings and additions measuring 569 square metres with be required to make space for the northern addition. The development concerns an industrial parcel of land located on the north side of Lloydtown-Aurora Road between Jane Street and Highway 400. The property currently supports the offices and operations area together with an existing repair garage for the Priestly Demolition Company.

Committee recommends that Planning Department Site Plan Report Number SPR- 2018-03 be received and the recommendations therein be approved, as follows:

A) That Planning Report SPR-2018-03 be received.

B) That Site Plan Development application file number SPD-15-47 BE APPROVED; and that prior to the issuance of a Building Permit, the Owner shall enter into an Site Plan Development agreement with the Township and the Region of York to be registered on title to the satisfaction of the Director of Planning (or designate) to ensure that the proposed works are carried out in accordance with the approved plans .The Site Plan Development Agreement shall include provisions addressing the following:

i) Prior to issuance of a Building Permit, the applicant shall submit for approval to the Director of Planning, photo documentation confirming that all silt and erosion control measures, including mud mat have been implemented according to the approved plans;

ii) At the time of execution of the Agreement, the owner shall submit the required municipal levies as required by the Township’s Parkland By-law to the satisfaction of the Director of Finance and Treasury;

A BY-LAW TO ESTABLISH AN ACCOUNTABILITY SERVICES FRAMEWORK FOR THE TOWNSHIP OF KING

WHEREAS the Municipal Act, 2001, S.O. 2001, c. 25, as amended, provides for the establishment of codes of conduct for members of council and local boards of a municipality and for the appointment of an Integrity Commissioner to carry out certain functions and responsibilities;

AND WHEREAS The Corporation of the Township of King will benefit from having a framework that creates a regime to provide for a code of conduct for members of its council and its local boards, the appointment of an Integrity Commissioner and the various accountability services to be provided by the Integrity Commissioner;

AND WHEREAS sections 8, 9 and 10 of the Municipal Act, 2001 authorize the Township of King to pass by-laws necessary or desirable for municipal purposes, and in particular paragraph 2 of subsection 11(2) authorizes by-laws respecting accountability and transparency in the municipality and its operations;

THEREFORE THE COUNCIL OF THE TOWNSHIP OF KING hereby enacts as follows:

1. Definitions:

In this By-law the following terms shall have the meaning indicated:

(a) “Accountability Services” means advice, education, complaint resolution, investigation, inquiry and reporting to Council and any matters related to or required to assist Council in the application of any procedures, rules and policies of the Township governing the ethical behaviour of Members of Council as set out in subsection 223.3(1) of the Municipal Act, 2001 and, without limiting the generality of the foregoing, includes specific advice to Members of Council with respect to sections 5, 5.1. and 5.2 of the Municipal Conflict of Interest Act;

(b) “By-law” means this Accountability Services Framework By-law;

(c) “CAO” shall mean the Chief Administrative Officer for the Corporation of the Township of King.

(d) “Clerk” means the individual appointed by Council to the office of clerk in accordance with section 228 of the Municipal Act, 2001;

(e) “Code of Conduct” means the Code of Conduct for Members of Council established under the authority of subsection 223.2(1) of the Municipal Act, 2001;

(f) “Complaint Protocol” means the Complaint Protocol, being Appendix B to the Code of Conduct;

(g) “Council” means the Council for the Township;

(h) “Integrity Commissioner” means the Integrity Commissioner for the Township appointed under the authority of subsection 223.3(1) the Municipal Act, 2001;

(i) “Local Board” means a Local Board as defined in the Municipal Act, 2001;

(j) “Member” means a person who is a Member of the Council;

(k) “Township” means The Corporation of the Township of King; and

(l) “Year” means calendar year, unless otherwise indicated.

2. Code of Conduct

(a) Council shall adopt and maintain a Code of Conduct in accordance with the provisions of the Municipal Act, 2001 for the members of its Council and its local boards;

(b) In recognition of their roles as elected representatives of the Township and as Members of Council, Members shall at all times conduct themselves in accordance with the Code of Conduct.

