Sec. 74-652. Tax imposed.

(a) Except as otherwise provided in Sections 74-655 and 74-666 of this article, a tax is imposed upon the privilege of using in the county non-titled personal property which was purchased outside of the county. The tax shall be at the rate of 1.25 three-quarters percent (0.75%) of the non-titled personal property's value when first subject to use in the County.

(b) The tax imposed by this article and the obligation to pay the tax is upon the purchaser or user of non-titled personal property.

(c) The tax imposed by this article shall be payable whenever said non-titled personal property is first subject to use in the county. Evidence that the purchaser resides or that property was delivered to a location in the county shall be prima facie evidence that the property is purchased for use in the county and first used in the county on the date of delivery.

(d) The use of non-titled personal property in Cook County by a person who paid a county sales or county retailer‟s occupation tax in another county with respect to the sale or purchase of the property shall be entitled to a credit towards the tax imposed by this article in the amount of the tax actually paid in the other county.

(de) Nothing in this article shall be construed to impose a tax upon any business or activity which, under the constitution and laws of the United States or the State of , may not be made the subject of taxation by the County.

(ef) The tax is imposed, in addition to all other taxes imposed by the County of Cook, the State of Illinois, or any other municipal corporation or political subdivision of the State of Illinois.

Effective Date. Ordinance Amendment shall be effective upon passage.

PROPOSED CONTRACT

ITEM #12

MICHAEL MASTERS, Executive Director, Department of Homeland Security and Emergency Management and SHANNON E. ANDREWS, Chief Procurement Officer requesting authorization for the Chief Procurement Officer to enter into and execute Contract No. 13-50- 12734 with Motorola Solutions, Inc., Schaumburg, Illinois, for the purchase of interoperable radios and associated radio equipment.

Reason: The Department of Homeland Security and Emergency Management (DHSEM) has received and allocated Homeland Security grant funding for the continued purchase of first responder interoperable radio equipment that will be used by various Cook County agencies and municipalities across the County. Approval of this contract will allow for the County to continue to equip first responders throughout Cook County with the necessary equipment for enhanced interoperable communication capabilities.

Estimated Fiscal Impact: None. Grant Funded Amount: $5,000,000.00. Contract period: Upon execution to December 31, 2014. (769-570 Account).

PRESIDENT JUSTICE ADVISORY COUNCIL

PROPOSED GRANT AWARD AMENDMENT

ITEM #13

Transmitting a Communication, dated May 29, 2013 from

JULIANA STRATTON, Executive Director, Justice Advisory Council requesting authorization to amend the grant period for Project Reclaim from the original end date November 27, 2013 to the new end date of June 30, 2013. The new term of the grant will be November 27, 2012 to June 30, 2013. This will facilitate a transition in the management of this grant at the State of Illinois. A new grant agreement will be provided by the Illinois Criminal Justice and Information Authority (ICJIA) for a period between July 1, 2013 and November 27, 2013. These changes will permit the Illinois Department of Healthcare and Family Services to complete their transition to managing the Project Reclaim grant. This amendment will provide funds to continue to support Project Reclaim, which provides a wide range of services to 10 to 17 year-old high-risk youth with the goal of improving the safety of the community by reducing recidivism of juvenile offenders. Services provided to the youth under the program will not be disrupted.

The authorization to accept the original grant was given on January 16, 2013 by the Cook County Board of Commissioners in the amount of $573,285.00 with a cash match of $63,698.00.

Estimated Fiscal Impact: None. Amended funding period: November 27, 2012 through June 30, 2013.

PROPOSED ORDINANCE AMENDMENT

EXEMPTIONS FOR OWNER-OCCUPIED RENTAL PROPERTIES OF SIX UNITS OR LESS FROM PROVISIONS OF THE PUBLIC ACCOMMODATIONS AND HOUSING SECTIONS OF THE HUMAN RELATIONS CHAPTER OF CODE

BE IT ORDAINED, by the Board of Commissioners of Cook County that Chapter 42 Human Relations, Article II Human Rights, Sections 42-37 and 42-38, of the Cook County Code is hereby amended as follows:

Sec. 42-37. Public Accommodations.

(a) Prohibition. No person that owns, leases, rents, operates, manages, or in any manner controls a public accommodation in Cook County shall withhold, deny, curtail, limit, or discriminate concerning the full use of such public accommodation by any individual on the basis of unlawful discrimination.

(b) Exceptions.

(1) The prohibition contained in this section shall not apply to sex discrimination in any of the following:

a. Distinctly private facility. Any facility that is distinctly private in nature, such as rest rooms, shower rooms, bath houses, dressing rooms, or health clubs.

b. Sleeping rooms. Any facility that restricts rental of residential or sleeping rooms to individuals of one sex.

c. Educational institutions. Any educational institution that restricts enrollment of students to individuals of one sex.

d. Determination of sex or gender. For the purposes of the exceptions set forth in Section 42-37(b)(1)a through c, the determination of an individual's sex or gender shall be based upon the sex or gender of that individual as reflected on any official identification of that individual recognized by the State of Illinois, including a driver's license or state identification card. page 9 AGENDA Meeting of June 19, 2013

(2) The Cook County Commission on Human Rights ("Commission") as defined in Section 42-34 shall adopt rules specifying any additional exceptions to the prohibition contained in this section based on bona fide considerations of public policy.

(3) Notwithstanding anything to the contrary contained in this article, nothing contained in this section shall require any person who does not owner-occupied rental properties of six units or less to participate in the Federal Section 8 housing assistance program (42 U.S.C. § 1437f) or to accept any subsidy, payment assistance, voucher, or contribution under or in connection with such program or to lease or rent to any tenant or prospective tenant who is relying on such a subsidy, payment assistance, contribution, or voucher for payment of part of the rent for such place of accommodation.

(c) Sexual harassment.

(1) No person who owns, leases, rents, operates, manages, or in any manner controls a public accommodation shall engage in sexual harassment affecting access to, participation in, or the full use of such public accommodation.

(2) When used in this subsection, the term "sexual harassment" means any unwelcome sexual advance, request for sexual favors, or conduct of a sexual nature when:

a. Submission to such conduct is an explicit or implicit term or condition of an individual's access to, participation in, or full use of a public accommodation;

b. Submission to or rejection of such conduct by an individual is used as the basis for any decision affecting the individual's access to, participation in, or full use of a public accommodation; or

c. Such conduct has the purpose or effect of substantially interfering with an individual's access to, participation in, or full use of any public accommodation or creating an intimidating, hostile, or offensive environment with respect thereto.

Sec. 42-38. Housing.

(a) Definitions. The following words, terms and phrases, when used in this article shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning: page 10 AGENDA Meeting of June 19, 2013

Person shall mean any person as defined in Section 46-31(15) of this article that is also an owner, lessor, sublessor, assignor, managing agent, or other individual, firm, or corporation having the right to sell, rent, lease, or sublease any housing unit within Cook County, or any agent, broker, or other individual working on behalf of any such individual, firm, or corporation.

Real estate transaction means the sale, exchange, rental, occupancy, lease, sublease, or lease renewal of real property for residential purposes in Cook County or the provision of services or utilities in connection with such sale, exchange, rental, occupancy, lease, sublease, or lease renewal. The term "real estate transaction" also means with respect to activity conducted or property located in Cook County, the brokering or appraising of residential real property in Cook County and the making, purchasing, or guaranteeing of loans or mortgages or providing any other financial assistance either:

(1) For purchasing, constructing, improving, repairing, or maintaining a dwelling; or

(2) Secured by residential real property.

(b) Prohibitions.

(1) Terms and conditions. No person shall make any distinction, discrimination, or restriction in the price, terms, conditions, or privileges of any real estate transaction, including the decision to engage in or renew any real estate transaction, on the basis of unlawful discrimination.

(2) Discriminatory communications. No person shall publish, circulate, issue, or display, or cause to be published, circulated, issued, or displayed, any communication, notice, advertisement, sign or other writing of any kind relating to a real estate transaction which will indicate or express any unlawful limitation or discrimination on the basis of unlawful discrimination.

(3) Listings. No person shall deliberately and knowingly refuse examination of any listing of residential real property within Cook County to any individual because of unlawful discrimination.

(4) Representations. No person shall deliberately and knowingly represent to an individual that residential real property is not available for inspection, sale, rental, or lease in Cook County when in fact it is available, or fail to bring a residential real estate listing in Cook County to an individual's attention, or refuse to permit a person to inspect residential real property in Cook County because of unlawful discrimination.

