I hope everyone enjoyed a great end of the summer – hard to imagine that schools are back in session and workplaces are in full gear once again.

City Hall is no different – after an August recess we hit the ground running right after Labor Day. Much of the attention is now turning towards November when we have a number of important Supervisor races in the odd numbered Districts 1,3,5,7,9 & 11 as well as a number of very important ballot measures – in particular our Parks Bond (Prop B) which will provide vital funding to upgrade the infrastructure of our City parks.

In District 2, everyone is still talking about the August America‟s Cup World Series races and getting excited about the second round of races coming up in October during Fleet Week. While the August races were a logistic success, with all our hard work on the public transportation plan, media coverage and neighborhood engagement paying off, we are continually working to improve both the spectator and resident experiences.

RECENT LEGISLATION AND POLICY UPATE

Payroll Tax Exemption Legislation Passes I am thrilled to report that on July 31st, Mayor Lee signed my Payroll Tax Exemption Legislation into law. This limited payroll tax incentive allows small businesses with a payroll under $500,000 to expand their payroll by $250,000 without application of San Francisco‟s 1.5% payroll tax. This bill, which covers a period from 2012 to 2015, is the result of work with small business owners throughout the city. I believe that the payroll tax exemption is an important step for our community‟s economic growth. This legislation will allow small businesses to grow, expand and create jobs in our city and allow San Francisco to thrive. I've always said that small businesses are the heart and soul of our neighborhoods in San Francisco. It is estimated that this legislation will create hundreds of jobs by removing barriers to small business expansion.

Condo Lottery Bypass – Land Use on September 24 On June 12th, I held a press conference, with over two hundred people, and announced the introduction of legislation to create a one-time condo lottery bypass. The heart of this legislation aims to protect vulnerable TIC home owners who are facing significant difficulties in the financing market - in some instances paying double the interest rate of traditional borrowers – from the threat of losing their homes. And, at the same time the fees paid in will create a large pool of money for affordable housing.

The legislation will create a one-time condo lottery bypass to allow TIC owners eligible for the lottery to pay a significant fee -- $20,000 per unit – to convert their TICs. Revenue from the measure, estimated at up to $25 million, will be dedicated to affordable housing. Any tenants residing in a unit converted under the legislation will receive lifetime tenancies, similar to what senior and disabled tenants receive under the current lottery, and thus will retain tenant protections. Only buildings that are eligible for the lottery will be covered by the legislation, meaning that buildings with a problem eviction history, such as Ellis Act evictions, will not be eligible.

The condo lottery has become more and more unworkable over time for TIC owners. Limited to 200 units a year (on average, 55 buildings), the number of lottery applicants has more than doubled in the past eight years, from 1,000 in 2003 to an estimated 2,500 in 2012.

The need for condo conversion reform has never been greater. In this year‟s condo lottery, approximately 2,500 applicants vied for only 200 spots. The estimated time to win conversion approval for new entrance into the lottery is currently 19 years. San Francisco‟s outdated condominium restrictions are penalizing hundreds of middle income, first-time homeowners. My legislation will be heard in the Land Use & Economic Development Committee on September 24, 2012 at 1:00 p.m. in Room 263 of City Hall.

Neighborhood Schoolyard Project Kick-Off – June 16, 2012

Last year in partnership with the San Francisco Unified School District, San Francisco Recreation & Parks Department and Department of Public Works, we raised enough money to open up schoolyards on the weekends year round at public schools across San Francisco. On June 16, 2012 we opened the first of those schools and kicked off the summer with family-friendly fun and entertainment. A full 24 schoolyards will eventually be open by mid-November 2012. Starting the weekend after Labor Day (September 8&9), the project will be adding new sites every other weekend. RCV Charter Amendment Recap On March 6, 2012, I introduced a charter amendment with five of my colleagues for the November election to repeal ranked-choice voting for citywide elections in San Francisco. The charter amendment would have returned San Francisco‟s election system to the less confusing and more democratic run-off process for citywide offices including Mayor, District Attorney, Sheriff, City Attorney, Treasurer, Assessor-Recorder and Public Defender. Unfortunately, my attempts to place this important measure on the November ballot were thwarted. By the time it reached a vote at the Board of Supervisors, there were three competing proposals that would have confused the voters if all three made it to the November ballot. As a result, all three measures were sent back to committee where I am sure the subject will come up again. I continue to believe that ranked-choice voting needs to be eliminated and resolve to work on this again in the future.