3. Integrity Commissioner

(a) Council shall appoint an Integrity Commissioner by by-law to provide Accountability Services in accordance with Part V.1 of the Municipal Act, 2001, sections 5, 5.1. and 5.2 of the Municipal Conflict of Interest Act, the Code of Conduct, the Complaint Protocol and this By-law.

(b) The Integrity Commissioner shall carry out in an independent manner the duties and responsibilities of his or her office as set out in Part V.1 of the Municipal Act, 2001, sections 5, 5.1. and 5.2 of the Municipal Conflict of Interest Act, the Code of Conduct, the Complaint Protocol and this By-law.

(c) The Integrity Commissioner is accountable to and reports directly to Council.

(d) The Integrity Commissioner is independent of Council and the Township’s administration, subject to the requirements of this By-law.

(e) The Integrity Commissioner has full carriage and control of, and is fully responsible for, carrying out his or her responsibilities in compliance with the Code of Conduct, the Complaint Protocol, this By-law and all applicable laws except that the Integrity Commissioner is entitled to rely on the services of Township staff to ensure that complaints are validly received and that adequate reporting to Council is facilitated and arranged.

(f) The Integrity Commissioner shall liaise with the Clerk, or his or her delegate and any persons that the Clerk assigns responsibility to deal with any matter related to Part V.1 of the Municipal Act, 2001, subject to the duty of confidentiality set out in subsection 223.5(1).

4. Appointment, Removal and Resignation of Integrity Commissioner

(a) A simple majority of Council is required for the appointment of an Integrity Commissioner, as well as the extension of term, removal from office or termination for cause of the Integrity Commissioner.

(b) The Integrity Commissioner shall be appointed for a fixed four (4) year term of office.

(c) The term of office for the Integrity Commissioner may be extended by Council, for one additional term.

(d) The Integrity Commissioner may only be removed from office, prior to the expiry of the term of office, by a decision of Council.

(e) The Integrity Commissioner may resign from office at any time by giving ninety (90) days’ written notice to the Council, unless the notice requirement is waived by both parties.

5. Selection of Integrity Commissioner

(a) The selection process for the Integrity Commissioner shall be overseen by the CAO and the Clerk, in consultation with legal counsel. The Clerk will prepare a short list of qualified proponents and invite submissions of a proposal to provide Accountability Services to the Township based on the following criteria:

(i) possess a degree from a recognized university in a relevant field of study, with an emphasis on law, ethics or public administration or a combination of equivalent education, training or experience;

(ii) possess comprehensive experience in managing investigation activities, preferably in the municipal context, including the application of alternative dispute resolution;

(iii) possess extensive knowledge of relevant legislation, including the Municipal Act, 2001 and the Municipal Conflict of Interest Act, and have the ability to interpret relevant statutes, regulations and policies;

(iv) have no present or past involvement in political campaigning or endorsement of any current Members of Council members or any potential conflict of interest related to Township services or its residents and taxpayers;

(v) have no other dealings or employment with Township or any financial interest in work undertaken by the Township;

(vi) have any relevant Integrity Commissioner experience, including drafting, advising and interpreting codes of conduct or other ethical policies, procedures and rules;

(vii) have experience in training and educating with respect to ethical regimes and proper ethical conduct in a local government environment; and

(viii) demonstrate a sufficient ability and capacity to service the needs of the Township, especially in the case of multiple complaints and investigations.

(b) The CAO and the Clerk, in consultation with legal counsel, shall assess the qualifications of the proponents as to the aforementioned criteria and may, but shall not be obligated to, hold interviews with selected proponents in order to choose a preferred proponent for recommendation to Council for appointment as Integrity Commissioner.

(b) Council shall consider the CAO’s and Clerk’s recommendation and duly appoint its preferred proponent as Integrity Commissioner for the Township.