(5) Blockbusting. No person shall solicit, for sale, lease, or listing for sale or lease, residential real property within Cook County on the grounds of loss of value due to the present or prospective entry into any neighborhood of any individual or individuals of any particular race, color, sex, age, religion, disability, national origin, ancestry, sexual orientation, marital status, parental status, military discharge status, source of income, gender identity, or housing status.

(6) Encouragement of blockbusting. No person shall distribute or cause to be distributed written material or statements designed to induce any owner of residential real property in Cook County to sell or lease such owner's property because of any prospective change in the race, color, sex, age, religion, disability, national origin, ancestry, sexual orientation, marital status, parental status, military discharge status, source of income, gender identity, or housing status of individuals in the neighborhood.

(7) Creating alarm. No person shall intentionally create alarm among residents of any community within Cook County by transmitting communication in any manner, including a telephone call whether or not conversation thereby ensues, with a design to induce any person within Cook County to sell or lease the person's residential real property within Cook County because of the present or prospective entry into the vicinity of the property of any individual or individuals of any particular race, color, sex, age, religion, disability, national origin, ancestry, sexual orientation, marital status, parental status, military discharge status, source of income, gender identity, or housing status.

(c) Exceptions. The prohibitions in this section shall not apply to any of the following:

(1) Age. Restricting rental or sale of a housing accommodation to an individual of a certain age group:

a. When such housing accommodation is authorized, approved, financed, or subsidized in whole or in part for the benefit of that age group by a unit of State, local, or Federal government; or

b. When the duly recorded initial declaration of a condominium or community association limits such housing accommodations to individuals 50 years of age or older, provided that an individual or members of the household of an individual owning or renting a unit in such housing accommodation prior to the recording of the initial declaration shall not be deemed to be in violation of the age restriction as long as the individual or household member continues to own or reside in the housing accommodation.

(2) Religion. Limitation by a religious organization, association, or society, or any not-for- profit institution or organization operated, supervised, or controlled by or in conjunction with a religious organization, association, or society, of the sale, rental, or occupancy of a dwelling which it owns or operates for other than a commercial purpose to individuals of the same religion, or from giving preference to such individuals.

(3) Single sex. Restricting the rental of rooms in a housing accommodation to individuals of one sex. The determination of an individual's sex or gender shall be based upon the sex or gender of that individual as reflected on any official identification of that individual recognized by the State, including a driver's license or State identification card.

(4) Private rooms. Rental of a room or rooms in a private home by an owner if the owner or a member of the owner's family resides therein or, while absent for a period of not more than 12 months, if the owner or a member of the owner's family intends to return to reside therein.

(5) Housing assistance program. Notwithstanding anything to the contrary contained in this article, nothing contained in this section shall require any person who does not owner- occupied rental properties of six units or less to participate in the Federal Section 8 housing assistance program (42 U.S.C. § 1437f) to accept any subsidy, payment assistance, voucher, or contribution under or in connection with such program or to lease or rent to any tenant or prospective tenant who is relying on such a subsidy, payment assistance, contribution, or voucher for payment of part of the rent for such housing accommodation.

(d) Sexual harassment.

(1) No person shall engage in sexual harassment in any real estate transaction.

(2) When used in this subsection, the term "sexual harassment" means any unwelcome sexual advance, request for sexual favors, or conduct of a sexual nature when:

a. When such housing accommodation is authorized, approved, financed, or subsidized in whole or in part for the benefit of that age group by a unit of State, local, or Federal government; or

b. When the duly recorded initial declaration of a condominium or community association limits such housing accommodations to individuals 50 years of age or older, provided that an individual or members of the household of an individual owning or renting a unit in such housing accommodation prior to the recording of the initial declaration shall not be deemed to be in violation of the age restriction as long as the individual or household member continues to own or reside in the housing accommodation.

(2) Religion. Notwithstanding anything to the contrary in this Ordinance, nothing contained in this Chapter shall require any property owner who owns real property with six or less dwelling units and who does not participate in the federal Housing Choice Voucher program to accept any subsidy, payment, assistance, voucher, or contribution under or in connection with such program or to lease or rent to any tenant or prospective tenant who is relying on such a subsidy, payment, assistance, contribution or voucher for payment of part of the rent for such housing accommodation.

Notwithstanding anything to the contrary contained in this article, nothing contained in this section shall require any person who does not participate in the Federal Section 8 housing assistance program (42 U.S.C. § 1437f) to accept any subsidy, payment assistance, voucher, or contribution under or in connection with such program or to lease or rent to any tenant or prospective tenant who is relying on such a subsidy, payment assistance, contribution, or voucher for payment of part of the rent for such housing accommodation.

a. Nothing contained in this section shall require an owner of rental properties to alter any screening standard or leasing policy that is consistently applied to all other lessees in order to participate in the Federal Housing Choice Voucher Program.

URGING FEMA TO CHANGE THE POPULATION-BASED FORUMLA IN ORDER TO ALLOW COOK COUNTY TO OBTIAN PUBLIC ASSISTANCE FUNDING

WHEREAS, the Cook County Board calls upon the Federal Emergency Management Agency (FEMA) to change the population-based formula it uses to determine which counties and states are eligible to obtain federal aid funding; and

WHEREAS, the population-based formula unfairly penalizes large counties and states, thus weakening their ability to recover after natural disasters like the recent flooding; and

WHEREAS, Cook County, the second largest county in the nation, sustained over $10 million in damages during the recent flooding that occurred in April; and

WHEREAS, Cook County is not able to obtain federal assistance funding unless it suffers at least $17,922,000.00 in damages due to the population-based formula; and

WHEREAS, Cook County must realize roughly six times more damage than the next largest county in Illinois in order to be eligible for federal assistance; and

WHEREAS, individuals in Cook County were able to qualify for public assistance funding, yet the municipalities and county in which these residents live were not able to meet the threshold; and

WHEREAS, these funds are desperately needed rebuild lost infrastructure and repair damages.

NOW, THEREFORE, BE IT RESOLVED, the Cook County Board of Commissioners urges the Federal Emergency Management Agency (FEMA) to revisit their current population-based formula that determines public assistance funding because it unfairly penalizes large counties like the County of Cook.

This agreement was approved by the CCHHS Board of Directors at their meeting of May 31, 2013 and is presented to you because of its nature as an intergovernmental agreement requiring your approval under applicable law.

The proposed intergovernmental agreement provides for the sharing of vital records data to facilitate the implementation of the Medicaid 1115 Waiver Demonstration Project ("CountyCare") from the federal Centers for Medicare and Medicaid Services. Based on eligibility criteria set forth in the Special Terms and Conditions for the CountyCare Demonstration Project, which will expand Medicaid eligibility, CCHHS will need to work with the State of Illinois to enroll low income Illinois adults, who have not been eligible for Medicaid in the past, into CountyCare during the term of the CMS Waiver. To prepare CountyCare applications for submission to the State of Illinois for review and approval, CCHHS needs to verify birth records of Medicaid applicants to ensure proof of citizenship, an eligibility criteria of CountyCare, and needs access to vital records data from the County Clerk and IDPH to verify birth records of eligible adults within Cook County and outside of Cook County, but within the State of Illinois during the term of the CMS Waiver. This agreement will facilitate the enrollment and membership of individuals into the CountyCare program by allowing CCHHS access to statewide vital records data. The term of this agreement is through January 31, 2014.

Reason: The State of Illinois Department of Central Management Services (CMS) entered into a contract on December 11, 2012 for the provision of goods and services by the consultant for CMS relative to CMS Disparity Study; and the County wishes to leverage the procurement efforts of CMS; and the Cook County Office of Contract Compliance desires certain specific and similar services of the consultant; and other County offices, departments and agencies may utilize this contract for specific contracted procurement efforts, as may be applicable via future modifications to this contract.

The vendor will conduct a disparity study, which includes data collection and analysis to provide all of the evidentiary elements necessary to meet the requirements of strict constitutional scrutiny and best practices in the Minority- and Women-Owned Business Enterprise (M/WBE) program evaluation. The data will provide the County with a reliable availability and disparity analysis to provide validity to the County's M/WBE Program. The study compares the actual number of M/WBEs that exist within a specific geographical area against the actual number of M/WBEs being utilized in government contracts. A disparity exists when there is underutilization of available M/WBEs. This study will be conducted for Cook County Government including Cook County Health and Hospital Systems and the Forest Preserve District of Cook County (FPD). The FPD will reimburse the County for their portion of the study.