Union Street NCD – Reinstating Liquor License Controls In April of this year, the Board of Supervisors unanimously passed legislation to simplify and streamline the permitting process for restaurants, cafes, bakeries, and other food and drink establishments. The legislation reduced the number of classifications of restaurants from 13 to 3 and eliminated baffling rules such as: allowing some restaurants to serve ice cream in cups but not cones; allowing cold bagels but not toasted; and allowing a restaurant to have 10 seats but not 11.

The legislation was supposed to keep key neighborhood controls in place, but had unintended consequences in the Union Street Neighborhood Commercial District by allowing more restaurants to apply for alcoholic beverage licenses, thus eliminating the controls in place that both the neighbors and merchants worked together on years ago. Thus, I introduced legislation to reinstate the alcoholic beverage license and restaurants controls that existed in the Union Street NCD before the previous legislation passed. Union Street is enjoying a nice balance of restaurants, bars, retail and office space. The groundbreaking of the new Metro theater project this fall will contribute greatly to the atmosphere on the street. Both the Golden Gate Valley Neighborhood Association and the Union Street Merchants Association are in favor of the legislation and have been working together with my office to see that it gets passed.

Two-Year Budget passed On July 25, 2012, Mayor Lee signed the City's 2-year budget. This is San Francisco‟s first two-year budget, and marks a change toward long-term planning and improved fiscal heath for the City. Due to a collaborative effort between city officials, department heads, and community members, the city was able to close a projected $263 million dollar shortfall and balance the budget.

The budget places an incentive on innovation and job creation within San Francisco by funding legislation like my Small Business Payroll Tax Exemption and my Film Rebate Program. Both of these pieces of legislation were intended to help create jobs in the City. Additionally, the budget will create nearly 400 public sector jobs and places an emphasis on public safety, by funding 3 new Police Academy classes and 2 new Firefighter Academy Classes. Finally, I am proud to say that the budget replenishes portions of the City‟s General Fund Reserve, and places money into a Budget Stabilization Reserve, a State Reserve, and also a Ratepayer Stabilization Reserve. These reserves are intended to address a number of issues including; revenue shortfalls, and expected cuts from this year‟s State budget.

San Francisco‟s 2-year budget is a product of hard work and compromise between all involved. As a result, I believe San Francisco is financially sound and that the final plan is one that reflects priorities that we should all support.

June 11, 2012 – Mayor signed Film Legislation Mayor Ed Lee signed my legislation on June 11th to extend our "Scene in San Francisco" Film Rebate Program for another two years. This legislation will continue to bring more jobs and direct economic benefits to our City, and will send a message to the television and film industry that San Francisco is open for business. Thanks to Joanne Desmond with Local 16, George Rush and Susannah Greason Robbins (director of our Film Commission) for participating in the signing ceremony and for their continued persistence in bringing more film production to San Francisco. I‟m happy to report that Woody Allen is currently filming in San Francisco with several scenes being shot in District 2.

Helicopters Meeting When Doyle Drive was closed for the weekend a few months ago, many people feared that traffic disruptions would cause major delays and confusion. However, the demolition and closure went smoothly but the helicopters monitoring the situation seemed to cause the most distress due to noise throughout the day beginning at 6:00 a.m. and lasting until approximately 9:00 p.m. in the evening. I recently convened a meeting with SFO airport officials, representatives from the FAA, the and the America‟s Cup to discuss helicopter traffic during the America‟s Cup races. I am confident we have a plan in place to minimize disruption during the races. Our recommendations and requests have been taken seriously by the helicopter operators and additional efforts will be made to stay water side and minimize noise for Marina residents. I believe this made for orderly helicopter flights during the first of the America‟s Cup racing series this past week in August.

Proposition B – November 2012 Clean and Safe Neighborhoods Parks Bond Fixing our infrastructure in our parks has been a key priority for me as a member of the Board of Supervisors – it is a huge quality of life issue that has always been and will continue to be a main focus for my office. Currently our park system has over a billion dollars in unmet capital needs. The Clean and Safe Neighborhoods Parks Bond on the ballot this November will help meet those needs. District 2 will benefit greatly from the bond. Moscone East playground and Mountain Lake Park are specifically named in the bond for playground renovations and other critical park improvements. The Laurel Heights Playground will also be eligible for renovation funding and additional money will be available to correct irrigation problems that have long plagued Park. Proposition B will not raise taxes as City policy only allows for new bonds to be issued as old ones are paid off. By replacing expired bonds, this measure is funded at current tax rates.