6. Responsibilities of the Integrity Commissioner

The Integrity Commissioner will provide Accountability Services to the Township including:

(i) to provide advice to Council or the Township staff on the application of the Code of Conduct, Township policies, procedures and rules, the Complaint Protocol and sections 5, 5.1 or 5.2 of the Municipal Conflict of Interest Act;

(ii) to conduct inquiries as directed by Council regarding whether a Member has contravened the Code of Conduct or sections 5, 5.1 or 5.2 of the Municipal Conflict of Interest Act;

(iii) to provide written advice to a Member, upon receipt of a written request from the Member, respecting the Member’s obligations under the Code of Conduct, Township policies, procedures and rules, the Complaint Protocol and the Municipal Conflict of Interest Act;

(iv) to provide opinions on policy matters and make other reports to Council as requested on issues of ethics and integrity, including reports with respect to the status of compliance with any Council decision imposing a penalty or corrective measure or action upon a Member;

(v) to provide educational information and training to Council, to Members and to the public on matters related to the Code of Conduct and issues of ethics and integrity, and to the Municipal Conflict of Interest Act;

(vi) to provide general information to members of the public, on request, about the Code of Conduct, the Complaint Protocol and the availability of complaint resolution services or referrals as contemplated by the Complaint Protocol;

(vii) to maintain custody and control of the Integrity Commissioner’s complaint and inquiry/investigation files and, on completion of his or her term of appointment, to retain jurisdiction of any complaints that are made to the Integrity Commissioner during the term of appointment;

(viii) to provide an annual report to Council summarizing the Integrity Commissioner’s activities in the preceding year, including all complaints received and their disposition (including complaints deemed and ruled not to be within the jurisdiction of the Integrity Commissioner and complaints not investigated and/or summarily dismissed or terminated) and such periodic reports as may be requested by Council from time to time; and

(ix) to provide such other services respecting ethical and integrity matters as assigned by Council or as may be required by the Municipal Act, 2001.

7. Vote Required for Changes

(a) A simple majority vote of all Council Members is required to pass a motion to amend or repeal this By-law.

(b) This By-law shall come into force and take effect on the date it is passed, except for such provisions as may be required to come into force and take effect by any transitional provisions included within the Modernizing Ontario’s Municipal Legislation Act, 2017 or any regulations made thereunder.

8. Short Title

This By-law shall be referred to as the “Accountability Services Framework By-law”.

A BY-LAW TO ADOPT A NEW CODE OF CONDUCT FOR MEMBERS OF COUNCIL

WHEREAS pursuant to the Municipal Act, 2001, S.O. 2001, C. 25, as amended, requires that a municipality's capacity, rights, powers and privileges, shall be exercised by by-law;

WHEREAS Section 11 of the Municipal Act 2001, S.O. 2001, c. 25, as amended, authorizes municipalities to pass by-laws regarding accountability and transparency of the municipality and its operations and of its local boards and their operations;

AND WHEREAS section 223.2 of the Municipal Act 2001, S.O. 2001, c 25, authorizes the municipality to establish codes of conduct for Members of Council of the municipality and of local boards of the municipality;

AND WHEREAS the Council of the Corporation of the Township of King considers it desirable to pass such a by-law;

NOW THEREFORE the Council of the Corporation of the Township of King HEREBY ENACTS AS FOLLOWS:

1. That Council adopts the new Code of Conduct for Members of Council of the Township of King, attached hereto as Appendix “A” and forming part of this by-law

2. That Council hereby repeals the 2007 Code of Conduct for Members of Council;

3. That this By-law shall come into force and take effect upon final passage.

BY-LAW NUMBER 2018-77

A BY-LAW FOR THE COLLECTION AND REMOVAL OF SOLID WASTE, OTHER REFUSE, YARD WASTE MATERIALS, RECYCLING MATERIALS AND SOURCE SEPARATED ORGANICS IN THE TOWNSHIP OF KING

WHEREAS the provisions of paragraph 3 of Section 11 (3) and Sections 75(1) and 127 of the Municipal Act, 2001, as amended, authorize the Township of King to enact by-laws to maintain a system for the collection and disposal of refuse;

WHEREAS such by-laws may require the separation of any class of waste at the point of collection and establish fees for the use of any part of the waste management system and may establish different rules, fees and incentives for different defined areas of the municipality, different classes of premises, and different classes of waste;

WHEREAS the Council of the Corporation of the Township of King deems it appropriate and expedient to repeal By-law Number 2011-45, as amended, and enact a new by-law as part of its continuing effort to reduce waste in the Township and to achieve a cost-effective system of waste management;

NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWNSHIP OF KING HEREBY ENACTS as follows:

1. DEFINITIONS

1.1 In this By-law, the following terms shall have the meanings ascribed thereto as follows:

a) "Ashes" means the solid residue of any fuel used for heating or cooking purposes and cleanings from chimneys;

b) “Appliances and Metal Item” means white goods as identified in Schedule “A”;

c) "Blue Box" means a durable plastic Container distributed or sold by the Township for the Collection of Recyclable Materials;

d) “Bulk Item” means any Refuse that is listed in Schedule “A” of this by-law under “Bulk Items”;

e) “Bundle” means a bundle of magazines, newspapers, cardboard or waste paper which is securely tied with a non-metallic material and weighs less than twenty- two (22) kilograms, or a bundle of branches, twigs or cuttings, which is securely tied with a non-metallic material and which does not exceed 1.2 metres in any physical dimension and does not exceed twenty-two (22) kilograms in weight;

f) “Collection” means the collection of Refuse by a Contractor or the Township and includes delivery to a waste management facility or other site identified by the Director;

g) “Composter” means a retail or home-made unit of reasonable appearance and in reasonable condition, or one that is distributed or sold by the Township, that is intended to accommodate and enhance the decomposition of organic materials into a compost soil or soil supplement;

h) “Container” means a receptacle used to place Refuse for Collection by the Contractor or the Township that meets the specifications and requirements set out in Section 5 of this by-law, and includes a Bundle;

i) “Contractor” means any person, corporation, or individual with whom the Township has entered into a contract for the Collection of Refuse, and includes all employees, agents, or servants of such person, corporation or individual;

j) “Director” means the Director of Engineering, Public Works and Building, or his/her designate or successor;

k) “Dwelling Unit” means a room or a suite of rooms operated as a separate housekeeping unit, other than a hotel, motel, restaurant, industrial, commercial or institutional establishment, that is used or intended to be used as a domicile by one or more persons and that contains cooking, eating, living, sleeping and sanitary facilities;

l) “Garbage” means any Refuse that is listed in Schedule “A” of this by-law under “Garbage”;

m) “Green Bin” means a durable plastic Container distributed or sold by the Township for the Collection of Source Separated Organics;

n) “Intermittently Collected Refuse” means Yard Waste, Christmas trees or other Refuse identified by the Director from time to time;

o) “Multi-Residential Premises” means any structure designated by the Director and which is legally used or operated to accommodate multiple Dwelling Units;

p) “Municipal Act” means the Municipal Act, 2001, S.O. 2001, c. 25, as amended or successor legislation thereto;

q) “Non-Collectible Waste” means any Refuse that is listed in Schedule “A” of this by-law under “Non-Collectible Waste” and any materials or Refuse that is listed as an acceptable item under the Ontario Electronic Stewardship program;

r) “Recyclable Material” means any Refuse that is listed in Schedule “A” of this by-law under “Recyclable Materials”;

s) “Refuse” means any object or material that has been discarded by any person or that is no longer in use or reasonably intended to be used by any person having ownership or control over such object or material;

t) “Regularly Collected Refuse” means any Refuse that is not intermittently Collected Refuse or Non-Collectible Waste;

u) “Source Separated Organics” means any Refuse that is listed in Schedule “B” as a “Source Separated Organics - Acceptable Item”;

v) “Tag” means a sticker purchased from, and issued by, the Township for the purpose of being affixed to a receptacle or Garbage item to permit the Collection of curb side waste;

w) “Township” means The Corporation of the Township of King;

x) “White Goods” means any Refuse that is identified in Schedule “A” of this by- law under “White Goods”; and

y) “Yard Waste” means any Refuse that is identified in Schedule “A” of this by- law under “Yard Waste”.

2. SCOPE OF BY-LAW

2.1 This By-law shall apply to all lands within the Township of King.

3. INTERPRETATIONS

3.1 Wherever this By-law refers to a person or thing with reference to gender or the gender neutral, the intention is to read the By-law with the gender applicable to the circumstances.