Estimated Fiscal Impact: $673,506.50 (*FY 2013: $500,000.00; FY 2014: $13,149.75). Contract period: This contract will commence upon fully execution and shall end eighteen (18) months thereafter. (022-260 Account).

LYDIA MURRAY, Chief Information Officer and SHANNON E. ANDREWS, Chief Procurement Officer requesting authorization for the Chief Procurement Officer to enter into and execute a contract with Spinnaker Support, LLC, Denver Colorado, for a payroll tax software patch and JD Edwards ("JDE") maintenance.

Reason: The Bureau of Technology seeks to procure the following services from Spinnaker Support, LLC (“Spinnaker”): (a) a payroll tax software patch and (b) support services for the County's JD Edwards (JDE) software.

The Spinnaker payroll tax software patch, the only known such solution in the market, will enable to the County to manage County payroll and issue payroll checks. Without this solution, at year‟s end, the County's current payroll tax calculation software will no longer function with the County‟s legacy version of JDE. As a result, at that time, the County will be unable to process payroll and issue payroll checks.

In seeking a solution to this problem, the County has procured the services of Denovo, which will migrate Bureau of Technology (BOT) outdated JDE software to a current cloud-based JDE version that communicates with Vertex. However, the delivery of this solution is extremely close to the date at which the County‟s payroll will fail. Accordingly, the County is in need of a “Plan B” solution to mitigate its significant risk of complete payroll failure. The Spinnaker solution will offer this "Plan B."

Bundled with this patch software, Spinnaker provides maintenance support services for JDE. The County's purchase of this bundled service is warranted, given that the County currently lacks any support contract - atypical for standard operations - for JDE.

Spinnaker will provide 35% MBE/WBE direct participation under this contract.

Estimated Fiscal Impact: $390,000.00 [$315,000.00 - (009-441 Account); and $75,000.00 - (717/009-579 Account)]. Contract period: June 19, 2013 through June 30, 2014.

The Chief Procurement Officer concurs.

Vendor has met the Minority and Women Business Enterprise Ordinance.

PROPOSED FUNDING SOURCES AND USES FOR THE 2013 PROGRAM YEAR

MARÍA CHOCA-URBAN, Director, Department of Planning and Development transmitted herewith are the proposed funding sources and uses (including specific project funding recommendations as applicable) for the 2013 Program Year for the Community Development Block Grant (CDBG); Emergency Solutions Grant (ESG) (formerly known as the Emergency Shelter Grant); and HOME Investment Partnerships (HOME) programs.

These funds are provided to Cook County via an annual formula grant through the U.S. Department of Housing and Urban Development (HUD) and are restricted for use within suburban Cook County. The Cook County Community Development Advisory Council (CDAC) adopted these recommendations at a public hearing held on May 21, 2013.

The 2013 Program Year funding allocations are as follows:

CDBG: $9,879,916.00 ESG: $641,618.00 HOME: $4,011,248.00

CDBG funding may be utilized to support various community development activities for the benefit of low- and moderate-income persons.

ESG funding may be utilized to support various shelter and service activities for the benefit of homeless persons or persons at-risk of .

HOME funding may be utilized to support affordable housing development activities for the benefit of low-income persons. Please see the attached summary of proposed uses. Given the cyclical nature of affordable housing development, specific project recommendations will continue to be submitted to the Board for consideration on a rolling basis throughout the year as required.

The proposed sources and uses of all program funds will be incorporated into the County‟s Annual Action Plan, which will be made available for public comment prior to submittal to HUD by August 15, 2013.

I respectfully request approval of the recommended proposed funding sources, uses, and project recommendations as specified for the 2013 CDBG, ESG, and HOME funds; and that the Bureau Chief of Economic Development or his/her designee be authorized to execute, on behalf of the County of Cook any and all documents necessary to further the programs approval herein, including but not limited to, subrecipient agreements, intergovernmental agreements, amendments, and modifications thereto, loan documents, lien assignments, releases of mortgages and liens, and mortgage assumptions. page 40 AGENDA Meeting of June 19, 2013

MARIA CHOCA URBAN, Director, Department of Planning and Development respectfully submitting this Resolution regarding adding members to the Cook County HOME Consortium.

Given the current economic climate and the continual reduction in Federal dollars to entitlement programs at the Federal, State, and Local levels, various agencies are exploring options for consolidating, streamlining, and reducing costs of related program administration. Towards these ends, the U.S. Department of Housing and Urban Development (HUD) has solicited assistance from the Cook County Department of Planning and Development in recruiting current non-member municipalities to join the Cook County HOME Consortium. As lead entity of the HOME Consortium, Cook County administers HOME Investment Partnerships Program (HOME) funding for affordable housing awarded by HUD on behalf of suburban Cook County.

While an initial County corporate investment is needed to facilitate these membership additions in compliance with HUD rules, the related annual ongoing benefit is significant particularly given national budget reductions to the HOME Program. Specifically, an investment of $ 84,562.50 has the potential to increase the County‟s HOME funding allocation by over $84,000 annually.

PROPOSED RESOLUTION

WHEREAS, the County of Cook (the County) is an entitlement community pursuant to the regulations of the HOME Investment Partnerships Program (HOME) at 24 CFR Part 92, which entitles the County to receive an annual allocation of HOME grant funds from the U.S. Department of Housing and Urban Development (HUD); and

WHEREAS, the amount of HOME funds that the County receives pursuant to entitlement status is determined by a HUD formula that takes into consideration the populations of the municipalities within its jurisdiction; and

WHEREAS, certain municipalities (the Electing Municipalities) within the County can elect to join the County‟s HOME Consortium (the Consortium), which would allow HUD to take into account the populations of these municipalities when calculating the County‟s annual HOME funds entitlement grant, thus increasing the County‟s annual allocation; and page 41 AGENDA Meeting of June 19, 2013

WHEREAS, the Electing Municipalities are pursuing joining the Consortium, which will be formally signified by resolution of their municipal boards; and

WHEREAS, each Electing Municipality must conform to the Consortium Program Year, which runs October 1 through September 30 in accordance with HUD rules; and

WHEREAS, as the Electing Municipalities move to the Consortium Program Year they may experience a gap in their Community Development Block Grant (CDBG) administrative and program funding for the few months after their old program year expires and before the Consortium Program Year begins. (i.e., if their current program year ends on June 30 there is a three month gap before the new program year starts on October 1); and

WHEREAS, the County wants to maximize its federal allocation of HOME Funds by including the Electing Municipalities in the Consortium. The County‟s HOME Investment Partnerships Program could see up to a $84,000.00 increase over one year by adding the populations of the Electing Municipalities into the formula for calculating the grant amount.; and

WHEREAS, to facilitate the addition of the Electing Municipalities to the Consortium, the County will provide the financing for the loss in CDBG administrative funding and program funding that is needed to align the program years in each Electing Municipality; and

WHEREAS, HUD requires that the Cook County Board of Commissioners act by resolution to add the new municipalities into the HOME Consortium.

NOW, THEREFORE, BE IT RESOLVED, by the President and the Board of Commissioners of the County of Cook, Illinois:

Section 1: That the County will set aside no more than $84,560.50 in non-federal dollars to be used to fund the administrative and programmatic costs incurred by the Electing Municipalities for periods not funded, due to the alignment of the program years of the Electing Municipalities with the Consortium Program Year in accordance with HUD requirements.

Section 2: That the County be and is hereby authorized to enter into an Addendum to the HOME Investment Partnerships Program Consortium Agreement for Federal Fiscal Years 2014 to add the Electing Municipalities and that the President, Bureau Chief of Economic Development, County Clerk or their designee are hereby authorized to execute said HOME Investment Partnerships Program Consortium Agreement Addendums, any additional documents necessary to further the aforementioned initiative, and any modifications thereto. page 42 AGENDA Meeting of June 19, 2013

1666 E. Touhy, LLC requests approval of the tax incentive based on the special circumstances that the property has been vacant for less than 24 months and is being purchased for value under the Class 6b Ordinance. This Resolution is required so that the company can complete its application to the Assessor of Cook County.