DISTRICT 2 UPDATE

Lafayette Park Renovation and Appeal In 2008, SF voters devoted over $10 million of the Clean and Safe Neighborhood Parks Bond to improving Lafayette Park. The project includes the repair and renovation of the restroom facilities, the children's play area, picnic area and courts. The project will also restore roads and pathways, upgrade lighting and irrigation and improve accessibility as well as overall reconditioning of the park landscape. We are so grateful to our community advocates for their ongoing commitment and contributions to improving Lafayette Park, especially the Friends of Lafayette Park (FOLP) who raised over $500,000 to create a world-class play area for children and families.

Renovation on the park has slowed down a bit due to an appeal filed by a nearby resident, which was denied on August 22, 2012 at the Board of Appeals. However, the permit for the renovation will remain suspended for the next ten days, and it remains to be seen if delays will continue. But, the Recreation and Park Department still expects a completion date of May 2013. For continued updates on the renovations at Lafayette Park, visit www.sfrecpark.org.

Mountain Lake Park Mountain Lake Park is bustling with activity lately that will result in several different upgrades to the park. As a result of the 2008 Park Bond measure, Mountain Lake is slated for new restrooms. According to the Recreation and Park Department, the construction of the bathrooms will begin this fall (no earlier than September 2012) and will be completed by Spring 2013. An alternate bathroom facility will be made available during the construction. Mountain Lake Park is also specifically named in the 2012 Parks Bond (Proposition B) for upgrades to the playground and other park facilities. I‟m also thrilled to report that the Friends of Mountain Lake Park Playground, a volunteer group, is working with the San Francisco Parks Alliance, Friends of Mountain Lake Park, and the San Francisco Recreation and Park Department to make this new playground a reality by 2014. I recently met with their group and I‟m very encouraged by their enthusiasm and plans for the new playground. For more information, visit www.fmlp.org.

Mountain Lake In May 2012, the Department of Toxic Substances Control (DTSC) approved a Final Feasibility Study/Remedial Action Plan (FS/RAP) for environmental cleanup of the Presidio's Mountain Lake which involved excavation by dredging. The Presidio Trust and the California Department of Transportation (Caltrans) will implement the work beginning in summer of 2012 through fall of 2013.

Step 1 involved stabilization work which began in July and is projected to last through November 2012. Caltrans will stabilize Highway 1 (Park Presidio Boulevard) prior to the start of lake dredging work by installing approximately 400 stone columns into the ground along the northbound shoulder of the roadway west of Mountain Lake. Caltrans will also install treatment devices in storm drains along the highway to prevent contaminants from entering the lake in the future. Step 2 involves dredging of the lake beginning October of 2012 and continues through mid-2013. The Presidio Trust will dredge sediment contaminated with lead and motor oil from the bottom of the lake which will then be transported via pipeline to a staging area north of the lake where it will be dewatered. After dewatering, the water will be pumped back into the lake. Dried sediment will be transported offsite and disposed of in a permitted, offsite landfill. NPS Alcatraz Embarkation Study Recently, the (NPS) indicated that they will be studying as a possible location for their Alcatraz passenger ferry service. This news is distressing to say the least, and in response I have written to the NPS asking them to reconsider even studying the location. Fort Mason is an inappropriate location for the Alcatraz ferry service because of the dramatic adverse impact that would result in the surrounding area. A plan to use Piers 1, 2, and 3 of Fort Mason for ferry service would bring 4,000 visitors per day and have a negative impact on traffic in an already congested area. On the other hand, the alternative Fisherman‟s Wharf location that NPS is studying is much better suited for this type of project because it is a commercial district with better public transportation and equipped to handle large numbers of visitors. Going forward, I will be working with community associations, Fort Mason Center staff, and federal elected officials to help ensure that the best decision is made for District 2.

CPMC Update On July 31st, the Board of Supervisors unanimously voted to delay its decision on CPMC‟s final environmental impact report until at least November 20, 2012. This decision results from an ongoing dispute with Sutter Health regarding the future of St. Luke‟s Hospital. Sutter Health has offered to work with a mediator to resolve the issue of what assurances it must offer with regard to the future of St. Luke‟s. Many issues have also been raised about inadequate traffic studies and appropriate mitigations to address the traffic and congestion impacts.