3.2 References to items in the plural include the singular, as applicable.

3.3 The words "include", "including" and "includes" are not to be read as limiting the phrases or descriptions that precede or follow them. Specific references to laws in this By-law are printed in Italic font and are meant to refer to the current laws applicable within the Province of Ontario as at the time the By-law was enacted, as they are amended from time to time.

3.4 Section headings in this By-law are not to be considered part of this By-law and are included solely for the convenience of reference and are not intended to be full or accurate descriptions of the sections of this By-law to which they relate.

4. RESPONSIBILITIES AND RESTRICTIONS

4.1 Any person setting out Refuse for Collection shall place it at a location and in a manner that is in accordance with the provisions of this by-law.

4.2 No Person shall set out Non-Collectible Waste, warm Ashes or liquids for collection.

4.3 No Person shall deposit, throw, or cast any Refuse on or in, or otherwise permit or cause Refuse to be deposited, thrown, or cast on or in:

a) Private property without the expressed authorization of the owner or occupant of such property; or

b) Any highway or other municipal property, unless done in compliance with all the provisions of this by-law, without express authorization from the Director, unless such Refuse is deposited into a public Refuse receptacle provided by the Township.

4.4 No person shall place any Refuse for Collection, or allow any Refuse to remain on lands and premises over which the person has control or where the person is an owner, occupant, lessee, tenant or mortgagee in possession, where such Refuse constitutes a nuisance or a hazard to members of the public, emits foul or offensive odours, or attracts or harbours vermin or insects.

4.5 No person shall keep a receptacle or repository for Refuse on the person’s premises in a condition or location so as to cause a nuisance, or to emit foul or offensive odours, or to harbour or attract animals, rodents or other vermin or insects.

4.6 No person shall undertake composting unless:

a) Any composting material is placed in a Composter with a secure lid and the Composter is located in the backyard of a property;

b) Any Composter being used for composting be managed in way to minimize any impact and/or nuisance, including offensive odours and vermin, to neighbouring properties;

c) Only suitable composting materials be placed within the Composter; and

d) Any genuine complaints received from neighbouring property owners or occupiers are addressed forthwith.

4.7 No person shall set out for Collection any Christmas tree unless it is free of all nails, wire, and decorations.

4.8 No person shall set out for Collection any material that is frozen to a Container and cannot be easily removed from the Container by shaking, and the Town or its Contractor shall not be required to Collect any Refuse that is frozen to the ground, or stored in a Container that is frozen to the ground, which cannot be easily detached.

4.9 No person shall place in a Green Bin items listed in Schedule “B” under “Source Separated Organics – Not Acceptable Items”.

4.10 No person shall place Regularly Collected refuse for Collection except on such regular and recurring days as established by the Director and as permitted in this By-law.

4.11 No person shall set out intermittently Collected Refuse for Collection except on such intermittent days as established by the Director and as permitted in this By-law.

4.12 No person shall set out White Goods for Collection except after 5:00 pm on the day immediately preceding the day for which a pick-up of such an item is arranged with the Contractor or the Town, and no later than 7:00 am on the day for which a pick-up of such an item is arranged with the Contractor or the Town.

4.13 Every owner or occupant of a property, whose property is subject to Collection of Refuse pursuant to this By-law, shall ensure that:

a) Regularly Collected Refuse is sorted into appropriate categories of Refuse and placed for Collection in an appropriate Container as prescribed in Section 5 of this By-law;

b) Refuse be set out for Collection in an organized manner and be secured to prevent material from escaping or spilling from its Container;

c) Containers are drained of liquid;

d) Recycling Material is placed for Collection entirely within one or more Blue Boxes;

e) Source Separated Organics are placed for Collection entirely within one or more Green Bins;

f) Containers are set on a level, smooth, hard surface in a location that is easily and safely accessible for Collection and that the area surrounding Containers left out for Collection be kept clear of snow, ice or any other obstructions, including vehicles;

g) Containers be placed as close as possible to the curb or pavement edge without obstructing vehicular or pedestrian traffic or street maintenance, or at a location designated by the Director;

h) Containers are not placed on any part of a highway that is used by vehicular traffic;

i) Containers are not set out for Collection before 5:00 p.m. on the day immediately preceding the day designated by the Township for Collection from the property of the owner or occupant;

j) Containers be placed or set out for Collection no later than 7:00 am on the day designated by the Township for Collection from the property of the owner or occupant; and

k) Containers that have been set out for Collection by, or on behalf of, the property owner or occupant, be removed from municipal property no later than 10:00 p.m. on the day designated by the Township for Collection from the property of the owner or occupant, unless the Contractor or Township forces have yet to attend for the purposes of Collection from the property of such owner or occupant.