WHEREAS, the Cook County Board of Commissioners has adopted a Real Property Assessment Classification 6b that provides an applicant a reduction in the assessment level for an industrial facility; and

WHEREAS, the County Board of Commissioners has received and reviewed an application from 1666 E. Touhy, LLC and Resolution No. R-115-12 from the City of Des Plaines for an abandoned industrial facility located at 1666 East Touhy Avenue, Des Plaines, Cook County, Illinois, County Board District #17, Property Index Number: 09-28-300-031-0000; and

WHEREAS, Cook County has defined abandoned property as buildings and other structures that, after having been vacant and unused for at least 24 months, are purchased for value by a purchaser in whom the seller has no direct financial interest; and page 43 AGENDA Meeting of June 19, 2013

WHEREAS, industrial real estate is normally assessed at 25% of its market value, qualifying industrial real estate eligible for the Class 6b can receive a significant reduction in the level of assessment from the date that new construction or rehabilitation has been completed, or in the case of abandoned property from the date of substantial re-occupancy. Properties receiving Class 6b will be assessed at 10% of the market value for 10 years, 15% for the 11th year and 20% in the 12th year; and

WHEREAS, in the instance where the property does not meet the definition of abandoned property, the municipality or the Board of Commissioners, may determine that special circumstances justify finding that the property is abandoned for purpose of Class 6b; and

WHEREAS, in the case of abandonment of less than 24 months and purchase for value, by a purchaser in whom the seller has no direct financial interest, the County may determine that special circumstances justify finding the property is deemed abandoned; and

WHEREAS, Class 6b requires the validation by the County Board of the shortened period of qualifying abandonment in cases where the facility has been abandoned for less than 24 consecutive months upon purchase for value; and

WHEREAS, the Cook County Board of Commissioners has determined that the building was abandoned for two (2) months at the time of application, and that special circumstances are present; and

WHEREAS, the applicant estimates that the re-occupancy will retain 70 full-time jobs, 10 new full-time jobs and 10 to 25 construction jobs; and

WHEREAS, the City of Des Plaines states the Class 6b is necessary for development to occur on this specific real estate. The municipal Resolution cites the special circumstances include that the property has been vacant for less than 24 months; there has been a purchased for value and the property is in need of substantial rehabilitation; and

WHEREAS, the applicant acknowledges that it must provide an affidavit to the Assessor's Office stipulating that it is in compliance with the County‟s Living Wage Ordinance prior to receiving the Class 6bincentive on the subject property.

NOW, THEREFORE, BE IT RESOLVED, by the President and Board of Commissioners of the County of Cook, that the President and Board of Commissioners validate the property located at 1666 East Touhy Avenue, Des Plaines, Cook County, Illinois, is deemed abandoned with special circumstances under the Class 6b; and

BE IT FURTHER RESOLVED, that the County Clerk is hereby authorized and directed to forward a certified copy of this Resolution to the Office of the Cook County Assessor.

The contract was approved by the Cook County Board of Commissioners on September 1, 2010. The first option year renewal for $136,000.00 was exercised upon approval of the County Board on December 1, 2011. The second renewal for the first six (6) months of the second option year was exercised upon approval of the County Board on November 1, 2012. This increase would constitute the exercise of the last six (6) months of the second option year.

The Adult Probation Department is currently preparing a new RFP for these services. The expiration date of the current contract is May 31, 2013.

The grant will fund the Circuit Court's Family Violence Coordinating Councils‟ participation in the Illinois Integrated Protocol Initiative.

The Initiative is a program of the U.S. Department of Justice, Office of Violence Against Women. The grant award will fund statewide training for public safety officials on model protocols for responding to victims of domestic violence and elder abuse, including victims who are persons with disabilities. The Circuit Court's Family Violence Coordinating Councils have been selected to join the 22 other such councils in Illinois to collaborate with the state-wide Family Violence Coordinating Councils organization and the Illinois Criminal Justice Information Authority on this Initiative.

The primary role of the Circuit Court‟s Councils in the Initiative, under the direction of the director of the Circuit Court's Family Violence Coordinating Councils Program, will be to train professionals in Cook County on these protocols. The grant will fund program training, transportation and a portion of the salary and fringe benefits of the Councils‟ program director.

A cash match is not required, but the program would necessitate supplemental county funding for salary and fringe benefits.

Estimated Fiscal Impact: $1,347.00. Grant Award: $33,040.00. Funding period: April 1, 2013 through March 31, 2014. (310-818 account).

The Cook County ICAC Task Force partners include representatives of the State‟s Attorney‟s Office, the Chicago Police Department and law enforcement agencies from throughout Cook County. Task Force partners from local law enforcement agencies concentrate their investigative efforts in the City of Chicago and the entire outlying suburban Cook County area. This grant does not require a match contribution.

The authorization to accept the original grant award was given on September 7, 2011 by the Cook County Board of Commissioners in the amount of $319,143.00.

EVIDENCE-BASED COOK COUNTY BAIL SYSTEM REFORM

WHEREAS, The Cook County Jail is on the verge of capacity and there exist serious and legitimate concerns that it will exceed capacity this summer; and

WHEREAS, in such an event, the County faces the threat of being ordered to build another jail at a cost of tens of millions of taxpayer dollars on an unneeded facility; and

WHEREAS, our jail overcrowding situation is the consequence of a failing pretrial justice system; and

WHEREAS, while nationally, 60% of inmates in local jails are pre-trial detainees, pre-trial detainees account for 90% of the inmates in Cook County Jail; and

WHEREAS, approximately 70% of incarcerated pre-trial detainees are being held pursuant to charges for non-violent offenses; and

WHEREAS, in 2011, 79% of Cook County defendants were either ordered to pay financial bond to secure release pending trial or held without bond, 13% were ordered released subject to electronic monitoring and only 8% were released pursuant to an I-bond; which allows defendants to be released upon a signature but still subjects them to payment of the full bond amount if they fail to make a required court appearance; and

WHEREAS, by contrast, New York City releases approximately 70% of their felony pre-trial defendants on personal recognizance, and Washington, D.C., releases over 80% of their felony pre-trial defendants on personal recognizance, yet both cities have high court appearance rates and low re-arrest rates; and

WHEREAS, when properly administered, bail is designed to be a function of risk to society or flight risk, not simply a means test of ability to pay; and

WHEREAS, the overreliance on monetary bail, and the inability of many detainees is among the primary drivers of the level and growth in our jail population; and

WHEREAS, an overreliance on monetary bail additionally means that those too poor to pay remain in jail regardless of their risk level or presumed innocence; and

WHEREAS, pre-trial detainees are more likely to be convicted of a felony, receive a sentence of incarceration, and be sentenced longer than those released while awaiting trial; and page 2 NEW ITEMS AGENDA Meeting of June 19, 2013

WHEREAS, pre-trial detention inherently hinders defendants from tending to their families, holding employment or otherwise participating in society, instead subjecting than to unnecessary immersion in prison culture; and

WHEREAS, the growing use of validated risk assessments create less need for money bail as people can be rated according to potential risk and released appropriately; and

WHEREAS, a Pew Center on the States study showed that 84 percent of surveyed American voters believed that community-based programs could be better used instead of relying on incarceration for people convicted of low-level, non-violent offenses; and

WHEREAS, according to the Justice Policy Institute, “evidence suggests that up to 25% more people could be safely released from U.S. jails while awaiting trial if the proper procedures are put in place, including valid risk assessments and appropriate community supervision”; and

WHEREAS, in fiscal year 2012, the Cook County Board of Commissioners appropriated over $236 million dollars to its Department of Corrections, an increase of more than $10 million dollars from 2011, and an increase of over $57 million dollars since 2002; and

WHEREAS, a 25% reduction in the average daily jail population would save Cook County taxpayers millions of dollars annually; and

WHEREAS, the adoption of evidence-based assessment of risk in setting pre-trial conditions of bail, coupled with the expansion of pre-trial defendant interviews can substantially reduce the rate of pre-trial detentions without impairing the judicial process or threatening public safety; and

NOW THEREFORE BE IT RESOLVED, that the Cook County Board of Commissioners urges the Cook County judiciary to work with other official stakeholders to design and implement a revised bail structure reflective of the true purpose and safeguards of bail, aimed toward a goal of lowering jail admissions by 25% over the next twelve months.

REDUCING THE IMPACT OF VACANT REAL ESTATE AND ESTABLISHING A SUSTAINABLE EMERGENCY RELIEF PROGRAM

BE IT ORDAINED, by the Board of Commissioners of Cook County that Chapter 74,Taxation, Article II, Real Property Taxation, Division 2, Classification System for Assessment, Sections 74-63 and 74-71 of the Cook County Code shall be amended as follows:

Sec. 74-63 Assessment classes.