Mediation is a step in the right direction and will allow both sides to take a different approach toward finding the best solutions for San Francisco. Throughout this process I have actively worked to ensure that any agreement regarding CPMC offers the best possible outcome for the city, and especially District 2 given that the proposed hospital will be located in the district and that the current campuses on Pacific and California will undergo significant changes once the new hospital on Van Ness and Geary is built. I will continue to diligently work towards these goals and support a plan that offers the best long-term solutions for the entire city.

Van Ness BRT (Bus Rapid Transit) – Locally Preferred Alternative Chosen The San Francisco County Transportation Authority (SFCTA) has been working on a plan to bring “bus rapid transit” service to the Van Ness corridor for years now. After incorporating significant analysis and public feedback on the Draft Environmental Impact Statement/Environmental Impact Report (EIS/EIR), San Francisco County Transportation Authority (Authority) and San Francisco Municipal Transportation Agency (SFMTA) staff prepared a report recommending a Locally Preferred Alternative (LPA) for the Van Ness Avenue Bus Rapid Transit (BRT) Project. Under their plan, buses would travel in the two central lanes on Van Ness Avenue, divided by a median with passengers boarding on the right side of the vehicles from central platform islands that flank the median.

As a Commissioner of the Transportation Authority with a seat on the Plans and Programs committee, I asked staff from the SFCTA to meet with several of my constituents to discuss their concerns about impacts on the neighborhood as traffic will likely overflow into other less traveled streets once a lane in both directions is eliminated on Van Ness Avenue. After securing their commitment to work through these issues and to implement several mitigation measures, the LPA received unanimous approval at the Plans and Programs Committee on May 15 and at the full Authority Board on June 26.

The LPA will now be analyzed in the Final EIS/EIR, which is scheduled to be completed in summer of 2012. SFMTA will then approve the project, and the Authority and FTA will approve the Final EIS/EIR in Fall 2012. Project construction could begin as early as 2015 with service beginning in 2017. USF & Sacred Heart Summer Reading Program This summer, USF and Schools of the Sacred Heart both dedicated five weeks to a Summer Reading Program for Western Addition Youth. The National Summer Learning Association provides children with enriching and educational experiences over the summer, and programs like the Summer Reading Program would not be possible without the generosity of schools like USF and Sacred Heart. The schools‟ many volunteers dedicated a significant portion of their summers to help 200 children succeed in school and life by helping to provide summer learning opportunities that bridge the achievement gap for so many of this City‟s youth. I was happy to congratulate them on their efforts at the Board of Supervisors meeting.

COMMUNITY SPOTLIGHT Honoring William Thomason At the meeting of the Board of Supervisors on July 31st, I honored William Thomason for his work with the Wall Street Wizards program and for his service to the city of San Francisco. In 2003, Mr. Thomason took 30 high school students and opened their eyes to the opportunities within the Financial District. By visiting the Federal Reserve Bank, the Pacific Coast Stock Exchange, and Bloomberg, he exposed the students to career opportunities that were available in the world of finance. He has continued to create programs that give students the necessary tools and know-how to be confident and financially educated. Since the official start of the program in 2006, it has grown to include: classroom education; a speaker series; and active personal money management (participants set up their own investment accounts). Several past and current participants of the program thanked Bill publicly for the difference he has made in their lives. I can't thank Bill enough for his service to the youth of San Francisco. He is truly an amazing individual.

IN THE COMMUNITY

May 23, 2012 – Francisco Reservoir Working Group Meeting On May 23, 2012, I attended a community-wide meeting to review proposed ideas and conceptual plans for public open space uses for the Francisco Reservoir site. The defunct reservoir is located between Hyde and Larkin Streets, south of Bay Street and north of Chestnut Street and is currently under the jurisdiction of the San Francisco Public Utilities Commission (PUC). The Francisco Reservoir Working Group is made up of representatives from Aquatic Park Neighbors, North Beach Neighbors, the Russian Hill Improvement Association and Russian Hill Neighbors. I‟m excited about the opportunity to create a public park in this area and have been working with neighbors and the PUC to design a unique park and public recreation area in District 2 that will have a lasting impact on generations to come.