4.14 In any case of uncertainty or dispute in relation to the proper location for placing Refuse and Container for Collection, the location shall be determined by the Director.

4.15 In any case of uncertainty or dispute in relation to what constitutes a unit to be serviced by the Township, how it should be categorized, or whether it falls within the jurisdiction of the Township, such matter shall be determined by the Director.

4.16 The number of items put out for Collection from any premises on any Collection day:

a) Shall not exceed a total two (2) Garbage bags;

b) Is unlimited, subject to subsections 4.17 and 4.18, in the case of Refuse that falls into the following categories and that is put out in accordance with all the requirements of this By-law:

i. Recycling Material;

ii. Source Separated Organics; and

iii. Yard Waste.

4.17 The quantity of any Refuse to be collected from any premise during any Collection may be limited at the discretion of the Director should the Director deem an amount that is put out for Collection to be excessive or unreasonable in relation to the normal amount expected from other similar premises in the Township.

4.18 No person shall set out for Collection an excessive or unreasonable quantity of Refuse, in comparison to other premises of similar type, unless:

a) The Director is satisfied that such Refuse was generated on the premises from which it is put out for Collection;

b) The Director is satisfied that such Refuse was not generated as a result of construction activity;

c) The fee prescribed in the Township’s Fees and Charges By-law for such disproportionate Collection is paid; and

d) Arrangements are made with the Township for such a disproportionate Collection prior to the material being put out for Collection and such a request, at the discretion of the Director, can be reasonably accommodated without incurring costs to the Town beyond those covered by the aforementioned fee.

4.19 Any person may contract at his own expense and at his own liability, for private collection and disposal of Refuse by using Containers or bulk containers from any premise. Such a person, and the owner of the property from which the collection is

arranged, shall ensure that the private contractor is operating in compliance with the Environmental Protection Act, R.S.O. 1990, c. E.19, as amended, and any other applicable law, and that no hazard or inconvenience is created to any person by the storage or collection of such Refuse.

4.20 In the event that Refuse is set out for Collection other than in accordance with the provisions of this by-law or the material that is put for Collection does not fall into the category of Garbage, Recyclable Material, Source Separated Organics, Bulk Item, White Goods, Yard Waste, or is otherwise a material that is not permitted or collectable under this by-law, then the Contractor and the Township may decline to collect such Refuse or material and the Contractor and the Township will be relieved of any obligation or requirement to collect or otherwise manage any such Refuse or material. Any such refusal by the Contractor or Town to collect or manage Refuse or material is in addition to and does not limit any other remedy or penalty authorized under this by- law or any other applicable legislation.

4.21 No person shall convey, through any lands or streets within the municipal boundaries of the Township, any Refuse unless it is:

a) Placed in completely covered Containers or in vehicles that are totally enclosed or covered so as to prevent any Refuse from falling upon streets or any other lands;

b) Sealed from flies or vermin; and

c) Placed in a manner, as far as possible, that minimizes the escape of any offensive odours.

4.22 No person shall set out for Collection or convey Refuse in a manner that will create a hazard to the public.

4.23 No person, without authorization from the owner of the Refuse or the Director, shall pick over, interfere with, disturb, remove or scatter any Refuse.

4.24 Any person may dispose of Refuse by delivering it, in accordance with this By-law, to an approved Regional Municipality of York disposal site or transfer station, or to a site otherwise designated by the Director, and depositing it in accordance with the rules and/or regulations of the Regional Municipality of York and/or any other applicable laws.