Real estate is divided into the following assessment classes:

(1) Class 1. Unimproved real estate.

(2) Class 2. Real estate:

a. Used as a farm,

b. Used for residential purposes when improved with a house, an apartment building of not more than six living units, or residential condominium, a residential cooperative or a government-subsidized housing project, if required by statute to be assessed in the lowest assessment category,

c. Improved with a building put to commercial and residential use, of six or less units where the building measures less than 20,000 square feet of above grade space; or

d. Real estate improved with a single room occupancy building, as defined in this division, provided that:

1. At least one-third of the single room occupancy units are leased at no more than 80 percent of the current "Fair Market Rent Schedule for Existing Housing for Single Room Occupancy Units" as set by the United States Department of Housing and Urban Development (hereinafter "FMR schedule");

2. No single room occupancy units are leased at rents in excess of 100 percent of the current FMR schedule;

3. The overall maximum average rent per unit for all single room occupancy units in the building shall not exceed 90 percent of the current FMR schedule; and

4. The subject property is in substantial compliance with all local building, safety and health codes and requirements.

In the event that the owner fails to comply with these requirements, the Class 2 classification shall be revoked.

(3) Class 3. All improved real estate used for residential purposes which is not included in any other class.

(4) Class 4. Real estate owned and used by a not-for-profit corporation in furtherance of the purposes set forth in its charter unless used for residential purposes. If such real estate is used for residential purposes, it shall be classified in the appropriate residential class.

(5) Class 5a. All real estate not included in Class 1, Class 2, Class 3, Class 4, Class 5b, Class 6b, Class C, Class 7a, Class 7b, Class 8, Class 9, Class S or Class L of this section.

(6) Class 5b. All real estate used for industrial purposes as defined herein and not included in any other class.

(7) Class 6b. Real estate used primarily for industrial purposes, consisting of all newly constructed buildings or other structures, including the land upon which they are situated; or abandoned property, including the land upon which such property is situated; or all buildings and other structures which are substantially rehabilitated to the extent such rehabilitation has added to their value, including qualified land related to the rehabilitation. Land qualifies when the rehabilitation adds vertical or horizontal square footage to the improvements. The amount of land eligible for the incentive shall be in such proportion as the square footage added by the rehabilitation bears to the total square footage of the improvements on the parcel.

a. An applicant must obtain from the municipality in which the real estate is located or the County Board if the real estate is located in an unincorporated area, an ordinance or resolution expressly stating that the municipality or County Board, as the case may be, has determined that the incentive provided by Class 6b is necessary for development to occur on that specific real estate and that the municipality or County Board, as the case may be, supports and consents to the Class 6b application to the Assessor. A certified copy of the ordinance or resolution need not be filed at the time of filing the Class 6b eligibility application with the Assessor, but must be filed with the Assessor no later than the date an assessment appeal is filed to request the class change to Class 6b. If the resolution is not filed at the time of the eligibility application, the applicant shall instead file, at that time, a letter from the municipality or the County, as the case may be, confirming that a resolution or ordinance supporting the incentive has been requested.

A copy of the resolution or letter confirming that a resolution has been requested, whichever is filed with the application, will be forwarded by the Assessor’s Office to the Secretary of the County Board for distribution to the members of the County Board from the affected districts. c. Class 6b applications for newly constructed or substantially rehabilitated buildings and other structures must be made to the Assessor within one year prior to the commencement of such new construction or substantial rehabilitation to qualify for a Class 6b incentive. With respect to abandoned property, the Class 6b application must be made to the Assessor prior to the commencement of the reoccupation of the vacant and unused property. c. d. In the instance where real estate does not meet the definition of abandoned property as defined herein, the municipality or the County Board, as the case may be, may still determine that special circumstances justify finding that the property is deemed "abandoned" for purpose of Class 6b, unless. The finding of abandonment, along with the specification of the special circumstances, shall be included in the resolution or ordinance supporting and consenting to the Class 6b application. Notwithstanding the foregoing, special circumstances may not be determined to justify finding that a property is deemed "abandoned" where: A. There has been a purchase for value and the buildings and other structures have not been vacant and unused prior to such purchase; or B. There has been no purchase for value and the buildings and other structures have been vacant and unused for less than 24 continuous months. The finding of abandonment, along with the specification of the special circumstances, shall be included in the resolution or ordinance supporting and consenting to the Class 6b application. Such resolution or ordinance shall be included with the eligibility application. If the ordinance or resolution is that of a municipality, the approval of the County Board is required to validate such a finding that the property is deemed "abandoned" for purposes of Class 6b, and a County resolution to that effect shall be obtained. included with the Class 6b eligibility application. The applicant must obtain the municipal enabling ordinance with the required finding of special circumstances and present such municipal ordinance to the Board of Commissioners of Cook County prior to its determination as to whether it will validate such a finding that the property is deemed "abandoned" for purposes of Class 6b and provide a County resolution to that effect. A certified copy of an ordinance or resolution finding that special circumstances exist, as well as a certified copy of a County ordinance or resolution validating such a finding that the property is deemed "abandoned" for purposes of Class 6b need not be filed at the time of filing the Class 6b eligibility application with the Assessor, but must be filed with the Assessor no later than the date an assessment appeal is filed to request the class change to Class 6b. If the resolution is not filed at the time of the Class 6b eligibility application, the applicant shall instead file, at that time, a letter from the municipality or the County as the case may be, confirming that a resolution or ordinance regarding Sspecial circumstances has been requested.

Temporary Emergency Economic Recovery Modification (TEERM) Program: In the instance where real estate does not meet the definition of abandoned property as defined herein, the municipality or the County Board, as the case may be, may still determine that special circumstances justify finding that the property is deemed "abandoned" for purpose of a Class 6b under the TEERM Program if there has been no purchase for value and the buildings and other structures have been vacant and unused for at least 12 continuous months. The finding of abandonment, along with the specification page 4 NEW ITEMS AGENDA Meeting of June 19, 2013 of the special circumstances, shall be included in the resolution or ordinance supporting and consenting to the Class 6b application under the TEERM Program. If the ordinance or resolution is that of a municipality, the approval of the County Board is required to validate such a finding that the property is deemed "abandoned" for purposes of Class 6b, and a County resolution to that effect shall be obtained. The applicant must obtain the municipal enabling ordinance with the required finding of special circumstances and present such municipal ordinance to the Board of Commissioners of Cook County prior to its determination as to whether it will validate such a finding that the property is deemed "abandoned" for purposes of Class 6b and provide a County resolution to that effect. A certified copy of an ordinance or resolution finding that special circumstances exist, as well as a certified copy of a County ordinance or resolution validating such a finding that the property is deemed "abandoned" for purposes of Class 6b need not be filed at the time of filing the Class 6b application with the Assessor, but must be filed with the Assessor no later than the date an assessment appeal is filed to request the class change to Class 6b. If the resolution is not filed at the time of the Class 6b application, the applicant shall instead file, at that time, a letter from the municipality or the County as the case may be, confirming that a resolution or ordinance regarding special circumstances has been requested.

Sustainable Emergency Relief (SER) Program: In the instance where real estate does not meet the definition of abandoned property as defined herein, the municipality or the County Board, as the case may be, may still determine that special circumstances justify finding that the property is deemed "qualified" for purpose of Class 6b under the SER Program if: A. The industrial enterprise that occupies the premises has been at the same location for a minimum of ten years prior to the date of application for the SER Program; B. The industrial enterprise that occupies the premises submits evidence of hardship supporting a determination that participation in the SER Program is necessary for the industrial enterprise to continue operations at its current location and maintain its staff, and that without such designation the industrial enterprise would not be economically viable causing the property to be in imminent risk of becoming vacant and unused; and C. The applicant is not receiving another Cook County property tax incentive for the same property. The finding that a property is qualified, along with the specification of the special circumstances, and a determination that the applicant’s participation in the SER Program is necessary for the industrial enterprise to continue operations at its current location and maintain its staff, and that without such designation the industrial enterprise would not be economically viable causing the property to be in imminent risk of becoming vacant and unused, shall be included in the resolution or ordinance supporting and consenting to the Class 6b application. If the ordinance or resolution is that of a municipality, the approval of the County Board is required to validate such a finding that the property is deemed "qualified" for purposes of Class 6b, and a County resolution to that effect shall be obtained. The applicant must obtain the municipal enabling ordinance with the required finding of special circumstances and present such municipal ordinance to the Board of Commissioners of Cook County prior to its determination as to whether it will validate such a finding that the property is deemed "qualified" for purposes of Class 6b and provide a County resolution to that effect. appeal is filed to request the class change to Class 6b. If the resolution is not filed at the time of the Class 6b application, the applicant shall instead file, at that time, a letter from the municipality or the County as the case may be, confirming that a resolution or ordinance regarding special circumstances has been requested.