May 23, 2012 – PHAN Annual Meeting On May 23, 2012, I attended the annual meeting of the Presidio Heights Association of Neighbors (PHAN) at the Presidio Golf Club, where I provided an update on citywide and District 2 specific issues. We were also joined by Stephen Barclay from the America's Cup Event Authority to discuss the upcoming races and corresponding events.

May 28, 2012 – Memorial Day Parade and Ceremony in the Presidio My Dad and I were honored to participate in the Memorial Day Parade and ceremony in the Presidio that honored all of our veterans and paid tribute to those who have sacrificed so much for the freedoms we all cherish. It's always great to see my Dad in uniform - a retired B-52 pilot from the United States Air Force and decorated Vietnam veteran. I am extremely grateful to all the men and women who serve our country in the armed forces, and continue to be incredibly proud of my father for his service and dedication to our country.

June 11, 2012 – Marriage Equality Plays On June 11, I helped introduce an evening of Marriage Equality Plays to benefit the American Foundation for Equal Rights (AFER). This benefit took place at the Bayfront Theater in Fort Mason and showcased the work of several local talents. The original plays were written by several Bay Area playwrights such as Trevor Allen, William Bivins, Garret Groenveld, Lauren Gunderson, Peter Nachtrieb and Lauren Yee. Additionally, there was a guest appearance by the BATS Improv troupe. This was a great night, and I was honored to play a role in it.

June 15, 2012 – City Club Roundtable I was honored to accept an invitation to speak at a meeting of the San Francisco City Club Roundtable. This monthly lunch meeting between local businesspeople, non-profit, and civic leaders was a great way to meet with members of the San Francisco community and discuss a variety of city-wide issues.

June 22, 2012 – Al Casciato‟s Retirement Party I was honored to attend the retirement party of one of our finest police officers in the City - Captain Al Casciato. He served our City in various positions for 42 years, including Captain of the Northern Station which serves District 2. Throughout his career, he was extremely dedicated to the police force and the residents of San Francisco and was willing to go above and beyond the call of duty to help. In his retirement, Captain Casciato will be dedicating much of his time to finding space for the “Guardians of the City” (GOTC) Museum. The mission of GOTC is to preserve the heritage and to record the history of Emergency Medical Services (EMS), the San Francisco Fire Department (SFFD), the San Francisco Police Department (SFPD) and the Sheriff's Department for the benefit of the citizens of San Francisco and beyond, and will include the conservation and preservation of the collection, which includes photographs, documents, graphic items, memorabilia, apparatus, appliances and other artifacts at a future GOTC Museum. June 24, 2012 – Pride Parade On June 24, 2012, I was happy to participate in San Francisco‟s Pride Parade. The theme of this year‟s Pride Parade was “Global Equality.” This year, I was thrilled to walk with several members of the San Francisco Fire Department. The SFFD was led by the Bag Piper Band and a Fire Engine. The Pride Parade is always a great time and it is an important way to celebrate the culture and diversity of San Francisco as we work toward local and global equality.

July 16, 2012 – Marina Merchants Association Congratulations to the new president of the Marina Merchants‟ Association, Ferris Ferdon of We Olive San Francisco, on Chestnut Street. I attended their meeting on July 16th and was encouraged to see how engaged the association is in the America‟s Cup events. As we know, Chestnut Street and the surrounding streets have much to offer in terms of fine dining, family restaurants, movies, shopping, boutiques and all kinds of unique San Francisco foods and gifts. Golden State Warriors to move to San Francisco I am excited to report that while we still have a long way to go, it looks as though the will be eventually moving to San Francisco. The construction of a planned waterfront arena for the NBA team would bring jobs, tourism, and national recognition to San Francisco. The arena is to be located at piers 30-32, a site which will require renovation before construction can begin. This project is receiving support from a promisingly bipartisan and varied array of San Franciscans, and I look forward to continuing to work with Mayor Ed Lee and the rest of the Board of Supervisors to see that it comes to fruition.

SFPD Cops and Joggers Annual Picnic and 5k Run to Benefit San Francisco SAFE Sunday, September 23, 2012, 10:00am start; Peacock Meadow, Golden Gate Park For the past three years SAFE has held its annual 5k fun run to benefit SAFE‟s services. This year, we decided to join up with the SFPD to combine the 5K run/walk and the police annual picnic. We thought this was a great way to have San Francisco join in on the fun, get to know the police officers that serve their neighborhood and spend a family friendly day in Golden Gate Park.