5. APPROVED RECEPTACLES

5.1 No person shall place Garbage for Collection unless it is contained in a waterproof plastic bag designed for the purpose of containing Garbage. Such a plastic bag may be placed in a rigid, waterproof receptacle that is either plastic or metal with a cover. Such a plastic bag shall meet the following parameters and requirements:

a) Maximum size of 133 litres; and

b) Maximum weight, including Refuse, of twenty-two (22) kilograms.

5.2 No person shall place Recyclable Material out for Collection unless it is contained in either a Bundle or in a Blue Box that is a minimum of sixty (60) litres and a maximum of eighty-three (83) litres in size.

5.3 No person shall place Source Separated Organics for Collection unless contained in a compostable bag or liner that is contained in a Green Bin and has a maximum weight, including Refuse, of twenty-two (22) kilograms and any tie or apparatus that serves to secure the lid of the receptacle is removed, unless it is a lock that is obtained from the Township.

5.4 No person shall place Yard Waste out for Collection unless contained in one of the following Containers:

a) A paper bag specifically designed for yard waste and with a width no greater than sixty-six (66) centimeters, a height no greater than ninety (90) centimeters and a maximum weight, including Refuse, of twenty-two (22) kilograms, with such a bag being durable enough to support the material contained therein when lifted without tearing and having the capability to be securely closed or tied when filled;

b) A rigid, waterproof, durable receptacle that is either metal or plastic with two rigid handles to facilitate collection, not exceeding a diameter of fifty (50) centimeters, height of ninety (90) centimeters and weight, including Refuse, of twenty-two (22) kilograms, with a Township issued sticker indicating “Yard Waste” firmly and visibly attached; or

c) Bundles, so long as any Bundle is only comprised of tree branches and brush and any branches/brush are individually no more than ten (10) centimetres in diameter.

5.5 Any receptacle placed out for Collection shall not be broken or break when lifted or manoeuvred.

5.6 Plastic bags shall not be used as a Container for Recyclable Material, Source Separated Organics or Yard Waste.

5.7 Notwithstanding anything in this By-law, in the case of Multi-Residential Premises, the Director may exempt or amend any requirements of section 5 and/or establish site specific requirements pertaining to Containers that may be used for setting out of Refuse for Collection.

5.8 Notwithstanding anything in this By-law, the Director may exempt, on any terms deemed appropriate by the Director, a person who occupies a residential Dwelling Unit from the requirements of section 5 regarding Container requirements provided that the Director is supplied with such information, forms and documentation, as deemed necessary by the Director, that will satisfy the Director that such an exemption is necessary and appropriate due to a disability, medical condition or another extraordinary circumstance.

6. BIN REPLACEMENT

6.1 Subject to the discretion of the Director, the Township will replace damaged Blue Boxes and Green Bins, provided that any such damaged bins are delivered by the owner or occupier of a premise located within the municipal boundaries of the Township, to a designated Township facility.

6.2 Blue Boxes, Green Bins, Composters and other waste management items, as authorized by the Director, will be available for purchase from the Township upon payment of an appropriate fee or charge set out in the Fees and Charges By-law, or a successor By- law, as amended from time to time.

6.3 The Director may at the Director’s discretion, provide Blue Boxes and Green Bins at no cost or at a rate that is less than the rate set out in the Fees and Charges By-law.

7. OFFENCES, PENALTIES AND ENFORCEMENT

7.1 Every person who contravenes any provisions of this By-law or an order of the Township issued pursuant to this By-law or the Municipal Act is guilty of an offence.

7.2 Any contravention of this By-law shall be deemed to be a continuing offence for each day or part of a day that the contravention remains uncorrected or an order of the Township issued pursuant to this by-law or the Municipal Act is not complied with.

7.3 All contraventions of this By-law or of orders issued by the Township pursuant to this By-law or the Municipal Act are designated as multiple offences.

7.4 Every person convicted of an offence under this by-law is liable to a fine as provided by the Municipal Act.

7.5 Where anything required to be done in accordance with this by-law is not done, the Director may, upon such notice as the Director deems appropriate, enter upon any land at any reasonable time and do such thing that was required to be done at the expense of the person required to do it, and such expense may be recovered by action or in like manner as municipal taxes.