Applications for the TEERM Program or SER Program under a Class 6b application must be received by the Assessor’s Office on or before November 30, 2018 to receive consideration.

The Assessor shall provide by rule for the filing of annual reports by recipients of Class 6b incentives granted pursuant to the SER Program as to the use of the property and the number of persons employed at the Class 6b site. In such reports, recipients shall be required to certify whether the industrial enterprise that occupied the premises at the time of the SER application continues its operations at that location. In addition, recipients of Class 6b incentives granted pursuant to the SER Program shall be required to report to the Assessor within 30 days if the industrial enterprise that occupied the premises at the time of the SER application ceases operations at that location. A copy of such reports will be forwarded by the Assessor’s Office to the Secretary of the County Board for distribution to members of the County Board from the affected districts. Failure to file such reports within the time established by the Assessor’s rules shall result in loss of the incentive for the period relating to the nonfiling. Additionally, if the industrial enterprise that occupied the premises at the time of the SER application ceases operations at that location, then the Class 6b incentive granted pursuant to the SER program shall terminate. d. e. This classification shall continue for a period of 12 years from the date such new construction (excluding demolition, if any) or such substantial rehabilitation was completed and initially assessed, or in the case of abandoned property, from the date of substantial reoccupancy, or in the case of incentives granted pursuant to the TEERM Program, from the date of the notice of approval. In the case of incentives granted pursuant to the SER Program, this classification shall continue for a period of 12 years from the date of the notice of approval, or until the industrial enterprise that occupied the premises at the time of the SER application ceases operations at that location if that occurs sooner. f. Unless a Class 6b granted pursuant to the TEERM Program or the SER Program, Tthis incentive may be renewed during the last year a property is entitled to a 160 percent assessment level pursuant to section 74-64(7), if the following requirements are met: 1. A. The taxpayer notifies the Assessor’s Office of intent to request renewal of the incentive from the municipality or the County Board if the real estate is located in an unincorporated area; 2. B. The municipality in which the real estate is located or the County Board, if the real estate is located in an unincorporated area, adopts a resolution expressly stating that the municipality or the County Board, as the case may be, has determined that the industrial use of the property is necessary and beneficial to the local economy, and supports and consents to renewal of the Class 6b; and 3. C. A copy of that resolution and a completed renewal application are filed with the Office of theAssessor’s Office before the expiration of the 160 percent assessment level period.

e. g. Class 6b incentives that are granted pursuant to the TEERM Program or SER Program are not renewable. For all other Class 6b incentives, tThe number of renewal periods is not limited as long as the property continues to apply and qualify meet the requirements for Class 6b. Any property owner that applies for Class 6b treatment on or before the adoption date of this ordinance change will be eligible for this renewal term at the end of their original incentive period subject to the above requirements. If, on November 23, 1999, a property is receiving Class 6b treatment, but the assessment level is higher than 16 percent, that taxpayer may apply for renewal as outlined above and receive a 16 percent assessment level for the prescribed period beginning after the filing and approval of the resolution and renewal application. However, if, as of November 23, 1999, the taxpayer's assessment is higher than 16 percent and the taxpayer is granted a renewal of the incentive for subsequent years, no reduction of the current assessment level based on renewal of the incentive will be granted.

f. h. A copy of t The notice of intent to request for renewal which is filed with the Assessor's Office of the incentive will be forwarded by the Assessor's Office to the Secretary of the County Board for distribution to members of the County Board from the eaffected districts.

g. i. If no renewal is obtained, the incentive shall be phased out over the next two years, pursuant to Section 74-64(7). After expiration of the last incentive period, the real estate shall revert to the applicable classification under this division.

h. Additionally, for newly constructed or substantially rehabilitated buildings and other structures to qualify for a Class 6b classificationincentive, an eligibility Class 6b application must be made to the Assessor within one year prior to the commencement of such new construction or substantial rehabilitation. With respect to abandoned property, the eligibility Class 6b application must be made to the Assessor prior to the commencement of the reoccupation of the vacant and unused property.

i. j. The Assessor may adopt rules consistent with this subsection necessary to ensure proper review of all factors relevant to determine eligibility for the benefits provided under Class 6b.

j. k. The Assessor shall provide by rule for the filing of triennial reassessment reports by all Class 6b recipients as to the use of the property and the number of persons employed at the Class 6b site. A copy of sSuch reports shallwill be verifiedforwarded by the Assessor's Office to the Secretary of the County Board for distribution to members of the County Board from the affected districts. Failure to file such reports within the time established by the Assessor's rules shall result in loss of the incentive for the period relating to the nonfiling.

(11) Class 8. Real estate used primarily for industrial and commercial purposes, consisting of all newly constructed buildings or other structures, including the land upon which they are situated; or abandoned property, as defined in this division, including the land upon which such property is situated; or all buildings and other structures which are substantially rehabilitated to the extent such rehabilitation has added to their value, including qualified land related to the rehabilitation.

The amount of land eligible for the incentive shall be in such proportion as the square footage added by the rehabilitation bears to the total square footage of the improvements on the parcel. Such real estate must be either obtained through the Cook County Tax Reactivation Project or must be located in one of the following designated geographical areas: 1. A. An area which has been certified as in need of substantial revitalization in accordance with the provisions of Section 74-65(b); 2. B. An enterprise community as proposed and approved by the County Board on June 22, 1994, or the on May 18, 1994, and the municipality in which such real estate is located, or, if in an unincorporated area, the County must by lawful resolution determine that such real estate is consistent with an overall plan for the rehabilitation of the area; or 3. C. Any one of the following five townships: Bloom; Bremen; Calumet; Rich; and Thornton. b. In the instance where real estate does not meet the definition of abandoned property as defined herein, the municipality or the County Board, as the case may be, may still determine that special circumstances justify that the property is deemed “abandoned” for purpose of Class 8, unless . The finding of abandonment, along with the specification of the special circumstances, shall be included in the resolution or ordinance supporting and consenting to the Class 8 application. Not withstanding the foregoing, special circumstances may not be determined to justify finding that a property is deemed "abandoned" where: A.) tThere has been a purchase for value and the buildings and other structures have not been vacant and unused prior to such purchase; or B.) tThere has been no purchase for value and the buildings and other structures have been vacant and unused for less than 24 continuous months. The finding of abandonment, along with the specification of the special circumstances, shall be included in the resolution or ordinance supporting and consenting to the Class 8 application, and sSuch resolution or ordinance shall be filed with the eligibility Class 8 application. If the ordinance or resolution is that of a municipality, the approval of the County Board is required to validate such, a finding that the property is deemed "abandoned" for purposes of Class 8, and a resolution to that effect shall be obtainedincluded with the Class 8 eligibility application filed with the Assessor. The applicant must obtain the municipal enabling ordinance with the required finding of special circumstances and present such municipal ordinance to the Board of Commissioners of Cook County prior to its determination as to whether it will validate such a finding that the property is deemed "abandoned" for purposes of Class 8 and provide a County resolution to that effect. A certified copy of an ordinance or resolution finding that special circumstances exist, as well as a certified copy of a County ordinance or resolution validating such a finding that the property is deemed "abandoned" for purposes of Class 8 need not be filed at the time of filing the Class 8 application with the Assessor, but must be filed with the Assessor no later than the date an assessment appeal is filed to request the class change to Class 8. The applicant must obtain the municipal enabling ordinance with the required finding of special circumstances and present such municipal ordinance to the Board of Commissioners of Cook County prior to its determination as to whether it will validate such a finding that the property is deemed "abandoned" for purposes of Class 8 and provide a County resolution to that effect. A certified copy of an ordinance or resolution finding that special circumstances exist, as well as a certified copy of a County ordinance or resolution validating such a finding that the property is deemed "abandoned" for purposes of Class 8 need not be filed at the time of filing the Class 8 application with the Assessor, but must be filed with the Assessor no later than the date an assessment appeal is filed to request the class change to Class 8. If the resolution is not filed at the time of the Class 8 application, the applicant shall instead file, at that time, a letter from the municipality or the County as the case may be, confirming that a resolution or ordinance regarding special circumstances has been requested.

Applications for the TEERM Program must be received by the Assessor’s Office on or before November 30, 2018 to receive consideration. c. A copy of anythe resolution or letter confirming that a resolution has been requested, whichever is filed with the application, receivedwill be forwarded by the Assessor’s Office to the Secretary of the County Board for distribution to the members of the County Board from the affected districts. d. For industrial and commercial properties tThis classification shall continue for a period of 12 years from the date of new construction (excluding demolition, if any) or substantial rehabilitation was completed and initially assessed, or in the case of abandoned property, from the date of substantial reoccupancy, or in the case of incentives granted pursuant to the TEERM Program, from the date of the notice of approval. e. Unless it was granted pursuant to the TEERM Program, During the tenth year, an application may be filed with the Assessor's Office for renewal of the incentive for an additional ten year period. Tthis incentive may be renewed during the last year a property is entitled to a 160 percent assessment level pursuant to 74-64(11), if the following requirements are met: 1. A. The taxpayer notifies the Assessor's Office of the taxpayer's intent to request renewal of the incentive from the municipality, or the County Board if the real estate is located in an unincorporated area; 2. B. The municipality in which the real estate is located or the County Board, if the real estate is located in an unincorporated area, adopts a resolution expressly stating that the municipality or County Board, as the case may be, has determined that the industrial or commercial use of the property is necessary and beneficial to the local economy, and supports and consents to renewal of the Class 8; and page 9 NEW ITEMS AGENDA Meeting of June 19, 2013

3. C. A copy of that resolution and a completed renewal application are filed with the Office of the Assessor’s Office before the expiration of the 160 percent assessment level period.

f. Class 8 incentives that are granted pursuant ot the TEERM Program are not renewable. For all other Class 8 incentives, the number of renewal periods is not limited as long as the property continues to apply and meet the requirements for Class 8.

g. A copy of the request for renewal of the incentive will be forwarded by the Assessor's Office to the Secretary of the County Board for distribution to the members of the County Board from the affected districts. If, on November 23, 1999, a property is receiving Class 8 treatment, but the assessment level is higher than 16 percent, that taxpayer may apply for renewal as outlined above and receive a 16 percent assessment level for the prescribed period beginning after the filing and approval of the resolution and renewal application. However, on that effective date the tax payer's assessment is higher than 16 percent and the taxpayer is granted a renewal of the incentive for subsequent years, no reduction of the current assessment level based on renewal of the incentive will be granted.

e. h. Any property which has applied for Class 8 treatment at the time November 23, 1999, will be eligible for renewal based on the requirements of Subsection (11) of this section. The number of renewal periods is not limited as long as the property properly applies for and qualifies for Class 8. If no renewal is obtained, the incentive shall be phased out over the next two years, pursuant to Section 74-64(11). After expiration of the last incentive period the real estate shall revert to the applicable classification under this division.

f. Reserved. g. i. The Assessor may adopt rules consistent with the foregoing is subsection necessary to ensure proper review of the application, supporting data and all other pertinent factorsall factors relevant to determine eligibility for the benefits provided under Class 8.

h. j. The certification of an area as in need of substantial revitalization shall expire five years from the date such certification is granted. The Assessor shall notify the applicant of the date of expiration of certification one year before the date of the expiration of the certification. Such certification, pursuant to the same criteria, may be extended for one additional five-year period subject to reapplication by the appropriate local governing body within the period from one year to six months prior to the expiration of the initial five-year period.

i. k. The Assessor shall provide by rule for the filing of triennial reassessment reports by all Class 8 recipients as to the use of the property and the number of persons employed at the Class 8 site. A copy of sSuch reports shallwill be verified forwarded by the Assessor's Office to the Secretary of the County Board for distribution to members of the County Board from the affected districts. Failure to file such reports within the time established by the Assessor's rules shall result in loss of the incentive for the period covered byrelating to the nonfiling.

Sec. 74-71. Definition.

Property tax incentive for the purpose of applicability of the Living Wage pursuant to Sec. 34-160 of the County’s Code means a reduction in the assessment level as set forth in Chapter 74, Article II, Division 2 of this Code for owner-occupied Class 6b industrial property, Class 8 industrial property, or Class 9 multifamily residential property. For the purpose of this article, “property tax incentive” shall not include page 10 NEW ITEMS AGENDA Meeting of June 19, 2013 a Class 9 designation granted to supportive living facilities, which establish an alternative to nursing home care for low income older persons and persons with disabilities under Medicaid and which are certified by the State Department of Public Aid pursuant to Chapter 74, Article II, Division 2 of this Code, the County Real Property Assessment Classification Ordinance.

Sales tax means the Retailer’s Occupation Tax, the Service Occupation Tax and/or the Use Tax.

Effective date: This Proposed Ordinance Amendment shall be in effect immediately upon passage and approval.

WHEREAS Father Andrew M. Greeley was the beloved son of the late Andrew and Grace, and

WHEREAS Father Andrew M. Greeley was the dear brother of Mary Jule (the late Jack) Durkin and the late Grace Ann Greeley, and

WHEREAS Father Andrew M. Greeley was the loving uncle of Laura (Brian Friedler) Durkin, Julie (Wayne) Montague, Eileen (John Goebelbecker) Durkin, Sean (Molly) Durkin, Daniel (Theresa) Durkin, Anne Durkin and Elizabeth (Patrick Murphy) Durkin and the fond granduncle of 18, and

WHEREAS Father Andrew M. Greeley was an internationally known best-selling author, having written over 50 novels and more than 100 non-fiction books that have been enjoyed in 12 languages around the globe, and

WHEREAS Father Andrew M. Greeley was an accomplished researcher at the prestigious National Opinion Research Center of the , and

WHEREAS Father Andrew M. Greeley was known for his outspoken nature, his willingness to challenge the hierarchy of the Catholic Church, and his advocacy of ideas that were often in conflict traditional views, and

WHEREAS Father Andrew M. Greeley was a Professor of Sociology at the University of Arizona, and

WHEREAS Father Andrew M. Greeley was a great philanthropist, often donating the proceeds from his successful publications to various charitable causes he believe in, and

WHEREAS Father Andrew M. Greeley once donated nearly half a million dollars to a scholarship endowment for the schools of the Chicago Archdiocese, and

WHEREAS Father Andrew M. Greeley was profoundly influenced by his upbringing in Chicago’s Austin neighborhood, having attended St Angela School and later preparing for the priesthood at Quigley Preparatory Seminary, and

WHEREAS Father Andrew M. Greeley continued his religious education at St. Mary of the Lake in Mundelein, and received his doctorate from the University of Chicago after being ordained as a priest in 1954, now therefore

BE IT RESOLVED by the Board of Commissioners of Cook County that the Board does hereby offer its deepest condolences and most heartfelt sympathy to the family and many friends of Father Andrew M. Greeley, and joins them in sorrow at the loss of this remarkable and accomplished Catholic leader, and

WHEREAS the medal presented to recipients at the University of Notre Dame’s annual commencement ceremonies has the Latin inscription “Magna est veritas et prevalebit,” meaning “Truth is mighty, and it shall prevail” and

WHEREAS first awarded in 1883, it is the oldest and most prestigious award for American Catholics, and former honorees include President John F. Kennedy, Joseph Cardinal Bernardin, Eunice Kennedy Shriver, Thomas “Tip” O’Neill, Dorothy Day, Dave Brubeck, and Robert Sargent Shriver, and

WHEREAS at the 168th Commencement of the University of Notre Dame, the 2013 Laetare Medal was presented to Father James McCarthy, Sister Susanne Gallagher, and Sister Mary Therese Harrington of Chicago, and

WHEREAS Father McCarthy, Sister Gallagher, and Sister Harrington are the three co-founders of the Special Religious Education Development Network, known as SPRED, established more than half a century ago to bring the Sacraments of the Church to those with disabilities, and

WHEREAS from its small origins in Chicago, SPRED has grown to become an integral part of faith formation and sacramental initiation programs for Catholics with special needs in 28 dioceses and over 200 parishes nationwide, as well as faith groups in England, Ireland, Scotland, Australia, South Africa, Malta, and Mexico, and

WHEREAS Father McCarthy, Sister Gallagher, and Sister Harrington were honored University President Rev. John I. Jenkins for “insisting that a developmental disability neither tempers Christ’s invitation nor restricts one’s right to respond, and they have ushered countless people to their rightful place at the Eucharistic table,” and