8. POWER OF ENTRY

8.1 The Township may, at any reasonable time, enter on any land for the purpose of carrying out an inspection to determine whether or not the following are being complied with:

a) This By-law;

b) Direction or order made pursuant to this By-law or the Municipal Act;

c) Condition of any permit or licence issued under this By-law; or

d) An order made under Section 431 of the Municipal Act.

8.2 For the purposes of an inspection under subsection 8.1, the person conducting the inspection may:

a) Require the production for inspection documents or things relevant to the inspection;

b) Inspect and remove documents or things relevant to the inspection for the purposes of making copies or extracts;

c) Require information from any person concerning a matter related to the inspection; and

d) Alone, or in conjunction with a person possessing special or expert knowledge, make examination or take tests, samples or photographs necessary for the purposes of the inspection.

8.3 The Township may undertake an inspection pursuant to an order issued under Section 438 of the Municipal Act.

8.4 The power of entry may be exercised by an employee, officer or agent of the Township.

8.5 No person shall decline or neglect to give, produce or deliver any access, information, documents or other things that is requested by the Township carrying out an inspection.

8.6 No person shall hinder or obstruct or attempt to hinder or obstruct the Township, its employees, officers or agents from carrying out any powers or duties under this By-law.

9. SEVERABILITY

9.1 If any provision of this by-law or the application thereof to any person or circumstance is held to be invalid by a court of competent jurisdiction, the invalidity does not affect other provisions or applications of this by-law which can be given effect without the invalid provision or application, and to this end the provisions of this by-law are severable.

10. SHORT TITLE

10.1 This By-law shall be known and may be cited as the “Waste and Collection By-law”.

11. COMING INTO FORCE

11.1 This By-law shall come into force and take effect as of the 9th day of July, 2018.

11.2 Section headings in the By-law are not to be considered part of this By-law and are included solely for the convenience of reference and are not intended to be full or accurate descriptions of the sections of this By-law to which they relate.

12. REPEAL

12.1 By-law 2011-45 is hereby repealed on the same date upon which this By-law comes into force and effect.

A BY-LAW TO AUTHORIZE THE MAYOR AND CLERK TO ENTER INTO AN AGREEMENT OF PURCHASE AND SALE TO ACQUIRE PART OF THE KING CITY PUBLIC SCHOOL PROPERTY BEING PART OF LOT 6, CONCESSION 3, TOWNSHIP OF KING, COMPRISING APPROXIMATELY 0.182 HA (0.45 ACRES) FROM THE YORK REGION DISTRICT SCHOOL BOARD

WHEREAS the York Region District School Board (the “School”) and the Township of King (the “Township”) require an agreement for the acquisition of lands by the Township of King adjacent to 1970 King Road, King City, ON;

NOW THEREFORE the Council of the Corporation of the Township of King HEREBY ENACTS AS FOLLOWS:

1. THAT the Mayor and Clerk are authorized and directed to execute the necessary documents to enter into an Agreement of Purchase and Sale dated July 9, 2018, attached as Appendix “A” hereto, for the acquisition of lands adjacent to 1970 King Road, King City, ON, for the purchase of a portion of the King City Elementary School property being Part of Lot 6, Concession 3, Township of King, comprising approximately 0.182 ha (0.45 acres);

2. THAT the Mayor and Clerk are authorized and directed to execute any minor amendments to the Agreement of Purchase and Sale, if necessary, provided such amendments do not affect the purchase price; and

3. THAT the Mayor and Clerk are authorized and directed to execute all documents necessary to complete the transaction.

The Council of the Corporation of the Township of King HEREBY ENACTS AS FOLLOWS:

1. The action of Council in respect of each motion, resolution and other action passed and taken by the Council at its said meeting is, except where the prior approval of the Ontario Municipal Board is required, hereby adopted, ratified and confirmed.

2. The Mayor and the proper officers of the Municipality are hereby authorized and directed to do all things necessary to give effect to the said action or to obtain approvals where required, and, except where otherwise provided, the Mayor and Clerk are hereby directed to execute all documents necessary in that behalf, and the said Clerk is hereby authorized and directed to affix the corporate seal of the Municipality to all such documents.