WHEREAS Father McCarthy, Sister Gallagher, and Sister Harrington have dedicated their lives to the service of others, and have served as an inspiration to countless parishioners all over the world, who have joined in their ministry of accessibility and inclusiveness, now therefore

BE IT RESOLVED by the Board of Commissioners of Cook County, that the Board does hereby offer its highest tribute and message of congratulations to Sister Susanne Gallagher, S.P., Sister Mary Therese Harrington, S.H., and Rev. WHEREAS, Almighty God in His infinite wisdom has called Gussie Williams-Lewis from our midst, and

WHEREAS, Ms. Williams-Lewis was born on June 27, 1926 to Will McClain and Johnnie Mae Harvey in Terry, Mississippi; and

WHEREAS, Ms. Williams-Lewis was raised and schooled in Jackson Mississippi; and

WHEREAS, Ms. Williams-Lewis began her life-long walk with the Lord as a youth; and

WHEREAS, at the age of eighteen, Ms. Williams-Lewis married Horace Williams, Sr.; in 1949 they moved to Chicago together where they raised six children over the course of their twenty-three-year marriage; and

WHEREAS, Ms. Williams-Lewis first worked at American Hospital on Chicago’s North Side and later went on to work with dedication as a nurse’s aide for thirty-six years at Stroger Hospital; and

WHEREAS, Ms. Williams-Lewis was extremely active in her community; she helped to register African Americans to vote, worked at local food pantries and provided comfort to transitional residents at the Salvation Army; and

WHEREAS, a member of Pleasant Ridge Baptist Church, Ms. Williams-Lewis served extensively in the Pastor’s Aide Ministry; and

WHEREAS, Ms. Williams-Lewis possessed a passion for life that was infectious; she loved her family and friends dearly; she loved to knit gifts for them and, most of all, loved to cook for them; and

WHEREAS, Ms. Williams-Lewis is survived by six children, Yvonne, Lorraine, Delores, Vivian (Clarence), Elaine (Jim), Horace (Dianna); eighteen grandchildren; forty-seven great-grandchildren; twenty-six great-great-grandchildren; one sister-in-law, Rosalie, and a host of nieces, nephews, cousins, family and friends.

WHEREAS, Michelle Kohut received her law degree in 2002 from Loyola University of Chicago Law School; prior to joining Corboy & Demetrio she was a judicial law clerk to William D. Maddux, presiding judge of the Law Division of the Circuit Court of Cook County; and

WHEREAS, Erich Sneideraitis of Orland Park has earned the title of Eagle Scout through community service by attaining 43 merit badges, performing 125 hours of service to his community, achieving the Historic Trails award, fifty-miler award, Den Chief Service Award, membership with the Order of Arrow, and serving in various leadership positions including Senior Patrol Leader, Assistant Senior Patrol Leader, Assistant Patrol Leader, Den Chief, Instructor and Troop Guide and attending the 2010 national Boy Scout Jamboree at Fort AP Hill, Virginia; and

WHEREAS, For his service project, Erich supported the Cancer Support Center in Homewood Illinois, building two vegetable boxes for patient therapy and education.

WHEREAS, Lois Harris was born in Chicago to Anne and John Pertl where she was raised with her brother George; she worked at her father’s insurance agency on the South Side, became an accomplished musician and has performed all over the world; Ms. Harris went on to teach music independently after semi-retiring; and

WHEREAS, Lois Harris was a consummate, professional musician during the Great Depression working at all the hotels in Chicago and even in New York City; she learned to play the accordion, piano, organ, guitar among other instruments; and

WHEREAS, Lois Harris’s talent at her craft led to musical engagements with her band at the 1933 Chicago World’s Fair and on the first train that traveled from Chicago to New Orleans; she traveled the world and played in Cuba, Japan, China, Europe, Argentina and many other countries; and

WHEREAS, Lois Harris was married twice, has two children, six natural grandchildren and forty-two grandchildren from her second marriage; and

WHEREAS, Lois Harris is known for her youthful vitality; now retired, she resides in LaGrange, still drives, still looks 80 (and gorgeous!) and plays the stock market; and

WHEREAS, Lois Harris is a kind and compassionate individual whose exemplary life, commitment to her family and musical forte are an inspiration to us all.

RECOGNIZING THE U.S. 65th INFANTRY REGIMENT “THE BORINQUENEERS” AND RECOMMENDING CONGRESSIONAL GOLD MEDAL

WHEREAS, the U.S. 65th Infantry Regiment (Borinqueneers) traces its linage from the first U.S. Infantry Battalion of native Puerto Rico Volunteer Troops authorized by Congress in 1899 and has fought bravely and has loyally defended America against all enemies while facing discrimination, segregation, and overcoming unusual obstacles as they accomplished many heroic feats; and

WHEREAS, in World War I, after Puerto Rico patriotically requested that the Selective Service Draft law be extended to Puerto Rico (236,853 men were registered; 17,855 served), the U.S. 65th Infantry went to war with approximately 1,969 men, defending the Panama Canal, while others fought valiantly overseas; and

WHEREAS, during World War II, the 65th Infantry gallantly served in North Africa & Europe (Italy, France-where it saw combat action, and Germany) and won the following Battle Campaign Awards: Naples-Foggian, Rome-Arne, Central Europe, and Rhineland Campaigns; and

WHEREAS, after World War II, the Borinqueneers were among the last Units to come home as they were assigned dangerous security, anti-sabotage and other occupation missions around Kaiserslautern & Mannheim, Germany; and

WHEREAS, in 1950, after arriving in Pusan, Korea, the 65th Infantry were amongst the first fighting Infantrymen, of the U.S. 3rd Infantry Division to fearlessly meet the enemy on the battlefield of Korea; and

WHEREAS, during the Korean War, some 61,000 Soldiers from Puerto Rico served with the U.S. Army; 6,000 of them with the U.S. 65th Infantry which again distinguished themselves over a three year period and received nine Korean Battle Campaign Awards, including, Presidential and Meritorious Unit Commendations, two Korean Presidential Unit Citations, the Greek Gold Medal, a Navy Unit Commendation, and many other awards for bravery and were credited with the last regimental (two battalions) bayonet assault in U.S. Army history; and

WHEREAS, there are many stories of the heroism and bravery of the 65th Infantry during the Korean War and General Douglas MacArthur once stated “…They write a brilliant record of achievement in battle and I am proud indeed to have them in this command. I wish that we might have many more like them;” and

WHEREAS, the 65th Infantry was awarded nine Battle Campaign Awards for bravery: UN Defense- 1950, UN Offense-1950, CCF Intervention-1950, First UN Counterattack Offensive-1951, UN and CCF Spring Offensive-1951, UN Summer-Fall Offensive-1951, 2nd Korean Winter 1951–52, Korean Summer-Fall-1952 and 3rd Korean Winter-1952-53; and

WHEREAS, over the course of the Korean War, Puerto Rico suffered one casualty for every 660 of its inhabitants as compared to one casualty for every 1,125 inhabitants of the States, proportionally suffering more casualties than a majority of States; and

WHEREAS, over the span of World War I, World War II and the Korean War, the Borinqueneers earned ten Distinguished Service Crosses, 258 Silver Stars, 628 Bronze Stars, over 2,700 Purple Hearts, and many other individual awards; and

WHEREAS, major achievements are attributed to many of those who returned to civilian life and earned leadership positions and respect as businessmen, corporate executives, religious leaders, lawyers, doctors, educators, bankers, and political leaders; and

WHEREAS, these brave Borinqueneers deserve a place with all American Heroes and should be honored, commended, and never forgotten for their great epic feats.

NOW, THEREFORE, BE IT RESOLVED, by the Cook County Board of Commissioners, that the U.S. 65th Infantry Regiment (The Borinqueneers) are recognized for their painful sacrifices; selfless service; gallantry in battle; great contributions, and steadfast loyalty for the good of United States of America and also commend the efforts of the original (1934) “U.S. 65th Infantry Regiment Association” who are the principle keepers of the Borinqueneers’ brave flame of devotion to: Duty, Honor, Country.

BE IT FURTHER RESOLVED, that the Cook County Board of Commissioners recommends the President of the United States and the award the Borinqueneers, of the U.S. 65th Infantry Regiment, the US Congressional Gold Medal (CGM).

BE IT FURTHER RESOLVED, that the Cook County Board of Commissioners urges the Governor of the State of Illinois to issue a Proclamation articulating his support in granting the Congressional Gold Medal to the U.S. 65th Infantry Regiment and to utilize his resources in realizing the aforementioned.
